South Shields Police Station - Threat of arrest under section 5 & Town Police Clauses Act

  • www.pinacnews.co.uk - Having a look around South Shields Police Station where I was threatened with arrest under section 5 public order and then Town Police Clauses Act.
    Police staff and Sargent were both muppets IMO.
    I'm not the only person to have problems here.
    ‪@mat12128‬ & ‪@TheTorbinator1‬ had issues here I believe.
    They have violated The Human Rights Act article 14. Allowing you in if you're not recording, but not if you are recording
    Article 33 of the Criminal Justice Act 1972 also says: “Public place” includes any highway and any other premises or place to which at the material time the public have or are permitted to have access, whether on payment or otherwise ”. ( The police station was open at the time, so I had every right to be there)
    Also the NPCC memo on Auditors / Social Media Bloggers also basically says that I am allowed to do what I was doing.
    So multiple failings here.

      Gods - a muppet is a genial, humorous type. I've seen them on the telly and they're always friendly and full of fun. There is no way that grumpy, hostile aggressive cop could honestly be called a muppet. He is an angry shouty moron! LOL

    24:15 Another cop who thinks "muppet" is abusive. It's an insult, but insulting is no longer a valid reason for a section 5 as it was removed in 2013.

    24:35 I bet he was so proud to be able to use the disorderly conduct in a police station section (29 of the Town Police Clauses Act 1847). Except he fails at that too. That's because the law is about violent and indecent behaviour. You weren't violent and you weren't indecent.

      This is relevant, but surely he's no right to trespass a member of the public conducting business in a public police station, that's not his job and it's discriminatory and he's using it to avoid taking a complaint and informing the public as requested

      @@jophillips8230 I'm not sure it's not a right given access is a right, however he chooses to access would be none of anyone's business, and it's not an offence, so hardly grounds for refusing service. Otherwise the cop could say come in here dancing on one leg and singing old Lang syne and he'd have no choice. What about the cop? What grounds had the cop for refusing service?

      That’s true Jo, on social media there seems to be a lot of misunderstanding about trespassing, implied rights of access etc. but as on this occasion he was attending a police station to view the PACE code of practice, which must be readily available at all police stations for consultation by members of the public, throwing him out was completely unacceptable. The filming is niether here not there.

    It’s unbelievable that he’s so causal and unconcerned about failing to comply with a request from a member of the public to consult the PACE code of practice. In any other job, if you don’t follow procedure, you face disciplinary action and ultimately dismissal. The constable even realised that it was some sort of test but still failed. Why do the police take offence at the public checking the police comply with the law, when the police themselves spend their entire careers checking that the public comply with the law?

    Any tenant or leaseholder or their representatives can ask someone to leave a place. But any force used must always be reasonable AND appropriate AND necessary. What would be reasonable in ejecting you from the foyer would be limited to blocking your way. But it wouldn't be appropriate since you were only doing something they didn't like not something that is causing others harassment alarm or distress. And it wouldn't be necessary since it's obvious that you would be leaving relatively soon after your enquires and requests had been met.

    24:15 Section 28 of the Town Police Clauses Act 1847 includes this about profane: "Every person who publicly offers for sale or distribution, or exhibits to public view any profane, . . . F34 book, paper, print, drawing, painting, or representation, or sings any profane or obscene song or ballad, or uses any profane or obscene language". However profane is related to being disrespectful to a religion. And it can't be obscene since it's something watched by children. In any case, that particular part of section 28 was repealed by the Deregulation Act 2015. So the cop is just another one who proves that he's stuck to his training script and not educated himself to the actual law and that he has been re-trained. So a failure on his part personally and the whole force too.

    Check the Land Registry.. and stop making stuff up about section 33.
    Auditors DO an important task bringing the police to account but when you get the basic fact completely wrong it demeans your credibility.

      It defines "public" for the application of offences. But we all too often hear "section 33 gives me the right" and "section 33 says", when it doesn't.

    S33 CJA 72 says you have an implied right of access if you are conducting lawful business with the property owner or tenant. What lawful business were you conducting with the police (filming them doesn’t count as that is business you are conducting with yourself)?

      S33 is a red herring which people keep misinterpreting. He was conducting lawful business though, as the public have the right to consult PACE code of practice at any police station.

    The officer on the desk is correct, it is a private building with implied access to people that can be revoked at any time. It is nice to see that the police have made themselves aware of the appropriate legislation as it is written and not the imaginary rules Auditors made up which are simply a copy and paste of those used by American 1st Amendment Auditors

      @@johncummins3860 Public Access has nothing to do with the Criminal Justice Act 1972 Section 33
      Public access is the right to enter property or land. You have the right to enter property or land but do so on condition you agree to abide by the "rules of the house" and instructions of employees/owners, if you refuse to stop filming they can then order you to leave revoking your right of access and declare you a trespasser if you then refuse to leave
      Your are welcome to prove me wrong citing the relevant legislation and acts of parliament

      @@Hellstorm901 We’ll start with the legality, it is NOT illegal, it might be against their POLICY but policy IS NOT LAW and does not have the force of law and ignoring policy does not violate law. Violating LAW is a crime. With that said, if it is privately owned property like most malls I am aware of then they CAN order you do leave under trespass laws and you must depart. ONLY after you refuse to leave can you be considered to have committed a crime. They can do this for ANY or NO reason at all. But this ONE THING you must comply with.

    It's a private building. True. But so is every other single building in the country. But the public enter thousands of such private buildings every day. And thousands of pieces of land that is private from waste ground to footpaths to carparks. And there is nothing in law that stops people using their camera in such private buildings be it a shop, a garden centre, a DIY store or a theme park.

    Muppet! Really? Foul and abusive language. That’s the 2nd time I’ve seen an auditor threatened with arrest for calling police a muppet. I looked up whether muppet is a swear word but there’s no definitive list in law but the BBC lists it’s consideration of swear words & muppet ain’t on it. So if it can be a swear word it’s gotta be pretty damn mild at best.

      There never has been a single successful, upheld complaint or legal action for an auditor being removed from police property. Several for unlawful arrests and searches though.

      ​@@budgetnuclearweapons7858 Lee Tench v Cheshire Constabulary 2021, Mr Tench was fined and issued a Criminal Behaviour Order for 5 years for Aggrevated Trespass on police property after repeatedly refusing to leave police property when declared a trespasser which he argued was "public property"

      Thanks for that. The number of auditors that blindingly refuse to accept "fact" when there's overwhelming evidence, is astounding. I know they don't like it, because it doesn't suit their agenda. And its what UK auditors have been saying for the last six years. But...at some point, theyre going to have to accept that police stations ARE private property.

I know really speaking it's the only part that lets this down a little.. I have been kicking myself about it and i wasn't sure if I was even going to post this but I said to myself that I would never hide mistakes or errors and that I would learn for it.       Maybe you’d like to fully explain what he said rather than citing prejudiced sound bites.
      He didn’t say that there was a absolute boundless right to free speech. He said that the parts of the legislation he was referring to (The Communications Act) hadn’t been intended to criminalise speech and so had been misapplied in that case.
      It is beyond doubt that the right to free speech is bounded. You can’t pick and choose bits of legislation to make your argument while ignoring the rest.

    I'm a retired police sergeant I am so embarrassed by officer Muppet. As you rightly said as long as there is no member of the public in earshot a police officer is deemed sufficiently robust to not be alarmed, distressed or harassed by swearing. Muppet is not a swear word it is considered common vernacular. Crimebodge, a renowned auditor and legal wizard, was hounded for weeks by a very fey constable for calling him a sausage. The case was dismissed with sniggers all round. The MET appealed two section five's all the way up to the Court of Appeal only to be politely told to grow up, go away and stop wasting taxpayers money.

      I actually love the fact that the sergeant and desk officer are fully aware of the actual legislation and not the imaginary laws Auditors make up
      Fun facts most auditors either don't know or don't want their followers to know. Section 33 of the Criminal Justice Act 1972 actually only applies to highways, public footpaths and places such as parks. Also the "Implied Access" law the auditors like bringing up actually has nothing to do with filming inside buildings. Implied Access was actually created firstly so that you could enter a business and conduct trade without having to get permission from the owner to enter the business every time you want to go in and secondly and most importantly to resolve rural disputes between hikers and farmers where a hiker may accidentally trespass on a farmers land unintentionally. Implied Access means that the farmer can't prosecute you for trespassing because you genuinely thought you were allowed to make peaceful travel across their land
