The lab that has the patent to make this material only operates in the UK, and will not export any item coated with the material, due to it violating some export law the UK has. While getting exclusive right to use the material was a bit of a dick move, yes, pretty much no other artist would even be able to use it if it was available. This is why we now have MUSOU black, as it can be painted, and is readily available to the public. Hely, be gla even Kapoor has the right to use it in art, the company that makes it, Surrey Nano-Systems could just as well have licensed it to no artist at all.

Funny, lots of huge companies like Monsanto try to own TREES and SEEDS as well--especially trees in 3rd world countries like India. This happens in the argicultural industry a LOT. then they force farmers to pay to plant the trees coming from their OWN country. Big companies do this, always licensing/patenting so they can earn money and prohibit others to earn as well.

The irony of this feud is that it adds to Kapoor‘s fame. I used to live in Chicago, which is where the Bean is located, but nobody in Chicago could tell you who made it, because nobody cared. There was also some racism likely going on, in that Kapoor‘s name is not Irish so people automatically block it out of their heads as soon as they heard it. Stewart Semple saying his name over and over again is putting Kapoor‘s name in the heads of regular people.
To be fair, it also ruined his name with the general public. If you go on any of his social media accounts, the comments are FILLED with trolls calling him “bean boy” and calling him a selfish prick etc. So now he’s more known outside of the art community, but he’s known for a shitty reason. He gained notoriety and no decent person wants that 😅

Some companies patent technology or buy it, a secret recipe in the food industry, or buy rights for a character in the entertainment industry. They do that so only they have access to it.
