Isn't there a state where the juries are taught about jury nullification? From 2016: "Last week, the New Hampshire House of Representatives voted 184 to 145 to pass a bill that would require courts to instruct jurors about jury nullification - the jurors’ power to refuse to convict even when they think all the elements of the crime have been proved beyond a reasonable doubt."
I think it's the charge. It's not okay, and is by definition 1st degree murder, but people wouldnt want that penalty for this level of crime as not the intended target.

As a potential juror I don't need the defense attorney to ask for jury nullification, I know my plan to get on the jury and to nullify it.
