Diana Alvarez's son always wanted to go to college. After seeing how expensive it was to send him to college, she started working in a smoke shop to support her family. A month later, she bought the store and began offering cannabis to her clients to help pay for her son's tuition. The Lit City Smoke Shop was then born.
Based in the Columbia Heights neighborhood of Washington, D.C., Lit City is part of the District's thriving gifting industry. Nine years ago, the city passed Initiative 71, making it legal to possess up to two ounces of marijuana for personal use. The law also created a loophole allowing stores to "gift" their customers small amounts of weed as long as they also buy another item, often at an exorbitant price, such as an 11-word motivational speech for $60 or a $95 Spiderman sticker.
"Four years later, my son did graduate from Clark University in Worcester, Massachusetts," Diana happily points out. She's a member of the I-71 Committee, which advocates on behalf of gifting stores throughout the city.*
Any store can get into the business of gifting weed-no license required- making D.C. home to one of the most vibrant cannabis markets in the country. Gifting shops also happen to be majority black- and Latino-owned.
Since Congress has authority over D.C.'s local affairs, gifting is a way for the city to circumvent a federal rule that prevents it from legalizing the sale of recreational weed, as 21 states have done since 2012.
Ironically, this system functions better than most regulated cannabis markets because, other than the gifting gimmick, weed is treated pretty much like any other good that consumers can just walk into a store and buy.
Meanwhile, in states like California, recreational marijuana is so heavily regulated that sellers are struggling to turn a profit and many consumers would rather buy on the black market because prices are so high.
So what's the D.C. government doing with this successful model for recreational weed?
Trying to shut it down.
Medical cannabis is legal in D.C., but up until recently, the district had an onerous regulatory system that capped the number of dispensaries that were allowed to open. Now, it's cracking down on gifting stores.
A new bill signed by the mayor in January will impose $10,000 fines on any store found gifting and $20,000 if they do it again. These stores can also have their business licenses revoked. The bill will also empower D.C. to fine commercial landlords who rent space to gifting shops.
Although the new law will lift the cap on the number of dispensaries allowed in the district, to obtain a medical license store owners will still face significant red tape. For one thing, applicants will have to prove to the newly created Alcoholic Beverage and Cannabis Administration that there's enough consumer demand for marijuana in a particular neighborhood before they can open their doors.
The new bill also grants the agency the discretion to reinstate a cap after one year.
Gifting shops may apply for one of the new licenses, but doing so means taking a big risk. According to the new bill, if their applications are denied, they'll be ordered to shut down within 30 days.
Unlike with gifting shops, anyone who wants to buy from a medical dispensary has to register in a government database, which could create problems for the D.C. area's 200,000 federal employees.
Federal law technically prohibits medical marijuana users from buying a gun or living in federally assisted public housing, though since the passage of I-71, the D.C. Housing Authority hasn't evicted anyone on these grounds.
There's a danger that D.C. will become more like California, where the illicit market for weed is now twice as large as the legal one. Licensing regimes can also be discriminatory, whether intentionally or not: Washington State has granted 558 recreational cannabis licenses, and four percent went to black applicants.
In the end, gifting store owners would rather be left alone than have to jump through hoops to be allowed to stay open. "I have employees that have families to feed. I have to pay rent. I don't want to have to go through all of that. I want to be able to still serve the entire community as I've been serving them until now," says Diana.

You want to legalize weed? Appeal the Control Substance Act and all of it's drug scheduling. It's unconstitutional. The federal has NO authority to prohibit anything. And taking away the gun rights to those who use pot is also unconstitutional. The 2nd Amendment states that the right of the people to bear arms shall not be infringed.
It was challenged long ago. Unfortunately SCOTUS has proven time and time again that they're not up to the task of enforcing the limits on federal authority over economic activity. Thanks to the four fake-liberal justices and the selectively originalist Scalia, they upheld federal prohibition of medical marijuana as recently as 2005.

Government destroys everything. In California when they first made it "legal" it was a mess. Getting a license was near impossible as they held licenses on reserve, most of those reservations were for political favors. On top of that the DEA would raid stores near weekly just to take the cash. It got so bad that some shops would have hourly cash runs to get the money off site into various safes spread out across the county. Sometimes the local PD would stop employees as they left and take any cash they had on them claiming "civil asset forfeiture" even though CA has laws against it. Is that employee really going to spend the $1,000 in court fees to get back the $200 the cops stole? Probably not and the cops know this.

The State of California has ruined one of its most famous products. I am a field biologist and ranch owner that has stumbled over more "Mendocino blacksnake" (irrigation line) in the woods than I care to recall. There was a brief period where it looked like the recreational legalization was effectively cleaning up the guerrilla grows and putting a serious dent in the influence of the Mexican cartels. But no, never let a good deed go unpunished. Sacramento and several of the Counties have so severely regulated, complicated, and taxed the production and distribution of MJ that the illicit market is back. And with it all of the same problems but with very little of the legal issues.
Let this be a lesson, excess and unnecessary regulation is almost as bad as prohibition

A good smell test on if a legalization bill is worth it or not is the part allowing for people growing their own stuff at home. Growing at home (and de-facto grey market) will always check the prices of the dispensaries they allow. If all they allow is dispensaries then they know they can tax it into infinity and give licenses to only the politically connected since they are basically licenses to print money at that point. People always need an option to opt out
Well led grow lights, living soil and ease of legal seeds make me think underground has many growing 4 plants for own use.
Yeah that's not gonna happen for a long long time. If anything, we'll see an increase in circulating dabs, waxes, oils and carts because they're heaps more convenient. Shrooms are going to make things very interesting once the ball gets rolling on that.

I didn't mean to just talk about flower, but was trying to just make a point that as long as people have a "veto" power of being allowed to grow small amounts of cannabis (and its derivatives), then the government will have something holding them back from getting too greedy with the tax revenue and raising rates to extraordinary levels. Obviously streamlined operations with standard procedures and a group of experienced professionals running a cannabis company will result in better quality product for cheaper compared to a single individual or low level individual grower. Some of those efficiencies would even leave room for some pretty hefty taxes and still hold the higher ground. There is a point where this tax burden will be too high and people will just revert back to growing their own or buying from a small time dealer that is operating in the grey market.
@@NathanHoff96 just to touch on the bit you first mentioned ("that's not going to happen for a long time"), I believe ever state that has legalized has a provision allowing for some amount of home growing, and in my mind that's all that's needed to allow for this check on over taxation+regulation I mentioned, plus effectively allow a grey market of small time dealers able to sell "their extra supply" to friends.
More people have to home grow, not just to check prices but also to check the political power of large dispensaries and grow operations.

Same here in Canada .. i was looking into a Micro-cultivating license, but when the government legalized they also Monopolized.. made it very hard for small owners to make even as a Farmer.
And like I commented earlier Canada’s not gonna be much different than America, cause. My days of assuming most libertarians only care about legalized weed are certainly coming to a middle.

It's weed, guns and gold, and not necessarily in that order, but there's a clear reason for this. The government aren't interested in taking our alcohol, our TV's or our pronouns. Weed guns and gold are what they want to take from us, so weed guns and gold is where the rubber meets the road for anyone who believes people ought to be treated with respect, like the responsible free adults they mostly are.
Or the "I don't wanna pay taxes" libertarians.. those are the worst, saying legalising all drugs is a bad idea and telling off John Stossel for supporting it, but most of them are probably the "BIG PHARMA IS EVIL, CANNABIS CURES ALL" which those people shifted into "KRATOM CURES ALL" so I mean, this is why we don't win.
Weed is also merely an example of a much more important underlying principle: the state has no business deciding what substances its citizens choose to ingest.
This is more important, imo, in things like the abolition of the FDA, whose approval process raises the cost of drugs and quietly kills those who would have used an experimental drug but never knew about it because it was locked up in approval.
I personally choose to not closely associate with people who regularly enjoy substance-altered states of consciousness (alcohol included), because, by and large, I find such people grating. But I support legalization of literally everything.
@@JoesWebPresence I think the more important issue is whether the usage requires permission. Sure they could deny usage completely, but then we wouldn't do anything for them. So they always leave open a loophole so that they get something back. But you don't actually need permission to do something that violates no one's rights. They (the vice police) don't understand laws as something that must never be broken though but as something which requires permission. A sort of privilege of the upper class.

I love legal herb, I prefer having safe bud that has been tested and there is a paper trail of lab results to make sure there is no heavy metals or anything unwanted in the flower. In California business is booming. I am not a medical patient. Just someone that loves smoking good legal weed on my Saturday nights. I also smoke premium cigars. Tis just smoking lol. I applaud this mom and woman business leader to keep business going.

Yeah, and in the process Missourians voted for 40 pages of new laws and regulations that dictate a whole assortment of bullshittery regarding businesses and licensing, specifically detailing for example that 1/2 of all new distributer/deal contracts go to people with less than 250k net, in historically impoverished communities with shitty schools. Areas that need decriminalization, not a bunch of smoke shops charging 30% more than the black market and an increase in driving while intoxicated violations.

The problem with unregulated weed is, how do you know what you're getting ? How do you know it's purity and potency? How do you know it has not be adulterated? Recently grey market smoke shops in PA were found to be selling products containing significant qualities of fentanyl. This is why I would prefer to pay a higher price for a product I know is not dangerous.
Dispensaries get street weed though..

You don't really know any of that from a dispensary, either. You always have to trust other people with the things you consume. Half of the food you buy is recalled on a regular basis because of contamination.

Cartels destroyed my life. I've worked hard all my life as a contractor. Due to NY states labor laws I've usually worked alone. After the kids were grown I grew more outdoors. Well for the first time in my life I didn't have to work myself to exhaustion every day. I mean 7 days a week and almost 365 days a year. And I started having "extra" money and started saving for retirement. About ten years ago the canadians and their Askesasni smugglers started flooding the market with their hydro and began eroding prices. Then the cali cartels started , then NY legalized. Now you can't hardly give it away. Now NYS is the new cartel. Greedy fuc%s will eventually tax themselves out of business but until then there heavy handed facist tactics will try to stomps us OG's out. Just like they did in northern cali.

@timothy longmore I prefer concentrates, especially live rosin and hash rosin, you're not wrong about the kids these days but the good news is it's pretty easy to turn your concentrates into a vape, it's just got to be decarbed. I'm not a vaper, but there's plenty of videos to help you if that's the route you go.
I'm in my 30s and my friends prefer to dab, it seems like the weed "connoisseurs" also prefer quality concentrates and don't mind paying top dollar. I've seen name brand live rosin sell for upwards of 50 a gram.

My one and only buyer couldn't do 20 a g because she could get it cheaper. Shortly after that she was out because she got under cut. My strategy is to ride it out until the state taxes there way out of business then us hillbilly bootleggers will be back in business.

If you grow your own you can take some of the market manipulation power away from large factory weed. This is important because if/when federalization happens, large weed producers will send lobbyists to DC in order to facilitate their monopolistic practices. The reason why gift shops exist is to bypass regulated cannabis industry. They are "grey market" operations. Dispensaries, being heavily regulated, would obviously be pissed some fake dispensary is down the street.
