    Todd couldnt lift his 110lb wife when he weights 220lbs but he can punch a windshield from the inside in a sitting position with only milliseconds to react using both hands to crack and bulge out the windshield while not loosing control of the car, also getting injuries to all 8 knuckles, his thumb and the back of the hand.

    As bad as it sounds....
    If he would have admitted to domestic violence where they both fought, and he accidentally killed her... he could have gotten away with aggravated manslaughter.
    So, he would have been better off telling the truth.

    • @Rae_777
      @Rae_777 2 роки тому +2

      Especially with his lack of history and lack of motive. His defense MIGHT have even been able to get a psychiatrist to claim diminished capacity or something. I could easily even see a plea deal for involuntary manslaughter with Todd’s arguably sympathetic personality and meek physical disposition telling the truth and saying how devastated and sorry he is.

    Lol, yeah, don't bother addressing the tiny issue the jury has with the fat that Todd's memory of what happened conveniently drops at the most relevant moments and that anything he does say, anything, is disproven via physics and material evidence.
    You can scream theres no motive and you would be right. Huge problem for the State except for the fact that Todd and everyone who knows him never ever witnessed a serious argument in their entire 26 years which is so bizarre and foreign to any other human whos had a relationship that it only makes the possibility that Todd snapped more believable than unlikely. Its just too weird.
    All that plus the fact your police stateement was ridiculous.
    Todd could have been out in 5 if he just fessed up.
    He had a perfect record, unlikely to reoffend and I doubt he intended to kill her. He could have made a plea agreement for manslaughter and probably got it but no, he was too cowardice to admit the truth. Good ridance.

    The worst defense theory ever. He might as well have said: "Todd and Barb were practicing the two-step in the front seat when, suddenly, a squirrel ran onto the road with a huge pipe, flipped them off and chucked the pipe through the windshield- hitting Barb in the face and causing Todd to vear off the road- and in doing so spins a 360*, ending up backwards in the ditch- where, by now, the squirrel has returned with a few squirrel buddies armed with small knives and crowbars and instantly, without mercy, attack the couple, pummeling them relentlessly- causing a myriad of injuries to Barb as Todd tries to fend them off with his fists- which end up scuffed and bruised...and then.... (Anyway, I'd be more willing to believe that story than the one presented here).

    • @josephdale69
      @josephdale69 4 роки тому +11

    So that mug caused a broken bone in her neck, deep bruising on the neck, multiple scratches, a broken nose and bruising on the inside of her lips without breaking the skin on the outside. Are they serious? This is the most ridiculous defense theory I’ve heard in all my years of trial watching. A pipe coming through the windshield in the manner that Todd described would cause one impact to Barbara yet she is covered in over 50 injuries from head to toe. How do you get multiple skull fractures on the back of your head when the pipe would be coming at you facing forward? Simple you don’t. Let’s not forget Todd’s injuries, the scratches on both sides of his neck where barb would have been clawing at him which also explains all the scratches on her own neck from prying at his hands. Every piece of evidence in this case doesn’t line up with his story at all. They may have looked like they had the perfect marriage but for whatever he snapped on that day, beat her to death and then panicked and did everything he could to cover it up so his being “distraught”would be in line with that.

There would likel;y have been ice. It should be relatively easy to prove, just use their ice and water in the mug then allow to sit for the amount of time they took and I bet the vast majority of ice and water would have been left and should have been a pretty obvious spill in the car yet no one seemed to notice any water or ice.

    I really am torn on this case. Bc I know things like "eyewitnesses" can be very very wrong. the eyewitness saying the window wasn't busted shouldnt be believed. he said his windows were down bc it was a beautiful sunny day, which was not true bc it was cloudy, rainy, and cold. the chances of him not noticing it, not seeing it are very very high. chances tht rumors in this town are running rampant and many have already made up their mind, extremely high. the chances that this couple was married 25yrs, he was abusive, controlling, or anythign at all and NO ONE, not her best friend, not their best friends, not her coworkers, not her mother, her adult children, NO ONE saw or heard anything out of the ordinary ever?? I don't believe that all these people that loved her and was close to her would ALL lie for him. every single person tht was close to him lied. if they ever had fights, if he was a controlling person, if he was a violent person, if she was thinking of divorce, wanting a divorce, I think someone would've spoken up in defense of Barb. I think it was a freak accident, he was stupid and said things he shouldn't have bc he was trying to come up with reasons for her injuries when they kept asking him. so he just started rambling. maybe i did this,maybe I did that. they should've done research on past accidents like this. I have a friend who had a huge bearing fly out from a truck, came thru windshield and hit him on the top front side of his head. how did it hit the top of his head if he was driving? he had bruises and lacerations on his shins, knees, legs, hands, arms, elbow. when it hit him his body seized, muscles seized. his legs went out and up extremely hard, hitting the underside of dash, his arms did same thing hitting whatever in the truck. his head went down hard into the steering wheel bashing his nose and mouth. he looked like he had been beaten with a bat. these cops would say "how did one bearing hitting his head cause all these injuries"?? point being our bodies do crazy things and he said she was "flailing" which sounds exactly like what happened to my friend. he was lucky to live.

      Jennifer, with respect I must challenge your thinking. There is no way you should be torn on this case because he is guilty as can be.
      I agree eyewitness testimony is often wrong. Disregard all the eyewitnesses then. The physical evidence alone is incredibly damning. There are so many, but I'll use only a couple: scratches on both sides of Todd's neck, his chest, and abrasions to all the knuckles of both hands. Also him lying about when she had to start work. There is absolutely no reason for him to do so unless to cover his guilt. Why do mental gymnastics to conjure some unbelievable "freak accident" when common sense shows you it was a fight?
      To your other point about their wonderful marriage, it is a logical fallacy. If a store has never been robbed, does that mean it can never be robbed? And all the evidence shows this was obviously a rage murder, completely not planned. She said something that cut him to the quick or she gave him an ultimatum, and he just totally lost his control in a fit of rage.
      If you think this is a "freak" accident because you had a friend who had one, that is another logical fallacy based on experiential bias. If you have watched Kendhammer's interrogation and cross-examination and still think so, then you are lost in trees you recognize from your childhood while completely missing the forest of common sense, the totality of all the evidence, and a ridiculously obvious consciousness of guilt.

    I'd like to see that pipe. If it was used as a "cheater bar or pipe" it will have some marks on it where it was used to tighten cargo straps or chains. Also, if the truck driver saw that pipe come off his or her truck and strike a car, the driver would be taking the first side roads available to lose whomever may be coming after him or her. The pipe most likely wouldn't have any DNA from the truck driver on it, truckers use gloves when handling cargo restraints and cheater bars. That driver needs to come forward.

    • @rayray8687
      @rayray8687 4 роки тому +5

      Peacock Moonlight: If you’re a Wisconsin taxpayer don’t put away your check book just yet - I think you’ll be paying Mr Kendhammer’s room and board for at least another 28 years. Under Wisconsin law he had 45 days to initiate an appeal but after an incredible 7 extensions he just filed it a few weeks ago, Aug 11, 2020, nearly 2 1/2 years late. To me this suggests his lawyers couldn’t find any believable grounds for appeal so they’re simply going to grasp at the same old straws a jury didn’t believe in the first place...and this suggests that his appeal will likely be tossed out and he’ll be off to the Wisconsin Supreme Court next. Anyway no matter how it goes Mr Kendhammer is going to be a guest of the State for a long, long time. In addition to your share of his accommodations and lawyers fees you might also consider sending him a bit of extra canteen money over the next several years. Just a thought.

    • @FathomlessJoy
      @FathomlessJoy 4 роки тому +1

      @@rayray8687 I suspect everyone in Wisconsin will fork over millions when his appeal is heard. That is what these sloppy convictions tired by incompetents get us: DAs elected to Attorneys General, overcrowded prisons, and heavy restitution burden when the convictions are overturned.

    • @rayray8687
      @rayray8687 4 роки тому +3

      Peacock Moonlight: I appreciate your blind optimism and I have no idea how you decided Mr Kendhammer’s innocence but I do know how 12 jurors decided his guilt - they listened to 9 days of testimony from both the state and the defense, they deliberated and they came to a unanimous decision. Since jurors are the entire backbone of the US judicial system, appeals courts hardly ever overturn their decision unless there are grievous errors by the judge or some sort of malfeasance by others or new evidence worth looking at. As far as I know Mr Kendhammer’s appeal document hasn’t yet been made public so I have no idea what his claims are. I do know it has a 93% chance of being denied.
      Anyway, if his appeal at this level is successful it will simply end up in a retrial which will take another couple of years and another couple of million dollars. If his appeal is denied he will apply to the Supreme Court which will take several more years and several million dollars and will have even less chance of success. As I said, don’t close your wallet just yet.

      @@FathomlessJoy: Nearly all spousal murder cases are decided by interpretation of circumstantial evidence because there are usually only two witnesses and one of them is dead. The other person knows things that the rest of us will never know - the things you refer to as “major holes” - and I agree! They ARE major holes. In this case a jury of 12 individuals obviously found more of these holes in Todd Kendhammer’s various stories than they found in the prosecution’s theory...and frankly so did I. In fact I found some of his testimony completely unbelievable and a few things physically impossible. I’ve watched and read about this trial extensively over many months and I would definitely have found him guilty.
      In other news, you seem to imagine yourself very clever by calling other people “moron”, a term that I find is most often used by children and by people of lower education who can’t come up with an actual supportive argument for their opinion - you are obviously just smarter than everyone else and that’s it! But I am not a moron and I’m willing to bet none of the jurors are either. I’m also willing to guess you don’t have an education much beyond grade 7, and that might be because you are only 13 years old or it might be because you dropped out being already too smart for all us morons out there. Anyway, get back to me when you’ve expanded your vocabulary a bit - it’s never too late!
