- This homeowner FREAKED out and is now Trying to sue me after ive been at her property for 4 days straight free of charge!!! So this video was supposed go be a fun video of me and AP collabing on this awesome yard that was super neglected and had a CRAZY overgrown driveway that took the majority of the day to makeover BUT THERE WAS A BAD TURN IN THE PLANS. We mowed most of the yard and only had the sidewalk left when I got a ALERT on my phone of this homeowner threatening to sue me!! She gets very heated and I tried to defuse the situation which I usually can in most but she wasn't having it and wouldn't even give me a chance to talk then kicked us off the poperty. On the other had this Yard is a amazing transformation and I one rotten apple don't ruin the good deed that was done and hope y'all enjoy.. Boy, you got that right ! Her saying it had pink flowers on it really causes serious doubts in my mind. We know Al and AP are always careful about anything that may be a deliberate planting. And for sure if it had flowers blooming they would have stayed clear of it.

I am a gardener, unless you dug out the roots it will grow next year and how could they see it through all the weeds and grass. The other thing, they said it was gone on other side too, when did she check it, she waited to complain when everything done. Very ungrateful people. Thank you for being the kind person you are, I find when you are kind, people think thats a weakness they can attack taking their frustrations from something else out on you. There are all kinds of nasty people out there and she is at the top of the list.
I am so glad you put this information in! Because, I could only think of one reason someone might act that upset. If it, yes, was a well developed plant/tree that someone incredibly special to her had planted. So, this answers that- if her mom planted it before she passed or something. The fact that it shall grow back is wonderful to know!

Accidents do happen, it is a common annoying problem with landscapers. I do my own now. I feel for the homeowners because I too love gardenias.. Maybe there should be a red flag placed to help remember. You guys are great regardless.
I'm a disabled veteran and recently someone took my garbage can to the curb for me. It's the little things in life that people don't seem to appreciate anymore. I appreciate what you do. I wish you guys were nearby as my backyard needs help lol. I have a lawn crew, but they only cut the front lawn as the backyard has overgrown on me. I was quoted $250 just for one side of the backyard 😮
The lady neglects her yard for years and complains about her gardenia? You couldn't even see it! Maybe you can have your attorney draw up a release for the owners sign before you start the job. That should protect you.

You did a great job on that makeover - it was badly neglected beforehand, and was a total eyesore from the street, but you made it look so much neater and tidier. You had apologised and offered to replace the damaged plants, so what on earth was her beef about? It's not like she had paid you for the job - but she was sure as hell trying to make money out of you!! [Who could even see the bloody gardenias anyway, when it was all in such a mess!!] Keep up the good work boys!! 😘

There are plenty of sleazy lawyers that will be happy to sue anyone for a percentage of the settlement, the more money they win for their client, the more money they make for themselves.

I'm pretty sure if she can't afford to hire a lawn service or buy a mower, she can't afford an attorney. She wanted her 15 minutes of fame. Al don't let one bad apple run the bunch.
If a lawyer feels the case is easily winnable, they work on commission. They get a percentage of the settlement IF you win. Otherwise nothing.

Even if there were enough damages to make it worthwhile to sue, the next question would be does the person you're suing actually have the money to pay if you win? She's just threatening. The best she might do is win a bit in small claims court, but even that is doubtful.
You guys do great work but township I live in you wouldn’t have had to do a thing. One complaint and they would have had an inspector out there and she would have been given so many days to clean it up. If she didn’t comply when he came back to inspect again then the township would do the job and send her the bill. No ordinance’s here? 😲🏚. 👏👏🤘💯

I have always enjoyed doing my own yard work and took pride in the hard work & sweat it was to keep up but now I'm disabled and handicap I cant. I would be so honored to have someone like you out of the kindness of your helping others. In my rural area there is no one that's does this type of charity work. hat's what I'm saying. This family is trash. If something was serious enough to sue, they go get a lawyer and the lawyer serves papers and requests items from their client that will help in that lawsuit. They don't engage in personal harassment campaigns and yell like children.

It sounds like a scam, because of how she waited until completion. She was under threat from the city for violations, right? Usually how they proceed is to serve notice as they already had, then they fine you, then they'll send a crew out to mow and such (with NO concern for damage to decorative vegetation, they'll just remove EVERYTHING), then they'll bill you for that service - and you still have to pay the fines. Seems like maybe this happened to her in the past, and this time upon notice being served, she worked out a way to get the property mown for free, and is using the lawsuit to get money to pay her fines. Even IF she goes through with a lawsuit, good chance with evidence including this video, that they'd throw it out. I'd even suggest possibly countersuing for the scam and things like defamation or whatever could be pursued for trying to destroy part of his livelihood (I'm sure the UA-cam channel helps him make money).
Why waste time researching into any of that stuff?🤔
Any case would be mediated easily once the court is aware that the individual accepted the free offer,
have them permission,
and especially when he offered to replace the plants.
The one thing he does need to keep an eye on is any bogus BBB complaints the individual may post if he is accredited with the service.

If she genuinely cared about her gardenia, she wouldn't have let it suffer in that jungle of a lawn. Even if she does sue you, she really doesn't have a case. No payment was exchanged, she agreed to the service and you offered a replacement all on camera.

That’s EXACTLY how I saw it! If you have a plant you’re so PROUD of, you’d be showcasing it! All plants are weeds, unless you cultivate around them and establish a garden spot. As a Master Gardener, I would recommend she encourage the new growth on the existing roots….or just let it go , like you had been doing.

The thing with lawsuits is that to fight a lawsuit a countersuit doesn't cost particularly much more to include in the response. Document the harassment and do exactly that... Defamation. Also make her prove there were gardenias there in the first place. I don't even think they can do that. She may has well said "My pile of diamonds is gone!" ... Just a load of bollocks!

I think the property was green as fuck and not dead as he claims. I see majority of yard is green. He is mad he is being held liable for his own actions. For 4 days they were terrorized to afraid to confront. Than after hiding for 4 days she comes out and reasonably gets upset you fuck uo her plants
Don’t stress about it too much. This only a minor speed bump. Could be much much worse than cutting someone’s flowers. As if they even cared about them. Their yard care was proof of otherwise.

Her yard was so massively overgrown, if there was indeed a Gardenia there, you would have seen it. She is probably making a false statement about a "non-existent gardenia", so she can claim she is going to sue you to make money off of you. You and AP worked very hard and did a great job cleaning up her yard for free.
She can sue but she's not going to get much more than a new plant and maybe the cost of having someone plant it. She can't even get attorney fees. He offered to replace it. It's not like it was a full grown bush . It was hidden in the grass it wasn't that spectacular. If they were that concerned they should have stop watching Honey Boo Boo reruns and went out and marked it out.

Yes but you never know someone’s state of mind. She could be depressed after loosing a loved one. That loved one may have been the one who tended to the lawn as well as the flowers. You can’t just go on to someone else’s property doing maintenance regardless of how well intended.
You cleaned her mess, she had a shame attack and took it out on you. Her triggers are not your responsibility.

There is an old saying that seems to fit this circumstance, "No good deed goes unpunished." Some people expect the world to bow down to them and they leave no room for mistakes. When you cut down her gardenias, it was not a careless act but a mistake. It's not like she had any super duper beautiful garden or anything like that. The fence beside her house is falling down in disrepair. The property is terribly neglected and an eyesore. She is looking for an easy buck and she thinks she is going to get it off of you. Sad, sorry, ungrateful people are in this world and we just have to move on and not let them tear us down or keep us from doing good.

If she cared so much about her damn gardenias, it was probably a miracle because I couldn’t see them at all through that 36 inches of high grass and weeds all over the place! What I’m trying to say to you, is contact the municipality that had put up that notice on her window regarding the disrepair of her lawn and let them know that after the cleanup that you did, she is harassing you after originally thanking you and allowing you to do the job for her. You can call them as a witness to the disrepair of her land. All of what you said is purely speculation; what if the "neglect" of the yard was due to the actual owner of the house being in the hospital, died, and now this person has only just received ownership of it. Perhaps the beloved relative had planted the bush and taken great pride in it, but could not upkeep the yard due to being in the hospital, and the new owner now only just discovering the city notice and yard condition. We know nothing of this person and their story, and comments are being way to quick to take the easy road to leap immediately to lazy ingrate, rather than even the possibility of a reasonable explanation.

That's what I was wondering too. The home owner waited until they were completely done then complained. When I have people doing my yard,
I always point out the area that is my garden or special this or that spot prior to them being any yard work...so that it doesn't get damaged. This home owner didn't say one word until after their yard was completely done and looking beautiful.
What would do that community a real favor is if that trashy woman left. Neighbors are thinking you forgot to take the real trash away. She doesn't deserve a yard, she should be living under a bridge somewhere.

People like this is why I changed my mind about helping people in need when I retired. I had planned to do all types of Handyman things for elderly that could not do it or afford to pay others to do it. I can fix about anything like install ceiling fans, or change oil or brakes or air filters in their cars. I would even do some lawn maintenance if needed. BUT, I was afraid to get sued and lose everything I had worked my entire life to some a-hole. Now I just give to the Church and they help those people. Sorry you and AP had to deal with that person.

Based upon my years practicing civil litigation, I predict that this sorry excuse for a human being will not actually sue you. And, if she does, you will prevail in your cross-complaint against her which will also include your attorney’s fees and damages for her harassment and stalking of you. You could even get damages (if any) done to your business and/or your reputation. I doubt she’ll sue you. I seriously suggest you get a restraining order preventing her from contacting you, your family and friends, etc. Unfortunately, crazy people do crazy and crazier things, so you need to protect yourself and your loved ones. I don't know what you cut down, but gardenia blooms range from white to pale yellow. She said they had pink blooms, so she didn't know what she had growing and didn't care enough to keep it visible by maintaining the lawn around it.

To be fair, Gardenia's usually are in bloom for a few weeks around May to June. This is either late August or early September, when Gardenia's are not in bloom.
