Given the fact that Maya WASN'T allowed to have any guests without staff allowing it, I find it way more believable that it WAS a hospital worker and not just some random person walking around the hospital.

It's worth reviewing records for that one entry that says there were or were not signs of sexual abuse or description of her private anatomy. I'll bet there's some comment. However brief, in that chart. I think some doctor who, while dictating their assessment or reviewing someone else's, realize that this portion of the physical exam wasn't documented.
This DOES NOT in any way make the "quick peek" acceptable. But, I'm guessing there is a smoking gun in an H&P.
As a career RN, I think this may be a perfect example of where electronic record keeping fails patients and staff. They make extremely difficult to review.

As anderson points out, when Maya was made a nonentity, she was in immediate jeopardy of being assaulted by opportunists. Yes I agree it was most probably a hospital staffer but we have to await the criminal discovery process, the sheriff's office work etc etc before we can come to conclusions.

Number one: if Maya had had a parent there this wouldn’t be an issue.
Number two: no such exam should have been conducted with out a female chaperone and Maya’s consent.
If it were a medical staff person, there should be documentation in her record.
It’s just as likely that without parental supervision and accompaniment she was vulnerable and not properly protected from a predator. That’s on the hospital.

The Family Law court record was not introduced into evidence and it's even more disturbing than the evidence introduced at trial. The hospital wanted to transfer Maya to Cincinnati with total disregard for her family and her mental state. They placed no importance on Maya's emotional support system and treated her like an object.

If there's a doctor or former doctor that they're protecting from liability for that incident, that's abominable. And if someone was able to get inside the unit she was in, pretend to be a doctor to get access to her, and abuse her, that's just as bad. This hospital is a mess and delusional for thinking they were better guardians of her than her parents.

So even if they wanted to say they had to look at Maya's girlie parts to make sure no SA, they'd still fail for not having a female present during examination. Even as an ADULT female, I have ALWAYS had at least one other person aside from myself and the Doctor in the exam room during any part of the exam, whether it was a pelvic exam or breast exam. Sometimes it’s one of the nurses aides, sometimes it’s a complete third party. If it’s a third party, no medical they function as an ADVOCATE. When they are non-medical observers, they usually sit down in the chair by the door (opposite end of the open gown) and they usually have a book in hand to look at. They aren’t there to SEE, they are there to HEAR if there may be an issue and can IMMEDIATELY observe what is going on if there is a patient protest or signs of discomfort. I have YET to have a single pelvic or breast exam with less than TWO people in the room. I have noticed with male doctors, they usually have TWO additional people in the room-a medical assistant or nurse AND a non-medically trained patient advocate or a nurse assistant. Even my pelvic ultrasound had an observer, but in that case the person sat right outside the curtain wall and they let me KNOW they were there for any issues. When I had a chest X-ray as a child for pneumonia/bronchitis? We had the lab tech, an observing medical assistant (I believe, I was only 10), and my mother involved as I had to strip my top layer for best accuracy. I was NEVER alone with JUST the radiologic tech.
There is NO REASON for ANY DOCTOR to do a pelvic or breast solo, regardless of the reason. The fact that the Dr came in ALONE to me SCREAMS “inappropriate” and should be viewed with great skepticism on the validity of that person’s “exam” and calls into question if they had any real medical reason to be there.
The sad thing is.. she MENTIONED THIS to the PSYCHIATRIC department. It was IN THE NOTES, it the Dr did not inquire further, nor expound on what happened, and left it very vague. Like how did she reach the inclusion it happened somewhere else? She never even answered the JUDGE correctly on if she further asked Maya about it, she just assumed it wasn’t a big deal and that it happened somewhere else. How the hell does that make it OK when you are evaluating a child for possible MBP from her mother, medical abuse, conversion disorder or facticious disorder? Like that would be a good reason for why she acted the way she did, she “defiantly.” Well no wonder, no one believed her about ANYTHING even when she tried to report inappropriate SA type behavior! poor Maya was basically told she was wrong, and that it was inappropriate of her to feel bad about it.

Your comment is EXCELLENT & I firmly agree! I also know that EVERYONE should have an advocate (family member) attending the doctor appointment if they’re facing a challenging diagnosis. The patient is usually so affected by the news they aren’t able to be fully attentive to the medical information.
A journal is essential to note the details & guidance and a list of questions & concerns.
Based on my experiences in the hospital as a patient & a with family members (death of my parents), someone should be with the patient NIGHT & day! A journal is essential especially if family members are at the bedside in shifts.

I think a bigger issue lies with the legislature. They make laws about medical neglect and how child protective services is to respond to it without understanding the issues. There is a huge difference between a parent who refuses to take their injured child to a doctor and a parent who has a difference of opinion on medical treatment.

Beyond the legal reasons for filing the claim, there are the social and psychological reasons. Filing the complaint is the strongest way you can attest that the abuse happened. As someone that has been abused, not being believed is devastating. This shows the naysayers that is more than just an emotional plea for attention, but that there is something to investigate. It also prevents victim blaming for those that would otherwise question why a person didn't come forward sooner.
As a culture, delayed disclosure is still not readily understood.

You may have mentioned this already, but if there were other similar complaints by other patients, the hospital was on notice and that could increase liability, similar to a defect that goes unprepared after the first few complaints. Discovery could get ugly and extremely risky for JHACH.

I didn't hear you mention the fact that it came out during the trial, though not in front of the jury, that Maya told the psychologist about it contemporaneously in response to a question about s.a., and she had it in her notes, but the psychologist INSISTED that it happened elsewhere (even though Maya never said so) and that it was not inappropriate and did not require follow up. Judge Carroll was clearly getting steamed up when he was questioning her, but he still refused to let it come in because of the jury issue. There should most definitely be some repercussions for that psychologist's failure to report, even if it's just suspension and/or retraining. She sat in that chair, in 2023, and still refused to even entertain the thought that it happened at ACH and could have been s.a. Then she claimed it was irrelevant because she couldn't have reported anything without a name. So nobody can report s.a. unless they already know exactly who the perpetrator was? Get real. This hospital is still trying to insulate itself within this fantasyland of its own creating. They need to have the bubble pierced as many times as possible. It's going to take a lot of daylight and consequences before they make any real, substantive change rather than just trying to create the illusion of change in order to shut everyone up.

They KNOW in their guts, they are NOT ALONE! There is a VERY HIGH PROBABILITY that these abuses happened to other children and their families while at JHACH! Part of recovering from deep trauma such as this, is speak truth to power. I believe that Maya does not want ANY OTHER CHILDREN and their families to go through what she & hers did!! Maya wants to hold JHACH to be exposed publicly so they are not only held accountable, but it will also make it easier for any other victims to come forward! Her mother Beata was a fierce advocate and Maya has inherited her mother's passion, tenacity, and heart! She has become an advocate for others, whether she realizes it or not. Beata would be very proud of her daughter!!!

As a victim of deep, depraved, long term abuse speaking truth to power isn't what helped me push through prosecution (not civil.) What helped was getting abuser to have to take accountability and the knowledge that ajury believed me. Belief is incredibly important for PTSD CBT, DBT therapy treatment. Helping others will come after she can heal more..... Possibly using some of the verdict money (after collection or settlement) to help treatment or research. People like A Hear use "speak to power" without knowing what a survivor canshould do.

      @CALB2009 6 місяців тому

@@LWM521 I hear your message and appreciate your feedback. I too am a victim of severe abuse, neglect, and gaslighting from close minded doctors, nurses and support staff. I have a rare auto immune neuromuscular disease which I KNEW was my diagnosis within 2 months of the onset of my symptoms, b/c of my own medical degree and years of clinical practice. However, for 2 years, I was ignored, told it was all in my head, it was conversion disorder or psychosomatic. I was denied the prompt, proper treatment protocol. In those 2 years my health declined severely....I was an elite gymnast growing up and prior to onset of my illness, was still extremely physically fit. I'm 5'7" tall and had weighed 125 lbs prior to my illness. By the time I was seen by the Chief of Neuromuscular Disease Center at Cleveland Clinic, where my diagnosis was finally confirmed and proper treatment started, I was down to 90 lbs. I had been wasting away for 2 years, became 100% disabled, lost my career and my marriage b/c my husband believed the arrogant gaslighting doctors instead of me. I had been tirelessly advocating for myself and begging multiple doctors to just listen to me! It's been 22 years now, and I still suffer from severe PTSD from the trauma of being treated like I was crazy. My disease causes my muscles to fatigue due to antibodies which attack neurotransmitters which tell our muscles to move. The more activity I do, the more antibodies build up. Four times my respiratory muscles and diaphragm have become paralyzed and I've had to be placed on a ventilator to breath for me. I can tell when my respiratory muscles starts to paralyze and the most important action is to get to the ER and be placed on a Bi-Pap Ventilator to avoid intubation, then plasmapheresis started. Because so few doctors truly understand the hallmarks of this disease, to this day, I still encounter gaslighting abuse from poorly informed ER doctors... who tell me I am just having a panic attack and don't need a Bi-Pap Ventilator. I literally have to use every ounce of strength in my body to BEG FOR HELP! Twice now, the ER Docs have failed to listen to me, follow the "Emergency physician orders" I carry from Cleveland Clinic, or even call my doctors to confer.....and denied me a Bi-Pap Ventilator....which resulted in me going into respiratory arrest and the doctors scrambling to INTUBATE me! Both times, this could've been avoided! Each time this happens, they risk me not just going into Respiratory Arrest, but full blown Cardiac Arrest! I have had more than a dozen friends who also had this disease, DIE in the ER because the doctors ignored them too! So..... It has become VERY IMPORTANT TO ME to be an advocate & educator. I have conducted disease and emergency treatment education meetings with the ER staff at several hospitals, both Nursing Staff and Doctors. I have also counseled patients and families dealing with this disease, on HOW TO ADVOCATE in the ER and the specific actions to take when their advocacy falls on deaf ears. It has saved the life of several of my fellow patients! Validation and vindication of a diagnosis only takes you so far in recovering from the abuse you've endured. The reality is, Maya like me, has a chronic disease for which there is no cure. There will most certainly be need for hospitalization from time to time in the future......and the FEAR of that perpetuates the PTSD. The only way to feel like you have some control over the future is to advocate and raise awareness of abuses you suffered to remove the bad actors, and encourage others who have suffered similar abuse come forward to further change the culture of the medical establishment. You know it happened to you, that it is highly likely others have suffered the same fate, and the only way to try to make it safer for yourself and everyone else in the future is to Raise Awareness and Advocate in any manner you can.
      Peace to you ~~

Completely agree! Based on her Suicide note where she purposefully mentions the hospital, and the state of Florida as well as the judge- it’s like she knew the ONLY WAY for her to save her child from the claws of the system was to commit this act against herself so that her family may use IT as a weapon and get the child back! The ultimate self-sacrifice of a Mother for her child!

I am so proud of Maya. She has gone through so much as a child and as a young woman. I’m glad she is doing well mentally and I wish her and her family happiness and wellness in the future. I realize she will be coping with CRPS for the rest of her life; but, I truly hope she has more good days than bad.

What about CPS and their roll in the original proceedings! You can't ignore their roll and not getting to the bottom of her diagnosis and treatment were to begin with and their actually not understanding her treatments and supporting the hospital in their actions?

Peter, I have learned so much about the civil trial process from you covering this case. So thank you for all that you do for our community! 💗 I was wondering if perhaps Maya’s lawyers filed the SA criminal case to have more leverage for negotiating a settlement in the Kowalskis’ civil suit? 🤔

Anytime I've had to have that kind of exam by a male doctor, there was ALWAYS a nurse or tech in the room with us!! First and foremost, there wouldn't have been any reason to do that kind of exam on Maya, especially him creepily saying "can I take a peek", and secondly, there is absolutely zero reason that especially a male doc should be doing an exam without a chaperone!!! I can totally understand why she would have suppressed that memory.. All of the terrible things she was being put through and then having some weirdo come in and pull her pants down and stare at her! I don't care what the hospital claims to have done to correct all their problems, places like that can never fully be rehabbed, they need to be closed down forever!

    • @elizabethmccready

Even my female doctor has a nurse in the room with her for my yearly exams. It's just good practice in my opinion.

@elizabethmccready I should have included in my comment that I have an all female team between my pcp and GYN, and they always offer me to have another person in the room, however I typically decline because I am very comfortable with them. If I were to go to a different provider, or the ER, I would 100% expect there to be another person in the room, whether it's a male or female provider!

@@My2Monkeeys I never need it with my gynecologist because I trust her 100%, but I always appreciate the care taken by her. My PCP wouldn’t need to either because he’s wonderful, but I know he would if he had to do any kind of exam like that. I’ve said for years I want the two of them as a team if I ever give birth haha.
