Some of these channels are scaring Veterans with “the VA is coming after your disability with new changes.” I have worked there for 20 years, so I know that’s not true. I agree to some point the VA needs to improve in areas, but their mission is not to take your money. If I did nothing but try and take Veterans money away, I would have been fired, because they have monthly quality reviews on a percentage of everyone’s work. So thank you again!!!

I recently got diagnosed with obstructive sleep apnea secondary to a service connected condition. I received my assisted breathing machine. I was gonna file a VA disability claim which is currently rated at 50 percent. However, there are now considering more changes to sleep apnea claims. I am currently at 90 percent disabled and I am hearing other disability ratings are gonna drop. If I open up a new claim, will I get reduced from the proposed changes. What should I do?
This is not a one answer fits all. That said, the proposed changes may change how a rating is assigned but no so much ratings are dropping. We have seen many veterans that have filed for their increase and been successful. The key in your case is knowing if there’s a path to 100 if you merit it based on the other conditions you have. Let’s say you have a case to make for migraines and for IBS and both of these would be rated high enough (based on your severity of symptoms) and that it takes you to 100% then that is a new argument and that doesn’t affect the other ratings. That said, sometimes a veteran may go to 100% but not P&T which might prompt the veteran to ask for P&T this in turn can trigger a review of everything. So again it really comes down to what are your options and what is the best course of action. You may well be in a situation where you might need to file this claim, you may well be able to file a total disability due to individual unemployability (TDIU) claim (granted you meet the requirement). (Noted in the new regs) below is a snippet. I will be doing a separate video on mental health. I just posted a sleep apnea video. “But, notably, a numerical value of 4 in just one domain will warrant a 100 percent rating; and a numerical value of 3 in just one domain will warrant a 70 percent rating. This criterion should generally lead to more generous compensation for veterans than the current rating formula, which requires “total occupational and social impairment” for a 100 percent rating and “deficiencies in most areas” for a 70 percent rating.”
You seem to be very knowledgeable. I need your help. I'm currently at 90% put in for Sleep Apnea Dec 2020 through a Judge's review after being denied. In May of 2021 I requested my claim be elevated due to financial situation. As of today I have not heard anything. Whats my next move? Thanks

Now you mentioned Congressional, please direct me where and who and how do I get this type of help. I'm based out of Florida. The final option of increasing other ratings I'm considering that but the Sleep Apnea is tired to my intent to file date of Sept 2017 and VA knows if they approve the SA they will have to pay me the back pay of about 60K. And if I file for increase, which I'm sure I will get, they WILL NOT have to pay me the back pay, am I correct? At any rate if this is your livelihood I'll glad pay you for your services. If the increase on other claims takes you to 100% and say in a few months sleep apnea comes back approved the effective date stands and they have to then go back and pay you from that effective date to when ever the 100% kicked in on the increases for other conditions. There is also a possibility for Total Disability Individual Unemployability (TDIU) if you meet the requirements for that. You have options for sure just have to explore the best one for you. To the congressional that would involve getting your local congressman involved which also has shown to be helpful for some. The White House line has been helpful but like you mentioned it really depends. What worked for one may not for the other. The system is sadly not good in that regard. I hope this helps.
I an currently waiting on my new Cpap machine due to the recalls. I have had issues with my machine while using it and have spoken with my sleep doctor and shared my issues and concerns. He referred me to dental and they made a mouth piece for me to use while I sleep. Will this have an impact on my rating for not using the Cpap machine but I am using the mouth piece? Thank you for your time.
I just uploaded a video for sleep apnea with some points there. I’d high recommend making sure it’s in your records and a sleep test study is done now along with any other conditions you might have.
Hey this is off topic but you seem like you may be able to help me, I filed for ptsd and anxiety. With the anxiety I was diagnosed in service. The va has it as ptsd claimed as anxiety, I’m not sure what that means. My question is if they deny my ptsd does that mean they will deny my anxiety as well? Even though it’s service connected ?

The changes to sleep apena will make it more difficult to obtain a 50% rating. Just follow the money!

Don’t do it , lay low! Too risky!
This is not a one answer fits all. That said, the proposed changes may change how a rating is assigned but no so much ratings are dropping. You can have REE medical help. They helped me get 100%.

No updates from the VA as of yet, they took back all the public inquiries and responses to the proposed changes. So we will see.

Hey this is off topic but you seem like you may be able to help me, I filed for ptsd and anxiety. With the anxiety I was diagnosed in service. The va has it as ptsd claimed as anxiety, I’m not sure what that means. My question is if they deny my ptsd does that mean they will deny my anxiety as well? Even though it’s service connected ?
As far as claims go they are both the same . not two different issues that is ....If that helps .

Nope. You will be fine the window for feedback is until April so it will take a few. They will share effective dates etc as they get closer as well.
