Why Didn't Lucius Malfoy Go to Azkaban after BOTH Wizarding Wars? - Harry Potter Theory

  • "Malfoy's been giving generously to all sorts of things for years... gets him in with the right people... then he can ask favours... delay laws he doesn't want passed... Oh, he's very well-connected, Lucius Malfoy."
    This quote got me thinking. Did...Lucius Malfoy, KNOWN Death Eater and proponent of pure-blood supremacy, actually BRIBE his way out of going to Azkaban? And if that’s the case, why didn’t money help Bellatrix in the same way?

    Bellatrix wasn’t a coward, she truly believed in Voldemort and when you believe in a cause you are willing to go to jail for it. Lucius may have believed in the cause on the surface but inwardly he only cared about himself and his family but when it came to pure blood action he was a coward at heart.

      Bella would've murdered the entire Weasley family if she'd been given a bigger chance/Molly hadn't done her in. The Weasley's were often called the biggest 'blood traitors' to families like the Malfoy's.

      If you read the books, that's exactly how her personality works. She'd have no issue killing fellow death eaters and family members who opposed them

    But he DID go to Azkaban. He was arrested after breaking into the Department of Mystery in the conclusion of the fifth book. He later escaped in a mass breakout thanks to Voldemort a year later, hence his appearance in the seventh book.

    I think it went deeper than that. I think a lot of the ministers agreed with Lucius in secret but weren't willing to become a death eater. Thus he had a lot of friends among the ministers. He also probably helped a lot of them get their place via money and influence. I think a lot of those same people were still in power at the second coming of he who shall not be named.

    The problem with the Wizarding Prison was that it is so inhumane that almost nobody deserves to go there. I do not know about the conditions after the removal of the Dementors though

    Slytherins are cunning. I wouldn't put it past Lucius to have dirt on various Ministry officials. Nothing related to Voldemort or Death Eaters, of course. But still, it would be stuff that they wouldn't want made public. The Ministry was always corrupt so it's a target-rich environment. And Lucius would know how important it was to always deal from a position of strength. So, I always just kind of assumed that Lucius alternately bribed and blackmailed his family out of trouble. Plus, he could bargain his way out too since the Malfoy family all did various things at various times to harm Voldemort's cause.
    Bribery, blackmail and bargaining.

    Bellatrix, along with the Lestranges and Barty Crouch Jr, didn't avoid prison becuz, for starters, they (not including BCJr) didn't deny their affiliation with Voldemort, with Bellatrix even proclaiming they would wait in Azkaban for their master's return, having no doubts he would, proving they were true believers in the Death Eater cause
    Another factor that ensured they were sent to Azkaban was the crimes they committed, the abduction and torture of Frank and Alice Longbottom, both prominent and well-liked Aurors, using the Cruciatus Curse, to torture them to the point they were rendered insane. A crime so horrific and vile that there was no question that they deserved to go to Azkaban, especially since they were completely unrepentant for what they did
    BCJr cowardly denied being involved despite the evidence of his complicity, and pathetically begged his father for mercy, only to be spurned by the cruel and ruthless Bartemius Crouch Sr, who renounced Barty as his son and gave him the same sentence as the others, both to set an example as well as becuz deep down he knew Barty deserved it (even tho the action tarnished his image)
    Barty's denials were cowardly (tho not w/o merit becuz Azkaban was, at the time, the worst place to be) but what made him even worse was his hypocrisy years later when he said to Harry, while disguised as Alastor Moody, that he hated any Death eater that walked free for abandoning their master and denying their allegiance to him, which is something he himself did. Even worse, Barty's parents sacrificed so much to free him from Azkaban; even tho his father kept him under the Imperius Curse, Barty was liberated from Azkaban by the love and sacrifice of his mother, who voluntarilty took hsi place via Polyjuice potion, and subsequently died alone in those dreaded walls... and Barty didn't care. He sought a bond with a man he thot was alike himself while denying or ignoring those who had truly loved him and made all they did for him turn out to be for nothing. Barty gave his loyalty to someone who did not return it or sincerely appreciate it, and his ultimate fate was being subject to the Dementor's Kiss
    Bellatrix was indeed a different of crazy; she wasn't simply loyal to Voldemort, she was obsessively in love with him, deluding herself into believing she was closest to him, that he loved her in return, and letting that false relationship alienate her from her family and overlook or even ignore their own feelings and positions, that she felt her nephew Draco should be proud to be a Death Eater and to have been given a mission by Voldemort directly, ignoring how this put Draco in danger and likely denying to herself that this recruitment and mission was a lie, an excuse to punish Draco and his parents with execution in the assumption that he would fail.
    In some ways, Bellatrix and Draco, as well as Lucius and Narcissa, were victims of their upbringing, raised in the pureblood supremacist beliefs, and how it steered them in the wrong directions and to align themselves with the wrong people.
    Draco and Narcissa were brave enough to subtly turn against Voldemort, with Draco hesitant to admit he recognized Harry when he was captured while Narcissa lied to Voldemort in saying Harry was dead in order to ask him if her son was still alive.
    Lucius was indeed an elitist bigot, corrupt, arrogant, and vile, but ultimately, he truly loved his family. Furthermore, despite how things turned out after the second war, Lucius, after finding a powerful time-turner, despite being tempted to use it to change the past, wisely chose not to... becuz he preferred a world without Volemort in it. He didn't completely change, holding onto his pureblood ideals, but Draco changed for the better since he, unlike his father, recognized that the pureblood supremacy was one of the major motivations and causes for the most harrowing and terrifying experiences of his life.
    Bellatrix was a casualty of that, and while i think they mourned her death they didn't truly miss her much. Bellatrix proved she was willing to murder even family members, since she murdered her niece, Nymphadora Tonks, for marrying a werewolf, and had she figured out Draco and Narcissa had turned against Voldemort, even slightly, she would have punished them or even killed them had her master ordered it, and he most certainly would have, since the Malfoys were no longer favored by him by then.

    The guy is like a real life politician. Those guys can do almost anything and get away with it (Provided their fellow politicians don't throw them under the bus to save their own hides from the exact same consequences)

    HP theory, here's an interesting idea that came to mind the other day, might be worth a video. I was thinking about the patronus charm and how its primary effect is to create a shield, only its a shield made of light and goodness. In that regard it feels like the spell could infact be an offshoot of the protego charm which produces just an all purpose shield
    But then i thought about other variants of the protego charm and something stood out to me, protego diabolica. Its clearly more than just a normal shielding charm but what's most intriguing is it also took on the form of an animal, almost exactly like a patronus would. These are 2 high level shielding spells that both take on the form of an animal?
    This leads me to 2 thoughts. Firstly could protego diabolica be like a dark patronus, its polar opposite being a shielding spell made of malicious intent which also takes the form of your spirit animal?
    Secondly, this brings up the question then, could this also confirm that grindelwald's patronus animal was infact a dragon just like how protego diabolica formed into in fantastic beasts? I know people like to say he must have had a phoenix like dumbledore cus they loved each other but i dont buy that. Not every couple automatically has the same patronus and i think its clear by the end dumbledore kept way more feelings to grindelwald than he had to him, it wasnt even close to the level of devotion snape kept for lily. Grindelwald having a dragon patronus feels the most fitting as he sought for power more than anything

    Cowardice is too simple a concept for Lucius Malfoy. It's true that he wasn't big on courage. Yet it would be more accurate to call him a social moon spirit. Someone who depends on the leadership and power of others. Voldemort refers to him, as "our slippery friend!" A moon is attached to the most powerful nearby gravitational body. So, Malfoy naturally gravitates to the fearsome power of Voldemort. Content to gather power through associations with the most powerful people he can find. Content to seek out influence from the influential. So more than incipient cowardice, but less than courageous.
    Voldemort used the Malfoys like toilet paper, with the greatest of contempt and disdain. Completely mistrusted and mistreated, the Malfoy's were more victims than followers.
    Especially once the Ministry falls. The wealth, power and position of the Malfoys, falls along with the ministry! So by the middle of The Deathly Hallows, the Malfoys are little more than slaves in the house, they once owned. All too fearful and conscious of the fact. Their capricious and violent master could and likely will consume them at anytime, for any whim. Voldemort feeds off their fear, like a cat playing with a favorite mouse. But even a rat, like Peter Pettigrew, had vastly more status, with Voldemort. It soon becomes clear that when the dark lord gets bored. They will be lunch for Nagini, or some other deadly amusement for Voldemort's court.
    So, conjuring up what little courage they had, the Malfoys turned on the master, they fear and hate so much. It's their betrayal of Voldemort and their status with him. That's what earned them some tolerance ftom the Ministry. After Voldemort's fall. Malfoy works hard to separate out the true followers of Voldemort. Partly in reparation, but mostly knowing that anyone he misses, will be committed to vengeance against the Malfoys. Placing the Malfoys in an odd position. Some of their former wealth, is restored, but little of their former status. The Malfoys serve as both a reminder, and an example of Voldemort's former power. Only, being less than a house elf, to Voldemort's never really going away.

    As Bellatrix questions Snape in HBP, did she question Lucius just as much? Did she question her own sister? 🤔
    I'm pretty sure Lucius was arrested but then released after Voldy fell. He definitely spent time in Azkaban during HBP. And I'd wager heavily that Kingsley had him arrested, even if there were no more dementor guards.
    Which brings up the question as to what happened to the dementors afterwards?

    It's highly unlikely and probably a bad idea, but for what little it's worth.
    I sometimes wonder is he was a redundancy in Dumbledore's machinations. Dumbledore believed Voldemort would return and that he'd need to orchestrate how it happened to ensure his defeat. Voldemort arguably came back on his timetable.
    The first question I ask is why Dobby? Why did Dobby actually help Harry? Lucius picked Ginny of all people to give the diary, someone Harry would have cared more about. While accused not seeing the signs by Voldemort, Lucius had apparently actually attempted to aid it with the diary. This idea makes Dumbledore just a bit more sinister because it would suggest he chose Ginny and had him give her the diary.
    Lucius may not have actually been as willing as Snape. Dumbledore may have actually used prison or some other threat to bring him in line. Perhaps even an unbreakable vow. This would have given him a redundant pawn. Having Lucius also leading the opposition to himself, Dumbledore could control when and how it happened.
    While still not nearly as redemptive as Snape, and likely more reluctantly, Lucius may have avoided prison because he was actually in Dumbledore's pocket. I'm not suggesting his hate of muggles was fake, or that any of his more sinister beliefs were all contrived. Only that as a pawn he was likely more easily controlled and those convictions made a far better mask for his involvement in Dumbledore's plans. He often seems like a darker and more reluctant version of Snape. It would make sense for Dumbledore to have been using him to try and control when and how Voldemort returns rather than leave it to chance.

    I'm thinking that the main reason was simple. Harry, " The hero of the day", spoke for them. As pointed out, at one point, the entire plan hung on Narcissa's successful deception of Voldermort. It was a Dumbledorian move, to reward a genuine change of heart with another chance which in their later years proved to be real. The result too would have affected Draco who needed his parents and whose path could easily have turned back to evil had they demanded further retribution. The entire "redemption arc" in the writing would not have been near as effective if they had stuck them all in prison for the rest of their lives.

    Thank you for covering this each time i reread the series,i wonder how he slipped away from a collection of crimes from busting out of prison torturing Hogwart students at the ministry,conspiring to murder a wizard of whom he Put and imperious curse on with a potted plant, allowing his Home to be used as a make shift Prison for Hogwart students and a wand maker False imprisonment and torture.of school age children.

    9:42: That's why Askaban fails at being good prison. Some people should serve a sentence; but unless you really BELIEVE someone should undergo mental torture for whatever reason, stealing a wand or too many 80" plasma TVs for example, you can't really put them there, can you?

    He had money, and was a "grass." A grass is UK slang for a person, usually a criminal, who tells the police about other criminals' activities.
    JKR once stated that the Malfoys had made their money before the Statute, and were at first against it, until it was brought about, where they then totally backed it. My guess is, the family took over organized crime in the wizarding world, such as smuggling restricted or banned items. That, and they could have secretly invested in the old Triangular Trade that had just started for England when the Statute was brought about. British involvement in the transatlantic slave trade began in 1562, and the Statute was passed in 1689; a little over one hundred years later. The equivalent of millions was made from sugar and tobacco, etc.
    A hint at this is the Malfoy's peafowl. Those roamed the old plantations of yore.

    The fact he was in prison before the 2nd war 100% means he could have gone back after Volement died. He would avoid new crimes for his involvement, but he still needed to serve his time for his crimes in the 5th book.

      Barty Crouch Jr was under the Imperius curse for years before he started regaining his senses, so it's entirely possible. Different people have different tolerances for it in the books, for example. Would've been an easy out for Lucius.

      True, but I don't think that would stick once he went in for a double dip. After the second war, I can't see Shacklebolt not prosecuting Malfoy.

      @@IM125 First Sr had Jr under the curse, then Jr began to fight back. When Voldy came calling, Voldy put Crouch Sr under the curse and Jr was free though he'd already been fighting for some time.

      I see your point, but also, it's Azkaban. Dementors basically make it the worst punishment ever. Granted, Azkaban didn't use them after Shacklebolt had them removed, but still probably isn't a great place.

    I thought Azkaban would stop being used as a prison all together, considering the dementors were used by Voldemort & the death eaters already had a mass break out.
    It wouldn't make much sense to put Magical Nazi's into a place they could turn into their own or potentially influence the "gaurds" the same way Wizard Hitler did.
    Would be smarter to try and figure out a way to cut them off from their powers entirely, erase their memory and toss their asses out into the muggle world.

    we also see that lucius is not untochable he DID get sent to azkaban afther the events in the minestry so clearly the "goodwill" only went so far.

    I think that Lucius Malfoy knew Tom Riddle in school and were probably friends in a manner of speaking. Why else would Riddle trust him with the diary? As to how Lucius managed to stay out of Azkaban, he has money and isn't afraid to throw it around. As for Bellatrix LeStrange, she may be rich, but I doubt that she ever once made any effort to ingratiate herself on others. In fact, I wouldn't be surprised if her own family wanted her safely locked away.

      Lucius is in his mid 40s when tom dies and he dies at 71, there's almost 30 year age gap here so they can't be schoolmates

    Not that we can reference our understanding of law unto the Harry Potter world though it seems a combination of no witnesses, and making suggestions that others acted on, so guilty without being guilty

      He's just a villain! The same as any villain from centuries of fiction.
      The fact that anybody would sympathise with, or take offense at the portrayal of Malfoy is simply confirmation that maybe your morals are in dire need of examination!
      He attempted to use an unforgivable curse on a child! He is prejudiced against a race he considers inferior (muggles)! The character is not a political statement, just a representation of an evil person.

    He had no interest in searching for Voldemort after the first war and he only joined him out of fear the second time. He might have been a pure blood racist but even Voldemort scared him.

    Bellatrix wasnt afraid to cast the unforgivable curses in front of others and boast about torturing a family of the order of the Phoenix. Luscious was a like agent inside the ministry.

    Couldn’t Lucius prove he was a prisoner in his own home. I mean Voldy took his wand, insulted and threatened him, and forced his son to try and kill Dumbledore…

    So much to discuss!
    I do believe there are plenty mistakes in your theory. Not to mention you present everything as a fact rather than just that, a theory.
    1. You make make it sound like Lucius had to prove himself to authorities. In fact, I'd gather they all knew very, very well who he was. Malfoys are NOT just any family. They are basically royalty when it comes to what seems to be a rather small community. So, no. There would have been no need for him to work hard making connections. He very likely WAS well-connected while wearing dipers.
    2. Therefore, there was no need for him to WORK at the Ministry. For real, what for? The Malfoys are actually well-known to prefer staying in the dark while playing their cards. It's like asking the Rothschild to get a regulat 9-5 job. Like, for real?
    3. Of course Bella and Crouch Jr got different treatment. Bella, unlike Lucius, was no politian. And Barty was too young to be able to play the strings.
    4. Why he got free both time? Well, you gave the answer: corruption. But not just because he simply bought half the Wizengamot. Nooooooo. I'd hazard a guess they were afraid of him opening his mouth. If Lucius were to go down, he'd take EACH AND EVERYONE with him. Karkaroff tried, but he was no Lucius. And that would have been too huge. So, he keeps his mouth shut, gets his freedom and they all get to keep their cushy jobs. Unlike him, they most likely had to work for them. And from the looks of it, working for the Ministry is not exactly THAT lucrative.
    5. You make it sound like it was Lucius who sought out Voldie. Again, I'd bet it could very well otherwise. Yes, Voldie is intelligent, powerful, ambitious and what not, but he's still a literal nobody without money or any real status. Who's going to pay for his champaigne? IMHO, he needed Lucius much more than Lucius ever needed him. Lucius has always been loyal and never changed his side. Voldie thought it was his side, but it has always been the Malfoy family side for Luc. And we do get to see it very well: for the decade after Voldies demise the Malfoy were not just fine, they were doing great. So it's kinda laughable that Voldie would accuse Lucius of being unfaithful. Living in delulu land much, uncle?

    Didn't Lucius go to Azkaban between the ifth and sixth movies? I thought Draco alluded to it on the Hogwarts Express. and there were other references during the sixth movie. It's entirely possible I'm remembering that wrong. Not going to Azkaban doesn't necessarily mean not being accountable. He lost a lot of the influence and connectionss he had, which mattered to him more thsn his freedom as ambitious Slytherin..

      I've heard this issue show up frequently at Warographics as well.... maybe it is on UA-cam's side that stuff is messing up.

    Bellatrix would be considered chaotic evil in D&D terms. She wouldn't have the pull Lucius had because she was a crazy person.

    I imagine it could be because of how much Lucius suffered after his failure to obtain the prophecy. He practically fell out of favor to Voldemort because of the failure. The Malfoys were all uncomfortable having to host Voldemort in their home .

    A lot of this doesn't make sense because i think originally it wasn't supposed to be about blood supremacy and nazi stuff but more so about opposition to the statute of secrecy, i think Rowling shoehorned that in later because she felt it wasn't dramatic enough as it was and needed to make the villains more evil, it ultimately causes a number of issues, why is Slitherin house still tolerated in Hogwarts for example? It produces nothing but nazis, and yet somehow everyone is just ok with that.
    And people can somehow lie to the ministry despite there being serums that force even Barty Crouch Jr to speak the truth against his will, i think that Slitherin and the Malfoys were too important to just remove from the story and ship to Azkaban, but by making them so unequivocally evil, Rowling wrote herself into a corner

    His involvement in the Second Wizarding War could not be used to prove guilt for his involvement of the first. That is something called "Double Jeopardy" A person cannot be accused of the same crime twice, if they have been cleared of all charges. The fact that he did it AGAIN, CAN be charged.

      That's the US, and the Muggle world. In Canada Muggle world, for instance, you CAN be. It might be the same in UK Wizarding World as Canada Muggle world for all we know.

    I was just wondering about this the other day. His contempt for Muggles and Wizards and Witches born to non-magical people was obvious and blatant. I concluded that he must have been bribing all the right people, and perhaps had something to blackmail a lot of people with.

    How did his Dark Mark not immediately incriminate him? Voldemort only put the Mark on his most imner circle; I think that would have destroyed his "I was under the Imperious Curse" narrative instantly

      Apparently the Dark Mark disappeared when Voldy fell. As he was regaining his body in GoF, the mark became visible and darkened.

    Just because the views of the majority of their population in years past is intolerant, does not mean their democratic system is corrupt. It simply means it acts in ways you or I don't like. That is NOT corruption...that is the dangerous and terrible flaw in democracy.

      Lucius is far more moral including his real relationship with his wife and actual care of his son.
      Trump sees his wives as objects and openly boosts he had very little involvement in his children’s upbringings.
