False accusers should be punshed as though they had committed the crime they accused the other person of doing. So if they accuse someone of committing first degree rape, then they should be sentenced equally.

Yes. It's the same idea as the US American 2nd amendment. You're allowed to carry because you have the right to defend yourself. This works as a deterrent for criminals who shoot at you because you can shoot them as well.
Likewise, punishing false rape accusations as if they were rape works as the same deterrent.
And perhaps now you know why it's so hard to work this into the legal system. It's hard enough to keep the 2nd amendment alive. Adding a new, similar law just like it will obviously face a lot of resistance from many people.

The only problem is that rape cannot be easily proven. So women who were raped and reported the rape could be punished leading to more silence.

@@emilyvillamil An accusation that has not been proven true or false would not be punished. If the evidence proves the accusation is true, then the rapist would be punished, and if the accusation were proven false, then the accuser would be punished. This should be true for all crimes.

@@emilyvillamil The same argument could be made of a plantif against a defendant. The issue is the evidence, and a court having an objective means of establishing justice. Most people desire a justice system that favors mercy over judgment, which means a person should be innocent until a solid case can be established against them. We don't have that either, since a person is often held in prison during the trial process, despite having not yet been convicted.
You seem to favor a system that punishes people on flimsy evidence in an attempt to proactively protect others, rather than protect the accused (prosecuting potential for future crimes.)
The only way to insure people don't make false accusations is to punish them.

Ironically, some of the radfems (like Big Red) actually have more in common with MRAs than mainstream feminists like the National Organization for Women (NOW). If we take child custody as an example, Big Red has argued that believing that women are better caregivers and therefore should get primary custody, as put forward by the current "primary care standard", is part of patriarchy and should be undone. MRAs argue that this idea is part of gynocentrism and a failure to acknowledge men's role in childrearing. They have different rationales but want this standard changed in order for men to have an increased likelihood of custody. Conversely, the NOW has consistently upheld the "primary care standard" and opposed laws designed to grant men more likelihood of custody.

It's very simply a matter of Communication and Intimacy, which comes with Trust. If either of the partners are horny and there is the potential, then communicate this. If he or she isn't in the mood, then there shouldn't be guilt or reluctance. It should be a clear and loving no. I've asked my GF if she was sure about this, that, or something else. If she says, "No," to certain ones I ask again and make sure. If it's no but playful, then I do things that she's indicated that she likes. It all should be natural. Folks shouldn't get with partners who are about these Games!

    • @JakkFrost1

It's no longer safe to be "playful" in this age of rape hysteria. It's far too dangerous for men these days. Once the word "no" comes out of her mouth, you stop, for _your own_ protection, even if you know she didn't really mean it. I would even venture to say you should be wary of starting up again even if she specifically says "yes, fuck me" after that.

As a lawyer, he should not be musing about cases where he doesn't know the evidence or information clearly (Denim Italian Case) and he should make a clear and cogent argument by citing to exact legislation or verdicts. As a lawyer, if someone were going to interview me about clients or issues that I am facing in my field, which is maligned by the general public AND it was going to be in a documentary, I would get my ducks in a row.

You are right although before talking about it he mention he didn't do any research about it, I did it personally because I was pretty outraged of this and wanted to read what the Jury wrote so I read the motivation of the sentence and it ended up a bit different than how it was reported in by the media, I don't know if that make it more grotesque or what but was actually the prosecutor to first bring the "too tight jeans" reasons to prove there was no consent by her, claiming the jeans were only partially removed because was impossible to remove them without consent then on appeal the defendant used this same concept against her accusation.
I wasn't able to access all the trial documentation yet but I hope I will, I'm not saying he was innocent but I like to know if, how and what gone wrong during the trial. There are instead other cases were the media (along feminist and actually most of the people) blamed the Jury but when you read the motivation of the sentence their decision actually makes fully sense

Oh also, on the idea of prosecuting false accusations... I think it should work something like this:
Potentially falsely accused rape cases where there is an assertion with absolutely zero corroborating evidence: If the case gets thrown out, and there is no judgement... If mental health professionals believe the story may have been true based on psychological factors, any therapy that alleged victim needs should be handled, not necessarily sure what the best way to pay for it would be, possibly tax subsidized, but that would be fair, I think.
Potentially falsely accused rape cases where there was evidence, but it did not meet burden of proof, same thing mostly, but the case should be open to appeal for free, even superceding double-jeopardy in cases where new evidence comes forth that proves the accusation beyond any doubt.
Falsely accused rape cases where the only evidence presented was planted, and the case looks like it was not a mistake, but rather intentional attempted character assassination on the other hand should carry EXTREMELY steep penalties, such as mandatory minimums (such as 4+ years)

For most crimes other than rape there is a real chance of being prosecuted if you accuse somebody of crime you know they didn't commit.

Most times there are no witnesses and a partner can say yes then sue you anyway. It is good to ask each time, but it doesn't cover anyone from being false accused, so what do we need to do ? Filming us giving consent with a paper journal of the day in foreground ? Even so, how proving a false accusation for an imaginary intercourse the following day ? If two persons were together in a private place there's no way we can prove something didn't happen, the absence of proof isn't the proof of the absence and it will lay to the credibility of the accusation against the one of the accused, which (for heterosexual relations) tends to give more credibility to the accusation just if it's a woman suing a man.
Sexual predators have to be stopped and punished, innocents don't. Some decades ago police often did a bad job not hearing properly victims, now this problem is a bit more limited but false accusations tend to explode, law has to keep this in mind and invent new protocols to keep protecting victims but also prevent innocent condemnation.

I would much rather be raped once than falsely accused, defamed, convicted, registered as a sex offender, and raped repeatedly in prison - which is what happens to sex offenders. Last time I checked more men are raped in prison than women in our entire society, often repeatedly, and they get zero help or sympathy. The only rebuttal I ever hear about this is victim-blaming them for being in prison in the first place.

Key points about rape and victim blaming:
    1) an unfounded accusation is not necessarily a false accusation. Rape has a mental element on the part of the alleged rapist and it’s entirely possible that, while the complainant did not consent, the alleged rapist genuinely did not realise this (e.g. if she went along with sex because she didn’t feel comfortable saying no even though he did nothing to cause that discomfort).
    2) there is a key difference between victim blaming and pragmatic self-protection advice which is often ignored. Getting drunk at a party does not make it morally OK to rape you, but the reality is that there are nasty people out there and the authorities won’t always be there when you need them. It’s the same reason why I don’t leave all my doors and windows open when I go on holiday.
    3) some people really do cross that line and blame the victim. It’s particularly heinous when rape victims experience it because of how serious that crime is. But this happens in all sorts of cases, not just rape. E.g. when I was younger and my friends and I got beaten up for being goths we were told by police that it was our fault for choosing to dress that way. So as bad as it is, it’s not because of “rape culture”.
    4) acknowledging these points rather than swallowing the feminist ideological narrative wholesale does not mean you take the crime of rape any less seriously.

Isn't it also just good practise to gather as much information as possible, so that if correlation does occur you can curtail those behaviours to improve an individual's safety?
To say, don't drink so much that you pass out isn't victim blaming, sure that may be entirely their own fault, but that doesn't excuse rape, or mean it should be expected. However, we need to still be allowed to have the conversation. To say, "don't drink too much, not only is it dangerous, but when you are unconscious your body is entirely at the whim of others". That's not condoning rape, that's just an objective fact, and saying don't do something that might lead to rape is obviously showing a desire for the rape not to occur.

Big Red, Katherine Spillar and the guys who were protesting the MRA meeting near the beginning of the film have much larger than average view counts. But Kimmel and Messner's counts are about average. The largest view count I saw belongs to MRA Karen Straughan. Why some videos create more interest than others I couldn't tell you.

The Denim Day issue was that a rape conviction was overturned on the assertion that because the victim was wearing very tight jeans, it wouldn't be possible for the assailant to remove them without her assistance (and therefore consent). That assertion being made by the Italian Supreme Court, in 1998. The ruling was overturned in 2008.
No clue whether they guy was actually guilty, but that is definitely a BS reason to reverse a conviction.

True but I've read the motivation of the sentence and it's a bit different that how it was reported by the media, I don't know if that make it more grotesque or what but was actually the accuse to first bring the "too tight jeans" reasons to prove there was no consent claiming the jeans were only partially removed because was impossible to remove them without consent.
Sadly I wasn't able to have access to all the trial documentation yet but I hope I will

Making women passive victims does not help. Any predator needs prosecuting of course. There is no excuse for actual rape, ever. I wanted to raise my daughter where that is least likely to happen.

Yeah, the extreme explicit-verbal-consent-needed to have sex idea is just going too far.

  • @OldToughDW

If we apply the same standard Feminists want to apply to consent, to determine rape, instead of a biased and slanted standard, then a clear and decisive "no" must be expressed before it is rape. Which is clearly unfair to impaired rape victims.
I only expressed this to expose the ridiculousness of the Feminist position. It ignores that in real life there are grey areas where the responsibility and tacit consent is unclear. As far as Feminists are concerned it is all men's fault no matter what happens and no matter whether non-verbal consent is given or not. When the KKK says, "states rights" it is coded language for "the right to own another human being" and people quickly point that out, but when Feminists use, "patriarchy" as a coded language for "Men" nobody holds them accountable for their bigotry.

When you leave your car unlocked and a bad person steals it, you've earned blame. When you get stabbed or shot in Harlem for wearing a racist shirt, you've earned blame. When you don't wear your seatbelt and get injured in an accident, you've earned blame whether or not the accident was your fault. When you get blackout drunk at a party and bad things happen, you've earned blame.
Bad people will do bad things, and sometimes bad things just happen; not protecting yourself earns you some blame, regardless of the situation. And putting yourself INTO bad situations does not absolve you of some responsibility.

This somehow felt very topical in regards to the recent deadly Humboldt Broncos bus crash in Saskatchewan a few days ago. Today I was listening to a talk radio program that was discussing this topic, and a caller called in saying that while it was tragic, they were privileged white boys that died and that this crash is overshadowing the even more recent bus crash in India that killed a whole bunch of children, which in her mind was not a good thing.
The host then made a good point (after a break, so he mulled it over for a bit) saying that we shouldn't pit victims against each other, and claiming that one crash is less tragic than another is a very bad and divisive way of talking about tragedies, which is along the lines of what was being discussed here (both rape victims and victims of a false accusation are both still victims and should be treated as such).
This really has me pondering how we treat victims, and if there is any real reason why victims should be treated differently. I'm still hung on the difference between a well-known person being murdered (e.g. pop star, president) and any nondescript civilian being murdered, as I don't think there's a way to treat these hypothetical deaths the same, even though they are both tragic. Maybe it's how easy it is to relate to a given tragedy that makes some appear bigger than others.

Humans communicate in many ways. verbally, body language and the clothes you are wearing. Yes, what clothes you wear is a form of communication as to what kind of person you are and what your intentions might be. For example. I wear a suit. that tells you something. I wear a track suit... different. I wear a thong. yeah... you know what I'm communicating then. So what clothes you are wearing, is relevent when talking about rape. Because it's asking what you were communicating in an attempt to establish some form of context.

For most of it he's just talking about telling the full story of a rape incident. That may be more damning for the perpetrators or it might give understanding as to why the perpetrator thought it was okay to cross the line. And it's not necessarily that "she was asking for it", but maybe she was giving a lot of implied consent by her words and behavior before she passed out.
My other big takeaway from a lot of these rape/consent stories is the common thread of alcohol. If you don't want to be accused of rape or be raped, make sure you're not drinking and you're not around people who are drinking. It's dangerous to lose control of your decision-making or be around people who are out of control. You might hurt someone or be so inebriated that something happens to you. I think college-aged men need to think long and hard about whether to include drinking as part of their college experience.

It's my right to wave MY money around! Sure there's a small criminal element in society that may want to rob me, I could have left it in my pocket or taken a taxi to minimize potential risk. But I should be able to do whatever I want in public without facing repercussions of any sort.
