You are also not allowed to claim self-defense if you are the aggressor, and you can't claim self-defense if you are in the process of committing a felony. There are MANY exceptions to self-defense. And this case, obviously, is one of them.

Basically if somebody pushes you, you can push them back, or if somebody hits you you can hit them back, or if somebody attacks you with a knife or pulls a gun on you, and you somehow kill that person, self defense also applies, pushing=death is not self defense, that is murder

I think one thing to point out, is why he even went to check whether the car had a handi capped parking sticker. There was no reason to assume they did not, other than the reason of course "It was a black family". Not a single person would deliberately look around the car to see the handicapped sticker. The fact that the defendant wanted to prove that they did not have a handicapped sticker proves a lot as well.
the handicap spot may be slightly further than the parking spots in the front of the store... but there's probably a ramp near the handicap spot which is why it's around the corner.

I looked at the JCS video and footage etc to give info for anyone looking for it here who didn't see the ToS part or perhaps doesn't want to, aswell as some information from the comment section that I haven't personally verified, but will rely it anyway. That comment section info is at the bottom. The father pushed the guy, the guy falls to the ground, the guy on the ground sits up from what it looks like and pulls his gun, the moment he reached visibly for the gun, the father stopped his forward body momentum and started visibly backing off even turning his body away from the guy on the ground. Now here's a very crucial detail that I personally failed to realize when they mentioned he had 2.5 seconds to think. That is NOT the time after he was pushed. That is the time, and I saw this visibly in the footage, that the guy on the ground had to pull the trigger, 2.5 seconds where he was literally pointing the gun at this father. So to recap, father pushed guy, guy falls to ground, guy sits up while reaching for gun and pulls it out, the moment the father sees this motion/the gun he takes 3-4 steps back and starts turning his body away from the guy, this happens over 2.5 seconds where the guy on the ground is pointing the gun at him, he is holding the gun, fully ready to fire, for 2.5 seconds before shooting the father. Meaning while he was holding the gun, ready to shoot, the man was visibly walking away from this situation. He had 2.5 seconds EXTRA time before he shot as the gun was in his hands in your a-typical shooting stance. That part is crucial to understand. It didn't take 2.5 seconds to get pushed and the father to get shot, it took 2.5 seconds with this guy holding the gun ready to fire, until he actually fired. Comment Section Info: According to some, I haven't confirmed this myself. But according to some on the JCS video, he got 20 years and was allegedly also assaulted in jail by another inmate with a padlock in a sock. I'm not sure if this is true or not. I don't know how to look this up to confirm it. But I know some of you are curious what he got etc, and if someone could confirm this information, that'd be nice aswell. Don't take it as truth, as I have not confirmed it as truth.

So I'm just putting it into different ways in an attempt to have multiple chances of getting someone to understand. The general idea is the same.
the threat of a gun is a weapon in itself, when that threat isn’t enough or the situation escalates is when firing is justified. Even if someone “could have been armed”, if the 21 foot rule is true in the sense that it takes that long for someone to draw a gun and fire, surely you would have enough time to watch and identify someone pulling out a gun before pulling the trigger of a gun you already have drawn and ready to fire.
21 foot rule just means that if someone 21 feet away was running at you full speed. You wouldn’t be able to draw your handgun from resting position at your hip to accurately fire. It wouldn’t apply in this case. Since the two suspects were close to one another, and the shooter was on his back with his gun naturally in the direction of the other suspect. Both affecting the how much time each suspect has to gauge the situation.
@@bruhbuuuuurh7643 i know, but i’m saying that the 21 foot rule would mean that if, hypothetically, the victim was armed, the amount of time it would take him to draw a gun would be the amount of time it would take an attacker to close a 21-foot gap. This implies that if the victim had a gun, the suspect with the gun ready to fire would have enough time to identify a weapon on the victim before he has time to draw a gun and shoot, since closing a 21-foot gap would obviously take much longer than identifying a weapon and pulling a trigger. So assuming the victim had a weapon on them isn’t a valid defence in this case.
The interesting part is that it took him 2.5 seconds to fire, while holding the gun in a shooter stance pointing at the guy. 21 foot rule or whatever the hell right, the guy didn't even instantly shoot to begin with, he assased the situation (which in all reality was the father literally backing away before the gun was pointed at him, and visibly turning away) and then just shot to kill. So in this case, he legit had enough time to watch and identify his movements but was probably mad and powertripping that his defense was a gun. Idk if you do in a 21 foot rule situation or whatever, but in this case he 100% did have time.

In the video uncensored, the suspect 1 shoves suspect 2, suspect 1 aggresses on suspect 2, suspect 2 fiddles around in his pockets, at this moment suspect 1 identifies the gun, suspect 1 drops open aggression and backs up while still maintaining eye contact, suspect 2 remains in his sitting position, eyeing suspect 1, then fires, visibly striking suspect 1. Suspect 2 should’ve immediately stood up from his position once he had his firearm out, back up from suspect 1, then either order suspect 1 to drive away, or ask a bystander to call the cops to sort the situation out.
@@adriaanvanberkel7469 The issue here was suspect 2, the one that had the firearm, gained control of the encounter almost immediately once his gun was visible and out. I could see self defense in fear of weapon working here if suspect 1 was still standing over suspect 2 even though the gun was out. But in the uncensored video, once the gun is pulled suspect 1 stops open aggression and backs up while maintaining eye contact. Hypothetically, if suspect 1 had a weapon, let’s say a pocket knife or switch blade, he could’ve easily stabbed suspect 2 before suspect 2 was able to draw his gun. However he backed up immediately and gave up control of the situation, making the fear of a concealed weapon not make sense. Since suspect 2 was the one in power here.

Self-defense is very specific. You have to be in immediate threat of harm with no option of retreat and no option of non-lethal de-escalation. There are HUNDREDS of factors that are used to determine these conclusions at times.

What I find amusing in a dark yet satirical manner, is the level of control expected of a citizen when feeling threatened is far stricter than the level expected from an actually trained law enforcement officer. For those of you who didn't understand what xQc and chat were saying when it came to the accusation of racism, his and chat's point was that the interrogator gave no question about the identity of the individual and had not asked the suspect to identify the individual's look. But that the interrogator was asking about the actions that the victim was taking in order to establish whether the suspect was following a narrative he had created or whether he was operating off of a truthful recounting of the situation. When the suspect identifies the skin color of the victim unprompted, it implies that skin color was so relevant within the suspect's mind, that it should be a topic of consideration within the case. xQc and chat's point is that the suspect's answer was unnecessary and illogical, that the answer implies race to be at the forefront of the suspect's mind since he had not been provoked to give such an answer. xQc says that these unnecessary and illogical things (which people had glossed over) are important to take into consideration to whether these actions were racially motivated.
I recommend rewatching the segment because I actually don't understand how you were this far off the ball. It's like you watching something entirely different. The investigator was pushing decently hard for him to give a description of what he saw happening in front of him. Even asking things like "You couldn't even tell he had jeans or something else on?" being a part of the discussion. Michael seemed to get agitated at this turn of events and seemed to genuinely not recall anything from what clothes he was wearing or other details like certain movements he made. I was in the infantry for eight years and can tell you right now that if you ask any combat vet small details about their first firefight or shitty situation they will laugh and say it was mostly a blur of adrenaline. Even the more experienced guys will say the same. So you can sit here and ASSUME he was so racist the only thing he could bring up is his skin color. Or I can sit here and ASSUME Michael was extremely flustered during the event and after when he just realized the investigators are starting to accuse him and are pushing for small details like what clothes he was wearing and the only thing he can genuinely recall is him knowing he was talking to his girlfriend (black) who had black kids with her and a black male ran up to him saying "DONT MESS WITH MY GIRL" and shoving him (massive adrenaline spike), him shooting seconds later, and the guy running away. Can even see michael already looking around and away from the guy who got shot. So I think a vastly more valid ASSUMPTION to make is Michael genuinely can't recall the details due to the situation that happened and how fast it happened, but after being pressured by the detective the only thing he can actually recall is him being black and he blurted that out. I'm willing to bet 99% of the people in the comments, including myself, would have issues not saying stupid shit if an attractive female is having small talk with you. Much less them being thrown into this situation where he just fuckin realized he was actually being accused of negligence instead of what he thought. Hardly anyone on the planet can walk in to a police station after this situation and be extremely calculated. Your average human will say stupid shit they regret in small conversations almost daily. I think one thing to point out, is why he even went to check whether the car had a handi capped parking sticker. There was no reason to assume they did not, other than the reason of course "It was a black family". Not a single person would deliberately look around the car to see the handicapped sticker. The fact that the defendant wanted to prove that they did not have a handicapped sticker proves a lot as well.

I looked at the JCS video and footage etc to give info for anyone looking for it here who didn't see the ToS part or perhaps doesn't want to, aswell as some information from the comment section that I haven't personally verified, but will rely it anyway. That comment section info is at the bottom.
The father pushed the guy, the guy falls to the ground, the guy on the ground sits up from what it looks like and pulls his gun, the moment he reached visibly for the gun, the father stopped his forward body momentum and started visibly backing off even turning his body away from the guy on the ground. Now here's a very crucial detail that I personally failed to realize when they mentioned he had 2.5 seconds to think. That is NOT the time after he was pushed. That is the time, and I saw this visibly in the footage, that the guy on the ground had to pull the trigger, 2.5 seconds where he was literally pointing the gun at this father.
So to recap, father pushed guy, guy falls to ground, guy sits up while reaching for gun and pulls it out, the moment the father sees this motion/the gun he takes 3-4 steps back and starts turning his body away from the guy, this happens over 2.5 seconds where the guy on the ground is pointing the gun at him, he is holding the gun, fully ready to fire, for 2.5 seconds before shooting the father. Meaning while he was holding the gun, ready to shoot, the man was visibly walking away from this situation. He had 2.5 seconds EXTRA time before he shot as the gun was in his hands in your a-typical shooting stance. That part is crucial to understand. It didn't take 2.5 seconds to get pushed and the father to get shot, it took 2.5 seconds with this guy holding the gun ready to fire, until he actually fired.

But according to some on the JCS video, he got 20 years and was allegedly also assaulted in jail by another inmate with a padlock in a sock. I'm not sure if this is true or not. the threat of a gun is a weapon in itself, when that threat isn’t enough or the situation escalates is when firing is justified. Even if someone “could have been armed”, if the 21 foot rule is true in the sense that it takes that long for someone to draw a gun and fire, surely you would have enough time to watch and identify someone pulling out a gun before pulling the trigger of a gun you already have drawn and ready to fire.
21 foot rule just means that if someone 21 feet away was running at you full speed. You wouldn’t be able to draw your handgun from resting position at your hip to accurately fire. It wouldn’t apply in this case. Since the two suspects were close to one another, and the shooter was on his back with his gun naturally in the direction of the other suspect. Both affecting the how much time each suspect has to gauge the situation.
@@bruhbuuuuurh7643 i know, but i’m saying that the 21 foot rule would mean that if, hypothetically, the victim was armed, the amount of time it would take him to draw a gun would be the amount of time it would take an attacker to close a 21-foot gap. This implies that if the victim had a gun, the suspect with the gun ready to fire would have enough time to identify a weapon on the victim before he has time to draw a gun and shoot, since closing a 21-foot gap would obviously take much longer than identifying a weapon and pulling a trigger. So assuming the victim had a weapon on them isn’t a valid defence in this case.
The interesting part is that it took him 2.5 seconds to fire, while holding the gun in a shooter stance pointing at the guy. 21 foot rule or whatever the hell right, the guy didn't even instantly shoot to begin with, he assased the situation (which in all reality was the father literally backing away before the gun was pointed at him, and visibly turning away) and then just shot to kill.
So in this case, he legit had enough time to watch and identify his movements but was probably mad and powertripping that his defense was a gun.
Idk if you do in a 21 foot rule situation or whatever, but in this case he 100% did have time.

In the video uncensored, the suspect 1 shoves suspect 2, suspect 1 aggresses on suspect 2, suspect 2 fiddles around in his pockets, at this moment suspect 1 identifies the gun, suspect 1 drops open aggression and backs up while still maintaining eye contact, suspect 2 remains in his sitting position, eyeing suspect 1, then fires, visibly striking suspect 1. Suspect 2 should’ve immediately stood up from his position once he had his firearm out, back up from suspect 1, then either order suspect 1 to drive away, or ask a bystander to call the cops to sort the situation out.

I could see self defense in fear of weapon working here if suspect 1 was still standing over suspect 2 even though the gun was out. But in the uncensored video, once the gun is pulled suspect 1 stops open aggression and backs up while maintaining eye contact. Hypothetically, if suspect 1 had a weapon, let’s say a pocket knife or switch blade, he could’ve easily stabbed suspect 2 before suspect 2 was able to draw his gun. However he backed up immediately and gave up control of the situation, making the fear of a concealed weapon not make sense. Since suspect 2 was the one in power here.
This is a sad, pathetic person, who has little to none self-worth, but has sky-high self-esteem due to the fact that he possesses the ability to end another person's life, those types of people should never have a weapon.

This was a cold blooded murder but the thing about this was this wouldve made 10x more sense (still not justified) if the person wouldve shot the guy who pushed him AS SOON as he was on the ground because MAYBE he couldve kept hitting him and that couldve been the thought process . Self-defense is very specific. You have to be in immediate threat of harm with no option of retreat and no option of non-lethal de-escalation. There are HUNDREDS of factors that are used to determine these conclusions at times.

What I find amusing in a dark yet satirical manner, is the level of control expected of a citizen when feeling threatened is far stricter than the level expected from an actually trained law enforcement officer.
Where as a citizen makes bad decisions due to inexperience leading to death then lying to save themselves, a cop will just shoot someone in the back and lie or choke you until your body is flapping around due to the lack of oxygen while screaming "why are to resisting", then lie about to save themselves.
I've had this same exact thought. The idea that a lawyer needs years of school to be ina courtroom and a police officer needs just months of training to enforce the law with deadly force is terrifying. For those of you who didn't understand what xQc and chat were saying when it came to the accusation of racism, his and chat's point was that the interrogator gave no question about the identity of the individual and had not asked the suspect to identify the individual's look. But that the interrogator was asking about the actions that the victim was taking in order to establish whether the suspect was following a narrative he had created or whether he was operating off of a truthful recounting of the situation. When the suspect identifies the skin color of the victim unprompted, it implies that skin color was so relevant within the suspect's mind, that it should be a topic of consideration within the case.
xQc and chat's point is that the suspect's answer was unnecessary and illogical, that the answer implies race to be at the forefront of the suspect's mind since he had not been provoked to give such an answer. xQc says that these unnecessary and illogical things (which people had glossed over) are important to take into consideration to whether these actions were racially motivated.
I recommend rewatching the segment because I actually don't understand how you were this far off the ball. It's like you watching something entirely different. The investigator was pushing decently hard for him to give a description of what he saw happening in front of him. Even asking things like "You couldn't even tell he had jeans or something else on?" being a part of the discussion. Michael seemed to get agitated at this turn of events and seemed to genuinely not recall anything from what clothes he was wearing or other details like certain movements he made. I was in the infantry for eight years and can tell you right now that if you ask any combat vet small details about their first firefight or shitty situation they will laugh and say it was mostly a blur of adrenaline. Even the more experienced guys will say the same. So you can sit here and ASSUME he was so racist the only thing he could bring up is his skin color. Or I can sit here and ASSUME Michael was extremely flustered during the event and after when he just realized the investigators are starting to accuse him and are pushing for small details like what clothes he was wearing and the only thing he can genuinely recall is him knowing he was talking to his girlfriend (black) who had black kids with her and a black male ran up to him saying "DONT MESS WITH MY GIRL" and shoving him (massive adrenaline spike), him shooting seconds later, and the guy running away. Can even see michael already looking around and away from the guy who got shot. So I think a vastly more valid ASSUMPTION to make is Michael genuinely can't recall the details due to the situation that happened and how fast it happened, but after being pressured by the detective the only thing he can actually recall is him being black and he blurted that out.
I'm willing to bet 99% of the people in the comments, including myself, would have issues not saying stupid shit if an attractive female is having small talk with you. Much less them being thrown into this situation where he just fuckin realized he was actually being accused of negligence instead of what he thought. Hardly anyone on the planet can walk in to a police station after this situation and be extremely calculated. Your average human will say stupid shit they regret in small conversations almost daily.
