  • The Atlanta Police Department evens the playing field for a group of motorists caught parking in the wrong spot in Midtown.
    Several motorists got the boot when they left a large lot on Ponce de Leon Avenue to go into Green's liquor store on Saturday.

    The property owner had the right to enforce its parking policy. However, when officers were called to the location, it was determined that one worker with the booting operator had an expired license to boot.
    So officers asked, and the SBS Company complied, and removed the immobilizing devices. Each motorist was saved $75.
    Richard Spear, the operations chief for SBS, said the worker had been hired part time to act as a spotter and was not supposed to attach the devices.
    Atlanta police issued a citation.

    Was booted on private property while doing business with only that property. Booted and then I called. Explained and they refused. Said had business owner to back me up. Took a selfie with business owner and boot. Called back and said 10 minutes and I'm cutting it off. They threatened so I cut it off. 6 years and nothing. Still have the selfie.

      Even if it’s illegal, they would have to prove you were the one that removed it and damaged it. There are ways to remove those without damaging them. However, if your in a hurry you could use a cordless angle grinder and rip right through it. Then take it with you and dump it somewhere ASAP in case it has some type of tracking system (which I doubt). Then there is no evidence of anything. Just a missing vehicle and boot.

    Simple solution. Buy 4 boots of your own. (The triangle kind which cover your whole tire) then when you park, boot all 4 of your own wheels thus stopping the parking company from being able to!

    Grandparents moved into an apartment complex for 6 months while awaiting their home construction to be completed…..the had out of state plates so the apartment parking lot attendants booted their vehicles multiple times each month for 3 months by mistake until Charlotte PD came out and told the person putting on the boots that if they came back again to the location for another call about cars being wrongfully booted, they were going to start arresting apt, management and the owners of the towing company the apt had contracted for extortion and auto theft.

      this is the first time I heard about the police dept on the side of the person that's getting towed, usually the towing company and police work with each other so it's hard to get treated fairly.

      Maybe motorists should start carrying lock picks, so they can use self-help means to remove the boot without paying.

    Yeah...this is something that Georgia (and many other states) need to fix. The only people that should be allowed to boot is Law Enforcement (Even deputized parking authorities) and _only_ for issues of parking tickets that are outstanding and unpaid.

      Its private property why would police boot on private property. If the owner of said propert wants people booted that park on their private property and go else where while parked on their private property that's their right.

      they try to do that to in Belgium, law is clear on that over here;
      no private person/organisation can touch your car or place items on it (including a boot or any other device) or immobilise it in any other means
      the only people that can do that over here is law enforcement and only in certain cases; behind taxes, car used in a crime, etc . . .

      Noone should be allowed to boot. If the car has significant unpaid tickets, tow it. Booting serves no purpose other than to extort money from the car owner while leaving the car in the spot. Personally, I think it should be illegal to boot at all and towing should only be allowed during business hours and never for technical violations such as back in parking, stickers not properly displayed (but visible), obvious typos in parking apps, etc...that in no way affect the ability of anyone else to park.

      That won't necessarily get the owner off the hook.
      In Colorado, a parking enforcement officer can place a boot on a car in a client's property and require the car owner to pay a fee to remove it.
      While a boot can be removed by picking the lock, the Booted will have likely recorded the VIN. So, if the boot it removed by the owner without payment, the Booted can legally filed a lien on the car. In Colorado, the cars registration cannot be removed, nor can the car be traded in or sold unroll the lien has been released hybrid leinholder/ booted.

      There is one word to describe such a legal policy- unconstitutional, and probably not on the books, either. One cannot simply place a lien on the property of another. One must have enough proof that a debt exists involving the property to place the lien. In essence, a mechanic could place a lien on a car or a contractor can place a lien on a home, but in each case, their must be strong evidence of debt related to that piece of property.
      One cannot just place a lien on property because someone owes money. If it were that simple, credit card debt collectors could attach a lien to peoples' cars, homes, or whatever else they owned to enforce the debt. They can't. The courts generally wont allow it. A private booting company would have to show the same. A VIN that anyone can copy and a private claim that the owner of the car cut a boot or picked a lock is not enough. There must be actual evidence.
      Three years after the fact when the owner attempts to sell the car and discovers the lien from the booting company, it is the booting company which will have to prove their case, not the car's owner. The owner of the car can also file charges against the booting company for filing a false lien. Most booting companies, especially shady ones, will think twice before going to the courts to enforce what is already a very shaky charge.

      In Colorado, we can and do. When a vehicle is cited for unauthorized or other violation on a client's property, a boot can legally be installed.
      Notices on signs around the lot are legal warning and notification.
      . A lien can be placed on the vehicle if payment for boot removal is not paid.

      How does a client manage to obtain a lien if the customer cuts the boot or its lock and drives off? Anyone can photograph a car and its plate plus VIN, and then claim that the owner parked the car and left the lot. What standards of proof are there? How does the owner of the lot prove that the driver parked and left the lot without shopping at one of the covered stores, and that no one else in the car got out to shop at one of the covered stores? Also, years after the fact, it seems kind of unlikely that a judge would uphold a lien for a few tens or even hundreds of dollars. Private entities are never the equal of public law enforcement, and don't have the rights of public law enforcement. I would like to see a copy of the actual law, if you have it.
      I did do some internet research on this and the most I came up with is that car liens can be placed by mechanics for services rendered but there has to be some form of contract and most probably a judgement from a court. Nothing came up about private booting companies in Colorado or anywhere else having a special right to place a lien for a booted vehicle. The only car lien articles which came up were for tow companies and mechanics. Tow companies could place a lien on a car for fees owed and ultimately dispose of the car but only after judgements from courts in some states and with special law enforcement permission in other states.
      As for booting companies, it sounds like the only way for a booting company to place a lien on a car is if the owner agrees to or promises payment to the booting company in writing to get the boot removed and then refuses to pay what was agreed to. If the car owner simply cuts the boot and splits, there are two words which apply- prove it. Prove it means that the booting company become a plaintiff in small claims court and the car owner a defendant. If you can show me actual paperwork from an actual car owner who self removed a boot without notifying the boot's owner, paying, or agreeing to pay, I would like to see it.
      Private booting companies requested by the police to boot illegally parked vehicles or for other official government enforcement are a different entity altogether.

      In the same way a mechanic places a lien on a car. Though the car owner did not sign a contract, there are official signs placed on the client's property warning of unauthorized parking, which are considered official notice.
      When a boot is placed on a car, it's VIN is recorded. Also, photos and notes about the car are recorded to back our claim.
      We're very carefully and through in what we do.
      Filing a lien though is very rare. In the past 2 years, we've only had to do it 4 times. (We boot a few thousand a year)
      Our company is licensed by the state, insured and bonded.
      Nothing illegal or shady here.

      You would not go to jail. They have no legal authority to hold your property. It's nothing more than an attempt at extortion. They may not like you parking in their lot and going somewhere else, but it's not actually illegal. And even if it were they have no authority to enforce the law.

      Rowgue51 it is legal to boot... That's why they have to register with the state. Obv every state is different but it is legal. If there are signs and they are licensed.... you can't park there unless you use the business..... and yes.... it is criminal to damage a boot... It's destruction of private property. You might not go to jail but you will have to pay for the boot.... go look up the laws just like I just did to make sure I was right before I posted this....

      They'd have to prove you destroyed the property.. They might claim 'this plate/vin vehicle was booted' and the boot was destroyed... but that'd not pass 'reasonable doubt' nor the 'preponderance of evidence' requirements.
      And claiming that you stole it would be hard.. how could you steal something that immobilizes your car.

    Here in florida it is illegal to boot a vehicle on a non compensatory lot. Only a pay lot can boot a vehicle legally. Although the apartment complexes have these companies boot cars. I have people call me and I’ll cut these illegal boots off as a courtesy. The booting company calls the police and the police give them the bad news.

      @@rivahkillah Except that's not how titled property works. Land and cars have titles and are private property. The parking is trespassing so a fine and towing is legally allowed. A boot is a form of extortion and by having the boot on a titled piece of property transfers the boots ownership to the title owner. Booting is wrong on many levels.

    A question for armchair lawyers. To tow or boot is a penalty for an "alleged" violation. That is to say an infraction not proved in court, and with denial of due process. Seems like illegal seizure of property to me until adjudicated in a court of law, assessing penalties before a legal violation is determined. Anyone have any thoughts?

      First must try and resolve the illegal parking issue before boot is installed. Give the driver a grace period to move the car then if no response from said driver the police are called to issue a ticket and possible tow.
      What they are doing is slapping the cuffs on prior to resolving, said case, peacefully.

      It is not a government authority that is booting/towing. so there is no due process here unless you want to sue the boot/tow company. The one thing I did hear in this story is these people were parking in the lot of business NEXT door, so they were legitimately booted. They just got lucky the one guy did not have a licence.

      There is nothing beyond a civil dispute going on. They argue you parked where you shouldn't have, so they clamp your car, or worse, tow it.
      If it's a private company booting your car, just sue them afterwards for damages to brake rotors or rims for whatever the fine is plus a couple tenners.

    One of the really nice things about having worked for a lock company back in my youth, I learned some mad skills. If some hack company boots my car, they will lose their boot in under 3 minutes. A boot is only as good as it's lock, if they are keyed alike, it's easy peazy. I have a buddy I used to work with who sells boots as scrap metal.

    Easy, don't do business with, in or around businesses that work with, and more then likely get a kick back from, these tow companies. Problem solved.
    I've never had a parking ticket, been booted or towed doing this.

      take the tire off or just cut it hate to say it but if its that magnesium cast like shown in this video those snap VERY EASILLY i dont reccomend it on newer cars (that have plastic bumpers and guards) but lets say like my little work beater a 2001 hyndai accent with cheap alluminum and plastic just drive forward untill it hits the wheel well and give it a tiny gas to force it in there and go itll snap itself like i said i highly dont reccomend this on new cars for obv reasons

    Quick question to all of the people saying "Just jack the vehicle up and change the wheel"... If the boot covers the lugnuts, or even if covers just 1 lugnut, then it would seem destroying your hub or wheels studs at minimum would defeat the whole purpose, as you cant attach a wheel to a vehicle without studs & lugnuts. How does this make the vehicle any more driveable than just leaving the boot on it?

    In Texas booting is really left to be regulated by cities. In San Antonio, they can't boot it until a hour after time has expired on a lot and on your second offense as long as you have proof of paying. Other wise the max fee is $35 for a boot.

    its 100% ILLEGAL for anyone to boot cars if they are not the city's parking enforcement. you can call a tow truck to come and remove the cars but you CAN NOT boot them. doing so will get you a huge lawsuit that you will lose.

      @@johntracy72 i am not going to say as my name is my job and that would narrow it down to 1 city in which people who read these could find me and put my family in danger when i am working and i will not do that to my family
      but as my name is my job i know property laws, a ton of police officers and the court systems as i have been doing this job for over 20 years now. just like any job there are things you dont know when first starting out but the longer you do the job the more you learn.

    What happened to "Due Process"? Everyone should have their day in court to contest the "illegal" parking. This is theft, blackmail, plain and simple. Every private boot on someone's vehicle should be able to be removed any way possible.

      @@dynocompe Your example is more. If someone bolts a chair inside your house you can't touch their chair? If someone puts a boot on your car they are on your private property your car and you have a right to remove it by any means. Still fine a car for parking there but booting is wrong.

    The best way to prevent the boot is to just roll with old fashioned steel rims. That limits the type of boot they will use. Some boots can be slipped off by deflating the tire. Dont cut of the boot. You could have to pay a fine. If you dont damage it, its really up to the judge then lol.

    I won't pay to have a boot removed from my vehicle I will just make a call and have my buddy bring his grinder and cutting torch and cut the boot off parking fines and parking violations are a way for towns and cities to extort illegal revenue from people

    Make sure you have spare tire and jack. Remove the tire with the boot, install spare. Call booting company and tell them they left property on one of your tires. If they want it back, it will be a fee of $400. If not, you will dispose of the abandoned property. How can they boot cars if everyone does this and they run out of boots?

    Decades past while my dad was alive, he got booted in his work truck. Unbolted the single tire they could reach, and install the spare. When by the booters office told em remove it and keep it or he'd cut it off and weld it up for them. The actually hired him to repair them.

    how does a spotter get a company boot to illegally boot a car with, without the knowledge of the booting company? i believe the company knew exactly what that guy was doing, but didnt if they were violating the law....i believe their greed got the best of them. they unlawfully siezed those vehicles and should be sued for their actions....as well as criminally fined.

    doesnt matter if the employee had a license or it expired or what ever. If he was not taking payment then he can boot the cars on private property. Dont park on private property.

    While a private property owner has every right to protect their interests, they don't have the right to imprison or immobilize for ransom one's self or one's property. Towing or other removal is a good remedy only if the private property is properly marked with clearly visible signs at the entrance and at individual spots so that there is no chance for error on the part of the public. Law enforcement must be carried out by police on the public payroll, only. Private companies should never be given authority beyond citizens arrest. We have a very dangerous trend in the USA now and it must be reversed.

      That's actually how it is in California. The Former AG (now Senator Kamala Harris) clarified that only law enforcement (even deputized parking agents) are allowed to boot cars. Also that's if and _only_ if there are outstanding parking tickets. The only remedy private lots in California have is to actually tow the vehicle, and there state and federal laws apply. That is, in California (and some other states) private boot companies are non existent.

      This is one time I will applaud California. I only hope that towing companies are held to stringent standards as well, including full exercise of due diligence to locate the owner of the vehicle and inform them of the intent to tow. This must be in addition to clearly posted signs at the entrance to the lot and at locations easily and clearly visible and readable from every spot. The same spotters who watch people get out of their cars and walk to businesses not serviced by a lot must be required to inform those people to move their cars before towing them. Towing must be an honest method of removing illegally parked vehicles and not a dishonest "fool the public" profit sharing enterprise between the lot owner and the towing company.
      As an aside, is there any progress in California in removing those onerous speed traps and red light cameras? They are a prelude to totalitarianism in our great nation and must be gotten rid of.

      The plunge into the abyss of totalitarianism is usually slow and gradual. It does not happen overnight. Those who wish to seize power do so slowly and gradually over time, so that people gradually become acclimated to the seizure and don't notice. People gradually agree with the arguments made by the illegitimate totalitarians that the invasions and infringements of their rights are being committed for their own safety. That is how every totalitarian regime throughout history has come to power. Now, we have incursions into our rights and freedoms by big corporate. They seize our personal information, including medical and financial records for so called marketing and anti fraud purposes. They hang out our personal data for criminals to grab and then sell us ID fraud insurance. If there was ever mass legalized extortion, it is going on right now, right under our noses. Camera law enforcement by private companies is one more step in the slow slide towards totalitarianism. There is a huge difference between video or camera evidence at a crime scene being gathered and analyzed by law enforcement, presented in court in front of a judge and jury, and a rubber stamp hearing officer deciding guilt based upon the say so of a private company with no opportunity to cross examine or question the evidence. The standards used for RLCs and speed traps would be deemed entrapment if applied to most other types of cases.
      The system you refer to is not unbiased. RLCs and speed traps are installed at the behest of private companies that manufacture and install them. Very rarely are they installed at the request of the people. RLCs and speed traps are designed to set the public up to fail.
      DivideByZero, are you perfect? I don't believe so. Nor would anyone else. You violate red lights, or park imperfectly, or do the roll through stop signs, forget to signal turns or lane changes, cut off oncoming traffic when exiting parking lots, or commit any number of other violations. There is no such thing as a perfect driver. If you doubt this, you are either lying or very selective in your observation and memory. There are only those who try their best and those who don't care. That is why the police and only the police have the right to enforce the law, on the spot, not weeks after the fact by photographs and video.
      Only a trained police officer can spot a dangerous driver who does not care and pull them over for their violation(s). Only a trained police officer can read the attitude on a driver's face and make an evaluation. Only a trained police officer knows the difference between a driver who made an honest mistake and one who does not care. Some officers are strict and others are more lenient. Most officers have thresholds for writing tickets. Those thresholds vary by the location, level, type of offense, and the nature of the violator. In most cases, if one appears to be an otherwise good driver, the police will not bother one for a minor infraction such as missing a red by a few tenths of a second, going a few mph over a speed limit or going a mph or two through a stop sign.
      Camera enforcement by greedy private companies takes away the officer's discretion and the opportunity for the individual to fight the ticket in an unbiased venue. It is bad enough that traffic courts are usually rubber stamps for the police. It is even worse when greedy, corrupt private companies and the politicians in their back pockets become involved in the enforcement process.Those who are major shareholders in the RLC and speed trap companies have big plans for us all. They will make violators of us all, Soviet, Nazi, CCP, or North Korean style, so they can use our violations against us to justify their illicit and egregious power seizure. We Americans pride ourselves on keeping the nanny state at bay. We have little to no tolerance for those who wish to punish every person into submission for every tiny perceived wrong they commit. No one is perfect. No one deserves to be punished for every tiny infraction they commit just because they are only human. That is why we have a jury system. That is why that jury system must be mandated for every instance of government prosecution, no matter how small. If someone is really so bad, gather the evidence and present it to a jury. If the jury rules the defendant not guilty, then either there is not enough evidence of guilt or the law was deemed wrong by the jury. That is why the jury is supposed to be there in the first place. The jury is a buffer between the defendant and corrupt or malicious prosecution. Our jury system helps to protect us from malicious prosecution and the enforcement of bogus laws which should not be on the books to begin with. Speed traps, RLCs, and other automated law enforcement schemes violate every legal protection we as Americans hold dear. Under no circumstances does our government ever have the right to presume guilt, infringe upon our right to due process which means a jury trial, or in any other way infringe on any of our rights.

    Those boots you gan just remove/change out then crawl in from passenger side that way you have not broken door seal or damaged the boot. Just remember to have the car in the garage when they come to pick up the boot.

    Basically the state/municipal government tellls the booting business that if we dont get a piece of the pie or our taste $ by you renewing your licence to boot, that you cant operate and we know this business is lucrative so were going to enforce it with our police officers (muscle).
