Okay, I have to correct you on something you've been passing on to your viewers, Reno, and that I've heard some attorneys (incorrectly) advise. It is *NOT* illegal to take your standard cap mag out of state with you and return with it. That is not defined as "importing", even by the State of CA. The definition of "import" is to bring into the State from a point of origin outside the State. If you purchased an item within CA, then CA is its place of origin when you took possession of it, and taking it back and forth with you across state lines is simply possessing your property during your travels. Otherwise, if we take these attorneys' poor advise at face value, then every single time you drive your vehicle back into CA when visiting another state, that is the same action and would be subject to CA's Usage Tax, and you'll have to pay sales tax on your vehicle's value every time. Is a person re-importing the money in their pocket, the wedding ring on their finger, their phone, their other property, etc every time they go on vacation to Las Vegas? No. And the same goes for standard cap mags.
Pinning this. And while it very well may be true here’s the big thing to still think about. It’s been talked about a handful of times online that people driving from Nevada have been stopped on the ca border and cops have found mags. Even if you legally own them it’s still possible that cops can potentially put you in jail temporarily and you could lose your rights for a time. I just today got an email from a man who owned mags legally but the cops took them all and charged him with 19 felonies. He eventually got let out after a few days and after suing got his rights and his property back. But it took over 9months of being disarmed and treated like a criminal

But please bear in mind (as I'm sure you do...I've been following you for years here) that the issue of legality and the issue of LE ignorance are two different matters. My point is to simply clarify the legality as per CA P.C. I work closely with LEOs/LEAs who understand the law and largely disagree with the mag ban, but who have advised me to be cautious as well due to widespread ignorance among the LE community. After all, there are so many laws on the books here in CA - and the status of 2A related ones change so often - that it's becoming increasingly harder for LEOs to properly enforce. Well sadly most of those laws don’t apply to law enforcement. They legally can go out and buy or be given 30 round mags for service ARs no problem at all.

We had 90 minutes of freedom in WA before an AG appointed official put a stay on an injunction that was against the AGs office. The judge did an awesome job writing the injunction, he cited Bruen and Heller and common use and addresses that magazines are protected arms and the AG and WA spit in his face.
After serving a few years behind bars go ahead and make this argument on appeal... only to have it denied in the 9th and then passed over by the SC. Relying on the courts is an awful idea: instead, get out in front of it by addressing pub op and the legislatures. The facts of the origin, purpose, evolution and history of gc in this country is plenty of grist for the mill. There is no comeback for the gatgrablers when you point out their hypocrisy and drive it home with the fact the fastest growing demographic of 2A owners over the last few years. California’s terms for these are “Large capacity” and “Non-large capacity” magazines. The terms “Standard” and “High capacity” are never used. Goes to show how the state makes up its own words to make up its own rules.
And how did they decide what the number of rounds would be to constitute a "large" capacity magazine? Why >10 rounds? Why not >15 rounds? How about >20 rounds? Are there transcripts available of those Calif State Legislature sessions?
@@Eddievoneddie13 how do they determine the rounds a magazine holds? For example, I have some AR magazines which hold over 100 rounds of .22LR. Same exact magazine holds 30 rounds of .223. It holds 8 rounds of 450 Bushmaster. It holds 2 rounds of 338 Win Mag, and 0 rounds of 50bmg. I don't know how many rounds of other cartridges it holds, but anything bigger than 50bmg is out for sure... so no 16" shells for sure. So is my magazine a 100, 30, 8, 2, or 0 round mag?

I've seen a speedloader for those fixed-mag ARs. You clip it into the ejection port, dump some rounds into it, then use a pushing tool to shove them down into the mag. No need to take the gun apart to swap mags. Probably it'll be illegal when they catch up with it. It's a 3D-print, which will make it hard to stop.
If they can be altered to accept more than 10 you can be in trouble. Rivets can be punched, welds can be cut, the only way to abide is to have a cartridge that can only accept 10. In NY they are challenging the fixed mag sheer pins because they can be drilled out as per manufacturer instructions meaning not permanently fixed.
4:47 I believe LA county was the first to do this. They had officers with 20 round mags and they had reported that it "alarmed" citizens. So if I'm correct, LE can't even carry them.
Special 4th option. Meet a friend in NV who can have the standard capacity mags, borrow them while in NV, and return them before going back to CA. So option 2 without the cost.

hey man fellow CA gun owner here. from my understanding "import" doesn't simply mean "bring in" in the eyes of the legal, "importing" is specifically a term that applies to business, as in, it's is imported within the framework of retail/wholesale. I'm willing to be incorrect here but, all these terms are defined within the legal code, not within the casual day-to-day language.
I don't believe you can "import" something you already own and transported out of the state. "Import" has a specific legal definition, regardless of what the state would like it to mean. If California's interpretation of the term "import" was accurate, you'd have to pay a tariff on your car every time you crossed into the USA from Canada or Mexico.

I'm not a lawyer but the definition of import is: "Bring (goods or services) into a country from abroad for sale" and the emphasis is on "sale". If I owned the large capacity magazine, legally, before I left to Nevada, I'm not importing it back when I return to California. Like I'm not importing my car or any other thing I owned before I left.

In my latest San Bernardino renewal class the instructor was asked about them and he kinda hesitated then said "Don't do it. I know they're legal but just don't do it." Not sure what kind of advice that is......
I know. 6 years ago they told us not to have Red dot sights. But in that same class a few months ago they praised them and said everybody should have a red dot.... I think at the time the department wasn't allowing them for their officers so they didn't want us to have them either. A few months ago, I drove from the Houston area to Las Vegas... As a Texan, *of course* I'm carrying and in fact, I'm actually *open carrying* because I was going to be in my vehicle the entire time except for a few minutes every 250-300 miles when I needed to refuel and Texas, New Mexico, and Arizona had legal open carry... Unfortunately, I was following the directions of Google Maps and for whatever reason, it had changed my route from what I had originally planned and as I got close to Las Vegas, I saw a sign that told me that I was entering PROK (People's Republic of Kalifornia), followed soon thereafter with going through one of the road blocks for "agricultural inspection"... I hastily grabbed a towel and tossed it over the center console area so that it would cover my handgun... Of course, the handgun that I was carrying had more than 10 rounds in it and I knew that PROK would not accept my out-of-state CHL... On my way back from Las Vegas though, I made sure that Google didn't route me through PROK...

Talking with LE when I am behind enemy lines temporarily to work, some agencies have a policy not to charge banned mag possession because the issue is not decided. But not all and they are not trustworthy.
If you're talking about "off-roster handgun," here's how you do it legally: 1. Order an off-roster handgun to your local gun store 2. Have them convert it to single-action only 3. Buy and pick up the gun 4. Convert it back to semi-auto (or SA/DA for revolvers)

As soon as I was started watching this video, I have firsthand knowledge of somebody getting pulled over with legally obtained items. The cop took them and said if you want them back hire a lawyer to get them back so cheap $20 or $30 items will cost you thousands to get back And the police know that and say, prove it.

I live in Commierado, a state that Unconstitutionally passed Capacity Restrictions in 2013. I bought mine before the Law became Law, so under the Law they're grandfathered in.

*in actual reality a 10+ magazine will be a fine or misdemeanor charge in CA. An assault weapons charge will also just be a misdemeanor. Carry without a CCW is always a misdemeanor also. On the books mags and AW charges **_may_** be charged as felonies, but we all know that after Prop 47 felonies are basically abolished in California. Bottom line: punishment for standard mags, AWs, and no CCW is essentially irrelevant/non-existent. I am not advocating breaking the law, simply saying that in real world cases anyone violating these laws will get a fine and a suspended sentence (if that). "Jail time" is California's Kryptonite*
On visiting Nevada, would it be possible to dismantle the magazine and only carry back the legal parts? Then, mail the offending parts back to yourself, separating the parts by type. Afterwards, you can reassemble the parts claiming you already own those parts and are simply restoring the separate pieces to workability. No law states if the magazine has been disassembled, that it cannot be reassembled back to working order. At no time was a functioning magazine imported into California.

We had 90 minutes of freedom in WA before an AG appointed official put a stay on an injunction that was against the AGs office. The judge did an awesome job writing the injunction, he cited Bruen and Heller and common use and addresses that magazines are protected arms and the AG and WA spit in his face.

As A NV resident I had cleaned out all of my "high capacity magazines" before passing through CA.
Fortunately for me as an assault Donkey almost killed my car at 69 MPH in Northern CA the Cops would have likely arrived to see "high capacity magazines" strewn all over the highway.!
I should have noted if you carry a gun on your ccw and are breaking policy of your IA you are essentially carrying without a permit. So be mindful of the risk.

@@Eddievoneddie13 how do they determine the rounds a magazine holds? For example, I have some AR magazines which hold over 100 rounds of .22LR. Same exact magazine holds 30 rounds of .223. It holds 8 rounds of 450 Bushmaster. It holds 2 rounds of 338 Win Mag, and 0 rounds of 50bmg. I don't know how many rounds of other cartridges it holds, but anything bigger than 50bmg is out for sure... so no 16" shells for sure. So is my magazine a 100, 30, 8, 2, or 0 round mag?

I've seen a speedloader for those fixed-mag ARs. You clip it into the ejection port, dump some rounds into it, then use a pushing tool to shove them down into the mag. No need to take the gun apart to swap mags. Probably it'll be illegal when they catch up with it. It's a 3D-print, which will make it hard to stop.
If they can be altered to accept more than 10 you can be in trouble. Rivets can be punched, welds can be cut, the only way to abide is to have a cartridge that can only accept 10. In NY they are challenging the fixed mag sheer pins because they can be drilled out as per manufacturer instructions meaning not permanently fixed.

hey man fellow CA gun owner here. from my understanding "import" doesn't simply mean "bring in" in the eyes of the legal, "importing" is specifically a term that applies to business, as in, it's is imported within the framework of retail/wholesale. I'm willing to be incorrect here but, all these terms are defined within the legal code, not within the casual day-to-day language.

I don't believe you can "import" something you already own and transported out of the state. "Import" has a specific legal definition, regardless of what the state would like it to mean. If California's interpretation of the term "import" was accurate, you'd have to pay a tariff on your car every time you crossed into the USA from Canada or Mexico.

I'm not a lawyer but the definition of import is: "Bring (goods or services) into a country from abroad for sale" and the emphasis is on "sale". If I owned the large capacity magazine, legally, before I left to Nevada, I'm not importing it back when I return to California. Like I'm not importing my car or any other thing I owned before I left.

A few months ago, I drove from the Houston area to Las Vegas... As a Texan, *of course* I'm carrying and in fact, I'm actually *open carrying* because I was going to be in my vehicle the entire time except for a few minutes every 250-300 miles when I needed to refuel and Texas, New Mexico, and Arizona had legal open carry... Unfortunately, I was following the directions of Google Maps and for whatever reason, it had changed my route from what I had originally planned and as I got close to Las Vegas, I saw a sign that told me that I was entering PROK (People's Republic of Kalifornia), followed soon thereafter with going through one of the road blocks for "agricultural inspection"... I hastily grabbed a towel and tossed it over the center console area so that it would cover my handgun... Of course, the handgun that I was carrying had more than 10 rounds in it and I knew that PROK would not accept my out-of-state CHL... On my way back from Las Vegas though, I made sure that Google didn't route me through PROK...

1. Order an off-roster handgun to your local gun store
2. Have them convert it to single-action only
3. Buy and pick up the gun
4. Convert it back to semi-auto (or SA/DA for revolvers)

As soon as I was started watching this video, I have firsthand knowledge of somebody getting pulled over with legally obtained items. The cop took them and said if you want them back hire a lawyer to get them back so cheap $20 or $30 items will cost you thousands to get back

I live in Commierado, a state that Unconstitutionally passed Capacity Restrictions in 2013. I bought mine before the Law became Law, so under the Law they're grandfathered in.

If you lived in an actual FREE STATE like TN, FL, TX, etc, then this is something you wouldn't have to worry about.
*in actual reality a 10+ magazine will be a fine or misdemeanor charge in CA. An assault weapons charge will also just be a misdemeanor. Carry without a CCW is always a misdemeanor also. On the books mags and AW charges **_may_** be charged as felonies, but we all know that after Prop 47 felonies are basically abolished in California. Bottom line: punishment for standard mags, AWs, and no CCW is essentially irrelevant/non-existent. I am not advocating breaking the law, simply saying that in real world cases anyone violating these laws will get a fine and a suspended sentence (if that). "Jail time" is California's Kryptonite*

On visiting Nevada, would it be possible to dismantle the magazine and only carry back the legal parts? Then, mail the offending parts back to yourself, separating the parts by type. Afterwards, you can reassemble the parts claiming you already own those parts and are simply restoring the separate pieces to workability. No law states if the magazine has been disassembled, that it cannot be reassembled back to working order. At no time was a functioning magazine imported into California.
