FSU Law Professor Murder Trial Prosecution Opening Statement

- Sigfredo Garcia, 37, and Katherine Magbanua, 35, stand trial in Leon County, Florida in the 2014 shooting death of Florida State University Law Professor Dan Markel, 41.
The victim was shot twice in the garage of his home on the morning of July 18, 2014, and he passed away the next day at a hospital.
Who did it? The alleged answer is messy and fraught, even by the standards of a typical murder case. Markel had had an ugly divorce from his ex-wife. Police have said that they think Magbanua was the link between at least one of Markel’s in-laws and the murder.
She used to date the brother of the victim’s wife, and cops said that she had begun receiving checks from the family’s dentistry business, according to The Tallahassee Democrat. She also has children with Garcia.
Luis Rivera pleaded guilty to second-degree murder in Markel’s shooting death last year. He told cops that Magbanua helped set up the murder, and that she hired Garcia for the killing, according to The South Florida Sun Sentinel. Garcia, in turn, allegedly recruited Rivera for backup.
Police believe the ex-wife’s brother and the mother possibly played a role in the plot. None of them have been charged, however. State Attorney Willie Meggs cited lack of evidence, saying that the allegation was speculation.
Rivera, who is already spending 12 years in prison for a federal racketeering case, is set to spend another seven years for the Markel murder. This February quote from Magbanua’s attorney Christopher DeCoste likely foreshadows how the defense will attack Rivera’s story at trial.
“The prosecution created a theory fit for a soap opera, built a case around that preposterous plot using the wholly unreliable word of a thug as mortar, and peddled it through the media without mentioning any of the massive inconsistencies,” he said, according to the Sentinel. “Before they turned Luis Rivera, a lifelong gangster, into their snitch, the threadbare circumstantial evidence wasn’t even enough to arrest Katie.”

They saw them end of April at older boys Bar Mitzvah. Next month in May Wendi gets to say that in court

OK. I am looking at my comment and I don ‘t know why I said they saw them at the Bar Mitzvah. In fact, I don’t understand my comment, unless at that time that is what I though. It was 6 months ago. They saw the boys for an hour ,so Wendi can say the Markels have seen them…..

Yea , she was good, but my favorite opening statements come from the Chandler Halderson trial, if you haven't seen it ,then you should give it a watch, just type chandler halderson opening statements, it's a terrible case, Chandler was on trial for murdering his parents and dismembered their bodies, he his body parts all over southern Wisconsin, he wasn't even close to getting away with it, Attorney William Brown gave the opening statements, its like nothing I've never seen before. Lots of work has to be done before trial. Justice moves slow.
Here we are 2 years later and this mess is still going on. The people who actually killed him have been convicted as well as Ms Magbanua. Charlie Adelson was just recently arrested and I pray Donna and Wendi Adelson are next. Only then will justice be served.
They need to get unequivocal evidence -- they only get one chance 😊 at the trial.

Especially when she takes the stand and says the State isn't going to charge me for this murder and smiles. Ok evil women you did not want to share custody of the boys with their father. No stranger would just go up too this man and kill him without someone paying them. Your family had the money and didn't want him too share the boys with him sad. Now these boys have no father or their father's last name. The in laws can't see them either anymore.

Murder has no time limit. I believe they r just wIting for the right moment to arrest them all involve in this murder too hire crime. Money is no good now after they all locked up. They will soon be talking. Prosecutors know that.

I remember this on True Crime Daily...Louis Rivera (one of the 2 guys in the Prius, wanting to be a part of the "Latin Kings") opened his mouth and told them everything. Hope they arrest the whole Adelson Family and place the 2 young Markel boys with their Dads side of the Family.
He didn’t want to. He was and actually the leader over 100 others. He took a plea for reduced sentence of 19 years instead of life.
He was the leader since he was 14/15.
Two members of the Adelson family are in custody, two more to go…..

You can clearly see that the prossecuter puts the accent on the Adelson's family and who had the most motives to hire a hit man on windi's husband .this is to influence the jury so that she can make a plea bargin with Katherine Magbanua so that she will spill the beans if ever she wants to see her kids again one day . Her entire case is based on those expectations to bring the real killers to justiceand conspiracy to commit murder with an actual murder case always finish with death row or real life without parole with no possibility of freedom

@@veegee916 Yeah, my sympathy for Magbanau (because she wasn't brought up with the kind of advantages that Charlie and Wendi had, like their educational opportunities) has been eroded over the course of the last 8 days of the trial. She's a real piece of work. Constantly manipulating the men around her, mostly Garcia, and under the illusion that she was getting one over on Charlie but he was putting one over on her. Over some money$$. Kinda sad.

Does anyone else feel like this opening statement lacks oomph in it's delivery? She is so dispassionate and doesn't use all of the verbal and nonverbal elements of language combined with the flat narrative type of presentational style she chose.

i think normally opening statements focus on motive, but because the person with the most motive in this case is wendi, she decided to focus on the hard facts instead. but i agree, it's bland, complicated, and hard to follow, and takes way too long to introduce the actual defendants into the narrative

If Luis had not been arrested for racketeering this case would have remained unsolved. Horrible investigative work. Opening statements reference it taking 2 years to compile evidence. Nope. You retrieved your evidence after given all the info by Luis & only went after the ones who couldn't afford to hire a dream team of attorneys. I feel so sad for Markels parents. Justice truly has not been served. The killers are still free. Power is in the money and status in this case.
And they still haven't seen those children. Heartbreaking.

I feel more than sure that Donna and Wendy are where this begins. Perhaps Donna more than Wendy, but this was a family affair. I truly hope Donna and Wendy are held accountable, but I doubt Charlie will drag them down with him. He'll take one for the team so his 70 year old mother and his princess sister won't be convicted.

@@lighthouse1136 Charlie’s trial started October 23 and he was found guilty on November 6. His mother was arrested one week to the day later and she’s facing the same charges.
This opening statement was tediously over-detailed.
The Judge on the 1st the 1st trial interjected much more than any other Judge I've seen in other trials. He did that on other trials he purcided over as well. Annoying and overly rude.
Prosecutor sounds exhausted and it’s only the opening statement … I’m surprised I never heard of this and I live here! But my question is why the verdict came down for only ONE person… why haven’t they gone after the people they CLAIM PAID HER TO DO IT? Cappleman is a badass. I love her confident methodical style. I’d hate to be the defendant. She handled Charlie’s smugness with relative ease. I think most prosecutors would have lost their focus and effectiveness questioning him. She didn’t.
IT SEEMS THAT THE STATE HAS GATHERED A LOT OF EVIDENCE AND IF IT PANS OUT THE PRINCIPALS IN THE CASE WILL BE LOOKING AT EITHER A LIFE SENTENCE OR THE DEATH PENALTY WHAT I WOULD LIKE TO FIND OUT IS WHAT WILL HAPPEN TO THE ONE THAT WANTED THE POOR MAN DEAD TO ME THAT PERSON SHOULD SUFFER THE FATE OF THE VICTIM.

It was a mistake to combine the two trials. Two different defence stories then add in the Prosecution's version of events and you have a complex, convoluted mess. It's not fair to the defendants
Katie completely innocent and big question marks about Sigfredo"s involvement also, but it's difficult to see because Georgia and co have muddied the waters with their assumptions and confirmation bias

The state of Florida has an excellent case against these two defendants. Unfortunately for justice, it does not have an excellent prosecutor. Georgia Cappleman is when at her best mediocre, but most often she's ineffective and at times almost incompetent.
In her opening arguments Cappleman muddles thru what is otherwise a clear and compelling line of evidence leading directly to not only the defendants but also the Adelmans. She leaves the jury focused on mundane ancillary issues and obscures Wendi Adelman's ultimate involvement, and hence what should be the state's theory of the case.
in her defense, this is not a trail for the family that caused Dans death ...... the trial is only about the two who were arrested and did not plea

Please get a better prosecutor to present this case. Cappelman stumbles even in the beginning when she has a script in front of her. It's like listening to a high schooler learning how to debate for the first time. She needs to use a better tone and speech to paint a picture with a captivating narrative and compelling evidence to back it up. The police did a good job but she's not using their hard earned evidence effectively. Justice for Dan Markel!
