(4) “Secure gun safe” means a gun safe that meets the standards for gun safes adopted pursuant to Section 23650. (d) (1) Except as provided in paragraph (2), a violation of this section is punishable by a fine of up to two hundred fifty dollars ($250) for a first violation and up to five hundred dollars ($500) for a second violation. A third and any subsequent violation is a misdemeanor. (2) A person shall not be penalized for violating this section if they secure their firearm using a firearm safety device or gun safe that they reasonably believed to meet the requirements of this section, including a firearm safety device that was certified at the time the individual purchased the device or a safe that met the standards for gun safes adopted pursuant to Section 23650 at the time the individual purchased the safe. (e) The provisions of this section are cumulative and do not restrict the application of any other law. However, an act or omission punishable in different ways by different provisions of law shall not be punished under more than one provision. (f) The Department of Justice shall seek to inform residents about the standards of storage of firearms as outlined in this section. (g) This section does not apply to unloaded antique firearms, as defined in Section 921(a)(16) of Title 18 of the United States Code, or firearms that are permanently inoperable.

This is what happened in South Africa starting about 25 years ago. All firearms had to be locked up in safes and unfortunate people whose homes were invaded couldn’t get to them, then being unalived and worse. This was and still is the situation for white farmers.

I'm against this law, but what you quoted does not contradict with the California law. This does not outright ban ready firearms in the home, and the scenarios in which you can get in trouble have nothing to do with self-defense.

Possible to get it back since it was just evidence, but they can hold it until appeal option has timed out. Personally the worse I have dealt with a loaded magazine in an airport (forgot about it in a "hidden" Pocket in my pack). DA Dropped the charges, lost my CCW until "case was resolved." Getting the info on it being dropped then getting it in writing was a PIA. I was told I could get mags back, but investigating officer had to release them... they never did.

This made up my mind to move from California . Friend of mine last year got fed up with California laws ( especially taxes ) and closed shop and moved . He had about 160 employees who joined the unemployment line, and each average family was 4 persons so about 700 persons joined the welfare system ( about one million a month ) when they were happy working and having a good life . That is all happening under our capable hands of governor Newsome.
He also just banned small propane containers like for a propane camping stoves, hes out of control, home ownership is a PRIVATE dwelling, what goes on in your private home is none of californias bizz.
I really don't want to leave Cali. It is my home and where my family lives and has lived for over a hundred years. Anyone who lives alone may not have any other "authorized user" of their firearm. Anyone who lives in a residence with their SO may reasonably give them "authorized access" to their firearm, given their SO is lawfully able to handle firearms (The owner's proximity to the firearm in these cases may no longer be questioned by the law). In both of these statements, the owner of the firearm has no reason to believe some other "unauthorized user" is lurking in their residence to obtain access to their firearm at any time ... leading to the fact that this law may be used against firearm owners in the event of a home intrusion by potentially "unauthorized users" involving the loss or operation of that firearm in the event or thereafter. (That is all assuming the firearm is not locked in a gun safe.) I must include, if there exists the presence of children in the residence, the firearm owner should not leave the weapon in any condition unattended and accessible if ammunition is also nearby. I think that children should only operate firearms under the close supervision of a combination of their guardian and firearm owner. Yeah, kids can tear down the weapon, learn how to clean its parts, but a child needs to understand shooting a firearm comes with responsibility and is not to be taken lightly. Never mind gifting them a firearm for their person like it's a new plushie. When I say this, I'm all for applying ACTUAL common sense to gun ownership and protecting our youth. Too bad common sense discussion in this regard points towards suppression of our 2A...

A court in IL has pulled out of thin air "Semiautos are not covered by the 2nd Amendment". It is going to take years and millions of dollars to get past that court and that's only going to happen if the Supreme court takes the case. There is no penalty for passing unconstitutional laws. If the current IL gun ban gets stuck down they will just pass another. Cali is in the same boat. Politicians should be charged with violating citizen's civil rights under color of the law but they never are. I don't know if it is even possible. Im maryland we can only keep it out on a night stand if there are no kids in the house. If there are kids you need a lock box on your night stand. I recommend and use Stop Box. Whats crazy is alot of people think firearms need to be unloaded, locked away, and or disassembled to mean safe storage. Safe storage means 1)communication with whoever you trust in your home to have access. 2)out of physical reach from children 3)where they wont drop and be damaged or discharged in the event of an earthquake or unforseen accident 4) everyday maintenance check to ensure whether they are unloaded or not, just so you and others with access cant say they didnt know it was or wasnt loaded. I'm born and raised Illinois. I've said in the past several years, Illinois is California's landlocked brother in so many ways. They, next to New York are amongst the most anti gun states. We are in our 50's and as soon as my wife retires, we are moving to a red, non hating gun owner state. To no irony, these states tend to have lower taxes. Wyoming is currently ticking many boxes but we could benefit just by moving 70 miles east to Indiana. Once I leave Illinois, I feel my happiness will greatly increase.

This law is an indirect advance toward revoking CCW possession. I just received my CCW from Pasadena P.D. Part of the process involves B.I.s showing up to your place and conducting interviews inside of your house. Departments who elicit to enter your home for interviews will ask to see your safe and possibly check if the safe is DOJ compliant. BTW, I wasn't home when they showed up at my place.
The thing is though, the cops won’t come to your home and you won’t be charged with a crime so long as someone else doesn’t take your gun and use it. So if there’s no threat of that happening, then you won’t get in trouble, because how would they know?
That new Cali law is similar to the "safe storage" law that went into effect here in CT. Used to be safe just from children or prohibited persons, now that's not a qualifier. Needs to be locked up if not in your direct possession (basically within arms length). Not just a fine here - It's considered a felony

If the state can't force me to put a trigger lock on it, they can't force me to put it in a safe.

So Newsome and the lawmakers are basically saying that if the police knock on your door for whatever reason, if your gun isn't already locked up or whatever, you're supposed to have your firearm on your person when you answer the door. Of course cops won't get nervous and trigger happy if anyone answer the door armed right? They are really gonna be leaning into qualified immunity I guess. If people follow this law, trigger happy cops will kill way more lawful gun owners than any firearm incidents it will prevent. Hmmmm 🤔, did I just say the quiet part out loud?
A good rule of thumb is if you feel that you need to be armed when you answer your door, you probably shouldn’t be answering your door. If it’s important they’ll leave a note. I sometimes carry in my yard. In my neighborhood we sometimes have coyotes, mountain lions, and the occasional door to door salesman/scammer. The overly aggressive scammer that wants access to my house offering “free” house or carpet cleaning has no idea. California is not known for passing constitutional gun laws. Eventually the SCOTUS will overturn it once it gets there, but it will cost gun rights groups millions in legal fees before that. Meanwhile, California has a seemingly endless supply of tax dollars to spend to defend these bogus laws.

When you are a man in a blue state, it serves you to learn how to use a variety of weapons well. I can easily use guns, but if those become unavailable, I have good skills with throwing axes, sticks, blades, metal water bottle on a lanyard, etc. I’m never unarmed. I just pick the deadliest of those options legally available to me at any given time.
I do lock my firearms when I’m away. Worth to much money for someone to steal. But while I’m at home I choose to do what ever I want. My home my business. Another law I attend to ignore. As he said, they won't find out unless something happens out of the ordinary, like a break-in while you're home, the cops show up with a search warrant, someone at your house rats you out, you have a house fire, etc. But these laws are still intrusive and infringements of 2A. Saying a law is inconsequential because "you can get away with it" is a slippery slope.
The constitution says any judge of any state that infringes on the constitution and the law of the land is therefor notwithstanding. Why is the 2nd amendment the ONLY amendment we need a permission slip?! No one needs a permission slip for freedom of speech or any other constitution.

Here is where I got confused about this modification to CA Penal Code Section 16745. As indicated by the following excerpt from the Legislative Counsel's Digest, this bill seems to only apply to the sections that are specific to a child obtaining access to the firearm: "Existing law makes it a misdemeanor or a felony if a person keeps a firearm within any premises that are under the person’s custody or control and the person knows or reasonably should know that a child is likely to gain access to the firearm without the permission of the child’s parent or legal guardian, and the child obtains access to the firearm and causes injury, other than great bodily injury, or death or great bodily injury to the child or any other person, or carries that firearm off-premises, as defined, to a public place or a school. Existing law exempts a person from the above provisions if the person has no reasonable expectation, based on objective facts and circumstances, that a child is likely to be present on the premises. This bill would remove these exemptions." In other words, and seemingly consistent with reading this thing from end-to-end, the imposition of this addendum or modification removes the exemption under the child protection section that protected the gun owner from liability if the owner had a "reasonable expectation" that a child would not in any way gain access to the firearm. The original text contained within this code section made allowances for a child gaining access by way of a criminal act by others. It appears, but is certainly not clear, that ultimately this entire code section ultimately applies to a child gaining access and that what is changed is that there is no exemption for the gun owner, even if the firearm is accessed via a criminal act, if the firearm was not stored in compliance with the new code subsection, (essentially in a safe at all times unless under your direct control). So my reading is not that this means you are liable if someone breaks into your home or makes any other illegal entry and gains access to your firearm and consequently a child ultimately gains possession of the firearm. If a child does not get possession there is no violation of this section which seems to be specific to child protection. I may well be reading this wrong, but since the entire code section is directed to the child protection aspects of firearm storage and handling, this seem to be the correct context.

(b) A firearm is “securely stored” if it is maintained within, locked by, or disabled using a certified firearm safety device or a secure gun safe.
(c) For purposes of this section and Sections 25105, 25135, 25205, 27882, and 27883, the following terms have the following meanings:
(1) “Authorized user” has the same meaning as provided in Section 16745.
(2) “Certified firearm safety device” means any firearm safety device or gun safe that is listed on the Department of Justice’s roster of tested and approved firearm safety devices certified for sale pursuant to Section 23655.
(3) “Readily controlled” by a person or another lawful authorized user means either of the following:
(A) The person or other lawful authorized user is carrying the firearm on their person.
(B) The person or other lawful authorized user is within close enough proximity to the firearm to readily prevent unauthorized users from gaining access to the firearm.
(4) “Secure gun safe” means a gun safe that meets the standards for gun safes adopted pursuant to Section 23650.
(d) (1) Except as provided in paragraph (2), a violation of this section is punishable by a fine of up to two hundred fifty dollars ($250) for a first violation and up to five hundred dollars ($500) for a second violation. A third and any subsequent violation is a misdemeanor.
(2) A person shall not be penalized for violating this section if they secure their firearm using a firearm safety device or gun safe that they reasonably believed to meet the requirements of this section, including a firearm safety device that was certified at the time the individual purchased the device or a safe that met the standards for gun safes adopted pursuant to Section 23650 at the time the individual purchased the safe.
(e) The provisions of this section are cumulative and do not restrict the application of any other law. However, an act or omission punishable in different ways by different provisions of law shall not be punished under more than one provision.
(f) The Department of Justice shall seek to inform residents about the standards of storage of firearms as outlined in this section.
(g) This section does not apply to unloaded antique firearms, as defined in Section 921(a)(16) of Title 18 of the United States Code, or firearms that are permanently inoperable.
Literally says nothing about children and felons. Though those populations would be implied, this is more about restricting gun owners on their own property, making it increasingly difficult to own a gun and consider yourself a law-abiding citizen. Personally the worse I have dealt with a loaded magazine in an airport (forgot about it in a "hidden" Pocket in my pack). DA Dropped the charges, lost my CCW until "case was resolved." Getting the info on it being dropped then getting it in writing was a PIA. I was told I could get mags back, but investigating officer had to release them... they never did.

This made up my mind to move from California . Friend of mine last year got fed up with California laws ( especially taxes ) and closed shop and moved . He had about 160 employees who joined the unemployment line, and each average family was 4 persons so about 700 persons joined the welfare system ( about one million a month ) when they were happy working and having a good life . That is all happening under our capable hands of governor Newsome.

Anyone who lives alone may not have any other "authorized user" of their firearm. Anyone who lives in a residence with their SO may reasonably give them "authorized access" to their firearm, given their SO is lawfully able to handle firearms (The owner's proximity to the firearm in these cases may no longer be questioned by the law).
In both of these statements, the owner of the firearm has no reason to believe some other "unauthorized user" is lurking in their residence to obtain access to their firearm at any time ... leading to the fact that this law may be used against firearm owners in the event of a home intrusion by potentially "unauthorized users" involving the loss or operation of that firearm in the event or thereafter. (That is all assuming the firearm is not locked in a gun safe.)
I must include, if there exists the presence of children in the residence, the firearm owner should not leave the weapon in any condition unattended and accessible if ammunition is also nearby. I think that children should only operate firearms under the close supervision of a combination of their guardian and firearm owner. Yeah, kids can tear down the weapon, learn how to clean its parts, but a child needs to understand shooting a firearm comes with responsibility and is not to be taken lightly. Never mind gifting them a firearm for their person like it's a new plushie. When I say this, I'm all for applying ACTUAL common sense to gun ownership and protecting our youth.

Safe storage means 1)communication with whoever you trust in your home to have access.
2)out of physical reach from children
3)where they wont drop and be damaged or discharged in the event of an earthquake or unforseen accident

I'm born and raised Illinois. I've said in the past several years, Illinois is California's landlocked brother in so many ways. They, next to New York are amongst the most anti gun states. We are in our 50's and as soon as my wife retires, we are moving to a red, non hating gun owner state. To no irony, these states tend to have lower taxes. Wyoming is currently ticking many boxes but we could benefit just by moving 70 miles east to Indiana. Once I leave Illinois, I feel my happiness will greatly increase.

This law is an indirect advance toward revoking CCW possession. I just received my CCW from Pasadena P.D. Part of the process involves B.I.s showing up to your place and conducting interviews inside of your house. Departments who elicit to enter your home for interviews will ask to see your safe and possibly check if the safe is DOJ compliant. BTW, I wasn't home when they showed up at my place.
The thing is though, the cops won’t come to your home and you won’t be charged with a crime so long as someone else doesn’t take your gun and use it. So if there’s no threat of that happening, then you won’t get in trouble, because how would they know?

That new Cali law is similar to the "safe storage" law that went into effect here in CT. Used to be safe just from children or prohibited persons, now that's not a qualifier. Needs to be locked up if not in your direct possession (basically within arms length). Not just a fine here - It's considered a felony

With cops shooting people who answer the door with a gun pointed at the ground in their hand, (Florida resident Airman Roger Fortson), I have to wonder how long they'll wait for you to lock yours up before you will open the door.

Nope. As was stated in the video, in Heller v DC (case no 02-790), SCOTUS already ruled on storage laws preventing the gun from being available for self defense:
"3. The handgun ban and the trigger-lock requirement (as applied to self-defense) violate the Second Amendment. The District’s total ban on handgun possession in the home amounts to a prohibition on an entire class of “arms” that Americans overwhelmingly choose for the lawful purpose of self-defense. Under any of the standards of scrutiny the Court has applied to enumerated constitutional rights, this prohibition-in the place where the importance of the lawful defense of self, family, and property is most acute-would fail constitutional muster. Similarly, the requirement that any lawful firearm in the home be disassembled or bound by a trigger lock makes it impossible for citizens to use arms for the core lawful purpose of self-defense and is hence unconstitutional."

So Newsome and the lawmakers are basically saying that if the police knock on your door for whatever reason, if your gun isn't already locked up or whatever, you're supposed to have your firearm on your person when you answer the door. A good rule of thumb is if you feel that you need to be armed when you answer your door, you probably shouldn’t be answering your door. If it’s important they’ll leave a note. I sometimes carry in my yard. In my neighborhood we sometimes have coyotes, mountain lions, and the occasional door to door salesman/scammer. The overly aggressive scammer that wants access to my house offering “free” house or carpet cleaning has no idea. California is not known for passing constitutional gun laws. Eventually the SCOTUS will overturn it once it gets there, but it will cost gun rights groups millions in legal fees before that. Meanwhile, California has a seemingly endless supply of tax dollars to spend to defend these bogus laws.

When you are a man in a blue state, it serves you to learn how to use a variety of weapons well. I can easily use guns, but if those become unavailable, I have good skills with throwing axes, sticks, blades, metal water bottle on a lanyard, etc. I’m never unarmed. I just pick the deadliest of those options legally available to me at any given time.
I do lock my firearms when I’m away. Worth to much money for someone to steal. But while I’m at home I choose to do what ever I want. My home my business. Another law I attend to ignore. I’m 100 percent confident if I grab the mail or walk my dog they will not find out at all. Please explain to me how they will find out.
As he said, they won't find out unless something happens out of the ordinary, like a break-in while you're home, the cops show up with a search warrant, someone at your house rats you out, you have a house fire, etc. But these laws are still intrusive and infringements of 2A. Saying a law is inconsequential because "you can get away with it" is a slippery slope.

The constitution says any judge of any state that infringes on the constitution and the law of the land is therefor notwithstanding. Why is the 2nd amendment the ONLY amendment we need a permission slip?! No one needs a permission slip for freedom of speech or any other constitution.

Here is where I got confused about this modification to CA Penal Code Section 16745. As indicated by the following excerpt from the Legislative Counsel's Digest, this bill seems to only apply to the sections that are specific to a child obtaining access to the firearm:
"Existing law makes it a misdemeanor or a felony if a person keeps a firearm within any premises that are under the person’s custody or control and the person knows or reasonably should know that a child is likely to gain access to the firearm without the permission of the child’s parent or legal guardian, and the child obtains access to the firearm and causes injury, other than great bodily injury, or death or great bodily injury to the child or any other person, or carries that firearm off-premises, as defined, to a public place or a school. Existing law exempts a person from the above provisions if the person has no reasonable expectation, based on objective facts and circumstances, that a child is likely to be present on the premises.
This bill would remove these exemptions."
In other words, and seemingly consistent with reading this thing from end-to-end, the imposition of this addendum or modification removes the exemption under the child protection section that protected the gun owner from liability if the owner had a "reasonable expectation" that a child would not in any way gain access to the firearm. The original text contained within this code section made allowances for a child gaining access by way of a criminal act by others. It appears, but is certainly not clear, that ultimately this entire code section ultimately applies to a child gaining access and that what is changed is that there is no exemption for the gun owner, even if the firearm is accessed via a criminal act, if the firearm was not stored in compliance with the new code subsection, (essentially in a safe at all times unless under your direct control). So my reading is not that this means you are liable if someone breaks into your home or makes any other illegal entry and gains access to your firearm and consequently a child ultimately gains possession of the firearm. If a child does not get possession there is no violation of this section which seems to be specific to child protection. I may well be reading this wrong, but since the entire code section is directed to the child protection aspects of firearm storage and handling, this seem to be the correct context.
