I am so confused. Are you saying the only way to deal with DUI is by catching the officer in some procedure breaking? So all the defense eggs go into « what the officer did wrong » basket??? What if everything was done by the book? Isn’t there smth an attorney could argue to minimize the damage such as zero priors of any kind and a history of being responsible and the fact that breathalyzer test numbers are only slightly higher than the legal max limit??? Are you saying that unless a very skillful lawyer squeezes the arresting officer and finds fault with procedure , that’s it? No way to reduce the charge to reckless driving?
That would be up to the prosecutor. Your first DUI should be a slap on the wrist in most states. Things you can do are an alcohol evaluation and courses along with community service. It might convince the prosecutor to offer a lesser charge.

I was told I had to take a blood test
I never got the breathe test I didn’t get it until they put me in jail and then brought me to the hospital
And I only blew a 0.89
