Yes, the EU and the North America (all three countries not just the USA) clamped down on the "It's a licence for usage and not ownership of the digital copy."-Bullshit, but the Wii U VC release of SMB3 + eReader Levels was released just before the forced errata in the terms of agreement. Granted a Judge may rule otherwise due to close proximity but we don't have a case yet so better assume the worse outcome.
I originally had no internet in Mario Advance 4. It just looked like the Mario All-Stars version on handheld. Until I found out the Virtual Console version has all the inaccessible E-Reader content unlocked. Didn’t wait to get it.
