Janet is bragging online that the case is going GREAT for her and that they are going to move into discovery soon, and that her bar decided that she was indeed ethical and perfect... I'm pretty sure that these statements won't age well

runkle! some context on the "perjury" thing. it's not bunnie xo. when janet originally had the DWKT podcast videos pulled down, she submitted copyright claims on behalf of that "demps" character, despite the fact that when the video in question was filmed, jessi and lily didn't even know who demps was, did not discuss demps, and therefore none of the content in the video could have possibly belonged to demps. the perjury part is that janet submitted those copyright claims to youtube. the copyright claim form requires you to check a box that says: "The information in this notification is accurate, and under penalty of perjury, I am the owner, or an agent authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed." - ie, she submitted the claim on behalf of someone who was not mentioned in the video and checked the box asserting ownership or authorization, which is why lily called it perjury.

It’s my understanding that the entire upper peninsula of Michigan regularly calls us denizens of the lower peninsula Trolls on the grounds that we literally do live below the bridge.
I know that Lily's tweet about perjury was talking about the attestation box you have to click when filing a strike on UA-cam, but in my non-lawyer opinion, a layperson using the word "perjury" doesn't mean much. When a non-professional uses a word, I don't put a lot of stock in it, since we don't tend to be educated in every facet of the word or phrase's meaning or impact.

I’m still convinced she’s just a bully that goes after those she thinks she can intimidate. Ian is a practicing lawyer and not afraid of her in the slightest, so she won’t go near him.
FYI, if its a parody and the person is a public person you dont need someones permission to make a movie about them. So a Vampire parody about TS should be fine. People do stuff like that all the time. She could sue but she would almost certainly lose especially because nobody thinks she is actually a vampire.
The question though is weathering such a lawsuit worth it to the filmmaker? Some students doing a project that happens to take off at an indie festival might not be able to fight it. A big studio that has their own lawyers can probably just offer Taylor the lead role. Only a few people in between would have the resources to fight a lawsuit but not just call T Swift up and ask her what her fee is.
I mean, if Janet did state that they were in fact Unethical and Rogue… no, no it would still be frivolous.

You can't convince me they didn't create the acronym first then came up with the wording to fit the acronym. The gov't does this ALL the time. And while I believe it was meant to refer to slapping someone (with a lawsuit), in colloquial pop culture reference, it also fits. Double entendre (without the sexual context in this situation, of course).
@@michellerhodes5477 Lawmakers of all levels have lots of low-level, unpaid or low-paid staff, who would much rather come up with a catchy abbreviation than make yet another pot of coffee or run yet another memo across the building. Source: I was one of those low-paid (at least I was paid! The unpaid interns for more senior state reps definitely thought they were better than me!) staffers for a summer! I did not come up with any catchy abbreviations, but I did do some real work (along with making coffee and running documents around the complex), at least!

Still not done, but chiming in again because: someone DID attempt to sue Taylor Swift over the title of her album "Evermore." It was Evermore Park, who claimed Taylor naming her album "Evermore" was a form of copyright infringement and consumers would potentially be confused over what they were buying (Both Evermore the album and Evermore the park had use of trees in their branding). Not quite a DMCA take down, but kind of along those lines.
The hilarious part was that Evermore park was using Taylor Swift songs in the repertoire of their Dwarf Cover band without any permission from her or her label. Guess how that went for them when they tried to sue her over an album cover that could be somehow mixed up with an amusement park. 🙄
@@Seldarius How could I forget! There's so many layers to Evermore's downfall and the lawsuit with Taylor was a symptom of much bigger issues with management...
@@Seldarius they had an Evermore album of their instrumental medieval/fantasy music. That’s why they were claiming things could be confused since searching for the Evermore album meant people would now find Taylor Swift instead, which sucks for them. Still not a legal issue for Taylor since they don’t own the word “Evermore” and their poor marketing isn’t her problem. Her legal team found the clips online of the dwarves playing her songs in addition to the other random pop music they covered, something that typically would likely be a non-issue and a musician could just file a cease and desist if they for whatever reasons had an issue, but she sued them purely to push them to drop their nonsense case. They dropped their lawsuit, and so she dropped her lawsuit in response.
Such a silly situation.
@@DarksideBallerina Unfortunately, yes. It’s such a lovely idea, I think Evermore could’ve been a great success if they played their cards right - which they just never did. One of the most famous singers on the planet accidentally sharing an album name with their park could’ve ended up with some great publicity for them. Instead their most famous accomplishment is to try and sue Taylor Swift and miserably failing. 🤦♀️

Of course, if you stretch really hard you could maybe say that a couple people might’ve given up on finding the “Soundtrack of Magical Lore” in the jungle of TS fans discussing the new album, but it smelled mostly of “we’ve run out of money and maybe we can squeeze Swift for a couple million. She won’t mind”. Turns out, she did mind. And if you decide on a borderline frivolous lawsuit you should at least make sure your hands are clean. Infringing on her copyright, even in a pretty harmless way, was incredibly dumb while trying to sue her over copyright of a pretty common word they don’t own.

Provable doesn't mean proven, and until it is ... as long as there's no point, the defense will not offer any confirmation or disproof of anything, under the theory that you never know what might come in handy in the future, and also that it sounds funnier. In my not-a-lawyer's opinion.
It is a very interesting statement from someone who has address issues herself, however. She seems to live in multiple places. And Morty also has an address issue.
I'm pleased that the responses to this lawsuit are based on reasoning that what was said was opinion and is not actionable, rather than the tactic that seems to be popular lately of "Your Honor, this is an entertainment show and therefore no reasonable person takes it seriously."

As much as I enjoy ragging on Janet and this case I’m really starting to feel so bad for the girlies. It may be normal but this feels like it’s already dragging out unnecessarily. I hope they get their slap suits because if not, even if they get it all dismissed, it will feel like a loss IMO. Janet is probably getting free or greatly reduced representation while the girlies are dropping big bucks on it and they deserve to get every penny paid back by Janet and that other lady.

Semi-ish related question; if one of the parties involved in litigation has a history of defamation against others, is that allowed as character evidence in civil cases? I believe it's not allowed in criminal cases (in the US at least), but I'm just beginning my education.
