The original deal in 1878 - The Sulu sultan leases Sabah to the British North Borneo Co., represented by Englishman Alfred Dent and German Gustavus Baron de Overbeck in a deed of pajak (“lease”) in which the company would pay 5,300 Mexican gold pieces a year to the Kingdom of Sulu. Instead it was converted to ringgit. This is one of the reasons why the rent ballooned to 14.9 billion dollars in todays money. I hope this helps you all see the truth.
I'm sad for the heirs of the Sultanate of Sulu, and its people. they are not allowed to stay in SABAH, which is now controlled by Malaysia. The Malaysian government stopped rental payment in 2013. The heirs then went to the court to demand rental payment. Guess what? The biggest mistake was, discontinuing the rental payment which resulted to a breach of contract. It which case, the heirs of Sulu came into default. To regain control of Sabah and demand payment for the arrears based on current market price and maybe including the illegal use of natural resources of Sabah which is not stipulated in the agreement, destruction of environment, compensation for the human rights violation, and etc.

Sulu representatives have since tried to use the title deed granted to Overbeck as proof of Brunei having ceded the territory to Sulu. Any credence in the Philippine claim today is highly contested and purely historical in nature, which is rejected in international law. Clearly, this is not a sovereignty issue, it is clear from the Tribunal’s ruling.

The fact that Malaysia pays the rent, year after year until it defaulted thus accumulating arrears in rentals, would mean that it is a mere tenant, as the payment of rent is proof enough that it is not the owner of the said territory and naturally admits of its inferior position being a mere lessee-obligor who binds himself to pay rent to the lessor-obligee who is entitled to it. A tenant must comply with the agreement, express or implied, and pay the right amount or else it will be a ground for annulment of the contract, collection of rent and its arrears, damages, interest, or worse... eviction!
This would be a problem if Malaysia Paid the heirs of the Sultan of Sulu, meaning they just honor and acknowledge that they are just renting Sabah. If they don't, the Sultan's heirs will seize Malaysian government assets around the world, and they will go bankrupt. They need wise lawyers to handle this battle. This issue started when the west interfered the east. Sabah originally belongs to the Sultanate of Sulu which is now part of the Philippines. Based on documents and history, Sabah was a gift of Sultanate of Brunei to Sultanate of Sulu as a token of gratitude when the former seek help to the latter. Malaysia is yet to be a country by then. Malaysia is not the owner of Sabah, as 'evidenced' in their rent which they halted back in 2013. The real owner is not the one who rented but the landlord. The sultanate of sulu did not give up the rights to the british. In fact, the british were paying rent approximately 3,000 mexican pesos at that time. Which also means that sulu maintained their rights and never gave it up

Descendants of former Sultan of Sulu claim that Sabah belonged to Sulu Sultanate because Sabah was given by Brunei the original owner to Sulu as a gift. But Brunei refuted this claim and denied ever having given Sabah to Sulu. There was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans. In fact on 29 December 1877, the Sultan of Brunei ceded the whole of Sabah to BNBC/British and concurrently appointed Baron Von Overback, the co-owner of BNBC as Maharajah of Sabah and Rajah of Sandakan and Gaya. This cession agreement was documented. When BNBC went to Sabah to begin their business, Sulu claimed that Sabah belonged to Sulu. BNBC agreed to enter a "pajak" agreement with Sulu after they were advised by their fellow businessmen in Hong Kong who advised that Sulu would attack them if they didn't have a deal with Sulu. This "pajak'' agreement was signed on 22 January 1878. BNBC understood that this "pajak" was a "cession", so did early generation of Sulu Sultan accepted it as "cession". Only later generation of descendants of former Sultan of Sulu claimed that the "pajak" agreement was meant to be "rent" or "lease''. Still there was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans. The two above events led to an overlapping issue on Sabah. What ever it was, the above agreement and overlapping issue were superceded by later event. On 22 July 1878, the then Sultan of Sulu had relinquished all his possession and sovereignty of Sulu and it's territories including Sabah to Spain. The Sultanate of Sulu only remained as hereditary cultural and traditional entity without any sovereign territory. In 1885, to resolve overlapping issue on Sabah and other issues involving other islands, Britain, Spain and Germany arrived to an agreement known as Madrid Protocol in which Spain surrendered Sabah to Britain. As new owner of Sabah Britain had full control and sovereignty over Sabah and they could do what ever they wanted. Sulu could not claim anything because they had already relinquished the sovereignty of Sabah to Spain and Spain surrendered Sabah to Britain. What ever happened to Sabah after that was under British jurisdiction. Even though British had full control and sovereignty of Sabah, they still honoured the annual "cession money" payment stipulated in the "pajak'' agreement as consolation for the Sulu Sultan. So did Malaysia when formed in 1963, still honoured the annual "cession money" payment as consolation for the Sulu Sultan. The term "cession money" was used because to use the term "consolation" was felt to be too degrading. Thus the term "cession money" was continually used as used before by the British. On 31 August 1963 Britain gave independence to Sabah and before that on 22 July 1963 Sarawak was given independence. The people of Sabah and Sarawak had exercised self determination to form Malaysia together with Malaya and Singapore. The sovereignty of Sabah and Sarawak as component states of Malaysia is intact and recognized internationally and recognized by the UN. This was confirmed and clearly stated in the United Nations Malaysia Mission Report "Final Conclusion of the Secretary-General", 14 September 1963. The last sentence of the report says: "I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia". The Heirs of Sultan of Sulu have volumes of documents to prove their claims even the Check of last payment of "Rent". It will be very painful for Malaysia to know that Sabah is not a sovereign part of Malaysia. The rightful owners are Philippines Nationals.

Something doesn't make sense, if these so called secret agreements that you so confidently believe is true then why does the Malaysian Govt keep dodging the matter to discuss this in a diplomatic way? The Philippines have initiated a diplomatic way to take this matter in international court, on June 18, 1964 President Macapagal wrote to your then Prime Minister Tunku Abdul Rahman to discuss the matter in International Court. All above mentioned points happened before 1964. The malaysian govt could use these agreements to strengthen their claims. But they didn't do so. IMO, the malysian govt realized that their points and agreements wouldn't hold up in international court and the fact that Sabah, has an abundance of natural resources they just couldn't let go of that land easily, thats why your govt keep dodging the Philippines in international court.

June 27th - Dutch Court of Appeal had dismissed a bid by eight descendants of former Sultan of Sulu to enforce the arbitration award by Paris Court (lower court) ruling and dismissed an attempt to seize Malaysian assets following the Paris Court of Appeal decision. 3. Paris Court of Appeal also imposed on Sulu €100,000.00 (Euro currency) to be paid to Malaysia as legal cost. 4. Mean while in Luxembourg, a second attempt to seize Malaysian Petronas assets had been filed in Luxembourg Court due for hearing in September 2023 after the first attempt was dismissed. This will likely be dismissed too following the Paris Court of Appeal decision.

Brunei promised to give that piece of land to Sulu if Sulu helped Brunei Sultan in a family dispute, but Sulu didn’t turn up, so the land was not given. Anyway, in those days, there were no administration in the modern sense of the word. What the Brunei Sultan promised was for Sulu to collect taxes and basically ruled as a warlord but because they didn’t turn up, the promise was null and void. When Sulu was incorporated into Philippines, they never included Sabah because Sulu KNEW THEY DIDN’T OWN SABAH! You can twist and turn history as much as you like and still the conclusion is that Sabah belongs to Sabahans and since Sabahans went with Malaysia, Sabah belongs with Malaysia! Before commenting, know the history. In 1660 to 1673, A civil war broke out in Brunei between Sultans Abdul Hakkul Mubin and Muhyiddin. Muhyiddin was concerned that the civil war was dragging on too long and asked the help of the sultan of Sulu to send forces. Sabah was given to the Sulu Sultanate by Brunei as a reward for helping Sultan Muhyiddin's forces. Sultan of Brunei handover Sabah to Sultan of Sulu as a reward for helping Brunei to settle that civil war.
Correction. The Sultanate of Sulu never gave up Sabah to British North Borneo Company. They merely leased it to this company. They should not have passed it to Malaysia as it was never theirs nor Malaysia's to begin with. They engaged the Sultanate of Sulu in a contract behind which is bad faith.

Im seeing from both perspective here. If the verdict pass to say that Sabah should be 'returned' to Sultanate of Sulu: For Malaysia - The long years of investing and developing Sabah will be given freely to them. In order to rip of the riches and benefits of Sabah, BILLIONS was invested due to challenging terrains, economic, transportation and channeling education across Sabah. Therefore, for Sultanate of Sulu to request to 'return' Sabah back to them will deem unfair for Malaysia who put the effort of developing Sabah. For Sultanate of Sulu - It is their land of rights that was in generation given to another party without them being in control. Seeing their land devoloping and not being able to share the riches, it seems unfair. However, in a fair, economical and financial pov - IF Sabah is to 'be given back' to Sultanate of Sulu, they need to understand that the people of Sabah was not under their jurisdiction for generations. Culturally and morally, there would be a huge social challenge for the Sultanate to govern through. Then there is the financial part where maintaining the development of Sabah. To rip the benefit and riches of Sabah will require a huge funding and investments. The Sultanate of Sulu will need to consider a huge amount of budgeting firstly on the economic side and secondly on the governing side ( i may have left other points but those two are the apparent ones i see) which WILL BE costly. Just to get this corrected. The original deal in 1878 - The Sulu sultan leases Sabah to the British North Borneo Co., represented by Englishman Alfred Dent and German Gustavus Baron de Overbeck in a deed of pajak (“lease”) in which the company would pay 5,300 Mexican gold pieces a year to the Kingdom of Sulu. Instead it was converted to ringgit. This is one of the reasons why the rent ballooned to 14.9 billion dollars in todays money. I hope this helps you all see the truth.

That Sabah or North Borneo was once part of the Brunei empire is not disputed. But the Philippine claim to Sabah rests on the assertion that Brunei gave the territory to Sulu in return for assistance in the 1660-73 Brunei Civil War. However, the sources supporting this notion give the year of transfer as either 1658, two years before the Civil War broke out, or 1704, 31 years after it ended. The span of time covers the rule of different Brunei sultans.
Brunei has never accepted or acknowledged that North Borneo was given to Sulu. A narrative in Brunei states that although an offer of land may have been made in exchange for military support, that support never came so the deal was never concluded. No Sulu sultan or other authority has been able to furnish proof of ever receiving the territory from Brunei, or of having governed it since.
Britain annexed Sabah as a crown colony in 1946, after the chartered British North Borneo Company acquired it through a sale from the German magnate Gustav Overbeck, who had obtained the cession from the sultan of Brunei in December 1877. Since Sulu was making representations to the territory then, Overbeck also went through the motions of a cession with the sultan of Sulu some three weeks later. Two competing title deeds were obtained, signifying rival claims to ownership and sovereignty being given away.
Both title deeds were for a permanent cession, but only Sulu has tried to overturn the agreement. Sulu representatives have since tried to use the title deed granted to Overbeck as proof of Brunei having ceded the territory to Sulu. Even before the founding of the Republic of the Philippines, successive Spanish and US colonial administrations had already rendered the Sulu sultanate defunct. Any credence in the Philippine claim today is highly contested and purely historical in nature, which is rejected in international law.
The Manila Accord of July 31, 1963 facilitated the formation of Malaysia with Sabah without hindrance from the Philippines, while granting Manila the option of continuing to entertain its claim. However, conditions were set by both the Philippines and the descendants of the defunct Sulu sultanate. Manila wanted a UN-approved plebiscite of Sabah residents endorsing the creation of Malaysia, and the Sulu partisans wanted the continuation of the RM5,000 annual cession payment (later increased to RM5,300) from Malaysia.
Malaysia met both conditions. However, after the February 2013 attacks on Sabah by armed militants from Sulu which violated their part of the agreement, Malaysia discontinued the payments. Philippine partisans have also described the annual cession payments as “rent” to support their claim of ownership.
The persistent claims to Sabah, whether from Manila, Sulu or both, are disreputable and without foundation. They are a continuing irritant to the Philippines’ ties with Malaysia and risk a rupture in otherwise healthy relations. They cannot continue to be a weighty albatross because no sovereign nation can accept such blatant and baseless claims on its territory. As with his immediate predecessor Benigno (“Noynoy”) Aquino, President Rodrigo Duterte had said he would study the Philippine claim before proceeding with it. That has been some years now and he, like Aquino before him, has decided not to pursue it.

The Sultanate of Sulu entered into an agreement with a commercial entity, British North Borneo Company, to “lease” (“pajakkan”) Sabah. Therefore, the State of Malaysia did not inherit it from the Brits since the transaction was commercial in nature and the Sultanate of Sulu did not negotiate with the British Crown in the first place. Clearly, this is not a sovereignty issue, it is clear from the Tribunal’s ruling.
So you did not 'inherit' the house but you are sitting in it. What does that mean? Free loading? Malaysia has to pay one way or another, or she has to cede the land back to Sulu. Basically lose Sabah altogether.
The new tenants must pay because you extract oil to finance your sovereign wealth. The activities are commercial in nature, this is why the calculations includes all commercial activities and income of Sabah. Malaysia kept on paying until 2013 and sent apology letter for the succeeding non payments of rent. It is not rocket science. You pay the rent then it is not yours. Even the UN long time ago, does not solidify of your inclusion of SABAH.
If your logic is right that the Malaysian Government did not accept the idea that they inherited the lease agreement, then in the eyes of the Tribunal Court is that Sabah should have been returned to the rightful owner. The fact that Malaysia pays the rent, year after year until it defaulted thus accumulating arrears in rentals, would mean that it is a mere tenant, as the payment of rent is proof enough that it is not the owner of the said territory and naturally admits of its inferior position being a mere lessee-obligor who binds himself to pay rent to the lessor-obligee who is entitled to it. A tenant must comply with the agreement, express or implied, and pay the right amount or else it will be a ground for annulment of the contract, collection of rent and its arrears, damages, interest, or worse... eviction!

This issue started when the west interfered the east. Sabah originally belongs to the Sultanate of Sulu which is now part of the Philippines. Based on documents and history, Sabah was a gift of Sultanate of Brunei to Sultanate of Sulu as a token of gratitude when the former seek help to the latter. Malaysia is yet to be a country by then. Malaysia is not the owner of Sabah, as 'evidenced' in their rent which they halted back in 2013. The real owner is not the one who rented but the landlord. Even if Sabahans don't want to be part of the Philippines, the ruling has to be followed.

The sultanate of sulu did not give up the rights to the british. In fact, the british were paying rent approximately 3,000 mexican pesos at that time. Which also means that sulu maintained their rights and never gave it up

Philippines claims Sabah on the basis that Sabah was said to be once under Sulu Sultanate. Descendants of former Sultan of Sulu claim that Sabah belonged to Sulu Sultanate because Sabah was given by Brunei the original owner to Sulu as a gift. But Brunei refuted this claim and denied ever having given Sabah to Sulu. There was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans.
In fact on 29 December 1877, the Sultan of Brunei ceded the whole of Sabah to BNBC/British and concurrently appointed Baron Von Overback, the co-owner of BNBC as Maharajah of Sabah and Rajah of Sandakan and Gaya. This cession agreement was documented.
When BNBC went to Sabah to begin their business, Sulu claimed that Sabah belonged to Sulu. BNBC agreed to enter a "pajak" agreement with Sulu after they were advised by their fellow businessmen in Hong Kong who advised that Sulu would attack them if they didn't have a deal with Sulu. This "pajak'' agreement was signed on 22 January 1878. BNBC understood that this "pajak" was a "cession", so did early generation of Sulu Sultan accepted it as "cession". Only later generation of descendants of former Sultan of Sulu claimed that the "pajak" agreement was meant to be "rent" or "lease''. Still there was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans. The two above events led to an overlapping issue on Sabah.
What ever it was, the above agreement and overlapping issue were superceded by later event. On 22 July 1878, the then Sultan of Sulu had relinquished all his possession and sovereignty of Sulu and it's territories including Sabah to Spain. The Sultanate of Sulu only remained as hereditary cultural and traditional entity without any sovereign territory.
In 1885, to resolve overlapping issue on Sabah and other issues involving other islands, Britain, Spain and Germany arrived to an agreement known as Madrid Protocol in which Spain surrendered Sabah to Britain. As new owner of Sabah Britain had full control and sovereignty over Sabah and they could do what ever they wanted. Sulu could not claim anything because they had already relinquished the sovereignty of Sabah to Spain and Spain surrendered Sabah to Britain.
What ever happened to Sabah after that was under British jurisdiction. Even though British had full control and sovereignty of Sabah, they still honoured the annual "cession money" payment stipulated in the "pajak'' agreement as consolation for the Sulu Sultan. So did Malaysia when formed in 1963, still honoured the annual "cession money" payment as consolation for the Sulu Sultan. The term "cession money" was used because to use the term "consolation" was felt to be too degrading. Thus the term "cession money" was continually used as used before by the British.
On 31 August 1963 Britain gave independence to Sabah and before that on 22 July 1963 Sarawak was given independence. The people of Sabah and Sarawak had exercised self determination to form Malaysia together with Malaya and Singapore. The sovereignty of Sabah and Sarawak as component states of Malaysia is intact and recognized internationally and recognized by the UN. This was confirmed and clearly stated in the United Nations Malaysia Mission Report "Final Conclusion of the Secretary-General", 14 September 1963. The last sentence of the report says:
"I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia".

Something doesn't make sense, if these so called secret agreements that you so confidently believe is true then why does the Malaysian Govt keep dodging the matter to discuss this in a diplomatic way? The Philippines have initiated a diplomatic way to take this matter in international court, on June 18, 1964 President Macapagal wrote to your then Prime Minister Tunku Abdul Rahman to discuss the matter in International Court. All above mentioned points happened before 1964. The malaysian govt could use these agreements to strengthen their claims. But they didn't do so.

the son of the late Sultan Kiram is the legitimate heir but the opposition branded him as a pretender and the opposition refuse to pay for the land that they rented from the sultanate of sulu. The opposition illegally claimed the land and stopped paying rent to the heirs of the sultan of sulu in 2013.
The arbitration award by Paris Court (lower court)ruling had since been annulled by Paris Court of Appeal.
Latest as in June 2023:
1. June 6th - Paris Court of Appeal had set aside and annulled the previous Paris Court (lower court) ruling awarding the heirs of the defunct Sulu Sultanate.
2. June 27th - Dutch Court of Appeal had dismissed a bid by eight descendants of former Sultan of Sulu to enforce the arbitration award by Paris Court (lower court) ruling and dismissed an attempt to seize Malaysian assets following the Paris Court of Appeal decision.
3. Paris Court of Appeal also imposed on Sulu €100,000.00 (Euro currency) to be paid to Malaysia as legal cost.
4. Mean while in Luxembourg, a second attempt to seize Malaysian Petronas assets had been filed in Luxembourg Court due for hearing in September 2023 after the first attempt was dismissed. This will likely be dismissed too following the Paris Court of Appeal decision.

The british “ rented” Sabah. After they left Malaysia paid the rent for a few years then stopped paying rent. What Malaysia has forgotten was there was a signed lease/contract. The sultanate of sulu initially just asked Malaysia to pay the rent. Get your facts right. Research and get a copy of the signed lease. This has been going on for years!

The Sultan of Sulu did not have the authority to cede or lease any part of Sabah to begin with! If anyone had authority to do that, it was Brunei and indeed Brunei signed an agreement with the British North Borneo company to cede that disputed portion of Sabah plus additional areas before the agreement with Sultan of sulu was signed. Why did they signed something with the Sultan of sulu? Because they said Sultan was a pest and he was going to cause trouble. Remember he and his subjects were notorious pirates! They needed to pacify him. He never had a right to that part of Borneo. Please people, learn the history. Stop watering down the information. Brunei promised to give that piece of land to Sulu if Sulu helped Brunei Sultan in a family dispute, but Sulu didn’t turn up, so the land was not given. Anyway, in those days, there were no administration in the modern sense of the word. What the Brunei Sultan promised was for Sulu to collect taxes and basically ruled as a warlord but because they didn’t turn up, the promise was null and void. When Sulu was incorporated into Philippines, they never included Sabah because Sulu KNEW THEY DIDN’T OWN SABAH! You can twist and turn history as much as you like and still the conclusion is that Sabah belongs to Sabahans and since Sabahans went with Malaysia, Sabah belongs with Malaysia!

Before commenting, know the history. In 1660 to 1673, A civil war broke out in Brunei between Sultans Abdul Hakkul Mubin and Muhyiddin. Muhyiddin was concerned that the civil war was dragging on too long and asked the help of the sultan of Sulu to send forces. Sabah was given to the Sulu Sultanate by Brunei as a reward for helping Sultan Muhyiddin's forces. Sultan of Brunei handover Sabah to Sultan of Sulu as a reward for helping Brunei to settle that civil war.
Is there any conclusive evidence that Brunei awarded Sabah to Sulu? Not just history saying, of course.

Correction. The Sultanate of Sulu never gave up Sabah to British North Borneo Company. They merely leased it to this company. They should not have passed it to Malaysia as it was never theirs nor Malaysia's to begin with. They engaged the Sultanate of Sulu in a contract behind which is bad faith.
It is clearly a proof that SULTANATE OF SULU is the LEGITIMATE OWNER OF SABAH and not Malaysia.

Im seeing from both perspective here. If the verdict pass to say that Sabah should be 'returned' to Sultanate of Sulu:
For Malaysia - The long years of investing and developing Sabah will be given freely to them. In order to rip of the riches and benefits of Sabah, BILLIONS was invested due to challenging terrains, economic, transportation and channeling education across Sabah. Therefore, for Sultanate of Sulu to request to 'return' Sabah back to them will deem unfair for Malaysia who put the effort of developing Sabah.
For Sultanate of Sulu - It is their land of rights that was in generation given to another party without them being in control. Seeing their land devoloping and not being able to share the riches, it seems unfair.
However, in a fair, economical and financial pov - IF Sabah is to 'be given back' to Sultanate of Sulu, they need to understand that the people of Sabah was not under their jurisdiction for generations. Culturally and morally, there would be a huge social challenge for the Sultanate to govern through. Then there is the financial part where maintaining the development of Sabah. To rip the benefit and riches of Sabah will require a huge funding and investments. The Sultanate of Sulu will need to consider a huge amount of budgeting firstly on the economic side and secondly on the governing side ( i may have left other points but those two are the apparent ones i see) which WILL BE costly. So if Sabah is 'returned' PH governments will need a huge financial restructuring which I believe is a huge challenge to them since PH is also battling the current economic downturn and funding their current populace.
Would taking over Sabah be a good maneuver to add more into PH's plate?
