That last dialogue occurs when you raise their disposition to..I think 100 or above (usually with a charm spell). But only if you have a bounty that's less than a certain limit (it was either 500 or 1000).

Normal paralyze spell. The guards say that first line if you've murdered someone in the game. My disposition with this guard is over 90, so that's why he pays that fine for me. The items I've stolen from his inventory didn't count as a crime it seems, otherwise my bounty would've been much higher (the guards only pay your fines to a max. of 50 gold if I'm correct).
