I'm guessing that after the 456 incident in Torchwood: Children of Earth, the CIA(and other intelligence agencies in NATO and/or UN countries) added regulations that permit said intelligence agencies to rendition(a "surrender" or "handing over" of persons or property, particularly from one jurisdiction to another) Torchwood assets to aid in investigating extraterrestrial matters. Though why they can't simply work with UNIT(which is a UN agency with the same remit), I'll never know
