Second the truth is that no Pakistani Muslim so far asked for citizenship on religious persecution basis. Even if there are they can still seek through old law. The new expedited the process for people who are already in India from many years.

Harish Salve is not a synonym of Justice. He is presenting his own version of concept. I heard dozens of advocate and all those said in one voice and pointed out that CAA is an unconstitutional act.

Only the most truthful can pass the scrutiny of Karan. His calibrated questioning with iterative intensity will nudge any participant to speak the truth. And many get irritated because he exposes their hypocrisy midway. Justice Shah is not one of them. Great job Justice Shah.

MUST SEE. This is by far one of Karan's most wonderful interviews. Rarely if ever has one seen a Judge be so candid & open on issues that are critical of Laws made by a sitting Govt (CAA, Article 14 & Article 370 in Kashmir) & the SC itself.
My highest #Respect to Justice A. P. Shah the former CJ of Delhi & Chairman of the Law Commission for this very indepth & damning interview he has so openly given in the present climate where multiple CJIs have been sniveling & falling very short of the positions entrusted to them.
On CAA & Article14 he is very vocal & states 'Looking at it from any angle the Law is completely irrational & arbitrary".
On the exclusion of Muslims he states that, 'this is a wrong presumption that Muslims are always persecutors & not the persecuted, this is a completely erroneous belief, it is irrational, because Ahmadiyyas, Shia Muslims, Hazarias, they are all persecuted in Pakistan"
Regarding the SC Justice Shah has this to say, "There is a drift of the SC from being a Rights Court to being an Executive Court. The SC is speaking the language of the Executive, it is becoming indistinguishable from the Executive... " he further states that he believes that the the SC has indulged in an "abdication of duty as the protector of The Constitution"

It was great conversation. I wish karan sir would have been totally unbiased while discussing about Sharjeel Imam sedition charges. It was not peaceful call to block the ways connecting the north eastern state. And yes the speaker justice comment on Anurag Thakur was absolutely right. His speach was responsible for the attack on the protesters. I wish sir would have criticised both of them.

*Secularism is not the fundamental of preamble of Indian constitution*.
It is *first floor* of preamble of Indian constitution constructed (added) in 1976 when all the opposition and the people who could discuss the untouchable preamble were in *jail*.
The fundamental preamble of Indian constitution was decided with the lots of discussions among the stalwarts of the Indian constituent assembly in 1950.
*The secularism word was* *added in Indian* *Constitution by a dictator* *Mrs Indira Gandhi* and her crony political slaves not by the democratically elected prime minister and the parliament.
If we carry the secularism word in our constitution, it means we are carrying the dictator in our democracy.

Very educative.Scary on the verdict if CAA is validated. But protest must go on because it is immoral and arbitrary. If it can be translated in Hindi only for bigger audience. Karen and Justice Shah awesome.
Points:
1. CAA Violates the basic structure of constitution.
2. It betrays the vision of India as laid down by the framers of the constitution.
3. It violates article 14 as it's not reasonable, rational and completely arbitrary.
4. Linkage of religion with citizenship is against the spirit of constitution.
5. SC has clearly said 3 times that sedition law 124 a has not to be used unless there is incitement to violence. Chants of "Khalistan Zindabad" is not sedition, according to the SC. Chakka Jam is not sedition.
6. British repealed the law so that commonwealth countries who are misusing the law do the same.
7. Direct involvement of Anurag Thakur in inciting Jamia Shooting, but he is not charged with sedition.
8. Election Commission is no longer an effective body.
9. SC is not giving priority to Habeas Corpus cases in Jammu and Kashmir. SC has shifted from being a Rights Court to a Executive Court.
10. SC did not give any relief to the citizens of kashmir over internet ban. It amounts to the abdication of duty.

One correction. Equality is violated when a class gets preference over others. The issue here is there is no rational justification to violate equality.
