@lovejumanji5 how was it meh? I think it was super interesting and it's also important to show the jurors are normal people, not Depp stans. A lot of them wanted to get out of it and I don't blame them. I'd hate to be on a high profile case jury. The jury has been accused of being biased and loving Johnny and Runkle showed that's not true.

I can't be the only person that wishes they could see the "letters" resolving jury duty pay.
Well when they tried to force me they only offered to pay 40 or 50$ a day can't remember it was around 3 years ago when I told them to go fuck them self never heard anything since
The judge was wrong on the law, the employers do not have to pay for jury duty in Virginia. Once she looked it up and realized it, would be interesting to see what the letters look like. Something like "patriotic/civil duty to support the courts and pay for jury duty", or "nice business you got there, would be a shame if something happened to it", or a mix of both? But she would have no authority to order them to pay. And if they say no, she'll do what then? Meanwhile someone is sitting on the jury unpaid and wondering how they will buy food and pay the rent/mortgage.
@@rhymeswithorange6092 You seem to be correct. I even tried to see if there was a local(Fairfax) law. I couldn't find anything. The money they do get paid by the court is practically nothing. I don't expect a judge to know every law but all judge's should know that one.

A small business with one employee not only has to cover the missing employee, but also has to pay them to be absent.

@@rhymeswithorange6092 Jury duty is one of the very few things we are required to do as part of our citizenship in this country that everyone purports to love so much until it is time to prove that love by doing the bare minimum. Drives me nuts the lame excuses people come up with to get out of it (valid reasons are valid, obviously). What you bring up is where the system breaks down. I was fortunate enough to be able to sit on a jury but only because my wife had a very good job so I wasn't missing on rent/feed/etc. Many friends work retail or service jobs and 6 weeks without pay would leave many of them homeless.
I feel like juries should be paid by the state as they could be classified as government employees.
When I was on jury duty, the court clerk called my employer about paying me. My employer wasn’t happy, the court clerk was pissed! I got paid.🤣🤣
It all depends on the jurisdiction. Apparently in Virginia they are required to give pay. Where I am, they cannot fire you but whether or not you get paid depends on your employer and their benefits. At my place of employment we have to use our vacation/sick hours. Once they run out, they don’t pay anymore.

@@therealtimc08 In Virginia companies are not required to pay. They are required to give you unpaid leave. Judge and lawyer were wrong on the law.
It is simply absurd that a case like this can proceed without paying the jury their standard rate, or something close to it. This is not a criminal trial, and both sides spent $1m+ on legal fees. The trial went on for longer than most pay periods (up to 3 pay periods), which is an absurd time to be without pay. I'm not sure where the cutoff should be, but in this sort of case, I think both sides should put up substantial money to compensate the jury for wasting their time.

I can't believe this judge doesn't know that employers only have to provide UNPAID time off for jury duty in virgina. There's a reason they say "I think". They can send a letter and hope the employers don't know the law but that's it.

Yeah my state doesn't require that employers pay during Jury duty either. Only requirement is that the employee can't be let go or demoted for missing work due to jury duty. I don't know what this judge thought her letters were going to do, but they wouldn't be legally binding.

If that's the case, that's pretty effed up! How can the jury duty itself be compulsory but the compensation for it wouldn't be? Or the government wouldn't pay for loss of income?! US is wild!

How any court can expect anyone to live off jury duty pay is beyond me. Here in MI employers do not have to pay you. And 6 weeks? No way shoupd that be allowed and folks shouod have tp be paid somehow. For many, 2 days without regular pay could make them homeless.

Agreed. Don't think Wisconsin requires employers to pay either, and pay where I'm at is $32/day jury duty. That is one of the very few areas I would support increased government spending on. It's beyond insulting to enslave citizens into jury duty, put the lives of the accused in their hands, but at the risk of bankrupting the jurors.

I've had several employers who would pay no jury time, including one that effectively told me I'd better get out of serving, or I'd be fired. I had all but a total nervous breakdown in the courtroom, where I had to stand in front of a huge, packed room, and immediately burst into tears. It was beyond humiliating.

Public attorneys don't make that much. And they do also have to pay off all that college and law school debt. Expert witnesses cost what they cost. And that cost is usually paid by the party who hired them, which is not usually the state.
Expert witnesses are not paid by anyone who has any business paying a jury. Same goes for all attorneys except prosecutors and public defenders.
The court cant alecate the defendents money to the jury how dumb are u public defence laywers dont get laid as much as private and private money is not goverments to relocate for their jury

Jury duty is such a dumb concept. At least pay them properly it's hard work being a juror and then there's the whole possibility if danger if ur deciding on the fate of someone with a lot of power.
The reimbursement question is completly bonkers to me. Why not have the reimburesement of the jurours paid from taxes, and therefore fairly distributed to everyone, rather than randomly screwing over businesses? Outside of historical reasons.

@@Matt-xc6sp a false equivalency. For most government programs meant to make lives better, it's something that could be handled just as well, if not better in the private marketplace. And that's assuming it actually does make an improvement. They like to act like that know better than us what is best for us, which often isn't the case.
There really isn't a private sector equivalence to jury duty, yet it is something government is happy to throw you into hardship over, violating their own minimum wage laws.

Educational yes. I am self employed and didn’t realize it was a reason I could get out of a lengthy jury duty. I don’t mind serving a day or two, but it’s on my dime. $10/day just doesn’t pay my bills.
Having done IVF, the meds are no joke plus you have set daily tests during the cycle so I feel for juror 24. With NoVA traffic getting from the clinic to the court house in a timely manor would be almost impossible.

In Texas employers do NOT have to pay employees for time lost to Jury duty. Texans only get $6.00 per day from the court. Less than an hour wages at minimum wage. Furthermore employers are also allowed to deduct the jury duty days from an employees allowed alotment of time off.

Honestly a lot of people hate this trial. But i loved it, it got me into lawtube, but in general it was fun to watch Heard's side embarrass themseleves.

Interesting about juror 10 reasoning; I had been called to jury duty, when selected, I advised my employer that the trial was expected to be about two weeks n duration and was advised that my employer would Only pay for three days. As a single parent I was fearful of not having income. Thankfully everything was resolved in just under a week
That is so not fair. You should have told the judge. How would you like it if you were the one on trial and jury members felt pressured to agree unanimously because if they didn't they couldn't feed their family? It's not your fault it's your employers fault and that person on trial deserves your undivided attention and honest examination of the facts of the case. I guarantee even if you didn't do this that others do give in to other jury members even when they disagree because they are stressed out at not being paid or being fired at their job--hence the law employers must pay jurors for duration of trial. If your kids were under a certain age you could have gotten out of jury duty based on being sole caregiver. I think that applies still in most states but I'm not positive. It did in the 90's.

I can assure you the trial had my full attention at the time. On the advise of an attorney acquaintance/friend (who said they would have no qualms about taking my employer to court if there were any issues) I completed my service with my head held high and a clear mind

I thought I made that clear that I wasn't saying you felt rushed or stressed and in so maybe allowed your opinion to be swayed but that others absolutely would and probably by a huge number too because they are sitting there thinking "Please let this be over so I don't lose my job and get evicted." It's a real problem, employers being dicks and not wanting to pay for duration of jury duty. My point wasn't really about you but about your circumstance, which I hope you agree is totally unfair to the person on trial. I guarantee it happens every single day too in courthouses across the country and because of these cheapskate employers the justice system isn't being served properly. I think Judges should have to send mandatory letters to employers of all jury members so they know what their civic duty is when they have an employee who is serving their civic duty on a jury.
I was on a two week trial when working for a job that didn't pay while on jury duty. I didn't speak up as a hardship because I wanted the experience of being on a jury. It SHOULD be law work has to pay you during your civic duty but it isn't (or wasn't when i did it). For my jury, we got lots of snacks left in the jury room. We all took loads of snacks as our payment. 😂
It really depends on the employer. Some businesses cannot afford to compensate jurors and hire someone to do their job. Perhaps the state should provide an equivalent tax break to jurors or their employers.

I just looked it up. Judge A was wrong about Virginia requiring jury compensation. Most US states do not require any compensation at all, nor does federal law. Longer jury trials can make jurors homeless. Is it any wonder why most people do everything they can to get out of jury duty?
I’m curious about the juror who AH’s team said exchanged the son and father.. I’m venturing to think it was more of their regular bs… also in California employers don’t have to pay for any of their employees time away for jury duty and from my experience they paid $13 a day and the cost of parking was $30 a day… makes you wonder how the jurors on the OJ case were able to survive 11 months sequestered and possibly not paid more than the pathetic jury wages.
Yeah they MORE than verify who you are. And if they did it intentionally he’d have to really be able to pass as his father? I mean i guess anything is possible but it wouldn’t be worth the trouble for most people. @@katanyajason3316If they were sequestered they probably parked at the hotel and shuttled together, thus eliminating parking for the time if sequestration. Doesn’t make that money cover rent and utilities of course..
parking tends to get validated if you serve on jury duty and have to drive in. Which means as long as you park in the lots that they validate for then it's free.
Given some of the other dirty tricks people have been discovering in the transcripts Elaine used, I wouldn't doubt it if she realized the mistake, but chose to ignore it as an insurance for when they lost to use in appeals.
Here in Kentucky employers aren’t required to compensate for jury duty. It sucks.
Same in Virginia but hopefully the judges in Kentucky don't lie to you so you don't check the law until after it's too late.

No employer should. The court should be required to pay the median income for the district.

I owned a small business for 32 years in NY State. I would allow employees to use PTO if they ended up on a jury, but I wasn't obligated to pay them for jury duty. In one case I did pay when an employee got selected for a very complicated case. Also, as a small business owner that needed every single employee in order to make payroll for the entire team, I have a very hard time believing that the Court would expect any small business owner (10 employees) to lose money for 6 weeks.

My understanding of what Runkle was saying was that if they were running their own business that probably *would* have been enough to get them out of Jury duty. Being an Employee of someone else's business? not so much.

I couldn't even get excused for being out of the country studying for the forseeable future, and was when I received the summons. Tried to tell me "Well, we can put it off until 2 months from now." Like, unless you're gonna compensate my $1,500 roundtrip plane ticket and a hotel stay, I'm not gonna show up. I was denied twice before I finally got excused, so I can totally see that happening.
I had also heard the rumor that people wanted to be on the Depp vs. Heard jury. I dismissed it as no matter the state of your fandom, being on a jury for 6 weeks is not a trade off (at least for me) for a chance to see movie stars close up. I once got in the pool (about 100 of us) for a jury on SA. I was currently recovering from issues related to that subject. However "my" judge was not amusing and made me go into detail with the attorneys from the defense, prosecution and even the accused present in a relatively small room. Not an experience that has been easy for me to forget even decades later. So this transcript on judicial interaction with potential jurors was both healing and funny. Please, time permitting, do it for other trials!
I'm kind of expecting these transcripts to get difficult because of the spousal abuse issues in the case. I expect the court and the lawyers to interrogate people about being victims of abuse or accused of being abusers, and potentially for the courtroom to be cleared for some jurors to talk about such things.

@@yogijaya2897 Good luck. In regards to SA issues in case that is worrying you. Don't worry about it until you get to court. It could just as easily be a theft or a DUI or vandalism or anything else. Wait to hear about what the case is about. There are way more cases of DUI or other traffic issues plus tons of just random weird disputes that have nothing to do with anything like that before you get to worrying about SA.
If they do get into SA issues, then you can ask for privacy, and the courtroom will be cleared so that you only have to tell the judge, attorneys, accused, and the court staff (clerk and bailiff usually) your story. Your name will be redacted from any records as is everyone's name.
It is also perfectly reasonable to tell them all that you don't think you can be fair in a case because of your past trauma (a lot of courts will ask if you can be fair). Not everyone has the stomach for it.
They're just going to need to hear your story because they're the ones who have to decide if they think your experience would actually make you a better juror rather than a poor pick for the jury.
Ive been watching trials since OJ. I would love to be on a jury but the one time I got closest, I knew one of the witnesses. Dismissed.
Interesting … in Wisconsin financial hardship isn’t an option at all yet the State does not require jurors be paid by employers AND the state only pays 40$/day. I was summoned for a 4 week murder trial and was not eligible to be released for the fact that I would end up unable to pay rent or bills because I would have been missing 3/4 my income.

I think the pay is based on the county. I'm in Brown County, and jury pay is $32/day plus mileage reimbursement. Otherwise you are spot on, yet they act surprised no one wants to serve.

The lawyer and judge were wrong on the law. I checked, and there is NO requirement in Virginia that an employer pay for jury duty. The judge could write all the letters she wants, but she has no legal grounds to MAKE them pay. They are not parties, I don't believe she would have the authority to just order them to pay. I feel sorry for any juror who's employer's company lawyer looked at the letter and laughed, then ended up loosing multiple weeks of pay.

I have only been summoned for Jury duty once. I was 18, in high school, and preparing for finals. The case was capital murder. I asked (along with three other high school students) to be excused so that I could study and pass my finals. The judge basically said Get out of here.
Some of these very much have the vibe of “um, i’ve been turned into a cow - can i go home?””You’re excused.” 😂

Truly I think the self employed guy with a new baby on the way whose business couldnt survive a 6-7 week trial should have been given more consideration.
If you're in that situation you need to bring EVIDENCE of your situation. Judges and lawyers deal in evidence.

I served in a court-martial trial during Vietnam, I was the only female and I was only 18. It was an awful experience I was terrified but I felt the young man should get leniency he turned himself in. The first vote was 11-1. Then all the old men with gold up their sleeves just gave me such a look! I didn't even say anything but I knew, so next vote was 12-0. Young man was Dishonorably Discharged and given hard labor, etc I never wanted to be on another jury. Ever. That was 55 years ago. Being on a jury can really affect you. Especially if you think the decision was wrong. Hard labor?
Where’s the idea that “they have to pay you for jury duty” coming from…? That’s not a thing. You don’t have to be paid for jury duty. According to The Fair Labor Standards Act, you do NOT have to be paid for any time off INCLUDING jury duty. And vin Virginia specifically, they are also not required to pay you while you serve. They do not “have to reimburse you for the full time you’re on jury duty.” I hope anyone who was asking to be out for financial hardship was okay. I’m confused as to how having a vacation/trip planned was considered a “hardship” and was getting people out of jury duty, but being out of work and not being legally required to be paid during that time off isn’t considered hardship.

I can't believe the attorneys & judge believed that all employers pay for jury duty...only jobs I know that pay for more than two weeks is working for the government. Letter's from the court mean nothing. With a 6 week trial coming up this judge just looks like an asshole to everyone that would have major financial hardships by sitting in court for 8 hours a day for all but 1 day a week.
I was recently a juror on a 3 week trial, I work for myself so no time paid. I had to work long hours in the morning before court, after court, and the weekend to keep up with my clients. I was exhausted. Not the kind of person you want sitting on your jury.

I was told that if you own a house, you will get called for jury duty. I’ve been a home owner, property tax payer for about 35 years and have never been called. But I know someone who was called for jury duty 3 times in two years and had to serve. And he was a commission salesman.
So what do you think? They want to make it difficult financially? Or certain people are on a database?
It depends on the jurisdiction, but usually they go by drivers license and voter registration. When you do either one of those you go in the database.

I remember getting jury duty and told my boss, my boss said, "Eff that, let me see that paper." he walked to his office and came out 5 minutes later and said, "You ain't doing jury duty anymore, I took care of it." Unlike Virginia, in Maryland, they do not have to pay you for jury duty. Court pays you 30 to 40 a day plus mileage. that is all that is required in Maryland.

I ran my own business for 30 years & got called 5? times, didn't have to serve. Got called with no business & told the court that I can't serve for religious reasons. The gal on the phone said that I would have to come to court & explain that to a Judge. I was taking care of my mentally sick wife 24/7 at the time. Called back & got another woman who I convinced that I will not judge another person due to my religious beliefs & will never serve on a jury. She evidently took me out of the system, haven't gotten called in 10 years.
I feel sorry for anyone who tries to go against Judge A 😂
My friend lost her job after jury duty because they really needed to replace her while she was on jury duty. I'm in New Zealand. It took me three doctor's letters to get off jury duty. It is very strict and quite intrusive into one's life. If you can't make jury duty for any reason they will ask for a date within the year and will not defer you again. You need to either only defer once or permanently, no other options.
Most people don’t want to be on jury’s for any reason. Low pay, sometimes away from families, meanwhile worried about work piling up.
Making a smaller employer pay for 6 full weeks on jury leave is INSANE.
Wrap your head around 12 month deployments for army reservists, then a further 6 months of federal protection from being fired when they first return from deployment for a total of up to 18 months of required pay to an employee that isn't going to be there for most of that. Granted this is all under the basis that your employer knowingly hired you with knowledge of this possibility in the first place(which is a legal requirement when applying while in the reserves), but it can get pretty hectic for small business owners or in the cases I saw first hand, small schools like the one I grew up going to where 3 teachers, 2 in pretty key roles, were pulled at once and rather suddenly.
So…. She allowed people to be excused to go on vacations and not lose money on tickets, but some of the people who would lose income and get fired for the jury duty, not excused?
For a Civil case, why should employers be on the hook? Court TV should pay.
I've gotten three Jury summons. The most recent one would have been the first trial in the county in about 2 years (COVID) but got postponed. Another one I wasn't needed for (called in every day, never actually had to show up). But the other one, I actually got in the jury box only to be dismissed a while later. (I'm still not sure what got me off. It might have been the written questionnaire where I penciled in my own answer to a multiple choice question. Or it might have been when the judge, all 5 lawyers and I ended up standing around clarifying what exactly the judge was saying when he admonished us to "not form an opinion"; was he talking the kind of opinion a lawyer drafts, or the kind you toss out after a few pints?)
The thing I found most interesting about the process was first off, the number of bench warrants(!) the judge issued for people who didn't show up. The second thing was the ~18 year old who was in the jury box getting questioned on day one and showed up something like 2 hours late on day two. He ended up standing in front of the judge being told that he now had a court date a bit down the line where he was going to have an opportunity to explain why it was okay that he didn't show up on time and why he shouldn't face consequences. It was strongly implied the judge didn't think it at all likely the kid would have a satisfactory explanation.

I've always wondered about jury duty in the US - why don't those people who do not want to be on the jury not just tell the lawyers/judge that they have a bias? Isn't that one of the first questions the potential jury members are asked? Is that illegal in some way?

My state only pays $15.00/day and 34 cents/mi starting on the SECOND day. I’ve had 2 employers with a policy in place stating “no jury duty pay by employer. You are paid by the court.” How is it not a hardship at $15/day, after the first day being a TOTAL loss, and gas at $5.39/gl??? Really judge? Not a hardship?
These judges have no clue what it’s like living paycheck to paycheck so no skin off their nose, right judge???

I've been to jury duty a few times. About 80% of the people there don't want to be there and want to get out of jury duty, and they'll say various things that they think will get them out.
On the other hand the judge wants to seat the jury in one go. The last thing the judge wants is to not be able to seat the jury from the 70 or so potential jurors and have to go another round.
The most common thing people say to try to get out of jury duty is mirroring judge's words back by saying they are biased.
See, what the judge really doesn't want is to let other jurors see that there are magic words like "I'm biased" that you can say to get out of jury juty, because then the 80% who don't want to be there will say them and they won't have enough for a jury.
So the judge pushes back by saying that everyone has biases and that's normal, and asks whether the person can overcome their bias. That kind of grilling deters others from using that strategy.
Later on the judge asks whether you'll follow their instructions. I said no as I saw that as a chance to get out, and when asked why I explained jury nullification. That got me out.

In Ohio, you use your PTO to get paid for jury duty. If you don't have PTO... you don't get paid. No law here to make them pay you.

I don’t really understand why this trial was allowed to take SIX WEEKS. How do murder trials like the Shabusiness trial wrap up in a week and a defamation case is allowed to drag on for six weeks? Why isn’t there a time limit?
It should be a law that jurors get paid a liveable wage while in service. I mean what is this bs? Some people live paycheck to paycheck. Sone bosses are not understanding and would fire you.
And what is a livable wage? That would be different for each person and would be an exorbitant expense. Those expenses must come from somewhere, so they are either shouldered by the parties of the lawsuit, or by levying taxes. Realistically, since the state is the plaintiff in criminal proceedings, that would require taxation in either case.
As to being fired, many states (I'm not going through each one to check) have laws against that. 🤷♂

Looking back at when I got summoned for jury duty, I still can't figure out why my "staving student" excuse got me out of it. I'd just graduated, and was job hunting, and my excuse was that I needed to get a job to support myself, and that it was the prime job hunting time (I forget what time of year it was, but I know that was accurate). Listening to this, I kinda wonder why that worked TBH.
She let Heard and Heard's team walk all over her. She started the trial with Heard just refusing to turn over first subpoenaed and then court ordered phone and electronics evidence.
She let both of Heard's lawyers suborn perjury so many times I lost count.
She let fabricated and falsified evidence be used in her court. Then instead of doing anything about it she gave the jury weak ass non standard instructions. Instead of the usual don't believe anything this person says because they can't be trusted instructions.
She was weak and biased. Because of that she turned the whole American judicial system into a laughing stock.
Just imagine if the sexes were reversed. There would be outrage and rightly so. Instead everyone kisses that judges ass.

A starving student without a vehicle or money can probably just not show up and tell the court to come get you.
They can compel you to go but if you physically cannot that's their problem.

Just because you get a jury letter in the mail means nothing. If it doesn’t come certified, there’s no reason to complete it.

WA state. Employers do not have to pay while employee has jury duty but they cannot retaliate against the juror.
In the state where I live there is no law saying companies have to pay you for jury duty and the pay by counties is only 10 dollars per day. We have had hardship a number of times because of not being paid while serving on jury duty.
Let me guess, the pay was set back when $10 was not the price of half a sandwich...

Florida as well as many states DO NOT have to pay your salary during jury duty. I’ve always lost money serving.
This judge is incorrect there is no law or rule in Virginia or federally that employers provide paid leave for jury duty.
Some employers will choose to, but for non exempt hourly employees they may have to use their PTO. Which is probably why juror 10 said 2 weeks because that’s probably the amount of PTO he had it’s a very common amount for non exempt employees

😮😮In my town, a man was required to report to a judge for contempt of court. He fired an employee for not getting out of jury duty and put it in writing as his reason for protesting unemployment. The idiot ended up paying the employee a lump sum.
Very interesting stuff! I didn't know they had a transcript for jury selection. I've been going through some of the transcripts as well, mainly reading through the sidebars. The transcripts also made me like Judge A even more and I also became more sympathetic towards some of AH's lawyers, namely Rottenborn.

@@Gwentheferret I have a suspicion that his name comes from German, in which case it would be a word that likely was used to refer to a natural water source/spring (that's the 'born' part). People in the area would have come up with names for these natural wells, and 'rotte' is the term for a pack of wild boar! Around here there's one called 'Wolfsborn'. Same principle. So... If you want to be mean, his name means 'pigwell', which is still not great, but way better than the English meaning 😅

And I do have an Aunt whose husband took her name. Her last name was 5 letters long and while rare was easy to pronounce and intuitive to spell. Her husband originally had some 18 letter long monstrosity that did not operate by the rules of English, and he was very glad to be rid of it for that reason.
