      @ Rogue Mentality It is an ugly truth. I heard a superior court judge state he was tired of hearing people use the term "freeman on the land". People don't believe me when I tell them the law society has their own language called legalese. The law society created the penal codes(policies of the law society) for the different categories of law they created to generate income from the public. The only law that serves the people properly is known as common law today. AKA Law of the universe, Law of/from time immemorial as well as God's Law. The Law is about determining there was a crime or theft, or wrong committed and providing as just a remedy as possible to the victim. It also is not about punishment, it is about discipline to bring about correction in the wrong doer so offences r not reoccurring.

      Jim, agreed. Legalese is a legal word, also known as words of art. You’ll find in all vehicle codes, that all terms that they use, such as vehicle, driver, etc. pertain to someone acting in a commercial way.

      Precident law actually became limited in the 1930s when we finally lost any real pretense that we are still a Republic and previous earlier than a specific date could not be used by attornies in their cases. However, those who are not attornies are probably NOT limited to cases only after that date but they will get unlawful pushback when they try to use them.

      @@jessewoodsonjames6669 Does it specifically mention immunity by name? The Constitution has many Amendments that each offer specifi guarantees. Why? So that there can be no plausible deniability when government tries to play the ignorance card. The Constitution also acknowledges "unalienable Rights." Yet even as I write this the fight rages on to establish a Constitutional basis confirming that these Rights apply to women as equally as to men, firmly establishing that it's no longer subject to individual interpretation. So in this same tradition of not leaving to interpretation, why not an Amendment specific to the issue of immunity as well?

      That's actually kind of the issue, at least for qualified immunity, it is NOT even the law, per se! (That's exactly what this episode is all about, were you paying any attention at all?) Qualified immunity is a doctrine (basically a tradition or habit of how to deal with a category of cases by the courts), or a kind of habitually used exception to virtually any law. Civil asset forfeiture is actually part of the law in many states as well as federally; and those laws clearly need to be repealed/abolished. And qualified immunity needs to recognized and acknowledged for the blatantly egregious unjust lure to corruption that it is, as well as a carte blanche for public servants to break the law and commit atrocities against private citizens with impunity; and it needs to be brought to an end!

      4th of July. Qualified Immunity can not be used in cases of Constitutional Rights violations. The rights listed in the Constitution, Bill of Rights are the highest and most established laws in US, ratified in 1791, by the Founding Fathers. They are Constitutional Amendment Laws.
      Don't let malpractice of immunity spread. Rather, the defense must prove good faith.

      Just how bad is Qualified Immunity... it was instituted in 1967, against civil (Constitutional) right workers who were trying to sue police for violating they're civil (Constitutional) rights.
      And the Justice Black(?) is recorded as saying... "except in cases of established law."
      There are no laws more established than the Bill of Rights (attached to the Supreme Law of the United States) the Constitution, ratified (yes, that means those are Amendment Laws) in 1791.
      On it's very first use, it was used against Constitutional Rights (civil) rights workers.
      It's so absurd, it undermines it's own legitimacy and those of the Supreme Court.
      They also violated the SCOTUS oath to uphold and defend the Constitution.
      Basically, all it amounts to is "obstruction of justice" by the judicial system.
      Soon as you exit the court room, the doctrine holds no weight and never did.
      But such is the malpractice of law.

    The SJPD murdered an old friend of mine who was distraught and hiding in the crawl space of the home he rented.
    So instead of helping him they fired tear gas in the confined space killing him by asphyxiation. (It says it is not intended for use in a confined space right on the can)
    They sat around yukking it up for five hours then did it again to make sure he was dead. And after another five hours had medics go in and retrieve his body.
    There were better ways to handle the situation but since they were not liable this made for a great way to send someone out for food and get everyone on the force some overtime.
    The next day the SJ Mercury News deemed my friend guilty of everything from abusing women, dealing drugs, to downloading child pornography on his phone during his 12 hour standoff with the police. (And they had his phone to prove it)
    They blamed the neighbor who complained about noise, saying he informed them that my friend was armed and dangerous and would not be taken alive. (Which he was not nor did the neighbor make that statement)
    Plus the home owner gave them permission to do whatever they needed to help my friends situation.
    Just another day at the office for SJPD and the SJ Mercury News.

      BUT that statement should NOT be and need not be a frightening thing at all! It is only because our government has become so corrupt and bureaucratic that we are scared by this! It actually kind of funny and very ironic that in many parts of Europe that statement would bring comfort and relief! That is ironic, of course, because the whole point of the formation of this nation and the reason the European immigrants fled Europe was to escape the tyranny and theft/excessive taxation of the European governments (as well as religious and ethnic persecution), and now the tables have turned! And while we extol our unique American "freedom" and our government that is for the people and by the people, blessings that supposedly no other countries have.     Whatever happened to government by consent of the governed? Unless the government gets our consent, we can assume they don't have it. They only have the authority we delegated to them in the first place. If we don't have the right to do something, then how can we have delegated to them the same rights?
    That's what it means to have a 'representative republic'. They represent us as our agents, not as our overlords or usurpers of our powers and rights.

    I know this all to well... I couldn't find a lawyer to take my case, not because i didn't have one, but because they all said they wanted to continue to work in the state, and if they took on my case, they wouldn't be aloud to work in California anymore!!!
    I fought it pro se, and even know I didn't win, I still prevailed!

    If these Cops would be held personally monetary responsible, they would think it through and develop other options to preform their duties. With immunity, they can do it the easiest for them, with no consideration for citizens and property. If insurance companies or governments pay for damages, I doubt the Cops would be able to keep their jobs or get another one in LE. It is called vicarious liability and departments don't like that.

    They MUST be held PERSONALLY, INDIVIDUALLY accountable for their own actions!!! As long as there remains ANY shield, be it insurance purchased by their departments or government, or some form of immunity for their otherwise illegal and harmful, injurious actions, the men and women dressed up in costumes WILL NOT STOP BEHAVING LIKE TYRANTS!!! The insurance companies do not care if they have to pay out more claims! They simply charge higher premiums! The government doesn't care about paying higher premiums because they are spending money stolen, at the point of a gun, from the populace by mercenaries who are also paid with STOLEN MONEY! The cycle WILL NEVER STOP, unless those costumed men and women are forced to think about their actions (and their jobs), BEFORE taking them, conscious of the DIRECT PERSONAL CONSEQUENCES they WILL face if they abuse the power they have been entrusted with and bring harm or injury to those they have SWORN AN OATH OR AFFIRMATION TO PROTECT!!!

    when i got out of the police academy i was assigned to the 60 prct in brooklyn ny, coney island. shortly there after a seasoned officer recommended i get a throwaway weapon such as a knife screwdriver gun in case im involved in a bad shooting. i knew then i had to take the firefighters exam.

    One set of rules for state and another for the citizens is unjust and simply untenable. If this situation is not addressed it has to lead anachy.
    Instead of Congress wasting time and huge resources trying to overrule the voters choice of president, it would be far more useful to come up with laws to normalise the balance of power.

    I'm being censored , so I'll try here again: 7:27, that's where the jury are judges and the man posing as a judge is present as a witness to pass the judgment over to the man wronged who then has the court clerk, who is also a witness, to file the judgment, then the man wronged takes the judgment to the sheriff and orders the sheriff to seize the wrong-doers property, (this is only after the surety bond ; pension, doesn't cover the debt ), and auctions the property to pay the debt. If the debt still isn't meet write an order of garnishment for wages.

    I could never get an attorney to help me after Harris county sheriffs department officers went to the wrong address and refused to show me a search warrant for the person they were looking for.No attorney would take my case.I was told that because of qualified immunity that my case would not be feasible to the attorney's..

    Congress could amend 42usc1983 to provide strict liability (which they would not be likely to do) OR to provide liability based on respondent superior.
    i.e., deem political subdivisions responsible for any civil violations committed by any of their agents/officers/employees. (Congress would more likely go for that option)

    Insurable risks are still covered by the tax payers as they are the ones paying for the insurance coverage. Until part of the burden for doing bad government directly starts to impact the folks in government that did bad, they have no real motivation to do better.

    Good program everytown city should have these along with mAndatory debates with leaders on what police are doing on our streets. and put policies in place to protect citizens from this abuse .Don't need the Federal courts to tell us this is wrong. and that we can't hold people accountable for their actions even if they where a badge. we are all equal under the law.

    Personally, I say make the government officials and cops personally carry liability insurance. If they screw up, they have to pay higher premiums...or they lose their insurance and their jobs at the same time. As long as those in power are insulated from the consequences of their decisions and aren't PERSONALLY held responsible, this kind of crap will continue.

      ​@@sweetbread9008 I hear that a lot. I researched it long ago. They are interchangeable; completely synonymous. I use unalienable when it would be more difficult to speak the line and inalienable when it flows well enough.
      For example, "the exercise of unalienable individual rights" flows better to me spoken when compared to "the exercise of inalienable individual rights." When speaking, I would often stumble over "inalienable individual." The choice to use one or the other is that of style rather than definition since they both mean precisely the same thing.

    I don't know if I agree that private citizens should be able to sue government officials as a private individual. For something they did in their official capacity except for maybe some certain circumstances, but I totally think we should be allowed to sue the agency or government entity responsible if a cop does something illegal sue the police department, if a prosecutor does something illegal sue their office

    Okay..okay I got one. I was arrested for growing nine small plants in my bedroom closet, and my LANDLORD gave consent to search to the police and oh yeah, they kicked the shit out of that apartment, holes in walls even a broken window. My roommate and I (he was arrested too) were like WTF. So I was sentenced to 80 days in jail and while there I was arrested for criminal mischief in the 4th degree, a felony, for the damage to the apartment. It was a total scam, the charges were dismissed once I agreed to pay the insurance deductible. I am SOOO glad they are going after this shit. They need to try to do something about asset forfeiture too. That is legalized theft. And the courts and police do it all the time.

The questioned Statute can be Constitutionally impremissible as written on its face or as applied or both. The Statutes are like directives which are like official authoritative instructions that guide and direct police thoughts
    and behavior and if they are not compliant then they are ordered by supervisors to enforce the UNLAWFUL STATUTES, so police violate their Oath and the Rights of Citizens because they do not want to get fired. Most police know what are doing is UNLAWFUL, but they are just following orders like in Nazi Germany. The justify it by saying I AM JUST DOING MY JOB.

    They destroyed the woman's property BEFORE entering, and therefore her permission to enter does NOT apply. THAT has been a winning lawsuit many MANY times against police departments.
