    I bought an incredibly huge house for an incredible low amount of money! I had a lawyer check the "escrituras" to make sure it was legal....best deal in my life! (don't buy the London bridge) Most Americans lease land for 100 years to save money.

      In the near future, yes I’m planning to rent near Ensenada, Rosarito or near by. I will be looking to purchase a non on the beach property for investments and to pass on to my children’s. With that, I’m going to need your legal assistance to draft a Mexican Will to match my American Will to prevent future problems. Additional translated documents you recommend will be needed. I’m in the process of getting important documents Apostille Stamped from California.

    Thanks, very helpful info. Have a few questions:
    1) if I am an American Citizen and purchase a property say in Rosarito you mention 50 years that I would have land rights for. What if say 30 years from now I become a Mexican Citizen, would I then get full ownership of the property and not have to give up the property in 50 years?
    2) What if say I own the property as an American Citizen and something happens to me and I have 2 children who are American Citizens, would the house go to the kids if it's in a Trust, and IF SO, does the 50 years start all over or is there only 20 years remaining?
    3) Lastly, in this example if something happens to me and the kids become Mexican Citizens after something happens to me would they have ownership of the property without having to give it up?

      Hello there, very interesting questions, in short, if you become a Mexican and you have a trust (fideicomiso) on a property, you will have to do all proper process to cancel that fideicomiso and then acquire the house like any other Mexican, also, if you have a trust and have beneficiaries, they will get the rights of that document (not the property) as it is, so if there are 5 years left, that’s what they will get.
      I guess the best will be to get a proper consultation with your attorney., so he can explain better, since a lot of questions will keep coming up. Hope this helps

    Hi Carlos I have a question regarding citizenship/real estate ownership. My parents were both previous Mexican citizens but now are US citizens. Can they help me get my Mexican Citizenship (to have duel citizenship Mex/US) in order to purchase property in Baja California and not be abide by a temporary "Trust"... Thanks and great video!

      If you R over 18, you can request yr mex citizenship yourself. Get in touch with mexican consulate, and ask for all the requirements they will guide you.

      Hi Brenda, Yes, that’s a very good way to go, it is massively important to use your own lawyer and a Notary of your selection given the fact you are gonna pay for his services anyway., also keep in mind that you don’t have to pay for anything in advance since real estate agents are gonna get paid a percentage of the sale.     Is all land in Rosarito and Ensenada leased land? I want to buy property there but it seems like everything is just leased land.

      Hello my friend, if you are a foreigner, according to article 27 of the Mexican Constitution, you cannot buy property near the beach (50 kilometers) nor the border (100km), many foreigners are using a Fideicomiso (Trust) to get houses, and many others are getting scammed by so called Real Estate Agents or Groups, like in this recent case which was on the news involving Grupo Aries and Punta Azul. You can start your process to get your Mexican citizenship and then get your house. Hope this helps.

    I need your assistance in setting up a Bank Trust for my property that I bought 2 years ago or to talk to you about other options that I may have like citizenship and things of that nature. It's a major Realty Company named Groupon Concordia that I bought from and I'm pretty sure they're legitimate but it'd be nice if you could check anyway just to make sure. Because I want to start building in 2023 right after tax season and I didn't want any problems

    Hello Mr. Garcia, and thank you so much for posting this informative video. We're just starting to look into purchasing along the coast in or near Rosarito, and have been in contact with a realtor we found on on the web. We were told that any transaction will have a 7% closing fee, which includes lawyer, bank trust and notary services, so in the price range we're looking $14k-$21k US. Sounds like you're saying to avoid these types of fees and arrange our own lawyer, notary and bank?

      Hi Jim, yeah, Realtors are supposed to get commission from the sale which is from 6% and above which usually is paid from the seller, I guess it will be best if you get your own lawyer, bank and notary, you’ll save quite some money, hope this helps.... All the Best.

      Hello Hanna, thank you very much for your comments, just like I’m mentioning on the video, foreigners CanNot Buy land near the border or the beach, you can only have possession, basically Rent for a long term using a Fideicomiso which is a Trust, which you can renew, but at the end that possession must return to the rightful owner, so if I was to rent some property I’ll do that in the regular way saving lots of money in fees, taxes etc… hope this helps.

      Hello Shawna, legally speaking the property effectively must be owned by your husband, but since you are his wife, you can become a Mexican also and if you are married with common assets, then you’ll become a legal owner as well, hope this helps, all the best

      Hi Abraham, that’s a very good question, first you will have to get Escrituras to be able to prove to be the ownership of this property, then I guess the best will be to take those documents to US BANK to see if they will take this property. Given we are talking about a property and bank located in different countries, different laws apply, so I guess it will depend on the Bank’s policy. Hope this helps, All the best.

    ¡Hola, Carlos! My husband and I have our temporary resident visas and will be traveling to Mexico soon to complete the canje process. Do you ever provide your services to help people through that exchange? I tried calling the number you left here in the comments, but it was almost 5:00 and no one answered.
    Right now, we need help getting our resident cards, but then we will be looking to rent and then buy some property, hopefully a couple of hectares. We plan to build. I would love to talk to you about our plans and how we could possibly work together. I will try calling again tomorrow.

      Hello my friend, Yes you can, just get to any Consulate or Embassy from Mexico in the US and do the process, all you need is your mom's INE card, mexican Birth certificate, your birth certificate and official ID... Hope this helps, all the best...

      Hi Rachel, Very Good Question... In accordance with article 30 of the Mexican Constitution, those born abroad, children of Mexican parents by naturalization, of a Mexican father by naturalization, or of a Mexican mother by naturalization are Mexican by birth (section III). Therefore, before processing your Mexican nationality by naturalization, you must process that of your father or mother and later yours.
      Now, by virtue of the fact that you are a descendant in a straight line of a Mexican by birth, in accordance with article 20 of the Nationality Law, a residence of two years immediately prior to the date of the application will suffice for you, to be able to apply for your naturalization.       Hola Concepcion, muchas gracias por la pregunta, la ley aplica de igual manera para todos los extranjeros, mismos quienes tal y como lo menciono en el video, no pueden comprar propiedades cerca de las fronteras ni las playas, solo pueden básicamente adquirir la posesión uso, goce y disfrute de una propiedad mediante un fideicomiso que en realidad viene siendo una renta por 50 años, periodo que se puede extender a otros 50, pero al final, la propiedad tiene que regresar a su legítimo dueño, espero esto ayude, saludos.

      Que tal Ernesto, No se puede vender la propiedad, ya que no es el dueño de la propiedad, imagina que solo estas rentando la propiedad, es basicamente lo mismo, solo que es a 50 años, saludos

      Hi James Park, now that’s a question I honestly cannot answer, that will depend on your lawyer’s and notary fees, and depending on the property the corresponding taxes, etc. The Real Estate agent usually gets a percentage from the sale which is provided by seller, so you do not have to pay anything yourself. Your best option is to get a proper consultation with your attorney with all property docs (copies) in hand. Hope this helps. Regards.
