The scammer who leased the luxury house and scammers who rent it regularly are friends with police who do nothing about these undisciplined people. They think their 2 night rental gives them the right to do shoot outs in your neighborhoods. Yes people are buying up Jamaica but the scammers are the ones who have the money to buy next door and rent next door. So as the saying goes...yes it might be gated ...but who is behind the gate...???

Regarding adverse possession - I am a real estate agent in Virginia - and adverse possession/squatters right is allowed here. If a person/squatter meets certain criteria (varies from state to state) they may take legal possession of the property...the take away is begin vigilant in property management.
Past governments were careless not to get people to register their properties in Jamaica. That is why so many captured lands is Jamaica which is causing a problem to re-claim from the people. Another problem which happened there is, people captured the railway lands and built houses on them especially in Portland area which will cause problems when the government decides to sort the train service.

If someone builds a house on land they already own, How can you show ownership of the house? Would there be a Deed or Title? They already have the Land Title, but how can you tell who owns the house. Would the contractor who build the house have documents to show who paid them to build the house? I am really in the dark about this. Any help would be appreciated.

My 71 yr old brother has always lived in the property in which he was born. This property was owned by our grand mother and mother, who died 1970's & 1980's respectively.Crucially there was no Will. My brother has always paid the land tax and maintains the property to a good standard. My question is what is his legal position?
I am not a lawyer, but here goes-Adverse repossession. Basically, it’s a law in Jamaica that states if a person is living on a property and pays the taxes for 12 years, they can submit an application to the Land Agency for a title for the land. He will need to get an attorney to do this. Adverse repossession is a controversial subject in Jamaica. Two weeks ago in the Sunday Gleaner, a policeman owned a 1/2 acre property in the very popular Cardiff Hall area of St Ann. Along came an overseas investor who wanted to purchase the property; the policeman admitted he had not paid taxes on the property for 8 years, so he rushed to the tax office to pay the arrears, anticipating a windfall after he sold it. The title to the property was not on the tax office’s records. A call over to the Land Agency revealed what happened-Someone else had paid all the due taxes, made application for title to the property and it was granted. The policeman’s title was “extinguished” and he no longer owned the property. To make matters worse, the Land Agency can no longer find the application paperwork that was filed for repossession of the property. It has been said that people inside either the Land Agency or the tax office has been leaking records of properties around Jamaica where the taxes have not been paid for years to certain individuals; and those individuals are legally applying to repossess them. Good luck.

if you have a will in Canada and you have a property in a gated community . If the parents has passed what is cost to transfer the title into the kids name? Is there any capitL gain tax? What is the percentage?
Please do not share the attorney, I made that mistake, my attorney was friends with the seller and I was not represented properly, especially when dealing with a property breach.
In the US people are only disciplined because the enforced laws and the police make them so. Thats the problem with Jamaica at the moment. NO consistent enforcement of laws.
