@MeRia035 YOUR welcome it's sad that our legal system is as crooked as any scam artist and what I found worse is the police who destroyed your property says omg I thought you would get reimbursement for our damages like they are completely innocent . In the case with the apartment being on the third floor, where the police unable to contact the landlord or review building permits and or real estate transactions. I'm having trouble believing they couldn't figure out that was two apartments and which one was which.
How would this case be different if instead of the dog being left deaf and blind it was the daughter or the hostage? These were excessive force against a dead suspect and an innocent family. Why do they arrest people this way when they don’t know who is inside?
Are insurance companies forced into not covering government damages?? Seems odd to exclude. After paying the claimant, insurance companies go after the guilty party for compensation. Seems another way for government to be unaccountable.
I would argue that the best way to tackle this is for the FTC to step in and make a rule saying insurance cant exclude damage done by the government anymore. Make insurance do their actual job. Ignoring that tear gas is technically considered a war crime under the Geneva protocol why is it still being used against civilians by law enforcement in the first place?
Wny should the insurance company cover the incompetence of police? All of our premiums would all DRASTICALLY spike if this were the case. no, police just need to be smacked down and HARD. People, why are we paying taxes? Thats what funds these animals. Maybe we should all take a minute and think about where our taxes are going. Are you paying your taxes to fund this kind of behavior? No? put your money elsewhere.
Are there any lists of lawyers that IJ has vetted so we citizenry can hire if we end up in these situations? I’ve noticed that career criminals find lawyers that literally get violent abusers probation while innocent people are thrown to the wolves.
If you take a hostage or something and its your house that the police damage, fine. But if it's a completely innocent party with no legal fault in the situation, the government ABSOLUTELY needs to pay up. This is ridiculous.
It would be similar if a cop seizes your vehicle in the middle of a police chase in order to stop the suspect yes? So the cop wouldn’t be liable but the city/county would be liable. It’s preposterous that cities don’t automatically recognize their liability. I can guarantee that if the police destroy the mayor’s home in an identical situation, the mayor guaranteed would be immediately compensated. Or a city council member, or a police officer’s home, or the DA’s home. That is what pisses me off most about this. Is that they exclusively don’t compensate people they don’t deem to be important enough or people they don’t believe can afford to fight them in court.
The city will only pay if you sue them. But to sue them you need to have money. The poor get F'd. I am surprised that SWAT doesn't cover damages. Don't they have insurance? 60 cans of tear gas? WTH.
Has an unjust enrichment argument been used? I'm no lawyer but can't see how the city/state/etc can be enriched by the person being arrested and yet the innocent homeowner who had their home destroyed due to decisions made by the city/state/etc having to bear the burden.
They will ruin everything you’ve worked for and walk off and go to sleep at night like nothing happened.

A crime cartel masquerading as leaders
They represent the nation of israel. Not america. And its questionable if we actually elect them, since they clearly control ballot counters and always find just the number of votes they need to keep the aipac guys in office.
They pass laws that do not apply to them.
They are propaganda loving fools, the police union said we need this junk to keep you safe, how do we stay safe from them ?
Legal, Private Firearms Dealer in Norfolk County, Ontario, Canada was raided by Metropolitan Toronto Police SWAT Team replete with personal Ambulance. The Dealer was servicing a 'Patron' at the time in his home business when SWAT stormed through the doors and shot him quicker than he could verbally/physically respond. No reason was given for illegal, out-of-jurisdiction Raid. Man was murdered because he upset somebody in the Judicial System. Look that one up.
Rodger Wayne Kontako was the dealer
What tha….how much more corrupt can our country be? My goodness!
Courts always defend the government...they work together.
My neighbor had his front door kicked in by a SWAT team. They backed out real fast. He was a federal officer and so was his wife. Two police officers were arrested and it turned out the “tip” they were given was sent from a jailhouse phone by a gang member the wife had arrested a few days previously. The SWAT team didn’t have a warrant, didn’t check the address, didn’t do anything to make the search legal.
This story actually pisses me off.
The rest of us wouldn't be lucky enough to get a break. We would get shot.
And that's how people are supposed to get fired.
Sounds like the usual.
So, that gang member wanted revenge on the cop wife huh? He should get more prison time for that.
Implied exception to the takings clause? Case needs to be sent to the USSC.
Terrible argument that the gov't can torch my house and then leave me with the bill because the destruction was necessary. Who makes the decision that it was "necessary" should be a jury not an appellate judge.
Scotus Will find amorphous reasons for upholding the ruling that gave the homeowner Nothing.
But if that happened to thier home... the police would be drawn and quartered for thier mistakes
@@pilotnamealreadytaken6035; Laws/ rules for thee butt not for me. I'm rich important etc. Justice is coming, just give it a little more fuel. It will be a 🔥 mess!
It's only gonna get worse.
This exactly. Look at the recent SCOTUS decisions and be afraid of the future.
I wouldn't be surprised if they give cops full immunity. The roberts court has been absolutely catastrophic for the country
Wasn't Vikki Baker the incident where her daughter offered to help with things like opening the garage door but they didn't want that, they wanted to break down the door with their armored vehicle.
Yep. They just wanted to play with their toys. I don’t think they actually expected the city to pay for anything. Usually the cards they hand out go directly to a lawyer for the municipal insurance company.
They aren't going to let a civilian approach the house when there is a violent fugitive inside.
@@miramichi30how do cop dicks taste?
@@miramichi30she had an electric garage door opener. She didn’t even need to go near the house. Someone in the swat team could have used the bleeper to open the garage.
Miramichi is a boot licker going up and down the comments here trying to argue for government abuse.
16:14 Wow. Two days without pay. Such a harsh punishment.
Never call cops to your house
Pretty much this, they are worthless anyhow
There is no situation that they will not make worse
There is never a good reason for a no-knock warrant.
Agreed. That one is pure B.S.
I actually disagree. You don't want to give criminals the chance to arm themselves, or destroy evidence.
@@miramichi30 why not? 😄 Seriously though, they are doing this to people who are not criminals. This is a glaring problem. And it could happen to anyone right now.
There's no reason an agent of the government should be able to enter your or any other building without notice or permission. For the exact reason that mistakes can happen to anyone. Even police are not infallible. That said they should have to check, recheck, and check again before carrying out a warrant. Especially if it doesn't require notice, which should be illegal.
@@miramichi30 Id rather safety of the innocent over evidence retrieval
Expecting government to hold government accountable is ludicrous. They're gonna protect their own.
Going to the right house seems like it would be easy for LE to figure out. Just order a pizza sent to the address and follow the delivery person. I guess following the delivery person without losing them could be a challenge that SWAT might have a problem with.
Hahahaha
It is mind-boggling to realize that after 250 years there is no settled law in the United States. The same crimes and circumstances keep happening over and over and over and we decide each one Court by Court working our way up the ladder and each Court says yes or no and some of them contradict each other, anyway it's mind-boggling isn't it!.
If those who have power over you do not know yet alone respect the constitution then you have to wonder if we have one.
Yes a very convoluted system. Being of a suspicious nature, I have to wonder if that's on purpose...? 🤔
After SCOTUS decided against equity theft, Arizona and Minnesota introduced bills to let them keep stealing equity by giving homeowners a deadline to demand what's theirs. Arizona shtting all over the constitution does not surprise me, but say it ain't so Minnesota!
And it takes so long to get results
@@MeRia035 well then let me help you raise your suspicion. Why is our legal system written in code the word code means words letters numbers or symbols used to obfuscate or hide the meaning of. A wise man once said, if a well-educated 6th grader can't understand it it shouldn't be a law
Thank you IJ. Donation on the way.
They get Federal money to deploy and its a use it or lose it transfer.
Thank you for what you all stand for and do!
The government has an easy out by requiring homeowners insurance to cover this type of thing since they claim immunity.
WHy are the insurance companies allowed to opt out of this?
because they wrote the policy
Insurance companies exist to collect premiums. Not pay out claims.
Did I get lucky? I sued NYC in 2013 in small claim court when city's Parks dept contractor destroyed my sidewalk while removing a large sidewalk tree stump, and won in arbitration. NYC Comptroller office played dirty. it waited until last week of an entire year, and denied my damage claim. It pissed me off so hard.
“Implied exception” means WE MADE IT THE F%}* UP
Like Warzone, no consequences for them...
I'm so thankful that people have you.
“ We were just obeying orders “. How many years ago was this excuse rejected ? Why is is it that fairness integrity and justice is ignored in favor of saving bucks for “The Government “ Why are the courts bending over backward to defend the State ? Where is the unbiased and impartial dispensing of “ Justice without fear or favor ? “ .
Because the police, the DA, the court and the city are all on the same side. Only the plaintiff doesn't work for the city.
Qualified immunity = no accountability
"You break it, you bought it." It's such an old concept that everyone knows. And if you don't know it, you will learn it the hard way.
An appellate court sua sponte making up a new argument should be an immediate grounds for appeal to at least an en banc hearing. You don't ambush the appeals process as they just bring in their own facts with no rebuttal. Especially when you have a Jury finding.
Indeed. The judges are out of control
That guy should've claimed to be a squatter. He'd still be living there rent free.
Well, ignorance of the law is no excuse, and if im an escape driver and some other guy committed some crimes, i would be charged with them too. Government needs to be held to a higher standard.
Such a conflict of interest throughout so many examples mentioned. Thank you for your efforts to alert and inform us all.
I just talked to five officers from five different municipality and they all know the city will not pay for swat damages they have cards for citizens to call for damages it goes right to a law office of their insurance company the attorneys take the damage clame from citizens then tells the insurance what to say on clames over certain amount it goes straight to denial and lower than that amount a certain percentage is offered like 20% is original offered then negotiations above that amount if a attorneys are involved then your original amount may get paid but now you have to pay for your attorneys fees which is all most the same as what you were asking for
I don't know why I'm somewhat surprised to hear this. I should know better. Underhanded methods in effect.
Thanks for sharing this
@MeRia035 YOUR welcome it's sad that our legal system is as crooked as any scam artist and what I found worse is the police who destroyed your property says omg I thought you would get reimbursement for our damages like they are completely innocent . It's all about who you know and your ability to hire one of the best lawyers in the country
It's almost unbelievable what's happening.
In the case with the apartment being on the third floor, where the police unable to contact the landlord or review building permits and or real estate transactions. I'm having trouble believing they couldn't figure out that was two apartments and which one was which.
DID THE IRS HAVE COMPLICITNESS LIKE THE POST-PIZZA PERSONEL DUD?
How would this case be different if instead of the dog being left deaf and blind it was the daughter or the hostage? These were excessive force against a dead suspect and an innocent family. Why do they arrest people this way when they don’t know who is inside?
400k followers but I was the 112th like. Your channel needs more shares, likes and views.
I love this dialogue; helps us understand what's going on here and broken down in a way that's easier to understand the law.
Thx’s for all you do. ❤
Are insurance companies forced into not covering government damages?? Seems odd to exclude. After paying the claimant, insurance companies go after the guilty party for compensation. Seems another way for government to be unaccountable.
As described in the video, homeowners insurance policies almost always have coverage exceptions for force majeure damage causes.
Yet every city/county council across the country defer to the cops they employ when it comes to money and policy. it's ridiculous.
So well explained. Thank you
Raiding the wrong location should itself be criminal negligence.
"implied exception", basically means we just make up whatever we want.
If you take a hostage or something and its your house that the police damage, fine. But if it's a completely innocent party with no legal fault in the situation, the government ABSOLUTELY needs to pay up. This is ridiculous.
Every insurance contract excludes government damage because it's so common that they would go bankrupt if they paid the claims.
Thankyou for all you do
Thanks for the work you do.
That is a very serious problem. Selective importance.
the insanity must end! glad you are fighting for sanity, accountability, and justice.
Without transparency, there can be no trust, without trust there can be no authority!
Thank You very much for all you do Institute for Justice!
Really appreciate IJ's work, however, could you please extend the time of the clarefication box just a few more seconds, please.

How can the incident of attacking the wrong house be filled under "qualified” immunity?
Keep up the quality content. Kudos to the editor, perfectly professional in tone, and I love when text on screen appears with an audio cue :).
Aww, shucks.
This is why I give these guys money.
You guys are Awesome!!!
The problem is.... the bar is set too low for NO Knock Warrants.... They DO Not need NO Knock Warrants in MOST Cases.
Great work guys!! Thank God for The IFJ!!
The city will only pay if you sue them. But to sue them you need to have money. The poor get F'd. I am surprised that SWAT doesn't cover damages. Don't they have insurance?
60 cans of tear gas? WTH.
I don't understand why the home insurance company, doesn't fight this battle. This whole thing is unbelievable!
Steve Lehto (Michigan Attorney) sent me. You folks are the best!
Great advocate for IJ too bad they mispronounce his name
You allow police forces to obtain TANKS, they use it in a neighborhood to try and arrest ONE person.....I seee a problem,
I'd heard of IJ in the past, but never got really interested until Steve Lehto (LAY-to) spoke about their invaluable work.
This has been going on for decades... Americans need to learn to hold police accountable for their abuses.
Sounds like the commander was on the take and knowingly raided the wrong house!
Has an unjust enrichment argument been used? I'm no lawyer but can't see how the city/state/etc can be enriched by the person being arrested and yet the innocent homeowner who had their home destroyed due to decisions made by the city/state/etc having to bear the burden.
Thank you IJ lawyers.
