    I have a claim in process right now. My C and P exam was about two weeks ago. It was a telehealth exam, so what I did was print out the slides you showed and I checked off the boxes for the symptoms that I had, and put it on a clipboard next to me. I did this so that I could ensure that I explained/articulated each of these symptoms to the examiner in case I forgot something or they didn't ask.

    I like how he explains this so it can be understood and the breakdown of this. That process of looking into your VA medical notes is exactly how I am doing my supplemental claim. I was denied before and stayed the same. Just a matter of time now before I hear back. I hope every veteran here gets the claim increases they rightfully deserve. Great channel.     This was by far one of the most informative training videos I have watched on the MH process. 6 months ago I got a MH rating of 70% that brought my total rating to 90%. I filed for TDIU, thinking it was just going to be a records review (where my last C&P exams were only 6 months ago) No, the VA has me re-examining on everything! I'm very nervous about this and worry about a reduction. This should help me prepare.

    Many times your private consumer doesn't write in his report what you tell him or about half of what you tell him or not at all and this is supposed to be used as evidence in your favor, I found out the hard way

    i recently had a HLR for a claim of MDD and the VA doctor reported that I have PTSD. I did not file for PTSD and had a HLR and explained this to reviewer. Last week i received a letter from the va asking me to list my stressors for PTSD. I filed for PTSD several years ago and could not prove my stressors. So I filled out the PTSD form the va sent me and used the same incidents from my previous claim. I stated on the form that I did not file for PTSD and that my claim is for MMD. Have you ever seen anything like this?

    I have a 50% disability for Anxiety/Insomnia, at the time I wasn’t educated and didn’t know that PTSD, Anxiety and Insomnia all fall under mental disorders and can only be rated under one condition.

    I’m trying to understand why RO is sending me to a Behavioral Health exam after they rated me 30%(without a DBQ) for psychiatric with depression. Will they change my rating after they receive my DBQ or are they expecting me to file for a decision review, then they’ll use the DBQ to for a higher rating?

      I can't say as I don't know the details of what you are doing with your claim. Sometimes the rater can give a rating based on the evidence but request an exam as well to see if they can provide the higher rating. Without knowing what you are doing with your claim I can't say for sure.

      My claim was originally denied back in 2017, I opted BVA and got a granted in September of 2023. My hope was to get 70% mental health based off my documented symptoms, but they gave me 30% rating before I even attended my exam. From what I understand, they can still potentially bump up my rating after my exam?

    What does Extra Ordinary Award Procedure mean? I won a Clear and Unmistakable error that now my back pay should have started 30 years ago. I just had my 8th C and P exam and the Doctor said yes and rated me severe TMJ with dietary restrictions. The Secretary of the Navy sent me a letter last month saying they made a mistake and I should not have been discharged. I also won my forgery case on no informed consent was given. I also won that the Navy put my wrong Social Security number on my discharge papers preventing from getting my STR to file for SC. For back pay, would they go back 30 years and use those payments or just use what today’s payments are?

    Is there reason(s) that the VA would decrease my mental health rating if they have not asked to see me in the last 3 years since they gave me a rating. I have not been to a doctor since my C&P exam for mental or anything else.
    They have not decreased it currently, however, I would like to be proactive to make sure they don't. I am not looking for an increase.

      @@DewayneKimble I assume RFE is request for exam? No. The VA has not requested anything from me. They rated me 100p&t but I just want to make sure to be proactive in as I feel like there are rumors that you can lose it, other than fraud (which I am not doing). I was able to locate my rating sheet and everything is static. Again I just was wondering if there are things to do to be proactive not to lose it.

    Peace and Blessings I had a C&P scheduled they canceled it...then I got a call from the VA to set another date ...that got canceled also call the Regonial office they stated that it was moved forward for decision.....explain this to me please...without a DBQ?

      I can't explain it as I don't know the thought process of the VA employee that is handling the claim. What I can say it, some VA employees are screwing up claims. You have the option to call in and let the VA know that your exams where cancelled twice, so they don't think you failed to report.     I received stress fractures at basic training and went to the hospital on base for treatment. I also was in a vehicle accident which is in my military record for all my injuries but still was denied. Do they not consider my military medical record?

    I have a 30% on migraine and sleeping disorder since 2013. Recently I am being diagnosed with PTSD/Anxiety and taking medication and psychotherapy. Can I claim PTSD/Anxiety even though I have a migraine and sleeping disorder approved? Thank you.

    So what if my occupational and social impairment and symptoms don’t match? Because I got checked the 50% box for occ and social impairments box. But my symptoms have a lot checked at 70% and 100%.

    Are you still able to claim Insomnia as a secondary condition? This was brought up as an issue on another UA-cam channel based on a VA change in Jan 2024 . I was planning on filing for Insomnia secondary to Tinnitus.

      I'm almost certain that you can't claim insomnia secondary to PTSD, as it's considered a symptom of the condition.

      @@DewayneKimble Thanks for the response Dewayne, I read that M21-1 reference several times but I still can’t understand how the VA can acknowledge that insomnia can be a “symptom” of a primary SC condition but then say a separate evaluation is “not warranted” and that “a valid diagnosis of insomnia disorder meeting DSM-5 criteria means that the insomnia condition is not caused by (or secondary to) any other condition.” It sounds like the VA is no longer going to give a rating for insomnia on the Mental Health rating scale unless you had a direct SC diagnosis of insomnia in service, regardless of whether or not your symptoms merit a DSM-5 and you have a nexus letter tied to another primary condition (like tinnitus). Is that your understanding?

    Is it bad if you claim anxiety, depression and ptsd but only get a c&p exam for ptsd?
    Also I bought your book from the website and it wasn't signed 😢

      Check the fourth or fifth page and you will see it there. Claimed conditions have to fall under the five was of service connection.

      @@P47W but they are different dbq's. There is a ptsd dbq and a mental health dbq. I only had a ptsd one.

      @delirium47 yes but they have to assess them all to find out what is worst or what symptoms someone has.

      As a former rater, I never was trained to just to deny the claim. Vets have to take some accountability. This is not a yes to every claim. The vets that invest the time to educate themselves on this process have a higher chance of success. Thanks for sharing

      @@DewayneKimble you also should admit that the military and the VA do not train veterans on all of the word play and games with filing a claim. Not to mention, you are here profiting off guiding service members through the process…. The whole system from the VA, to the EAS process to UA-camrs to large scale claim companies are a shame.

      @@raiderjedi4160Couldn’t agree more. If vets truly were interested in helping vets navigate this corrupt system, they would give out the information for FREE. Zero cost should be associated with helping veterans win claims they rightfully deserve. This whole “know the game/keywords” crap is absolutely shameful. Why should vets have to play games with their livelihood? Make it make sense

      @@ladyroyale4280 yea, I use all of the information I’ve learned to help everyone that I know - my baby brother got out and was 100% p&t for free of charge, helped his buddies out as well.

      @@Broommaker19 don’t pretend that the half information presented online will get the average veteran an approved claim. You are using yourself and saying everyone should be the same, remove yourself from the equation and look down from fifty thousand feet. Why should it be free? That question is the problem with the entire claims process.

    If my DBQ had the social and occupational impairment box checked that is consistent with 70%, but in addition, the examiner correctly marked 2 of the symptoms for the 100% criteria, how is that handled by a rater... or better yet, how SHOULD that be handled?

      As stated in the video, it will depend on all the evidence of record and the rater. It could be bumped up as I stated in the video if there is other evidence showing you meet the criteria.
