Why home State of President of Supreme Court Bar Association Vikas Singh that is lawless Bihar has not even a single HC Bench and why the home State of the incumbent CJI Dr Dhananjay Yashwant Chandrachud that is Maharashtra has maximum number of High Court Bench? Sir kindly speak on why Uttar Pradesh which is the most populated State of India and has maximum number of pending cases and still has just one Bench and that too so near to Allahabad and nowhere else? Why when Justice Jaswant Singh Commission headed by former Supreme Court Judge recommended three HC Benches for undivided UP not one created and Maharashtra which already had multiple HC Benches was given one more at Aurangabad in 1985? This despite the irrefutable fact that Maharashtra tops in the latest justice index ranking list and still the former Maharashtra Chief Minister Uddhav Thackeray approved one more at Kolhapur for just six district only? Why for 30 districts of West UP which owes for more than half of the total number of pending cases of UP has not even a single HC Bench and lawyers go on strike for 6 months or five months or two months and so also strike every Saturday since last 42 years yet Centre is dead determined never to allow even a single HC Bench other than one created by Lord Pandit Jawaharlal Nehruji at Lucknow way back in 1948 which is so close to Allahabad and nowhere else and the litigants of West UP not attached with Lucknow but with Allahabad which is 230 km far away from Lucknow which means whole night and half day is wasted in just travelling alone from one side and still not one created till now and why Centre can approve transfer of Nainital High Court in Uttarakhand to Haldwani then why can't Allahabad High Court be transferred to Meerut or Mathura or any other West UP city? What this lecture is about, prosecution or defence?. Senior advocate Nagamuthu in his several lectures confessed that defense lawyers should first catch the technical flaws in the case and win the case. Here he speaks in opposite mood. There is no fair investigation means there is ground for defense. Naturally defense lawyer will make use of it. Why does not he speak in favour of defense here?
Because fair investigation and fair trial is fundamental right under article 21 and most important human right because court has to balance rights of accused as well as rights of victim because you want to convict the actual accused and not to convict innocent
