  • The plaintiff dated the defendant, and the two have a child together. The plaintiff says he gained full custody of their child after the defendant left their son in her car while she went to a casino to gamble. He’s suing for day care expenses and emotional distress, and he also petitioned for a paternity test. The defendant admits to leaving her son alone in the car. She claims the plaintiff assaulted her and she hasn’t seen her son in several months, so she’s countersuing for emotional distress.

      Possibly, but I find it hard to believe that she didn't display red flags during the dating process. He intimated that he knew when he mentioned "she showed her true colors". This woman is unbalanced.

    A mother should never leave her child unattended - especially to go to a casino. Shame on her. I hope she gets help with a therapist and attends parenting classes. I feel so sorry for their child - that poor kid. God help them all.

      @America Love The Mother was having her visitation time with her child, and She was the parent who decided to go to the casino and leave her child in the car while she went in to the casino to gamble instead of doing the responsible thing and either staying at home with her child, or getting a babysitter to stay with her child at home. The Mother left the child unattended sitting in the car By Himself. That was totally inappropriate and wholly irresponsible on her part. The father was not part of that visitation scenario - he was having his time off from his child. He didn't leave the child unattended - the Mother did. Shame on her.
      And yes, agreed that No parent should ever leave a child unattended in a car or at home...
      ...but this case was about the mother's stupid decision to put her desires (gambling in a casino) above her child's needs. Shame on Her.

    I can't even wrap my brain around why a non impaired, mentally stable person, could leave their child in a car unsupervised... To gamble at that. So something is off with her.
    Yet, I find it crazy how men can do the same thing they accuse women of i.e. Withholding the child and bringing strange women in the home around their child etc 😏

      Who is non-impaired and mentally stable? I try not to take sides based on gender, but it would take a lot for me to let my child be around someone with the kind of judgment that the mother demonstrated. Also, how was the woman strange? Strange to whom, her?

If they actually had an agreement not to do that, then why renig, record, search emails, but never get a court ordered child support contract. She did not portray herself to be a drug addict in court, and no mention of drug use was involved regarding her negligence in leaving the child in the car. Asking her if she was using drugs at the time would almost certainly end in a denial by her so as not to look worse than she already did. Furthermore, police probably would have noted her appearance and possible drug influence in a police report if anything was notable.
      You'd be surprised how many sober women do this during the day when they run into stores to run errands and Dont "feel like" unbuckling, removing and carrying a small child just to go into a store to get things, then lose track of time shopping or talking. Most of the time, passerbys will report seeing a child in a car to police, but the mother will return and drive off before police arrive.

      @@odog76543 .....she left her 3 year old in the car by himself to gamble....when questioned ....twice...she said she had no excuse or idea why she did it except to say she was in a bad place....it would have been more understandable if she said she was impaired and she would have gotten empathy....the way it stands ..and the judge questioned her and then mocked her...is the fact that she is off mentally...everything she has been doing...and not doing has been at the expense of the child....which is why the dad has custody of the child...and she resents him for that....even the judge had to check her for that.....

      She literally said “I didn’t feel like I had support and he was in the Dominican Republic.” So she essentially like the judge said punishes the child because she can’t have that man.

    Why would he specifically call her over to get her son when theirs another woman there.I believe he set her up for a recorded reaction to use in court. She wrong but he wrong too with the petty ah ha I'm in control type of behavior. She needs alot of help,counseling support and so on before getting the child back or joint custody for the child's safety.

    This version of JM is the 1 that makes the show enjoyable. He acted like a real judge, taught law, asked great probing questions of both parties. He didn't let his *opinion* of the litigants *influence or bias his judgment.* It's an unfortunate case because they are both young, attractive & seemingly intelligent. They both have parental support & hopefully can find their way back to a union w/effective mentoring or at least a way to effectively co-parent. So tragic, for their son.

    I’m confused why he’s denying visitation when it’s supervised. If the child stays with the grandmother often, let her monitor them and it’ll be in a comfortable environment for the child.
    If she’s that unpredictable (which sounds very possible), get the law-appointed person to do it.

      It sounded like his reason for refusing was because the child is usually with him when she attempts visitation and many times she will be dramatic and refuse to leave just like she showed in the recording. It seems to me that she is one of these women who is more concerned about what the ex is doing than her own child. And her lack of concern for her own child is already proven by her child endangerment conviction, leaving a 3 year old unattended in a vehicle in order to gamble while admittedly going thru financial issues. Someone like that should hardly be trusted to be civil and reasonable.

    HOW DARE ya’ll women sit in this comment section and say he’s the problem! That man can have whomever he wants at his home so as long as that party isn’t harming the child! This woman appears to be well put together and she left her toddler in a car while she gambled. Gambled! Not something that she needed to do, but wanted to do. She wasn’t running in the store to get milk and pull-ups. She wasn’t interviewing for a job. She wasn’t pumping gas! She had no clear explanation of why she did what she did and no real remorse. Courts rarely hand over full custody to the dad! Most courts fully support mothers, so for yall to sit and skate over this woman leaving her baby in a car when he could have suffocated and died or been kidnapped is so typical of women not holding other women accountable. Im glad he recorded her. She could have came over, kept her cool, picked up her kid and texted him about her feelings later but she sat right there and acted a fool. Police don’t believe black men, so he better record it to protect himself! Ya’ll gotta cut that foolishness out!

    The main question is will she learn from this? looking at her face when JM pour into her...something tells me up until that moment she had never taken accountability. She had one of those oh shiiiit facial expressions where something finally hits you.
    Its moments like this where you are force to look in the mirror and finally accept the BS you bring upon yourself...and do something about it. Eventhough she has made some really bad choices she can redeem herself but she gotta do the work.

The possibilities are endless when it comes to leaving your child unattended even just for a minute because in a minute something could go wrong and they are only innocent.     I believe she was in a very bad place at the time she left her baby. She probably thought that the baby would be okay. She DID pay for her mistake with the arrest and the awarding of full custody. Okay having said that. The father sure did set her up. It was his way of retaliating after she won split custody of her son. He invited her over and was pushed to pretty much begging to be heard. I don't know how the judge heard screaming and yelling in that audio. He coincidentally happened to record himself telling her to leave after he called her over there to watch their son while he went out on a date. I believe her when she said he choked her.
    The judge overreacted condemning her when she had a right to point out the father's negligence about their son but the judge stopped her. Why? Men do that silly move all of the time. They want the upper hand and so they torment the mother withholding visitation to punish her for winning split custody. He planned that piece of audio evidence just so he could play it in court. HE SET HER UP! I believe she is in a better place now and deserves to be in her son's life. She wasn't on drugs and she could have received counseling since. Single mothers are often pushed to the edge when she has no one to help them. This is a need in our society. It could be a non-profit organization that helps relieve mothers giving them respite from day-to-day challenges.

    Decided to move on and find a replacement. Not help the mother of his kids get the help she clearly needed. That recording put him in bad light, for me at least. I agree he did it to trigger her.     The plantiff is not 100% innocent. Why even call your ex over while you have company?! It's giving troll vibes, and given their circumstances, I would've just dropped my son off to her. She, however, leaves her 3 year old in a car alone in a parking lot surrounded by strangers coming and going but had a problem with the company her ex is keeping while he's with the child?!     So, The bih is sensitive about his son being around another woman.. but HAD NO FEELINGS ABOUT LEAVING HER 3 YR OLD SON IN HER CAR ALONE WHILE SHE WENT TO PLAY INTO THE CASINO..
    SHE SHOULD'VE GOTTEN ATLEAST 1 TO 5 YRS.. CUZ HELL NO!!@.

    She made a terrible choice by leaving her son in the car. However, I didn’t hear any further concerns about her behavior, that may be triggering. She should be given an opportunity to be a better mom. He definitely plays in her face, and has the advantage based on the choice she made, but it shouldn’t be used in a malicious manner.

      It should only be honored if she is stable minded. As long as she keeps behaving badly, he shouldn’t have to subject his child or himself to that instability.

    That Chick said... She left her child in the car.. while she went inside a WHOLE CASINO, because she felt like she wasn't getting the assistance she needed.. so she was mad..

    SET HER SON UP & LEFT HIM.. SO THAT ANYTHING COULD Happen TO him..

    She’s wrong as the day is long for leaving the baby in the car alone to 🤬 gamble
    He’s wrong for calling her over to get the baby knowing he had a woman over knowing how she is. Just to get a rise out of her and record her.
    How’d he JUST NOW come across an email a month ago from when she was pregnant 🤔
    He’s not showing up for court and they now have joint custody let her see their son.
    They BOTH need to grow tf up period.
