  • At the US-Mexico border, policies of prolonged detention and family separation have made seeking asylum in the United States difficult and dangerous. In this raw and heartfelt talk, immigration attorney Erika Pinheiro offers a glimpse into her daily work on both sides of the border and shares some of the stories behind the statistics -- including her own story of being detained and separated from her son. It's a clear-eyed call to remember the humanity that's impacted by policy -- and a warning: "History shows us that the first population to be vilified and stripped of their rights is rarely the last," she says.

      For all you Democrats out there. Let me tell you the reason why Republicans hate illegal immigration and are in favor of deportation and securing our borders
      The Republican point of view- The whole point of legal immigration is to vet out the bad citizens. (Murders,Rapist, you know, the bad people). America cannot take in everyone's problems. Not because we don't have space (we are a big country) but because of the long lasting effects it has on our country. Now as a Democrat, you are saying "Why can't we take them all in or most of them in?". Ok,ok,ok. I will answer your question.
      Remember the Vietnam war? That very controversial war? Well, in all wars there are refugees. California decided to vote no to accepting Vietnam refugees because joe Biden said (I believe he was in charge of California at this time) "If we cannot take care of our thousands of homeless Californians? How can we take care of the added population of vietnamese refugees?
      Still not enough?
      When america did take in immigrants. (I believe it was in Florida, I'm not sure) wages dropped by 30% the immigrants worked for less and that made the Americans have to work for less too.
      Still not enough?
      Ok, what about the moral argument? These are refugees fleeing persecution. Yes, this is true but is disproportionately reported by the media. If you look at the facts and statistics, only 20-26% of all asylum claims were granted. If only 20-26% of all asylum claims were verified. Then 2 things are possible. 76% of all claims considered illegible for asylum and are lies or our U.S asylum system is not competent enough to recognize people in danger. I'm gonna trust our government on this one.
      Still not enough?
      Now, think about how illegals stay in this country. They violate our laws. We pay them social benefits. They lower our wages for our American families. Some of them murder and rape our American families. They cause gang violence (MS-13). Keep in mind that 74% of U.S asylum claims are false and you get the anger that Republicans have for illegals.
      Still not enough?
      If a country has a small foriegn influx of people of a different culture, language, and traditions and they are surrounded overwhelmingly by another culture and language. Guess what happens? The smaller culture adopts the bigger cultures ideology. This can't happen if the smaller culture is not surrounded by the bigger culture. But in America there are 22 million illegal aliens. Some states are having dual languages on their signs and at airports. You see it in the democratic debates too. You see people at the debates speaking Spanish. Why is this bad, you might say? You are forcing the American people to learn a new language and conform to a different culture. Americans have a superior government and superior culture. If we weren't superior (I'm not saying racially superior, I'm saying culturally superior) why do we have the better country? Why do they want to force their way into our country?
      Still not enough?
      Let's be honest America takes in 4x the amount of legal immigrants then the world's second leading country. We take in 1 million per year legally. The second most country takes in 250,000 per year. U.S.A takes in the most, that's a fact.
      Still not enough?
      Just because you want to come here for a greater life doesn't mean you get to CUT the line of the hundreds of thousands of other people that are LEGALLY coming here. The people who are legally signing up for our country's citizenship are getting skipped in line by illegal immigrants from south and central America and that is why Republicans hate illegals.

      Tunnels. That's all. And I think since my husband and his family actually did the job of running people over the border, I might understand it a little better than you. I am not against restricting immigration at all. But the wall is a joke. You can't actually believe that a stupid wall will keep them out, can you?

      @@amyjkr Absolutely, walls will slow illegal immigration. It's a physical barrier to be dealt with. This will give border agents more time to deal with "tunnels" or other obstacles in time.
      We can't even take care of our own people in tent cities with feces on sidewalks. Yet, we must take care of anyone who illegally crosses border to overstep those who go though the legal process. I can't go to any country with out a passport or visa if I want to work there. Why should U.S. be different?

      Wall? it is just a Speed Bump, when the Laws are screwed up. People just have to say "political asylum" I can't go back to my dangerous country. As soon as they say that, they get YEARS of waiting for a Judge to decide. With all the Sanctuary Cities, they can go disappear inside USA, and Police are not allowed to talk to them or get fired.
      Walls...are...useless...without...strong...Laws.

    So what do you want, ANY "Refugee" or group of any size, should be simply allowed to enter the country, un-vetted, and roam free? Without processioning? Attorneys should be allowed to organize the subversion of immigration laws and not face any sanction, because, as best as I can understand her, it is really upsetting to them?

      This is not what was said or implied. Let’s ground ourselves in reality but keep optimism in hand. The least the government could do is make ALL detainment centers LIVABLE and offer healthcare so that diseases can be avoided.

      Nothing, my family fled communism. They can wait like we did and come in the right way. What this woman isn't telling you is that the majority of illegals crossing the border come here to seek wealth and stability. They are taught how to lie and use gang violence, politics, and religion to gain "asylum." She also fails to mention that they come here, procreate, and are able to seek government resources for their kids. She fails to mention that not all countries give you the privilege of becoming a citizen for merely being born on that land. She fails to mention that Mexico has their borders against Guatamala and Central Americans to keep them out. She fails to mention that Obama deported more immigrants than Trump ever has -- but hey, let's forget facts and focus on the emotional aspect. After all, who cares if American babies are now BORN into DEBT.

    It's a very controversial video for sure. I feel for the woman who lost her baby because she didn't get help in time. But why cross the border when you're 8 months pregnant? You know you're running a risk and you're using your UNBORN child to get access to better resources for yourself. You can't blame the CBP for not helping you trying to deliver your anchor-baby. She took a risk, she gambled, she lost. I wish for everybody to win, but I'm playing too, and we're just not always on the same team.

    Why don’t you go to Mexico and protest that the police can’t protect her and her child? Fix the problem at the root. Saving the few that make it here is not enough.

      Many US companies have settled in Mexico for labor and natural resources, this is sucking them up from farmers who can no longer produce their crops due to a lack of water from Mexico’s water reserves. In case you’re not aware, water reserves are how many farmers in Mexico and states like California and Iowa water their crops. Their crops dry up along with their livelihood. A US company is the source of the problem. At the very least, that family should be let into the country that stole their livelihood. This is just one example of the complex series of events that could lead to migration.

    Honestly you have no idea of how the US government treats it’s own people that wind up incarcerated, not until you have been there and done that. So the US has every right to protect its borders and running back and forth is highly suspect. The enforcement rate is up that’s why there are higher numbers. Just because you want to flood this country with Latin America doesn’t mean we all love that idea. Autonomy for our own country and LEGAL immigrants are synonymous. My sister in law is from Singapore. If she can do it, why can’t they? Oh they’re poor? Yea I slept on an abandoned school bus until I saved for an apartment. Don’t have kids if you cannot care for them properly. Do not expect hand outs and taxpayers to take care of your children. I pay 40% taxes and cannot afford to have a family but I subsidize those who sit at home their whole lives and get that luxury. Tough love.

    She is not telling the whole story about border issues. Illegal immigrant children are sepparated from the parents because the parents are being charged with illegal entry or illegally entering the country after deportation. It would not be appropriate to allow the children to serve the jail sentance with their parent. The assylum claims are mostly made up.

      this is how it's supposed to work. part of the problem is that a lot of people are being detained on suspicion alone. this wouldnt be that bad, but because of how backed up the system is, a lot of people wait months to even have their case heard. guilty or not

    Ok. So as I understand the situation, Mexico is the problem here. Why don't they:
    1) Use their armed forces to destroy the entities causing the threats and the violence.
    2) Request the assistance of the US military to destroy them faster and more easily, like Kuwait did against Saddam Hussein.
    A whole country can't just run away to another country just because their population of criminals is soaring. I believe if Mexico isn't willing to take steps to sort things, the USA should rightly refuse all refugee claims.
    When people are dying at an alarming rate, maybe the authorities will be alarmed and do something about it. That, or an alliance of countries should just storm Mexico and restore order like they did in 1945 when mass murders were happening.
    Were I in charge of Mexico or the USA, those would be my strategies. They worked in WWII and the Gulf, why won't they work here?

      Or if the citizens of Mexico have a problem with that, they should come together and ask the US and its allies to intervene and help.
      But illegally fleeing to another country, while leaving their fellow citizens behind to be slaughtered, is a poor choice and doesn't help anybody. The country they're fleeing to has every right and reason to deport them right back to Mexico.

    If I was running from something much worse, 3 months of separation, in hindsight, would not be all that bad. But what I am concerned about is the possibility of innocent people becoming lost in the system.

    Because of all the 'encouragement' for everyone in the entire world to come to the US illegally, (except white South Africans), because of the encouragement of amnesty programs, because of the generous welfare benefits available in the US, the southern border has been overrun.
    CBC is overwhelmed.
    Now, people act shocked when children are removed from the holding centers. People act shocked when children are separated from illegal aliens.
    You would be equally shocked if it were the opposite; minors being held in adult prisons because of the actions of their parents or legal guardians.
    You might also be shocked to learn that it is common place for asylum seekers to have children with them that are not theirs. The children were acquired for the specific purpose of securing entry to the US.
    The situation is FUBAR and it is a result of many causes in addition to what I mentioned.

    Why are we, the American government, failing to hold the Mexican, Guatemalan, Cuban, etc. governments accountable for their mistreatment of humanity and the cost of protecting our borders.     I don't blame any one for wanting to come here to build a better life for themselves, be it legal or illegal entry, but there has got to be some level of awareness at this point of the risk one takes of being separated from their child if caught crossing illegally. Where is there ever any mention of parental accountability in any of this?

      For most of these people, their choices are "stay home and definitely be killed by gangs, or totalitarian government, or starvation because of the economic and/or agricultural collapse of our country" and "flee to a country where we have at least a chance of surviving".

    I’m from South America and I think there are otherthings people can do to protect their human rights but in their own countries. People in USA dont have to pay with their taxes aid to inmigrants they have to do it right in their own countries.       Problem is in their own country, not the US. The problem is that they bring their problems to the US and make it a US problem when it really shouldn't! If their own government would give them VISAs, provide student exchange transfers, fix their economies, give hard working people incentives, etc. they wouldn't even come to the US looking for the "American Dream". They'd have it right at their doorstep, along with all their rich culture.

    A solution is for transnational would pay a dignify pay. One of the main reasons why my parents left it was because everything was as expensive as the u.s but the weekly or biweekly payment was of $30 dollars a week (depending on where you work) like Ford, they paid a decent amount but the other transnational warehouses they would lock the doors for a 12 to 14 hour shift, only your lunch brake of 30 minutes and they would tell you: "we have to thank God that we have a job", even if they sploited you for so long.

I know how it's like to work for $2 an hour and even for free and I also reached when I can save 40% of my budget and invest my money/go on vacation, etc. Let me tell you I chose the latter. That's why I work hard to maintain my job and climb the ladder. I even worked and went to school at the same time for 6 years, so I know a little bit of sacrifice and what's like to ride the bull by its horns.

      She said her home was in Mexico while her office/ work was in San Diego, a city in California. She also said she is a US citizen. She went to her work in the USA from her home in Mexico. Seems legit to me. I wonder what the tax implications of such a cross border live work arrangement are.

    Discrimination based on location at birth remains the most prevalent legalized form of discrimination globally. As with most forms of discrimination it persists primarily because the majority believe it won't happen to them and the people being discriminated against are easily silenced with threats of deportation or harsher treatment. Deportation in most countries can be carried out without any reasons given or any form of legal redress being available to the deported.

    Mexico actually can accommodate a lot of these people but they want to come to the US. I have family in TJ and other parts of Mexico and the Mexican government actually helps get these people jobs and housing. TJ is having an economic boom with US companies investing and having factories there.

      But this isn't about Mexico. That's a different conversation, especially since refugees HAVE indeed been moving to Mexico as well. Those caravans do dwindle in numbers as they march towards the United States because there are families that choose to remain in Mexico as opposed to continue the journey.
      Then there's also the mass migrations to Peru, Colombia, and the Caribbean. Its the United States that has notoriously turned this into a massive us vs. them catastrophe.

      @@johnnychang4233 I would be. I have family in Mexico that grew up as poor as much ranchers during the great cow epidemic that ruined much of my family's wealth. That was my grandfathers incentive to come to the US but now there are some big opportunities openning up in Mexico. I have family that have made it. I wont say how but there are ways to get educated in Mexico and making a life even from 0. The Mexican government has a lot of programs for its citizens where they will lease people land as long as they work it right and give them the machinery and animals to do it. There are other ways but I am not going to say because if you want to make it then people should see whats available. I was amazed on what was available in Mexico. I went in vacation and I had job offers for my field everywhere. Also more people are speaking English more than ever. The problem is that there are a lot of lazy people there like in any place of the world. I you have nothing in Mexico a person can go to any city hall and ask for employment and they can direct anybody to get a job. If they come with some sort of background they will even accomadate it. My problem is the illegal immigration. My dad is a resident and has done pretty good for himself and my mom is a legal citizen. My dad messed up so he cant be full citizen but he already has a good retirement plan and going back with my mom. There are towns in Mexico with mostly white American retirees. They get their Dual Citizenship. I encourage people with Parents that are immigrants to get dual citizenship then they can avoid visa bullshit.

      Coming to the border as a refugee is legal and a right under the 1951 Refugee Convention, and the USRAP which is a combo of federal agencies and nonprofits work to vet these people seeking asylum.... which is legal....

    If the problem at the US-Mexican border is going to get any better, the US government needs to give border agents the proper funding and resources they need in order to properly do their job and the government is not.
    It's very irritating how people are so up in arms about the treatment of refugees at the facilities when the treatment of these refugees was much worse in the past and has improved significantly, but no one cared until recently.

    We definitely have a problem without many easy answers. Revisions are needed to insure a humane management system is in place. With that being said, I can't wrap my head around the concept of economic or climate change refugees as a reason for asylum. Asylum is for life or death safety concerns. To state otherwise lessens the seriousness that true refugees deserve in recognition of their requests for residency.

      Vyes Sampson it’s not an executive decision. A federal court ruled that children cannot be interned in adult holding sites and thus must be separates. See Flores Settlement Agreement. Congress is really to blame if anything for their inability to find consensus on border policy

    Hate to tell you this but the fact is that people go about their business as usual all the time in any number of different situations where people are in potentially life or death situations.
    You want better facilities? You should tell your congressional representatives to stop trying to cut funding so far the border patrol exists in name only because thats what they've been doing for decades. Both democrat and republican.
    In regards to immigration in itself, we allow over 1 million legal immigrants every year. Over 100,000 more than the next closest country. Not including asylum requests. We do unfortunately need to draw a line somewhere.

      you cant listen to just her perspective. those people who work at the boarder are short staffed, begging for volunteers, YOUR tax money pays for those women who have their babies at the boarder including baby formula, the birth itself, clothing for both mom and baby, a place for her to stay and any medications she may already be on. we dont "torture" these people at all. when women come and have their baby at the boarder, we take them in and they both become citizens because baby was born here. its an abused system. plus most people just come through bc the cartel are running most of the system and they bring through kids for trafficking .... she is very one-sided for her job. there are a couple other sides that need to have attention brought to it

    its nice to hear the perspective from somebody that actually works in this field. I'm not a huge fan of how you tried to present it, but its certainly a unique perspective. unfortunately you'd have to change the minds of a lot of people to get anything done. She says that calling congressmen works without anything backing up the statement. and yet, it's been shown multiple times that after the 90's it became almost nonexistent for congressmen to vote across party lines. If you want to create this change, you need to change the mind of the masses to allow people to get elected that support this platform. the problem with that is american politics has become completely polarized with both sides believing the other is brainwashed and so their opinion doesnt matter. a lot of issues are going to be put on hold and get worse until we can decide to find democracy again, or take a chance with authoritarianism. What a time to be alive

    I could stand up there and tell you equally terrible stories about kids my daughter knew in school in the rural US, American citizens, some of them living in abandoned houses with no water or electricity for months on end with no adult to even look after them. But the difference is, if help is to be given, it should FIRST be given to that American kid. And education and health care should be given to that American kid too. And then to all the homeless Americans who live in their cars or on the street. Where is the massive media coverage of that? Shouldn't someone get up and muster sympathy for them? In the country with the highest poverty rate in the developed world. And she wants to complain that we aren't helping all the OTHER people in the world.

We acknowledge this clearly with animals, when someone takes in way more animals than they can care for, and we call it hoarding. The idea is that you care for the ones you are responsible for BEFORE you take on any more. If you cannot take care of what is your current responsibility then you have no business taking on any additional. You will not be allowed to adopt a 6th child if you have 5 children that you can't currently take care of. Pretty simple really. We do not currently take care of our own citizens so we need to do that before taking on responsibility for other countries citizens.

    What this woman isn't telling you is that the majority of illegals crossing the border come here to seek wealth and stability. They are taught how to lie and use gang violence, politics, and religion to gain "asylum." She also fails to mention that they come here, procreate, and are able to seek government resources for their kids. She fails to mention that not all countries give you the privilege of becoming a citizen for merely being born on that land. She fails to mention that Mexico has their borders against Guatamala and Central Americans to keep them out. She fails to mention that Obama deported more immigrants than Trump ever has -- but hey, let's forget facts and focus on the emotional aspect. After all, who cares if American babies are now BORN into DEBT.

    Before the 5 minute mark I have to say this before the finishing this upload.
    Imprisonment is never supposed to be pleasant and how do you differentiate a suicide bomber from a person just seeking asylum?
    It is not torture, it is protocol for National Security.
    If everything was candy canes and sunshines our country would collapse block by block, town by town city by city then state by state.
    That is why there is a waiting list to emigrate.

      For your concern about national security, there are no suicide bombers in Mexico (I think you are mixing them with radical ISIS fighters). There are people with guns and drug smugglers but even those are at low numbers about the same as a normal US citizen. Plus, they would have to give their weapons and drugs to the police when they enter. So they would have to buy them from inside America unless the stupid government finally stops selling everyone guns.
