Huge shout out to the surgeons who let the guy live long enough to face the consequences of his actions
The surgeons actually used him as an artificial skin graft guinea pig in order to later use that experience to heal his victims. He's currently the person with the most artificial skin grafts in the world.
An article had a quote from the surgeon. The only good thing to come out of the whole thing is that the doctor gained knowledge for skin grafts which have been used in other operations since then. The doctor's quote: "I believe you could say that saving [Aoba’s] life was meaningful, as it allowed for him to stand trial. I’m sorry, though, but I have absolutely no sympathy for him, and want him to feel the weight of the crime he committed."

More quotes from the surgeon: "Taking someone's life is not acceptable for any reason, I want him to explain everything at the court, and express sincere regret and apologise."

Plagiarism is a word that gets thrown around these days by people who don't understand what it means, and people would go out of their way to call something plagiarism for looking alike without any legal ground.
Plagiarism itself is a dumb af concept, be real, nothing is 100% original, everyone gets ideas from others.
I had a teacher in high school who was also a defense attorney and I asked him a question about defending someone who is definitely guilty. He told me that the purpose of a defense attorney at that point (if I remember correctly) is to ensure that the defendant is tried fairly in court.

Nah that's just half the truth. Yes that is their job in theory (mitigate cases where someone who have no idea about law get dunked on in court) but they care more about lessening people's sentence and possibily to get client off the hook not the notion of fairness. They are paid by their client, being unfair in favor of their client is their objective.

@@bimapriambada1098I think most of these old people are homeless and are habitual criminals who have been in and out of prison since they were young. It is said that especially during the colder months, the number of elderly people who commit petty crimes in an attempt to enter prison increases. At least once they are in prison, they can not only protect themselves from the cold but also enjoy chicken and cake at Christmas and lavish osechi dishes at New Year's.

And by the way that is for good reason... because there are all too often actually innocent people on Death Row (not just in Japan). Prosecutors in Japan are really viscious, when they believe (for whatever reason) that you are guilty. They will withold exculpatory evidence, hinder the defense and even fabricate evidence to get you convicted (keeping that 99% rate alive and well). And even if they are found out (like in the Hamada case), they will fight tooth and nail to keep a person they KNOW to be innocent on Death Row.
To answer Joey's question, the truth is, and I would not surprised if it is like this in most courts worldwide, every person has a right to a trial, regardless of whether they are guilty or not. A defense attorney is not necessarily employed to get the defendant off. Sometimes they are there to get a lesser sentence. This guy didn't deserve a lesser sentence, but it is his right to be tried.

Yeah the point is that everyone is presumed innocent until proven guilty, so you have to give them a defense. And in some cases, people’s mental capacity or state does effect the severity with which they should be punished… like for instance in the United States, some guy who was a house painter tried to assinate Pres Jackson… turned out the chemicals in the paint drove him mad and he thought he was Richard the 3rd and Jackson owed him money. Needless to say they didn’t give him the death penalty because he was clearly not right in the head.
Best I've heard is how defense attorney is similiar to doctor, much so in this case also. Doctors treated this guy for a year knowing full well he took lives of 36 people. Doctors should do their job regardless of the person in question, defense attorney is very much the same.

What was insane is the killer claimed that the studio plagiarized his contest entry, but the scene is so generic, it could be literally anything, especially since Kyoani made so many slice of life anime. It was some characters going to the store to buy meat.

From what I remember, he had entered his story into a competition to be published/adapted to an anime, like Evergarden. It didn't obviously win but he became obsessed that some parts were copied by them. It wasn't true and the story he thought was copied was written before his one was.
The head of Kyoani and a couple other actually went back after the attack to review all of the submissions manually and confirm whether there was any actual plagiarism that occurred. To still go to that much trouble over a spurious claims shows what standup people the owners of Kyoani and their staff are.

Hi Joey, legal defense isn't about "winning or losing" it's about ensuring their client is trialed fairly within the courts and to ensure that legal proceedings are done so in accordance to legal governce and not out of spite and revenge which dismantles the concept of democracy.
If the courts were permitted to pursue revenge then the idea of precedence would be dismissed and place too much power to individual judges.
Well, that's how it should be, but it doesn't always work that way in real life, especially in Japan.

Yeah. You may be outright guilty of murder but the law will still allow you to appeal and avail all other remedies available to every accused. Although sometimes there are lawyers too good at their jobs and get their clients off the hook on some obscure technicality.

Fucking Lucky star (the OG modern "Cute girls do cute things' anime) They'd just wrapped on Violet Evergarden before the arson attack. I'm not even listing 1/4 of them. This was a cultural tragedy. They were like the Van Gough of anime, just cranking out classic after classic.

K-on was my first anime, and it got me into guitar. KyoAni made part of who I am, and I pray for the souls who died there.
He had submitted his manuscript for the annual Kyoto Animation Award contest (it was not forwarded for consideration) and believed that a minor scene in one of KyoAni's productions had come straight from his work. However, the scene in question was a trope that had existed for years.
Fun fact, only one submission has ever been deemed worthy of the KyoAni Grand Prize - Violet Evergarden.

The lawyers have to defend their client no matter what, regardless of whether or not they believe that their client is innocent. Failure to do so might get them fired or even disbarred.

I remember this day so well. I just had a newborn and was cleaning guest rooms in Fushimi with the baby on my back. It was a sunny day so I opened the windows to air the place out and then suddenly it stunk like smoke so badly. 😢 A few minutes later all I could hear were sirens left and right. I turned on the car radio on my way back and heard what was happening. That was such a shock.
Joey don't attack the lawyers who defended the arsonist. They were paid to defend the arsonist probably because he requested for an attorney. It is possible that they dont want to but had to defend Shinji Aoba. So the reason why the attorney used a "mental disorder" claims to defend the criminal is because it is one of the most common and easier claims to try and contest the trial. For all we know, that was probably the only thing they could do to try and "help" this criminal, even if they don't want to help the guy. It is their job to literally defend their client, they are lawyers at the end of the day. And the guy gets the deserved punishment. No reason to further destroy the careers of the attorneys who tried to "defend" the criminal.

As I said, we don't know if they WANT to or they HAD to defend the criminal. I do not know if they are even allowed to reject an assigned attorney position for whatever case trial as serious as this one goes.
Don't get me wrong, I too questioned these excuses because an arson attack is usually done by an evil, sane perpetrator, RARELY by an actual mentally disordered patient. I just don't see why we should press on this matter with the lawyers. They're just doing their job.
For the "how to the defense lawyers do it" it's the idea that everyone deserves a good defense even if they're obviously guilty or "evil" or anything. There are always times where someone is "obviously" guilty but it turns out they actually weren't or there were other significant factors, and letting them have a defense is better than a sham court where they just get executed. Also, at least in the US, there's (theoretically, sadly not often in reality) the idea that it's better for many guilty people to go free than to infringe on the rights of an innocent person.
That's probably because we know we've executed people who were later found to be innocent.
A friend of a friend spent YEARS in prison for a crime he hadn't committed. He couldn't be with his mother on her deathbed.

@@stingerjohnny9951 I mean, it's a double-edged sword. You want to bring people to justice, but you don't want to wrongly convict someone either. "Innocent until proven guilty" may allow more evildoers to go free, but "guilty until proven innocent" not only isn't fair, it's an incentive for the real perpetrator to actively frame someone else for their crime.
If I remember correctly, he had entered a competition of the studio, in which you have a chance to have your scene/idea featured in one of their works (or something like that). He wrote a scene of two characters going to a supermarket and buying meat on sale. He did not win and for some time everything was fine, until he watched one of the studio´s anime, which had a scene similar to what he wrote. If you watch any documentary about this tragedy, you learn that he was pretty unstable and agressive individual and seeing this scene was his last straw. In his head the studio stole his work and he was in for the revenge.
I’m not sure about this particular contest but the whole plagiarism thing would also depend on who owns the rights to the story in question. Some of them stipulate, if in the fine print, that all entries to the contest become the property of the company running the contest, in this case KyoAni studio(?). Which makes this whole thing even more sickening imo.
@@lmizutani47even so, I don't think plagiarism would even apply here since a lot of the things he claimed were plagiarized were basic simple things. KyoAni is known for slice of life genre, so about of the things that were "plagiarized" were literal everyday scenes of life.

There's an article that talks about what he thought was plagerism... it was super mundane things in a show like: a teacher telling a student they're going to fail if they don't try harder, and a school banner flying in the wind. It's pretty crazy. I don't think a person like this deserves redemption. I'm not happy about it, I'm still devastated, but it's a relief to hear that justice was dealt.

If I recall some old video discussing the arson right, the arsonist was an aspiring screenwriter who entered a script into a contest hosted by the studio. He didn't win and the "plagiarism" that triggered the attack was a character getting a discount on meat that was almost out of date. That something so trivial led to something so horrible is mind boggling.

A while ago I remember listening something were some (criminal rights?) lawyer said about similar case basically that "If this isn't definition of insane to us, what is?"
I'm not saying anything about sentencing, but it kinda interesting that Joey himself proof the point that lawyers try to argue.
He's malicious instead of insane.
He's coherent enough to make a submission, perceive plagiarism, plan arson, disguise as officer, commence transactions of chemicals, track their targets for years, and physically attend the scene of the crime.
He is morally skewed, but he is in control of his actions where the malice is. He's not insane enough to actually go into the street and behave like a crazy person so the insanity plea didn't taken.

@@defaulted9485 You have a very strange view of mental illness. Insane people aren't monkeys who jump around and scream.
3:46 dunno how it is in Japan, but in the US (and most common law jurisdictions, I would presume) there's several tiers to "insanity" defenses. The full-on affirmative defense of "I'm crazy so I'm not guilty," has a pretty high bar complete with a lot of medical testimony, but the less-comprehensive defense of "I'm not a full-on crazy but just had diminished capacity" is more often used. The latter can stave off things like the death penalty or get the charge downgraded to a form of manslaughter.
As for how an attorney can try to do it, you kind of answered your own question. You couldn't help but call the whole thing "insane" despite your whole point being that it should be difficult to pull off an insanity defense here. The fact that the act itself is so outside the boundaries of normal human behavior can ironically help a bit, especially if the accused (1) had no prior history of doing anything off, (2) was a quiet but also generally productive or at least self-sufficient member of society, and/or (3) suffered a large (or series of grinding) setbacks that is widely acknowledged to be able to chip away at anyone's mental well-being.
As for whether or not the court/jury buys such a story is an entirely different matter. Honestly more often than not in truly heinous crimes, the entire defense is just something the system patiently sits through, simply because they have to before bringing down the hammer.
I wonder if there's an actual unbiased (if at all possible) psychiatric evaluation over there.
@@arualblues_zero I mean to proof criminal insanity, you basically gotta have no conscious and no self preservation. Best example of criminal insanity is the guy that killed his roommate, because he wanted to see what happened. Didn't really hide the body and had no plans to escape either. And if you do get that kinda sentence it usually means you're locked up for life, over medicated to keep you calm and never get out.
@@junrobin9335 Not from a psychiatric point of view. As I pointed out in my comment, it's a complex diagnose that should be properly assessed by psychiatric medical professionals (preferably one from prosecution and one from defense).
There's no "criminal insanity" as a diagnose in the DSM or other psychiatry books.
The "signs" that you mention as "proof" aren't such, it varies depending on which condition we're talking about.
@@arualblues_zero Criminal insanity is not really the diagnosis they would get. Criminal insanity is described in the law. It has nothing to do with like psychiatry or the actual diagnosis they would get.
In the law it would be described as a lack of motive and a lack of self preservation after the fact.
Most common diagnosis that would cause someone to display the behaviour in the law is actually people with antisocial personality disorder who have committed a crime.
And to decide on criminal insanity there's always experts. Not just from the persecutor but the defense can call up their own as well if they wish too. The job they got ain't to diagnose the disorder but to diagnose how compos mentis they where during the crime and if they even understood they committed a crime.

I feel so bad for not knowing about this story earlier and i can't even imagine how the familys of the victoms must have felt.
To think he would do something so heinous for such a petty reason is horrific. Glad that at least we got to see him face justice but it won't change what the people affected must have gone through. Hope this at least eases their pain.
I found out about it back in 2019 and was super shocked because it was with one of my favorite studios. I'm glad that the law has finally decided and that this crazy person has received his punishment. Now friends and relatives as well as fans can finally put an end to it It won't bring the talents back, but they can finally find peace. As the saying goes, karma always strikes back. And by the way, great new look.
I can guarantee you that's not tears of happiness, it's just a release from this horrible nightmare, a closure

My opposition to capital punishment comes down to two factors: we're not good enough at determining who is and isn't guilty (think of all the people who have been executed only to be later exonerated) and it is in some sense psychologically harmful to us for the state to have the power to execute people (both as a society and for the individual executioners). That being said, I'm not exactly shedding any tears for this guy

So many mistakes made in this video while talking about human rights, like we're talking about something that can be granted or denied freely, and while talking about the right to defense in court. What he's done is absolutely horrendous and he deserves to be punished, but even a mass murderer who took so many lives has the right to a fair trial and to defend himself, even though the proof of guiltiness is clear and the conduct is dreadful.

Not that I'm saying that his lawyers' defense makes sense or is good. But defense attorneys need to do their job, and there's a saying that even the devil has the right to an attorney. Basically, if there's no defense attorney (for most democratic countries anyway), the conviction of a criminal is meaningless. So while I understand that defense attorneys can be really annoying and may appear like they're the enemies of the public, the fact that they're doing their job gives more meaning to a conviction (when it happens).
What I'm trying to say is, if a suspect gets judged/convicted without a defense attorney, that wouldn't be real justice. Because without a defense attorney, it cannot be proven beyond doubt that a suspect is guilty.
I hope joey sees this but in regards with how lawyers deal with these cases at least in my country we go by the idea that "everyone deserves a fair judgement" we don't have to like it we just have to fulfill our duty, yes we can litteraly just go "i know you are guilty so we just have to settle for the best outcome for you" this is a massive simplificacion of justice and all of that but it should help clear things out

Lawyers are required by law to defend their client to the best of their ability. Its not like they like the client or agree with what they did, etc. They can literally get in trouble for not defending their client as best they can.
I still remember vividly the news when I read them. I had severe depression and anime (especially KyoAni with their beautiful work) helped me cope. I'm devasted for the loss of life, the victims, their friends and family. Not only did the perpetrator kill 36 INNOCENT young and talented people, but also injured 30 more. The perpetrator had an unfair delusional reasoning.
I usually want to believe in human good, but his crime is simply irredeemable and I hope he will think about his crime every day until he is put to rest.

I remember being on exchange to Kyoto and paid my respects to Studio 1 in 2019. There are really no words to describe the aftermath scene… but the overwhelming support from the Kyoto community such as through donation boxes and flowers at the scene was heartwarming (and still is!)
I also attended the Free! 10th Anniversary Event last August and at the end of the event, they included a timelapse drawing by Futoshi Nishiya (the character designer) was very emotional and I had broken into tears.
It took 5 years, but justice has been served.

Pretty much. It might take a few more generations for people to realize that free will is probably a hoax and that retributive justice is arbitrary trash that's only good for reinforcing rules. For now it seems we'll be left with big red arrow entertainment-justice complex videos on channels like these. I'm no lawyer, but a few of my family members are. Even if it seems clear that the person was in the wrong, it's not useful to start picking and choosing who should get the best possible representation in course (because otherwise it's a slippery slope where certain people just won't be represented). But yeah if nothing really sticks in terms of defense - like an insanity plea- , trying to reduce sentencing is the best they can hope for; things like feeling guilt for a crime can carry a lot of weight for some defenses.

Many people forget that the hand of justice does not always point to the right person and that, in fact, lawyers provided by the state do not have the right to refuse their work, and therefore are obliged to defend everyone who submits a request. These are rules, they exist for a reason.
8:40 Kyoto Animation was not also an animation studio, but also a publisher for novels. So he probably sent a of his work. Not to defend him and his claims for plagiarization was very weak anyway, but that's probably the reason why he attacked Kyoto Animation and not any other studio that had random features that resembled his novel. So usually amateurs send their drafts to publishing companies, and publishing honor the best novels with an awards which includes publishing contracts, of course--the no.1 novel usually even getting a contract for screen adaptation. It's fair to assume that this guy's work was rejected.

I remember seeing this on the national news in Denmark, when it happened. It was heart breaking. I had just begun watching Violet Evergarden, and had seen many of their other works too. They're great. The fantastic people of KyoAni will be remembered through their beautiful stories as they continue to captivate people. May they rest in peace.

Also regarding 6:53 , I’ve recently found out from crime podcasts that due to previous cases of criminals committing unalive before their execution, therefore was changed to a death row inmate to know their execution few hours prior. In this case, Shinji Aoba definitely doesn’t deserve the ‘easy way out’ if he were to consider unaliving himself before his sentence
I live in Kyoto and this was such a big deal, everyone knew about it wether they were anime fans or not. I went to the site after it happened and it was so heartbreaking. Glad to see there is finally a conclusion.

R.I.P to a lot of the K-on! staff, from what I remember a lot of the staff that were killed in the attack worked on that project. That was my childhood.
If I remember correctly, the man submitted his story to Kyoani's novel writing contest and that's why he thought they plagiarized him.
I remember I was in China at the time when it happened and there was a part of me who wanted to drop everything and fly over there to show my support. I cried so much, so much sadness that summer. After Kyoani, Etika, and personal events, I cried more than I have ever and I feel like I have been dried of all tears. And yet I still hurt so much when I even see the photos.

Did the Kyoani building not have alternate fire-exits? How did one man setting fire to one entrance end up killing so many? Were there no sprinkler systems?
I think they were blocked or something in a way by the killer. I don't quite remember but there are vids here on yt about what happend and articels out there
I remember reading up on this when this happened, so some of my info might be wrong. From what I recall, the building was VERY old. So much so that a lot of the sprinklers didn’t work, and there was only one exit from the building, the central staircase that was on fire.
A lot of Japans older buildings have a lot of paper and wood in the building, and that stuff burns like tinder, which added literal fuel to fire.
@@beanjothe sprinklers where better then what is required by the fire code. However the fire code was based on the fire spreading naturally but he had poured gas everywhere spreading it faster then which overwhelmed the safety systems.

Although I must admit as a European the death penalty always feels kinda weird cuz in Europe the worst thing you could get is life-long prison.
To add to the other law-related comments here: There's a reason why the quantum of evidence required for a person to be convicted is beyond reasonable doubt. It's to erase any wiggle room that the accused was not the one who actually committed the crime and the one who makes that wiggle room is the defense attorney while the one who eliminates that is the prosecution.
Even if you, as a lawyer, know your client is guilty, your job is to give them every available remedy the law allows which may be bail, a plea deal, mitigated sentence, etc.
One lawyer said that when defending a criminal, even when knowing they are guilty, they have to trust that the law will be applied correctly and justice will be done.
because the truth is that everyone deserves to be defended and while some cases seem obvious, some times it isnt always like that.
Again lawyers will do their job and then its up to the judge to make well.. the right judgment

to be fair, the murderer took approximately 2 years in the hospital to recover before he was able to be charged in court, and then covid came therefore everything got delayed

According to law in most countries, every criminal has to go through a trial and you need a lawyer for a fair trial to happen. Therefore if the criminals have to be punished it is necessary that they also have legal representation.

He sent the book into them as part of a competition. He didn't get recognised at all in that competition, but then his storyline was on a series they did. Aledgidly.
