Take it further. The IOPC response is nothing more than an extension of the stroppy non legal rules that front offices are trying to work from. The front office filming issue needs some sort of legal testing applied to it, as they are trying to ban legal photography from a public place. This response just renders the IOPC not worthy of complaining to and is definitely NOT independent.
Yes, we definitely need a truly independent body for complaint. Not somewhere that passes it on to their inspector that more times than not will backup his staff.
Hi I O A C, the first point about PACE is completely correct, in the real world must does not mean maybe!. The second point about the part of the police station you were in is a 'public' space according to the official statement and has no relation to the ownership of it, all places that are open to the public confer all the standard rights of citizens in public places, there are no limitations or exceptions. On the matter of your behaviour and their justification for arresting you they must have real evidence of a real offence before they start on you, whatever reaction they manage to provoke while acting beyond their powers during the encounter would not then justify such action, they are told that in such circumstances they are obliged to make every reasonable effort to de-escalate the encounter, failure to do so is a clear breach of their own rules.As this one stands it is yet another clear example where because they are allowed to mark their own homework in this manner they can do anything they like and wriggle out of it, there is no reason for us to suppose that this will change any time soon!, what is required is a completely independent complaints system, it should be funded on the basis of claims from police budgets, so that while they have to pay for it they have no say in it!, this way they would quickly find the best way to increase their funding would be to reduce the number of complaints to investigate. I wonder if your next move has to be to launch a private prosecution against the offenders, this you should only do if so advised by competent legal counsel, this probably best found by trolling the internet for personal recommendations, someone like 'Crimebodge' has a good deal of experience. From the start it is of course entirely up to you how far you want to take this and you alone have to make the relevant decisions, in which case you can depend on my utmost moral support!. Straight to Hnk solicitors from now on, the only plus side to this one is I can demonstrate the pure lies and bullshit they said in the response, which will go in my favour.
