Sabah was a gift by the sultan of brunei to the sultan of sulu even before malaysia became a country. It was rented by the British oil company and then handed to malaysia to continue the rent. However, Malaysia stopped the rent in 2013.

In my view, if the Philippine government recognizes the Sulu government as a sovereign government, logically, the Sulu government has the right to claim and establish its own government in the south of the Philippines. Therefore, the philippines had to hand over their land in the south of the philippines to the sulu kingdom as a new country. From Malaysia's point of view, Malaysia does not recognize the Sulu kingdom and its heirs because in the original agreement the Sulu sultanate had surrendered all its sovereignty in Sabah to the British before the existence of Malaysia. In the agreement, sultan sulu will not claim and absolutely hand over power to Sabah with the promised compensation. Even the term 'lease' has been dropped and in total Sulu has no rights over Sabah. However, in 2013, Sulu heirs violated the agreement by claiming Sabah and started a military attack on Sabah. Therefore, the Malaysian government has the right to stop the payment because Sulu has violated the agreement. This military action has challenged the agreement and violated Malaysia's sovereign boundaries. Malaysia still adheres to ASEAN principles and can still be diplomatic. But when it comes to sovereignty, Malaysia will not compromise. Don't let Malaysia take the approach of treating the Philippines as 'persona non grata'

It was the British who manipulated ownership of North Borneo, utilizing these lands as their plantation. Another example of how power and greed when combined they turn the world upside down. Sad to say I don't think that piece of land will be returned to the rightful owner "Sultanate of Sulu" during my lifetime. Simple logic must be applied: if Malaysia still paying its rent up to now, does that mean he owns what he was renting? There are reports prior to the standoff, that the Malaysian ambassador to the Philippines went to see the Sultan and negotiate to extend the lease for another 100 years with 360,000 ringgit annually. Sabah was and is owned by the Sultanate of Sulu, and consequently by The Philippines. Malaysia must now accept the decision and start moving for its own good.
What is clear is that up until now Malaysia is paying rent to the Sultanate of Sulu amounting 5,000 ringgit a year, therefore Malaysia has no right to claimed ownership Sabah to International court since Malaysia is only a tenant.
It's not rent money, it cession money. Cession means "the formal giving up of rights, property, or territory by a state." You read that right, the Sulu sultanate gave up all claims to Sabah ages ago.

@@dannybarcenas9701I think you were confused and misunderstood. Madrid Court didn't rule in favour of Sulu, it ruled in favour of Malaysia and Sulu lost. Then Sulu and the gang including their Arbitrator Gonzalo Stampa ran to Paris and put up their case in Paris Court. If Sulu was sincere, they should pursue their case further in Madrid court of appeal. It was Paris Court that ruled in favour of Sulu and they won easily became Malaysia didn't participate in the proceeding. Why Malaysia didn't participate? Because Malaysia has already won in Madrid Court. Stampa's action of going to Paris and put up their case in Paris Court when Madrid Court had already gave its ruling was seen by Spanish Judicial Authority as "contempt of court" and "professional intrusiveness". Followin this Stampa's appointment as an Arbritrator was revoked or annulled by Spanish Judicial Authority and his arbitration was also annulled. Criminal proceeding was also taken against him. Malaysia applied for stays of enforcement and annulment of Paris Court ruling in Paris Court of Appeal and in various other Court of Appeal in Luxembourg and Netherlands for other related claims put up by Sulu. And finally Malaysia won and Sulu lost in various Courts of Appeal. Latest as in June 2023: 1. June 6th - Paris Court of Appeal had set aside and annulled the previous Paris Court ruling awarding the defunct Sulu Sultanate. 2. June 27th - Dutch Court of Appeal in The Hegue had dismissed a bid by eight heirs of former Sultan of Sulu to enforce Paris Court ruling, and dismissed an attempt to seize Malaysian assets following the Paris Court of Appeal decision. 3. Paris Court of Appeal also imposed on Sulu €100,000.00 to be paid to Malaysia as legal cost. 4. In Luxembourg, a second attempt to seize Malaysian Petronas assets had been filed in Luxembourg Court due for hearing in September 2023 after the first attempt was dismissed. This will likely be dismissed too following the Paris Court of Appeal decision. Now is already November 2023, no news about Sulu's claim proceeding in Luxembourg Court. It looked like they withdrew their case after they acknowledged the Paris Court of Appeal decision. Malaysia had spent upto RM32m (USD6. 6m) to deal with these Sulu's claim cases in various European courts in Madrid, Paris, Luxembourg and Netherlands. Apart from the €100,000.00 Sulu has to pay to Malaysia as legal cost, Malaysia is planning to sue Sulu for compensation for the loss of RM32m (USD6.6m) spent.
The fact that Malaysia recognized the agreement by paying lease to the Sultan of Sulu, it's enough proof that they still have the proprietary rights of the territory. If Malaysia is not willing to return the land to its rightful owner they should at least compensate the family of Sultan. Otherwise, you can call it land grabbing or occupation like what Israel did to the Palestinian land or the Chinese occupying Tibet.

Do not forget Sabahan voted to join Malaysia, what the people want is what matter the most, no Sabahan want to be ruled by a long gone kingdom. The Sultanate no longer exist and they themselves do not know who is the current Sultan of Sulu. None of them bother to protect Sabahan during Japanese invasion. None come even to visit after WWII. They are no photo or documents showing Sulu Sultanate ever govern Sabah. No representative of the Sultan ever appointed to Sabahan. No record of tax ever been paid to the Sultanate. During the reign of the Sultan and current modern time none of them able to take care the welfare of Sabahan, now their princess have ordinary job and go to work by public bus. Malaysia govern Sabah together with Sabahan for Sabahan since 1963 and bring prosperity and security.

Any Filipino and Sulu supporters would point to the 1878 agreement and claim that Sabah was lease to the British North Borneo Company (BNBC). But there are numerous evidence to point that Sulu did not previously own Sabah as the self-proclaimed Sulu heirs would suggest, the claim that the Sultanate of Brunei gifted North Borneo (Sabah) to the Sultanate of Sulu as a gift can be disputed and debunked by the following evidence: - 1877 Agreement Prior to the 1878 Agreement which was signed between the British North Borneo Company (BNBC) and the Sultanate of Sulu, there was an agreement that was signed in 1877 between the Sultanate of Brunei and the British North Borneo Company. Within this agreement, the word “grant” has been used numerous times. It’s also stated within the agreement that the entirety of North Borneo (Sabah) will be ceded to the British North Borneo Company (BNBC) for 15,000 Mexican gold coins . With these statements, it’s clear that the Sulu Sultanate did not own North Borneo (Sabah) and that the 1878 agreement is redundant. I would also like to point out that within the 1878 agreement, the word “pajak” was meant to be stated a “grant and cede”, and within the receipts of the so-called “rent payments” are listed as cession payment. Cession means to give something away. With that this proves that the 1878 Agreement wasn’t a lease agreement but rather a cession agreement. But let’s say for the sake of argument that the Sultanate of Brunei gifted North Borneo (Sabah) to the Sultanate of Sulu and that the Sultanate of Sulu did indeed own Sabah and that the 1878 agreement was a lease agreement. Yet the Sultanate of Sulu has signed many agreements which relinquishes their rights over Sabah. These are the following: - 1878 Bases of Peace and Capitulation Agreement This agreement highlights the Sultanate of Sulu’s surrender of sovereignty to Spain. This means that anything happens whether internal or external affairs is under Spanish jurisdiction. - Article III of the Madrid Protocol of 1885 The Madrid Protocol of 1885 was an agreement between the United Kingdom, Germany, and Spain to recognise Spain’s rule over the Sulu Archipelago. There is a particular statement within Article III which states that Spain will relinquish all of their claims on Borneo. This alongside with the 1878 Bases of Peace and Capitulation Agreement as stated previously shows that the Sultanate of Sulu now no longer have any jurisdiction over North Borneo (Sabah). This also means that North Borneo (Sabah) is now under complete British jurisdiction. - 1903 Confirmation of Cession This agreement was signed between the Sultanate of Sulu and the British North Borneo Company (BNBC) in which it states that the Sultanate of Sulu will grant and cede North Borneo (Sabah) as well as additional islands which is how the payment of 5,000 Mexican gold coins which at this point has switched entirely to the Malayan dollar increased to 5,300 Malayan dollars. - 1915 Carpenter Agreement This agreement was signed between the Sultanate of Sulu and the United States. Within this agreement it states that any power that the Sultan of Sulu has over his land has been given to the Philippines which is under American-rule. -1930 Anglo-US Border Convention This agreement was signed between the United States and the United Kingdom. This agrement also define the border of North Borneo (Sabah) and the Philippines with the agreement being that North Borneo (Sabah) will remain under British jurisdiction and the Philippines being under American jurisdiction. -1963 Malaysia Agreement Finally this agreement was signed between the United Kingdom, Malaya, Singapore, Sarawak, and North Borneo (Sabah) to form a new country now known as Malaysia. Now that North Borneo (Sabah) has gained it’s independence from the UK, they opted to join this agreement and with the previous agreements signed, it means that North Borneo (Sabah) now have self-determination. And with the UK approving this agreement under the Malaysia Act of 1963 which has been passed in the British Parliament. This agreement has also been recognised by the United Nations and agreed on by the UN General Assembly and the UN Secretary-General himself. This means that Sabah is now rightful Malaysian territory. With all of these facts in place, it’s clear that Sabah rightfully belongs to Malaysia and neither the Philippines nor Sulu have any legal claims over Sabah.

Therefore, the philippines had to hand over their land in the south of the philippines to the sulu kingdom as a new country. From Malaysia's point of view, Malaysia does not recognize the Sulu kingdom and its heirs because in the original agreement the Sulu sultanate had surrendered all its sovereignty in Sabah to the British before the existence of Malaysia. In the agreement, sultan sulu will not claim and absolutely hand over power to Sabah with the promised compensation. Even the term 'lease' has been dropped and in total Sulu has no rights over Sabah. In my view, if the Philippine government recognizes the Sulu government as a sovereign government, logically, the Sulu government has the right to claim and establish its own government in the south of the Philippines. Therefore, the philippines had to hand over their land in the south of the philippines to the sulu kingdom as a new country.
From Malaysia's point of view, Malaysia does not recognize the Sulu kingdom and its heirs because in the original agreement the Sulu sultanate had surrendered all its sovereignty in Sabah to the British before the existence of Malaysia. In the agreement, sultan sulu will not claim and absolutely hand over power to Sabah with the promised compensation. Even the term 'lease' has been dropped and in total Sulu has no rights over Sabah.
However, in 2013, Sulu heirs violated the agreement by claiming Sabah and started a military attack on Sabah. Therefore, the Malaysian government has the right to stop the payment because Sulu has violated the agreement. This military action has challenged the agreement and violated Malaysia's sovereign boundaries.
Malaysia still adheres to ASEAN principles and can still be diplomatic. But when it comes to sovereignty, Malaysia will not compromise. Don't let Malaysia take the approach of treating the Philippines as 'persona non grata'

It was the British who manipulated ownership of North Borneo, utilizing these lands as their plantation. Another example of how power and greed when combined they turn the world upside down. Sad to say I don't think that piece of land will be returned to the rightful owner "Sultanate of Sulu" during my lifetime. Simple logic must be applied: if Malaysia still paying its rent up to now, does that mean he owns what he was renting? There are reports prior to the standoff, that the Malaysian ambassador to the Philippines went to see the Sultan and negotiate to extend the lease for another 100 years with 360,000 ringgit annually. What is clear is that up until now Malaysia is paying rent to the Sultanate of Sulu amounting 5,000 ringgit a year, therefore Malaysia has no right to claimed ownership Sabah to International court since Malaysia is only a tenant.
It's not rent money, it cession money. Cession means "the formal giving up of rights, property, or territory by a state." You read that right, the Sulu sultanate gave up all claims to Sabah ages ago.

@@dannybarcenas9701I think you were confused and misunderstood. Madrid Court didn't rule in favour of Sulu, it ruled in favour of Malaysia and Sulu lost. Then Sulu and the gang including their Arbitrator Gonzalo Stampa ran to Paris and put up their case in Paris Court. If Sulu was sincere, they should pursue their case further in Madrid court of appeal. It was Paris Court that ruled in favour of Sulu and they won easily became Malaysia didn't participate in the proceeding. Why Malaysia didn't participate? Because Malaysia has already won in Madrid Court.
Stampa's action of going to Paris and put up their case in Paris Court when Madrid Court had already gave its ruling was seen by Spanish Judicial Authority as "contempt of court" and "professional intrusiveness". Followin this Stampa's appointment as an Arbritrator was revoked or annulled by Spanish Judicial Authority and his arbitration was also annulled. Criminal proceeding was also taken against him.
Malaysia applied for stays of enforcement and annulment of Paris Court ruling in Paris Court of Appeal and in various other Court of Appeal in Luxembourg and Netherlands for other related claims put up by Sulu. And finally Malaysia won and Sulu lost in various Courts of Appeal.
Latest as in June 2023:
1. June 6th - Paris Court of Appeal had set aside and annulled the previous Paris Court ruling awarding the defunct Sulu Sultanate.
2. June 27th - Dutch Court of Appeal in The Hegue had dismissed a bid by eight heirs of former Sultan of Sulu to enforce Paris Court ruling, and dismissed an attempt to seize Malaysian assets following the Paris Court of Appeal decision.
3. Paris Court of Appeal also imposed on Sulu €100,000.00 to be paid to Malaysia as legal cost.
4. In Luxembourg, a second attempt to seize Malaysian Petronas assets had been filed in Luxembourg Court due for hearing in September 2023 after the first attempt was dismissed. This will likely be dismissed too following the Paris Court of Appeal decision.
Now is already November 2023, no news about Sulu's claim proceeding in Luxembourg Court. It looked like they withdrew their case after they acknowledged the Paris Court of Appeal decision.
Malaysia had spent upto RM32m (USD6. 6m) to deal with these Sulu's claim cases in various European courts in Madrid, Paris, Luxembourg and Netherlands. Apart from the €100,000.00 Sulu has to pay to Malaysia as legal cost, Malaysia is planning to sue Sulu for compensation for the loss of RM32m (USD6.6m) spent.

The fact that Malaysia recognized the agreement by paying lease to the Sultan of Sulu, it's enough proof that they still have the proprietary rights of the territory. If Malaysia is not willing to return the land to its rightful owner they should at least compensate the family of Sultan. Otherwise, you can call it land grabbing or occupation like what Israel did to the Palestinian land or the Chinese occupying Tibet.

But there are numerous evidence to point that Sulu did not previously own Sabah as the self-proclaimed Sulu heirs would suggest, the claim that the Sultanate of Brunei gifted North Borneo (Sabah) to the Sultanate of Sulu as a gift can be disputed and debunked by the following evidence:
- 1877 Agreement
Prior to the 1878 Agreement which was signed between the British North Borneo Company (BNBC) and the Sultanate of Sulu, there was an agreement that was signed in 1877 between the Sultanate of Brunei and the British North Borneo Company. Within this agreement, the word “grant” has been used numerous times. It’s also stated within the agreement that the entirety of North Borneo (Sabah) will be ceded to the British North Borneo Company (BNBC) for 15,000 Mexican gold coins .
With these statements, it’s clear that the Sulu Sultanate did not own North Borneo (Sabah) and that the 1878 agreement is redundant.
I would also like to point out that within the 1878 agreement, the word “pajak” was meant to be stated a “grant and cede”, and within the receipts of the so-called “rent payments” are listed as cession payment. Cession means to give something away. With that this proves that the 1878 Agreement wasn’t a lease agreement but rather a cession agreement.
But let’s say for the sake of argument that the Sultanate of Brunei gifted North Borneo (Sabah) to the Sultanate of Sulu and that the Sultanate of Sulu did indeed own Sabah and that the 1878 agreement was a lease agreement. Yet the Sultanate of Sulu has signed many agreements which relinquishes their rights over Sabah. These are the following:
- 1878 Bases of Peace and Capitulation Agreement
This agreement highlights the Sultanate of Sulu’s surrender of sovereignty to Spain. This means that anything happens whether internal or external affairs is under Spanish jurisdiction.
- Article III of the Madrid Protocol of 1885
The Madrid Protocol of 1885 was an agreement between the United Kingdom, Germany, and Spain to recognise Spain’s rule over the Sulu Archipelago. There is a particular statement within Article III which states that Spain will relinquish all of their claims on Borneo. This alongside with the 1878 Bases of Peace and Capitulation Agreement as stated previously shows that the Sultanate of Sulu now no longer have any jurisdiction over North Borneo (Sabah). This also means that North Borneo (Sabah) is now under complete British jurisdiction.
- 1903 Confirmation of Cession
This agreement was signed between the Sultanate of Sulu and the British North Borneo Company (BNBC) in which it states that the Sultanate of Sulu will grant and cede North Borneo (Sabah) as well as additional islands which is how the payment of 5,000 Mexican gold coins which at this point has switched entirely to the Malayan dollar increased to 5,300 Malayan dollars.
- 1915 Carpenter Agreement
This agreement was signed between the Sultanate of Sulu and the United States. Within this agreement it states that any power that the Sultan of Sulu has over his land has been given to the Philippines which is under American-rule.
-1930 Anglo-US Border Convention
This agreement was signed between the United States and the United Kingdom. This agrement also define the border of North Borneo (Sabah) and the Philippines with the agreement being that North Borneo (Sabah) will remain under British jurisdiction and the Philippines being under American jurisdiction.
-1963 Malaysia Agreement
Finally this agreement was signed between the United Kingdom, Malaya, Singapore, Sarawak, and North Borneo (Sabah) to form a new country now known as Malaysia. Now that North Borneo (Sabah) has gained it’s independence from the UK, they opted to join this agreement and with the previous agreements signed, it means that North Borneo (Sabah) now have self-determination. And with the UK approving this agreement under the Malaysia Act of 1963 which has been passed in the British Parliament. This agreement has also been recognised by the United Nations and agreed on by the UN General Assembly and the UN Secretary-General himself. This means that Sabah is now rightful Malaysian territory.
With all of these facts in place, it’s clear that Sabah rightfully belongs to Malaysia and neither the Philippines nor Sulu have any legal claims over Sabah.

In my view, if the Philippine government recognizes the Sulu government as a sovereign government, logically, the Sulu government has the right to claim and establish its own government in the south of the Philippines. Therefore, the philippines had to hand over their land in the south of the philippines to the sulu kingdom as a new country.
From Malaysia's point of view, Malaysia does not recognize the Sulu kingdom and its heirs because in the original agreement the Sulu sultanate had surrendered all its sovereignty in Sabah to the British before the existence of Malaysia. So, what is given centuries ago cannot be taken back by the newly formed government of Malaysia especially if it was handed over to them by the North Borneo Oil Company, a private entity, who turned out as a tenant or a renter only of the Sultanate of Sulu. As a matter of fact, the lease contract was well documented.

I am a Filipino and this Sabah claim has been going on since the 60 ‘ s , my question is their any documents exist that it was truly indeed a gift from the Sultan of Brunei ( the Bolkiah Family) and also being a Spanish or Spains province for 300 years there should also be a documents or maps that it was part of the Philippines archipelago and why does Malaysia pays the sultanate of sulu family every year if they ( Malaysia ) does not recognized the lease which was actually instigated by the British , and also why is the Sultan of Brunei ( Bolkiah Family) stayed TIMID on this Issue at least they have records about the Padiak between the sultanate of Sulu and the Sultanate of Brunei. The British Should Be One to be Blamed for all of these Chaos, like what they did in the Middle East and Africa it’s all about Oil , gas and the natural resources in which the British Government is so Hungry to possess and control.
1) There is no proof to show that the Philippines have legal claims over Sabah as Sabah was handed to the BNBC by Brunei. Brunei also denied any claims that they have gave Sabah to Sulu as a gift.
2) The payment that is given to the self-proclaimed Sulu heirs annually by the Malaysian government is not rent money but cession money. There is no proof of a rent, neither the 1878 agreement nor the official receipts ever state of a rent.
Even though we are Catholics from Luzon, we support our Muslim brothers on getting back Northern Borneo as it rightfully belongs to the Sultanate of Sulu.

So going by historical facts, Sabah was part of Bruneian Sultanate heritage accorded by proxy to Suluan chieftain which instead sold of that concession to two British traders that represent British East Hindia Company.
When you own so called country did not even acknowledged the existence n legitimacy of Suluan chieftain n having to fight Moro Muslim resistances of Mindanao for years until 2018/19 peace treaty was signed.
Until the issue of Sabah which was legitimately acknowledged n authenticated legally by UN in September 16,1963, only then it was fraudulently claimed without merit with dubious n falsified chieftain of previously unacknowledged territory.
Truly a naive jester story to amused a Sultan's courtiers...

This is the reason why so many rebels in southern Mindanao so exist, the 13B Dollars should be paid to the heirs of Sultanate of Sulu instead of giving to the rebels.
Malaysia should put a stop to the sulu claims. If not, the non existing sulu sultanete will keep on bringing this matter like its some kind of hobby
