    Dear Oscar, my application was rejected due to I did not provide an address of where I will work, I provided the location of the production plant, but I cannot build the plant or buy land without a permanent residency, this is crazy because VISA EB2 NIW is for people who do not have an sponsor. I presented a business plan with a project to be implemented in the industrial engineering field to optimised food production. I do not understand officer's decision? Have ever experienced similar situation?

      Hi Nelson , sorry to hear that. I assume you me "denied" , not rejected . I don't know the details of your case so it's difficult for me to say. But sometimes the decisions are not very logical, and sometimes (many times) the case is not presented correctly. Good luck!!

    A master degree from a Canadian public university is also required an equivalency? Do we need to submit the master's degree only or also submit all the academics too?

      I presume if your Master's degree is from an English Speaking territory in Canada you don't need to establish any equivalency. You are good to go.

      Technically you do need it, regardless of the language of study . Sometimes the officer doesn't send an RFE for it but I encourage people to include it to be sure

      Absolutely, I believe anything Oscar says regarding this process. Because his training has led me to the the right direction, without RFE.

      It's not mandatory . It's one of the types of evidence you may use

    Hi Oscar, it’s me again. I’m speechless as you are! I’m the poster child of incongruity and inconsistency. First an RFE, then a NOID in which they basically reject the entire evidence even with things that were established before. If this wasn’t as tragic for me as it is, it would even be funny. I feel hand tied. This will be really hard to reply to. It’s like I’m back at square one.

      Hi! Did we talk back in March? I remember talking with someone with your last name back in the day, about an RFE. Are you saying you got an NOID in the same process? That would be a first for me. Or was it in a resubmission? If the former is true, I believe your response should be on the "agressive" side, making them realize they have to review your evidence.

      @@OscarsGreenCard yeah, it was me. RFE was thoroughly and aggressively responded, we didn’t left anything out (or so we thought). Now, the NOID is worse than the RFE. It is like we never did anything to begin with. USCIS is asking for evidence of items that weren’t even considered on the RFE. A lot of evidence was overlooked as well as most of my accomplishments. The worst part is that I think USCIS is more concerned with finding small cracks on petitioners than to really foster the national economy/growth and benefit from our strengths.

      So after the RFE the petition was not denied? Instead, they sent a NOID? If that is the case I think you should be hopeful until the very end, because they almost never do that. @@flarue3678

    EB2Please I need advice, I did not sign my petition letter because I had no idea one needs to sign that but signed all my NIW forms, please is this bad? Not signing my petition letter cause me a denial? Thanks
    My proposed endeavor is Supply chain, AI, Automation and ML.

      Hola! no son nuevas reglas, son aclaraciones que hace USCIS al respecto de la visa de estudiantes. Una de las cosas positivas que aclara es que los estudiantes en visa F pueden estar en un proceso de green card por empleo y aún así probar que no tienen inmigrant intent, lo cual es bueno.
