      I thought this case was pretty ambiguous. Yes, they took advantage of her, but she also seemed like a willing participant. Where do we draw the line? Disabled people deserve love too, it’s a tough thing to adjudicate. I can see how this would be considered reasonable back when this was filmed.

      What he did was legal but absolutely should that was prejudicial AF, if the defense wasn’t smart enough to make the motion on their own sucks to be there clients 🤷🏾‍♂️, in reality I imagine he’d be kicked off the bench.

They may have the mental capacity of a child but they have the hormones and body of an adult. This is a perfect example of what makes law and order great they pick this grey area topics and make a fantastic show that puts both sides on display

Didn't help much that the judge was a well known misog ahole in the show though. The line, to me, in these cases is drawn at lying.

      @@jayyu8645 she "consented," but think about it: if a 13 year old consented to doing it with someone who is over 20, does that mean the person should not go to prison just because she consented? Consent alone doesn't matter: there are laws that make this type of thing illegal, and laws that protect people who are disabled from being victims. That girl CLEARLY had a disability, and didn't even understand what she was doing because the boys convinced her that it was a "game". Do you see how this explanation wouldn't work with a fully functioning person? You could never explain that to anyone like that and think they are going to believe you, only CHILDREN really understand it like that. This furthermore proves that she had the mind of a child, and these boys took advantage of her disability to do whatever the hell they wanted to. I mean, they basically incriminated themselves by telling her not to tell anyone what they did, but with the other girls they were telling people what they were doing? You see how that doesn't make any sense? I'm concerned that you don't see an issue with this, like that isn't normal at all. THEY STUCK A SODA CAN INSIDE HER. They LAUGHED at her when they did all of this to her, and you want to tell me that she "consented" to that? It doesn't matter that she said "she liked it." , she's only saying that because she already has the belief that you do it because you are in love, and any functioning person wouldn't think that type of abuse was "love." She CLEARLY didn't and never understood what truly happened to her because of her condition, and they should have been charged and sentenced for a long time.

    The young lady playing Valerie did a great job. You can see the conflicting emotions as she talks about what happened. I think deep down she knows they took advantage of her, but the humiliation would be too much to bear. She wanted to believe those boys really did like her and that she is capable of exploring her sexuality, and realizing it was all a joke to them would break her heart. 😢

    17:19-18:00 I understand that this case was pretty ambiguous, but I still despise that judge for overturning the conviction of those 3 teenage boys.

      I despise him too... and actually if that were in a modern episode of L&O TODAY, that would have been displayed even more obviously as being a corrupt/improper ruling. In point of fact, the judge WAS wrong and it was not ambiguous at all... Once the expert had diagnosed her mental age at 10-12 and had stated that she'd 'do anything to please whoever she was with', that sh1t was basically over. The Jury ruling being overturned was, I THINK, an attempt from the show at the time to show the deep divide between what the law SAYS it does and what it ACTUALLY does.
      It just doesn't play out as clearly in today's climate as it did back in the 90s when that episode must have first aired. I mean... they were still using the R-slur as a regular and accepted term to be using in court and professional discourses (as seen in the episode/clip).
      Sadly, I think this may also have been one of the episodes that was commentary of a REAL case that actually happened (and they don't always change the endings when they do that, sometimes, they just show the awful ending as it really happened).

    I felt so bad for the kid in the first part of the video as his grandfather was willing to send him to jail instead of a mental hospital to get treatment as he was scared the press or one of his competitors would find out his grandson inherited the condition from him

    2nd episode although it's a quite ambiguous case i feel there is reason to charge the boys. From her description they obviously knew of her disability, they laughed at her complying with them so easily and they took advantage of that.
    The victim's wish should be taken into consideration in most cases like this but this is not "most" cases, the victim doesn't understand the consequences and what the boys did

    While the second one is a good episode, it doesn't fit the title of the compilation. No one actually dies in the episode. And in the third one, the kid isn't the killer. So... 1 for 3 is not a good percentage

      In the second one, the kid (older sister of the mentally challenged girl) did KILL a teacher (accidentally) while shooting at the boys that raped her sister, so someone did die!

Even that wording is a bit rough and not the most agreeable verbiage I'd use. To be clear I'm not against the use of words that aren't exactly up to par with modern interpretations or vernacular. I just prefer that words not be used that have been co-opted by people that only use it as an insult or to demean someone less fortunate than others. Otherwise if it's a product of its time I hold no ill will against its use. You can't account for the thinking of people in the future and nor should you. I actually appreciate older speech. It's quite charming.

      The third case was a man murdered his sons ice hockey coach for not allowing him to play in the next game which his dad arraigned for college scouts to come to he pled not guilty as that his rage at the time of the murder was argued to be at such a level that it impaired his ability to appreciate the consequences of his actions in the end the jury found him guilty

    I'm a huge fan of law and order and have been for many years. There is one thing that I would like to bring to the table regarding the voice sample. Even low the voice sample sound of the same as the 911 call. You've also got to bear in mind that you get voice changers in my opinion I think this may be in a miserable in court.

    SKIP IF YOU ARE TRIGGERED BY ABLEIST LANGUAGE (being used as normal, every-day speech). That clip is SO old, it's actually extremely hard to watch even the defense happening. It's actually disgusting... but I recommend watching it if you can as it shows such a great amount of progress has been made in how we interact with, understand and even just merely speak about people who have these differences.
    The only way I could stomach that segment was by reminding myself that this is a time-capsule displaying the degree to which things were NOT understood back then.
