    Put in for secondary GERD on Sept 24, sent in the med records, NEXUS letter and DBQ. Got notified today they are doing a records review only. Had my Ducks in a row. To date, haven't had a claim denied. VA Med, Med records from private Dr, NEXUS statement have done the work for me. Got out of the Air Force in 1988 and submitted first claim last year

    Thank you again for your service and dedication to assisting other veterans getting their claims done correctly. I am educating as many vets as I possibly can. I am currently still reading your book and sent one to my cousin to read. My chronic pancreatitis makes it challenging to assist others that's why I always watch your videos!!! I even share them!!! Education is key!!! You have Blessed many with your knowledge and wisdom God bless you continuously and by the way I cried reading the beginning of your book!!! So relatable brother!!!     This is really helpful. I’m going to file my BDD in a couple of months and I’ve doing a ton of research. I plan on doing what you recommend in this video.
    I know a lot of videos are geared toward veterans specifically, but would really love to see more BDD videos. I know the process is mostly the same but it still feels very mysterious.

    Great video...again! You told me to keep you up to date on my HLR/Supplemental. DRO found in my favor, sent back for a doctor's opinion. The doctor's opinion came back in my favor. They should go ahead and rate the claim...but it's in a national queue? The DAV/VSO asked what are they waiting on (yes sufficient DBQ, and they stated they need no exam, and I have a diagnosis) seeing that they need no other information. That's where we stand.

    I just seen my vso and he read me the results of my c&p exam for pact act claims....its definitely in my favor...day 153 and it was just moved to another rater yesterday, not sure why....I am currently at 89% and keeping my fingers cross for a good rating to put me over the top....

    I feel like I did my raters job for them even submitted a clarification letter from the c&p examiner. Today was my suspense date and I know there’s nothing else that could possibly slow my supplemental up any further. Fighting for TDIU for over 800 days, 2 denials and 1 restarted supplemental. Let this be the end.

    Thanks Dewayne. I wish all the raters were as thorough as you were. Maybe things are different now, but I got a decision letter in July for a very simple increase for my right knee and add my left knee as a secondary. I got the left knee service connected but only half of what it should have been. The C&P doctor did a really bad job and made several mistakes. The rater then turned around and made several obvious mistakes. They didn't give me the increase for my right knee which was a very simple check to make sure I had a doctor prescribed knee brace. Seems like raters only look at the VA contractor C&P exam and disregard everything else. Just because they say they looked at doesn't mean squat to me. I finally got my C file that included my C&P exam from a VA doctor way back in 1997. The rater did the exact same thing, just recited verbatim what the C&P doc said and didn't even look at my service medical records. I am now waiting 2 months for scheduling informal conference and who know if that will correct it. Wait months and months more after submitting a supplemental claim. Really??? There needs to be much more accountability for how the VA handles claims. The "sit down and wait months or years" mentality is just unacceptable. I have all the evidence for an increase on my original claim with backpay to Dec 1996 but I'm sure they will deny that CUE claim as well. Off to wait years and years for a BVA judge. 😡

    Dwayne from my experience I feel you are the exception not the norm with regard to fully completed dbq and nexus submitted by the veterans doc. Too bad my eaters seems to be ordering a c and p for every claim.

    You are awesome, Dewayne! What were you looking for in reservists and guardsmen files? In the absence of complaints during short period of active duty for reservists, does the medical evidence recorded on their SF600 forms as well as medical profiles not even being considered?

    Thanks for the great information. Appreciate you addressing what Active Duty does and doesn’t need. Normally the only thing I hear is you don’t need a nexus if you’re active but not the rest of what is needed. I’m currently active and was wondering about secondary conditions. I have been diagnosed with cervical and lumbar spine degenerative disc disease and I get radiating pain to my extremities. Does that need to be diagnosed or how does that work? Thanks again

      Your welcome. If it is documented, you can claim it both ways. But if there is a diagnosis in service, direct service connection. Keep going to sick call.     Is a combat zone same a hazardous duty location/location? I ask since I was un the navy 99-04. 3 west pacs and south pac(drug ops)

    Thank you for the video. Something weird I hope u can explain. My non service connected pension was “effective” 2 days BEFORE my discharge date. They basically said I was p&T disabled BEFORE I got out but it’s not service connected? Has anyone ever heard of that? I never noticed until today . I was discharged Dec. 22 2011, on March 12 2013 I filed for a va pension. June 2013 I was approved but the effective date was Dec 20 2011, 2 days before discharge. Isn’t that strange? They found a p&t disability during my active duty but I’m NONE SERVICE CONNECTED

      No rhyme or reason...just be thankful....you got a lot of veterans that's service connected wishing they were where you're at. Bravo!

    Hi there, working through the claim process myself. Absolutely love your videos. With all due respect and I greatly appreciate your expertise and experience. I'm a little confused, you would not go thru 500 pages of paperwork, but you would go though 500 pages of a PDF. How does that work? Aren't you required to review the evidence? In whatever form.

      Thanks for the support and feedback on the channel. It was 5,000 thousands pages. Yes, a rater would have to go through that amount of paperwork, but what are the chances something was missed. What I'm trying to get vets to understand, if you only need 50 pages out of the 5,000, why not just send in the 50. Every vet has the right to send in the 5,000, just remember, VA employees are on production and quality quartos.     I just got my decision letter for a denial of a HLR for Chronic Sinusitis. The reason for the denial was because of no non incapacitating events in the past year.I went to my regional office and got a copy of the DBQ that was done. The Dr. and I discussed in detail the ways that this conditions effects me on a daily basis as far as the headaches and things as such. On 2 pages of the DBQ she stated that on a daily basis I experience the incapacitating conditions but on the page that specifically asked about the incapacitating events she checked no for whatever reason. If I want to submit a supplemental claim would a personal statement be considered new and relevant evidence and in your opinion would it be enough to point out what I just told you or would the fact that when asked the specific question she checked no still outweigh the other places that says yes?

    Hello KMD89!
    Scenario: In BDD, all C&P exams are complete, and svm retires at the end of Jan. He viewed his tricare health records to view the signed DBQs. He noticed he has two DBQs for migraines from two different C&P exams.
    First DBQ was with a TBI C&P exam (oct23). The second DBQ was with a nurse practitioner during the orthopedic exam (nov23)
    If there are two DBQs that read drastically differently, which one would the rater utilize is the decision?
    * SVM states that the headache exam wasn't even performed it just appeared in his record from the nurse practitioner, nov23.

      I can't say which one the rater will use, as I don't know the rater rating the case. Now, If I rated the case, I would use the DBQ that is completed correctly per the VA guidelines.       Hi Dewayne my question is would you grant this claim based on this evidence issue was diagnosed in service also veteran has 4 different in service medical records evidence a surgery to stop the disability and it came back worst then before the surgery veteran first VA visit he complained of the issue for 3 years VA give him pain meds for it private records contained same issue will this be enough evidence for you to grant the claim Looks like this evidence meets the beyond reasonable doubt in a criminal case should have been a slam dunk since the VA burden of proof is 50 or 51 would to hear your input on this matter Sir

    How is a doctor supposed to be able to look at your claims file? Not only does it take months to get, but it's on a disc and it's huge. Do they just need to look at a portion of it, or whatever is revalent to the claim? How does one get that box honestly checked?

    Dewayne no one has answered this question I been asking for months. I even called the VA hotline with mixed answers. I filled for mental health claim back in December 12 2022 and was granted 30% for mental health on February 1 2023. You taught me that I could do supplemental claim for new and revelent evidence. I went to the VA got reevaluated and received the new and revelent evidence. I then did the quick submit option and received a c&p exam the next day. Know that I got the increase for mental health to 50%. Do you know if I will be back dated to February 1 since I filed supplemental claim for the increase. Do I get awarded for the date I filed for new and relevant evidence. I did watch many of your videos none of them really answer this question.
