    • @kayladawson6871
      @kayladawson6871 Рік тому

      Sure, but isn’t one of the questions if JD published the statements?

    • @johnny_rook
      @johnny_rook Рік тому +7

      The 2nd Waldman statement was not about Amber exclusively. Besides the police, Waldman also mentioned Amber's friends, her publicist and lawyer. Depp legal team was not able to prove the 3rd parties were involved in the hoax - even if they were, there was no evidence provided to the court. Anyways, the jury concerns are not about the hoax or Amber's credibility.
      If I have any criticism on the verdict is that I don't think AH lawyers proved beyond any doubt, that Waldman produced the statement as a representant of JD. I don't know if the jury interpreted the facts differently than me and/or if the jury instructions weren't clear enough (we all know how AH team played dirty on that final day). But, one thing I'm sure: if there's any reasons to appeal, it's about this (the 2nd Waldman statement), and that's on JD's side, not AH's. The jury pretty much closed all of AH's appeal doors by answering YES to every single one of JD's questions.

      ABSOLUTELY RIGHT!! When you listen to that specific statement (written by AW) regarding the 2 police visits and the scene of AH and Co messing things up for the 2nd visit didn’t corroborate with the evidence. I could see her “winning” that statement. After watching the entire trial, the evidence, in my opinion, was that AH and Co DID mess things up, for photos, not for the 2nd police visits. So yes, that was a correct Jury decision as this is a defamation case.

  • @krinapple

    • @vonbonbonjager
      @vonbonbonjager Рік тому +14

      I agree but I also think it shows how much work these jurors did to make their decisions. They didn't show favouritism over either parties. It doesn't matter what AH try's to spin about women's rights and freedom of speech , neither of this has been changed because freedom of speech does not provide immunity to false claims. The majority of people can see their relationship was the worst combination of toxicity and troubled individuals. I have no doubt both of them behaved appallingly but he did not beat her or SA her. What "needs to change" is convictions without reviewing all evidence, MSM and the public need to learn from that.

      Nope. I hate that she won anything, but it kind of made sense. Because the 2nd lot of cops came out and saw no damage to penthouse, so how could they have spilled wine and roughed the place up at that point. I mean I believe they did, but it wasn't at the point the police came the 2nd time around. The body cams showed no damage so it would have looked bias if they hadn't taken that into account. But in comparison to Johnnys win, and the severity of the defamation is huge on Johnnys side. So he won no doubt. But I don't think she should have won because there was no proof Johnny had anything to do with waldmans statements IMO.

    Before the Depp v Heard Trial, Legal Eagle was the only youtube lawyer I've ever heard of. This case sure is a boon to the lawyer community on youtube, and for me, you are, by far, the best of them all because 1) you aren't an out-and-out "DeppHead"; 2) you aren't clickbaity, which is the case with DeppHead channels, even those owned by lawyers.
    Anyway, there was only one thing Legal Eagle said about this case and it was that the hurdle JD must overcome in a US court to prove his case is much, much, much, much, much higher than in the UK court system. Legal Eagle seemed to think that it was a foregone conclusion that JD would lose so this is some kind of a miracle and I am so happy to see it and grateful for your unbiased coverage. The jury question to the judge yesterday made me real nervous because it indicated to me that there was dispute meaning there was at least one pro-Heard juror. The one statement that Heard won on her counterclaim strikes me as appeasement for that juror or jurors -- it was the least bad one (i.e., not the ones that said Amber's claim were a hoax) and there was room to say "so they spilled some wine and roughed up the place" was actual malice even though Waldman may have believed it because he wasn't there so how could he know about spilling the wine and roughing up the place? So it's not that big a stretch to say that part was reckless disregard.
    I don't agree with that but it certainly works as an opening to appease any pro-Heard jurors. And Depp can always maintain that it was Waldman's words, not his, so court of public opinion still goes his way on it.

    So the jury didn’t find that JD’s lawyer had any basis to state AH & friends were coached on how to rough the place up by her divorce lawyer and publicist. Therefore, they found that statement to be defamatory. That’s my take on it. But I can’t wrap my head around how they can find agency when attorney-lawyer privilege stops them from being certain there was any agency…

    It seemed like they overall believed Depp's facts and deliberated accordingly, but they thought that, regardless, the statements made to the DM did hurt her professionally and 1 out the 3 (the one about her friends, the conspiracy, tricking the cops, spilling wine on purpose and staging a crime scene, etc.) was *false or not proven truthful with overwhelming (?) evidence*.
    It makes sense to me according to all her friends' testimonies and lack of substantial evidence: they would have had to deem them all liars and criminals who conspired with a lawyer if they overlooked the seriousness of that statement.
    It makes complete sense they didn't consider that statement proven as true and considered it defamatory more than the general concept of a hoax, as it was accusing a group of people of staging a crime for years and trying to trick the police into it, with involvement of a corrupt lawyer. That's a huge crime and if not proven true, it's actually hella defamatory.
    Depp still won big time, the fact that his lawyer shit the bed, luckily figuratively in that instance, with one of his statement years ago doesn't change that.

    • @timblizzard4226
      @timblizzard4226 Рік тому +2

      I don't know how anyone could consider this anything less than a sweeping win for Jonny. I think his primary objective here was to clear his name. He did that bigtime. I'm not even a massive Jonny fan, you know I liked his movies, but I liked Kevin Spacey more and that guy seems to be a total creep. I thought it was totally possible that Jonny was an abuser. But after listening to all the evidence, the audio recordings, the testimony of the people who worked for them, it was just crystal clear who the abuser was, and who was lying.
      Defamation is a very high bar to cross, especially in a case like this where, in terms of her allegations, the jury had to conclude that she was lying. That's tough. All they have to do to find in her favour was believe that she believed she had been abused. The fact that they found for Jonny at all means they concluded that she was lying, and that she did so maliciously. How is that alone not a gargantuan win for someone who's career and reputation was taken from them by this woman?
      That the jury found that Depp's counter-accusations about staging a crime scene were defamatory too changes nothing about the impact this has for him. In the end, she owes him $8 million bucks. Maybe Elon will handle the bill, that is until he's in court with his own defamation trial against her.

      @@timblizzard4226 I don't disagree about this being a win for Depp, as I mentioned.
      I'm in the industry and I like him fine as an actor (more in the early Tim Burton films and more serious picturse than the franchises, which I really don't care for), but I definitely like Spacey better (I don't recall what he did tho') too as far as acting chops go, hell, I even must admit that Weinstein, regardless of the criminal creep he is, has been a revolutionary figure in US cinema, bringing quality pictures that would have priorly been niche into the mainstream, but this is not about that. I don't like celebrity culture and I have no sympathy or kinship with the groups of startruck GenX women bringing alpacas outside a tribunal.
      I'm interested in the backlash of the metoo movement tho' and and how trials by the media sent many artists (like Woody Allen or Louis CK, you can disagree on their innocence, but those are a examples I'd personally give) running to Europe, in the best of cases, which is of course a shame for them and the people who enjoy their art, but more so for unknown people who fall victim of false accusations or, and the number here is larger, the actual victims of SA or DV, who see their pain trivialised and used for clout.
      That to say, I'm glad Depp won a very difficult case, but I simply mentioned that I do understand the reasoning of the jury in finding that one specific claim out of the three Depp's lawyer made defamatory. To me, it even reinforces the notion that they actually weighted the evidence and didn't deliberate because of likeability.

    Questions:
    1- why didn't the jurors get clearer instructions about the $350K cap on punitive amts? I'd be cranky if I were one, I would have bumped up the compensation part to factor in the full amount I wanted awarded. By awarding $5M in that space meant they did not understand the cap, maybe it should have shown the range $0 - 350K.
    *I didn't watch closing arguments but heard AH lawyer ask the jury to award $350K. I thought to myself, they've gone from $50M to asking for that?! Wow, they're really discounting to factor in the "we are screwed...scenario". so I myself didnt know it was capped.
    2- I wonder how the jury will feel now that they can look at online & other information not allowed or brought into the trial. And that people have been watching their every move & reporting on it. Kinda creepy.
    3. Firstly I know this doesn't matter at all, don't hammer me on it but did she come into the courtroom way more glam & hair dyed? It made me feel like this is all a big PR opportunity. good bad any press...
    4. Can she blame the ACLU now re; ghostwriting and it wasn't her fault. Someone/thing has to cop it, I don't think she accepts responsibility much.
    I'm not 100% on this but didn't AH's win have evidence from LAPD that 911 was not called 2xs like his lawyer said? Sort of conspiracy theory re: PR & a lawyer being involved too....
    JD's lawyer testified he had an in-person meeting with the UK media (ouch), JD testified he may have been present. Her team must have had the evidence to justify winning that claim, the agency argument and/or him possibly being there for a planning mtg. The $2M award is a rational imo, based on her historical earnings in a major movie paycheck. She never had aquaman3 in the bag (no option, bad bad bad contract) or any other gig paycheck to justify the $ she wanted.
    Crazy yet interesting case to see how the legal system works.
