Well if the new evidence has previously been held back by the prosecution I would say it's flaky evidence and at the time of the case proceeding was deemed unnecessary to include which brings me to the conclusion that the case is falling apart and now the prosecution want to try and throw this extra stuff in however if it was so weak to begin with that it didn't warrant consideration then I fail to see how it could possibly influence the outcome as the case stands
