I hear you Craig. I’m a civil lawyer. While I admire your approach, if anyone took me that deep into litigation, I’d take him to the cleaners for all of it. You’re not wrong to walk away, but I think that d-bag needed to feel it so that he doesn’t repeat the behavior with anyone else. You’d do the world a favor by handing him his ass!

Myself also. There comes a stage where someone needs to learn a lesson that it is not reasonable to just sue someone based on an emotional basis, rather than a fair basis. I would have pushed to get some maximum money back, including the costs of business dislocation, etc. Then to show him that I was fair & reasonable still, I would have an agreed figure, but give him some back to make a point.

Craig, What a great video!I've been a California attorney for over 27 years. Over that time, I've come up with several rules:
    1) You win a case before trial . . . you win in the preparation.
    2) It's easier to solve a problem before trial.
    and
    3) If you go into a case to settle, it won't settle. If you go into a case to win, it'll settle.
    Yep, Craig . . . I believe in CYA1

As a consumer I appreciate your honesty. My father in law is a business owner, I worked for a Mom and Pop aerospace engineering company for 22 years, I have seen what business owners have to go through with a public that lies! Plus as being said public I have also found that what goes around comes around, no deed, good or bad goes without future repercussions. I hate car buying, when you go in with a purchase in mind you walk into that dealership with your guard up! I am referring more to new car purchases in general. Dealers flip cars they know nothing about and customers expect a dealer isn't selling junk, otherwise why go to a dealer at all to buy a car? The customer is simply right to be pissed when a dealer is marking up cars for profit without actually inspecting and servicing first.

Good job. Reminds of when I had a customer make a rush purchase on a "NEW" boat. They used it over the weekend and brought it back claiming it had defects and wanted a another NEW boat. Pure buyer remorse I thought at first. Nope they had done this before. They just left the boat would not come get it. It had full warranty. I personally took it back to the factory for all warranty claims to be solved. Received threats from him and his lawyer. My lawyer advise me to settle it. I said I would rather pay the my attorney than give him his money back. In that state the law is more favorable to the customer than the businees owner. Always CYA on anything and everything you can think of. Found out these people had already sold the boat and were just waiting to get something out of me. Like you I did eventually pay some good faith money to settle(half of your total). My attorney said I went well above the law to rectify the situation. Best part about this experience was 1. I don't remember his name. 2. I still made a profit on that guy, even with the aggravation. But it like you said the law is funny about things and you have to ALWAYS PROVE your case and still can go the wrong way.

I bought 6 cars in the last 9 years from a used car dealer similar to yours here in Cranston, RI. They have been more than helpful when things went wrong with the cars. Craig,
When it comes to customer satisfaction and how to deal with litigation, I would say you already have the wisdom of an experienced lawyer and business man combined.
Having been a partner in small retail oriented training businesses, I came to realize just how time consuming, expensive, and distracting it can be for management to be dealing with the negativity of litigation. I fully agree with you that it is better to CYA your business legally at all times and then find a way to settle even the most absurd legal claims made by customers. Regardless of how much your business receives in a settlement it cannot repay you for your lost time, loss of productivity, and the distraction from your core business activities.
It took me some time and experience to temper my inner feelings of infuriation when customers who were treated well wanted to litigate over fanciful claims. Well done, “You’re a better man than I am, Gunga Din!”

What blew my mind when I sold cars was learning that a dealership was legally able to mark up a person's interest rate by up to 2% in my state. People are completely oblivious that a dealership not only profits by selling a vehicle above what they paid for it, but also by marking up the rate which they secured for them from the bank.

Craig your 1000 percent correct. I am fighting the same type of issue. I was sued in the start of 2020. Here is my issue and its total bullcrap. So I had a guy sue me for get this, 33,000 dollars. I was defaulted due to not showing up. The address the Rockingham county sheriff served notice too, I have not lived at for over 10 years. I had /have 2 other open cases (1 custody of a minor child I have custody off, who turned 18 this year but was a minor in the start of 2020, AND They had my up to date address in the court files. An The other is CIVIL superior court Brentwood for Suing a Trustee of a trust fund for theft. ) They also had my lawyers info. Jeanne Shaheens husbands law firm out of dover). So the property owner of the property that the notice I was served at, I spoke to when i found out about all this. She said 2 yrs ago, she came home and there was a notice left taped to her door. and It was soaking wet, in the rain, for 8 hours, and she couldn't even read the name nor the sheriff's name who left it. She did call the court to report it. But they didn't have a case for her name. An the address didn't come up with any cases they could find. An Then 2 yrs later. I am driving, pulled over for 42 in a 35, (was 45 about a 1000 feet before and I missed the sign it happens. ) Well Arrested Then After I start talking to the sheriff, and he says your bail is 1000 cash. I get the sheriff to agree to let me go to a bail commissioner and pay and not be processed at the county hotel. So then As soon as I find out the whole background of this, I file a motion to vacate. DENIED. Why Cause I was served in 2020 at the house I had not lived in for 10 yrs. Who I had no clue who lived there. An They never meet me, nor heard of me before I knocked on the door. See since the sheriff marked that he served me. I only had 30 days to appeal. So in 2020 I had to appeal a case i didn't know about. I'm appealing currently to the NH supreme court. But who knows if they will ever even see my case. Because the way the law works, I have to prove that a law of ethics was violated for them to agree to hear this case. An worse. The sheriff does not work for the county any longer. An lives out west. An by west. I mean western Europe. GERMANY to be exact. All I know is I am gonna fight this. Worse part is, who is to say the other side didn't pay off this dep to ""serve me"" . Since within 24 months he wasn't even part of the department anymore. COURT CASES SUCK. Wonder what would happen, If I filed a law suit against the judge in my case. Had him served at his house he lived at 40 yrs ago. An Did a SERVED like what happened to me. And Sued for the MAX amount allowed in Superior court civil litigation.

There's a term for it: SEWER SERVICE. Cause in NYC the process servers would literally throw all their paperwork into the STORM SEWERS.
I had a prick SOB process server do the same thing to me in Chitcago years ago. His problem was, when he swore under oath that he served me, I was actually out-of-state at a hunting cabin in the woods in the middle of nowhere with my father..............who happened to be a JUDGE.
So I had dear ol' dad sign an affidavit that he's known me all my life and, though he was blind, he's quite sure I was in the woods in the middle of nowhere with him on the date and at the time in question.
Yeah, my "default" was set aside, and I later sued the process server.
But they get away with it so often that it is ROUTINE.

      @IvanEatonIII So sorry-unless you've been thru a LawSuit-its gotta be up there w Tax issues w IRS..
The $$ upfront required was unbelievable just to get any lawyer to take case. Not my suit! My Ex's-
After a yr. so many things I told him we should almost do opposite of his advice- but no he did Arbitration...yep he lost over verbal when he did have it in writing. Jury case wld have won.
But I'm so sorry that is some real messed up stuff.
A guy that only Worked w Monica Lewinsky back then ended up w $250k in lawyer bills!
      It's financial hell.
So if u can do it in anyway shape or form or look for anyway or precedent etc I'd do it!
Or put it away & forgive it or I think it Will do too much damage & you sound like a decent guy-stuff "happens". I've had several good roommates over the years- but lately only bad ones- they are horrible if u fall out-so I only got through it by pretending I had a fire & lost everything.
Or something ppl face like that & nothing can do but be glad your alive & start over.
That helped me-or it can ruin your health & your life too on top of what you've already lost!

I think the CYA is certainly the biggest takeaway, but it's just so unfortunate to hear these cases where you try to do a positive thing and the other person senses weakness and tries to exploit it for all they can get (i.e. working with him after the as-is sale to go halfsies on the engine gives him the impression he could try walking all over you and extract as much as he can). That's why it's ALWAYS CRUCIAL to read and understand ANYTHING you sign. If you can't understand it, get someone to help you understand it before you sign, or just walk away. Contracts trump he-said-she-said and are hard to get out of when there's no obvious breach.
