    I was a Sheriff's Deputy, (Road Patrol) and then transferred to the court as a Court Deputy (FTO). If I learned anything from my 7 years in court it is Rule #1 = "NEVER EVER TALK TO THE POLICE WITHOUT A LAWYER....EVER". Detectives can spin a "Good Morning Detective" into a guilty narrative for an arrest affidavit! Rule #2 ="If ever in doubt, see Rule #1. A lawyer may cost you $$$$ upfront, but it can save you years of your life and in the long run, even more, money wasted trying to undo the damage you did by innocently flapping your gums with the detective in the first place. He is right, Detectives create a theory of the crime and then try to mold your babbling narrative to fit their theory. They don't care about you, THEY DO CARE ABOUT MAKING ARRESTS and closing out cases.

      Really? My police department like to do nothing but eat donuts. I was stalked for 7 years with evidence of the stalker leaving stuff inside my house. They did not ever call the person whose handwriting was left inside my house. 20 + illegal breaking in - all my stuff from my grandma & grandpa. My personal sentimental items. They couldn’t care less.

      @@Poppy-yx8js My point was don't talk to the cops without a lawyer. Not that cops "in some jurisdictions and cases" are lazy donut-eating oxygen thieves. But, I cede your point as I don't know where you live or what agency you are under.

    The very fact you need lawyers is a sign the system is broken.

      Its fucked up that you are making a mistake to directly face your accuser.

      Ehh idk about that. The system is very broken but I don't know if having to have a lawyer is an example.

      The fact that we have a right to legal representation is a sign that the system is actually working. When we no longer have that right, then it's broken.

      Get a bad attorney that won’t listen to your story then fire him before the case is tried 😂😂😂YOU WILL MAKE A KILLING.

      If you don't have the money to defend yourself, you're automatically guilty.

    Isn't your attorney also your agent for purposes of dealing with the police, and as such doesn't your attorneys fall under the party opponent via an agent exception to the hearsay rule. So how do you get your attorney to make statements for you that can't come back to hurt?

    • @xxstrawxx
      @xxstrawxx 8 місяців тому +1

      My amateur understanding is that this is correct. I don't know of any way for your attorney to make statements on your behalf without what they say being able to be used against you. However, your attorney should not really be saying anything incriminating you to the police so this is (as far as I know) not generally an issue.

    That’s true but they cross the line and lie but you can trap them . There recording you and ask them there name and if you can verify your badge . There trying to get hearsay on you why don’t report a crime at the same agency,😅😅😅This is a good advice .

    So if I was pro se, wouldn't all my communications with the police and prosecutor during discovery be hearsay?

    • @xxstrawxx
      @xxstrawxx 8 місяців тому +1

      There's an exception. Anything you say, can and will be used against you in a court of law. Look into the statements by a party opponent hearsay exception, amongst others. It is important to note that you are correct about it being hearsay (assuming what you say is offered for the truth of the matter asserted) and that the exception does not apply if you want to introduce the statement at trial to help yourself. What you say can be used against you, but cannot be used to help you. Being pro se is not some legal loophole for incriminating yourself without consequences.

      I would say use this as motivation to figure out what you want to do in life that is socially good, and then ask all the people you meet for advice in getting there, and if they know someone who's skilled in that area.
      I say this because it helps if you can demonstrate you won't repeat the same actions again by saying you have something interesting going on you don't want to lose. If it is taken away, you still have something to look forward to upon the next opportunity.

    Even if you don't answer questions they can still arrest you it doesn't matter I hate when people say don't talk most people can't afford a lawyer so what do you do in these situations you need money from lawyer too unless you have public defender
