  • A ruling dismissing a Muslim student’s High Court challenge against a ban on prayer rituals at her school is a “victory” for all others, its headteacher has said. Michaela Community School in Brent, north London, faced legal action from the pupil, who claimed its policy was discriminatory and unlawfully breached her right to religious freedom.
    In a judgment on Tuesday, a judge concluded the ban did not interfere with the student’s rights and was “proportionate” amid the school’s aim to promote an ethos of inclusivity and social cohesion.
    Katherine Birbalsingh, the high-achieving school’s founder and headteacher, said: “A school should be free to do what is right for the pupils it serves.

    The issue here is equality. Everyone regardless of faith should be treated equally. That means no one receives special treatment. That means if Maths is from 10am to 11am no one is permitted to leave the classroom to pray or do any other non educational activity otherwise a two tier system within a school will develop. If you don't like the school rules, go to another school that will accommodate your needs.

    How is it even controversial that a school has the right to advertise as a secular school and then enforce being secular? Why would this stupid person enroll at a school which makes their policy of being secular crystal clear and then take the school to Court for a policy they knew about. The arrogance of the lawyers and individuals who perpetuated this litigation knows no bounds. It is not relevant whether it is a Muslim, Sikh, Christian or whatever. But, it is a fact that it was not a Christian, Sikh and so on who challenged the policy even though they had as much right to do it as anyone.

      @@jeremyhards1911 Yes and as i point out, the legal apparatus in this country prevented Islam from being given special treatment in this instance. Because some people make statements or act in a way that implies a certain religion or group are dominating things, doesn't mean they are.
      I'm an atheist and live in one of the most diverse cities in the country and i can say with all certainty that i do not have Islam forced on me everyday. On the streets, i see Christian preachers, Muslim preachers buddhists.

I can see it around Birmingham for sure, but no more than Christianity. I can drive by 2 gurdwaras on my way to the city centre. I get stopped by the Buddhist guy trying to sell incense in the city centre. The Jehovah's witnesses stand there quietly, offering their handouts. Yes there are Muslims offering qurans but so are Christian preachers going up an down the street.
      I know there are incidents where Muslim groups attempt to influence and sway things in this country, but I have yet to see many examples of it successfully changing the way this country is run. I see far more attempts by 'woke' activists and far right nut jobs and far more of them seem to work.

    What religious people need to understand is, that in a democracy nobody is obliged to align themselves with religious beliefs, practices or texts. You do that on your own time. Not at school or work. We hear alot of religious freedom, well that doesn't mean the rest of us can't criticise or want no part of it. Personally I think it's down to the religious groups to prove what is written is factual and can be easily proved with a scientific test. So much for western enlightenment.

    Caller should look at the facts of the case. The school did / are not breaking the rights of anybody being religious etc, under the terms of the ECHR. If religion is so vital, 1, do it in your own time and / or 2, go to a school that allows it. But be ready for the education to suffer.

    Why is mentioning God an act of worship and not an act of blasphemy? Without sitting in the assembly this caller has no idea what happens in there. I think my school broke the law every day, as there wasn't a hall big enough for the school to gather every day, so assemblies were staggered throughout the week.

    I don't remember any pupils at my last school being given special rights concerning religion, if they had special food needs they would try to accommodate them but that was it, it would be better to say we ban all mention of religion at school. As for pupils being bullied because they don't follow Ramadan then tell the bullies bye bye your not welcome, just another story of a minority trying to force the majority to bend to their will

      Islamist thrive on contradiction, and this is one. It means they can weedle their way in.
      The Christian god, not that it exists, will need to grow a pair and take one for the team. I mean, either that or actually help. But since that day never comes and never has id rather we put a clear line, in law, that their be zero superstition in school.

    I notice that it is always muslims that complain, why? Followers of other religions make mo demands, they integrate and respect their host country's ways and do not continuously challenge.
    Best would be to have no religion in schools, just as places of learning what is necessary.

    As stated the school does not have space to have an indoor prayer room. This just shows religion causes all sorts of issues and problems. Children intimidating others for not what they wanted them.
    Plus, wasn't the girl suspended for threatening another pupil with a knife? There is more to this than meets the eye.

    Erm Julia, can you elaborate more on the mentioning of God once a day at assembly? Was it because the head kept dropping things? Just asking. I was thinking of starting up a Diversity Includes Everyone movement but unfortunately the abbreviation leaves a lot to be desired.

    I wasn't aware that the students are not allowed to carry out any prayer ritual even in their free time. That does seem a bit restrictive. However, to any Muslims viewing this, Asalaamu Walykum Wa Rahmatullah and whilst I am not an imam or a scholar I would suggest that prayer and worship are in the heart first and foremost and if under any form of duress I believe it is permissible to shorten those prayers and think of those specified movements for them to be counted as complete in accordance with the Sunnah. According to source it is definitely permissible to make up for any missed Sunnah prayers at a subsequent time. (al-Bukhaari (1233) and Muslim (834)). Asalaam

      Her right is to an education not to disrupt others education by demanding special treatment by a school that is reportedly an excellent one . All pupils are considered equal and receive the same education . It’s why school uniforms exist . They are there to learn . Period . And can we please stop talking about this child as if she is desperate to pray . This is her entitled parents using their child to push an agenda . There is all the time in the world out of school hours for them to impart their beliefs on their children

      I don't think the problem is she wants to go and pray during the lunch break. Islamic call to prayer occurs on a fixed time schedule and it seems it's clashing with class time and that's the issue.

      I wouldn't expect Christians to be given priority over any other religion so I wouldn't expect any child to be given priority over any other.
      You can pray before and after school, so all children are treated the same.
      No one child should be given priority over any other.
      There's a time and a place for praying and schools not it.

    I said long ago that they shouldn't allow religion in schools as its a personal choice and not applicable to everyone. Instead, learn maths, english history, geography, science, and engineering as these things are applicable to all as it teaches children to think and solve problems and think critically.
