      Did you watch the trial and hear the details? These women made choices. They tried to use their bodies to get ahead in Hollywood. Harvey is a pig but not a criminal.
      If you were forcefully assaulted would you date the man and beg him to be with you and offer sexual favors to him for six months after the “event”? I don’t think so

    Fellow trial attorney here (PA & NJ). Great discussion. I agree with Papa T, especially at 41:52 in the video. It is not likely that to prevail at trial, the prosecution needed the additional Molineux witnesses. I’m curious as to why the court or the prosecution would take a chance and potentially create a reversible error by allowing “irrelevant, prejudicial, and untested allegations of prior bad acts”. This was a very close case. Excellent analysis.

      He's glossing over the inconsistencies in the victims' stories. Each alleged victim also maintained an ongoing relationship with Harvey and benefitted from being friends/lovers with him. So to come back and cite some random encounter as being rape is questionable. Had it not been for the Molineux witnesses it likely would've been a not guilty verdict across the board. Remember: that's the ONLY evidence they had (the SCONY said as much in their decision).

    Joined the chat halfway through but finished on rewatch crew. That's good to know that New York state will probably enact a law that keeps these type of cases from getting pulled back on the conviction. It's really a terrible thing for SA survivors and this type of thing should not happen. Just like Bill Cosby should not be walking the streets of Los Angeles or Hollywood. It's a travesty of justice. These men need to be held accountable. And the system needs to work to protect not only the interests of the defendant but also the interests of victims.

      Half of these women bringing these charges years and years after they happen are more often than not liars looking for money. If a woman is legit being raped, why would you wait years to report. Sorry not buying it.

      That's not a reason to ignore an accused rights. There are countless examples of people lying about being victims. There's nothing more frightening than being sent to jail when you're innocent. Railroading every man who gets accused is the surest way to make every accusation seem like a lie. That's not fair to victims or accussed.
      Every woman I know has at some point told me about another woman who lied about her to ruin her reputation or to bully her. For some reason, if the story is about a woman doing something wrong, we don't take it as gospel, but if it's a man doing something wrong, we do.
      The jury is allowed to hear about everything he ever lied about, but nothing she has lied about? Maybe that's fair, but maybe it isn't.

      It sounds good in theory but we cannot trample on rights, even for the cosby's and harvey's.... its on the judge here.
      Should those men be walking the streets? No... but rights are rights are rights are right...

      The problem is there's a trend of women being willing to trade sex for favors and then when the public finds out about it they act like they're innocent victims.
      There are countless examples of women saying they desire men who have money. You take men like Weinstein and Cosby who are worth hundreds of millions of dollars and you really think they made it a habit of "forcing" women to have sex with them?
      SA victims should be heard and deserve justice but you shouldn't be able to call yourself a victim after seeking out and cozying up to men just because they have money.

    I feel like the problem with "consent" in a trial like this is the vastly unbalanced power dynamic. My understanding is that he would imply "non consent" would lead to the actresses being blackballed from consideration for roles not just in his films, but also with anyone he had influence. There needs to be a difference made between actual consent and coercion.

      I'm not saying he never said that, but the flip side of that coin is these women were receptive to his advances because they knew he had money, power, and influence. Being able to call someone like Weinstein for favors or to get you into certain parties or events because you know his name carries weight is how Hollywood works. They can act grossed out and disgusted by him now because his reputation is tarnished, but it was established during the trial that all of the alleged victims benefitted from knowing him.

    It’s very hard when it’s a technicality and not the belief he was actually guilty that overturned this. Disappointed but I would say it shocked no one. Men in power always win. No need arguing. Nothing’s changed.

      He was convicted of the most serious charges and will spend the rest of his life in prison… that is not him always winning.

      @@travispratt6327 He won on appeal. That’s a win. I don’t know how else to express it really. Every victim deserves justice and to win, not because they believed he was innocent, but on a technicality… makes it a bitter pill for some of us to swallow.

    As much as i Hate this for his Victims/Survivors, if this was a loophole in the law at least it's been uncovered on a Huge case that will get noticed Nationwide and hopefully fixed so it NEVER happens again? This is how we find out about loopholes in the law so they can be corrected, sadly! I do feel for these people that are going to have to go through this all over again! 💜🙏🏻💛🙏🏻💜

      The “loophole” seems to be they didn’t prove the case and instead used evidence and tactics known to elicit overturning of cases.

    Missed the live- North Carolina has a similar “consent” wording. My 21 yr old daughter was drugged and raped, he said she consented, when she couldn’t possibly have given consent given the drugs- he got 5 years probation and left the state for Virginia. Interestingly a woman from Maryland came forward with the exact same story from 8 years before and was ready to testify when he pled guilty to a lesser charge which included kidnapping as they wanted the felony and sexual assault of a female instead of the rape

Mais l'essentiel est que ça ne se reproduis plus, soyons plutôt concrets, mieux vaut prévenir que guérir : pour faire face aux manipulateurs, aux personnes dominantes, aux situations toxiques et au manque de respect en tous genres, il existe des solutions, des techniques, afin de préserver sa dignité et d'éviter que ça n'aille trop loin. Personnellement, je conseille le livre "SE FAIRE RESPECTER", de Nathan Stone. Il y a tout ce qu'il faut savoir, c'est le livre le plus complet pour faire face à des situations toxiques, c'est clair, pas de discours superflu, le top. Il cerne bien tous les aspects et ça peut convenir à tout le monde, c'est ça qui est bien ! 👌

    Introducing prior bad act convictions are a good idea only if you don't care about appeals. Prior bad act allegations are even worse. Even if there is tangent probative value, it can still be argued that the prejudicial aspect poisoned the case.

    Couldn't that argument be made in the exact opposite way too? That the judge took into consideration his 25 years in New York and maybe didn't sentence him as strictly in California as he would have if he didn't have the 25 years in New York?
    Like that man is going to be alive in 25yrs

    Question: since Weinstein's lawyers claim he couldn't testify because of all the facts allowed in cross - does he now have to testify? (I'm sure he doesn't, but it's so weird to let him use that card and then throw it away...)
    Another question: can the Molineaux witnesses be used again just to prove he might have felt entitlement to sex due to his position of power? He was used to women saying "yes" to him due to his position. It would make him mad to suddenly hear "no".
