    I’m only 20 minutes into this video and it’s stressing me out so bad that it’s giving me a stomachache, yet I can’t turn it off. The judge and lawyer are both so rude. I can’t imagine being a witness and having to only say yes or no when the answer isn’t a simple yes or no. I’d be so afraid to say the wrong thing - like how they yelled at him claiming he lied about how well he knew the girl. I feel so bad for this guy. I watch these types of videos every day and I’ve never seen a witness treated this way. Telling him he’s making it more difficult than it has to be. It’s not like this guy asked to be there. Most people have never had to be a witness in a trial before. It’s probably extremely nerve wracking and this guy is doing the best he can.

      Agree agree agree! This is ridiculous and something should be done because witnesses have zero recourse, yet court officials can smear them make false claims and speak to them in a brutally hostile manner and if they don’t take it all- they’re in contempt. Nope nope nope!! Grrr!!

    • @ChrisP3000x
      @ChrisP3000x 2 роки тому +22

      Every single time, it should have been a simple yes, no, or I don't know. There was no gray area in any of those questions. Kyle kept attempting to give extra context to WHY he said yes or know. No one has time for his life story on "Did you ask anyone to cut limbs?". When he asks: "what time did she get there?".......the answer is either 1) the time, 2) or "I DON"T KNOW". They may ask him later WHY/HOW you do/don't know the time.

    • @KingOfFvckingEverything
      @KingOfFvckingEverything 2 роки тому +11

      Agree however, it’s the game. A witness is confusing the matter by adding his version that is not being asked for.. it’s the nature of us wanting to do so and I would do the same, wanting to add context so the jury, people understand what I mean. Saying just yes or ni sounds nonchalant to the commoners, who have never been in trials. You ares there to help, to give your story but that’s not really how it works. It’s not story time.
      Having said all this, the jury looks for credibility of witnesses and when people are trying (like this witness) it describe the event further, they see him more credible than someone who would just sit their cold stained saying yes or no.
      I think legal teams and judges have become deaf to that, they forget what it’s like for a normal human being. Some of which have maybe tried to have been set up by the dependent, which is looks like in this case so far, that he lived on the property and she decides to hide a body there. So bizarre..

      It is a hardship for many people to be jurors. Judges want jurors to be rested and ready to deliberate. If defense and prosecution give an estimate of how long the trial will take it shouldn't go much past that. It is their job to make that estimate for the judge and jury. It's frankly in the defendant's best interests to have a jury that isn't stressed and rushed and who haven't sat there days longer than projected. They will do a better job of deliberating. I wouldn't want an exhausted jury or stressed because of days and days off of work without getting paid.

When I was practicing, I had upcoming trials in several courts. I couldn’t just call the court and tell them we ran over so I could not appear when I had already agreed to. Judges need to keep everything moving along. Imagine how you’d feel if you were rotting in a jail cell waiting for your trial date. The courts are clogged with upcoming cases, and every defendant has the right to a speedy trial. Take the time to attend a few trials, that’s the only way you will understand how this works. Never ask a question you don't already know the answer to. So say police & trial lawyers. It's not a good idea for a trial lawyer to be taken by surprise by anything that comes out of a witness's mouth. The only way to ensure this is to limit responses to just yes or no, to prevent a witness from saying anything that deviates from the (prosecution's or defence's) prepared narrative (regardless of whether true or not).

      @@croach2194 The Casey Anthony and OJ Simpson verdicts had _nothing_ to do with "unfocused" jurors. Yes, the O.J. jury spent a long time in sequestration, but members of the jury, including the forewoman, have already admitted to the reason for the verdict: retribution for Rodney King, and the opinion that Nicole Brown Simpson "took" one of "the good ones" and thus wasn't deserving of sympathy. The Casey Anthony verdict was a combination of an unusually unintelligent jury, an overconfident prosecution team who overestimated the jury, and a fundamentally corrupt defense attorney improperly and unethically manipulating the jury. Certainly, neither case was affected one way or another by taking a weekend break. (The Robert Durst jury recessed for a _year and a week_ and were still able to judge the case and render a verdict that basically no one disagrees with.)
      Regardless, despite the fact that the judge has jurors to think about, the defendant's rights are _paramount_ in any criminal trial, and concerns for jurors -- particularly concerns like "we promised them they'd be done before Labor Day weekend" -- are inherently subordinate to the rights of the defendant during the pendency of the trial.
      (Also, "grandstand" is a weird way to put it.)

      This is a murder trial. A person had their life taken from them. Another person is facing life in prison. That is the most literal example of “peoples lives being on the line”. The pursuit of justice is not something to take lightly and rush through. Rushing a murder trial could possibly end up causing a guilty person to walk free or an innocent person to go to prison. They should have either planned to wait for the storm to pass
      and/or moved the entire trial to after Labor Day. If for no other reason than to avoid the chance of the verdict being thrown out and a mistrial resulting from the rushed process.

      I believe she could end up with a hung jury because the judge keeps interrupting the witnesses testimony, and badgering them to “yes or no answers “. and factual info is being left out Or else the defendant could end up with new trial on appeal due to the same This is a murder trial and this judge only cares to rush through it. I would be very upset if I were this victim’s family, the prosecution, the community, and the defense if she does this to their witnesses as well In the testimony of Kyle Britt, on cross exam, the defense lawyer asked him a question regarding if the defendant was acting usual on the day of the alleged murder Kyle tried to say that he didn’t know her well enough to know. He tried to say he left for school soon after she arrived. The judge kept interrupting him as he tried to explain. The defense attorney hit him hard for a “yes” answer he had given to a question of the prosecution ( given said “yes” answer because judge badgered him
      at the time ). It made Kyle come off as not credible However, if you paid close attention you could see it was the judge blocking his answers So frustration

It's annoying, I know... but it usually doesn't matter because the prosecuter then re-asks the questions anyway so he can finish his answer. And to be fair, Kyle clearly feels she's guilty, is unhappy with her personally for other reasons as well, and his answers were reflecting that (and seemingly on purpose). The younger lawyer called him out on it once too. Anyway, all of the previous reasons are exactly the reasons why they're only supposed to answer the question directly.
