I appreciate you discussing these topics and not sugar coating any of it, lead by example, I suppose. I've insomnia and you have a video that covers it and my insomnia is a symptom. Though I think it proves the severity of the service connected issue. My case is not normal. Honorable discharge but was enlisted in error because a prior foot injury was overlooked then was aggravated, not normal progression, of the trauma neuropathy. Then I saw a video on radiculopathy... So much one needs to know. I hired a lawyer because I feel complex case, I could be delusional, and to help me keep my filings short concise and on point. But my anxiety is through the roof tell you what

Hi Dewayne. I bought your book last year. I was stuck at 70% for 8 years l filed 2 supplement claims in June and August 2024 and now I’m 100% T&P . I finally got 50% for sleep apnea,20 hypertension,10 IBS, 60 % stage 3B CKD and 20 for diabetes. By way of Pact Act and Tera thank you so much for your support and teaching.

Hey, can you share how you got 50% for sleep apnea? I had an overnight sleep study done at a private Sleep Institute and was diagnosed with Sleep Apnea and prescribed a CPAP machine, the sleep doctor even completed the DBQ for me, and I submitted the sleep study report and the DBQ to the VA and was denied!
I had a very good experience with VA getting my records. I submitted my claim on October 23, 2024. And, against advice I found out later, I did ask VA to go get my medical records. They got all four doctors, and one of them had to ship a box full of records to the VA, within three weeks. My claim was decided by January 6, 2025.
That’s good to hear.. I have 2 claims in moved to step 5 on October 7, & November 27. Neither have moved since then, I thought there was a freeze or something 🤷🏻♂️.

Can you do a video on female gynecological issues. Pelvic pain reported consistently in service with no treatment by military, symptoms pretty much ignored w/pre-cancerous dx. Now the female veteran needs complete hysterectomy.

I have given them information from two foot doctors, but the foot doctors are wrong in their eyes. The NP is the specialist when it comes to the VA exam. This fight has been going on since 2017. Currently sitting at the HLR.
Point out that your examiner is a specialist. Also, get a copy of the VA C & P exam to see what is being said. I submitted a claim for sleep apnea. I had a diagnosis of sinusitis when I was in the service due to a nose fracture I recieved in service. I continue to have problems with sinusitis and was just awarded 60% disability for sphenoid sinusitis and rhinitis. The doctor that wrote a negative opinion on my sleep apnea was actually a vein doctor. He also stated that I had a c&p exam, which never took place. Based on that, I was denied for sleep apnea. I also have a diagnosis of sleep apnea with moderate to severe sleep apnea and I have a CPAP which I use regularly. My question is can I submit a supplemental stating that the C&P exam never took place? How would you proceed? Please help

@Dewaynekimble Hey, I just watched The #1 Mistake VETERANS Make When Filing a Supplemental VA Claim video, and I am confused about filling out the 22B you mentioned at the time stamp 4:26, you said filling out the 22B form could add about 6 months to you alim, however, I am not sure you are saying to fill out the form OR not to fill out the 22B for, can you please elaborate on what is the best way to proceed? BTW: I do have your book, but I don't remember where it talks about completing teh 22B form. I served 16 months in Vietnam in 1969 - Thanks again for all your help....
You have to complete the form if you are submitting a supplemental claim. If you ask the VA to go out and get medical records, that takes time, might be a good idea to get them yourself. What if a person claims prior to service aggravated by injury is inducted performs honorably but due to training in cold weather, new Jersey winter cold, honorable discharge but was enlisted in error. Does this likely indicate service connected? If I could render it all down to one question.

So let me know if I did this correctly. I uploaded a buddy letter online on the VA website for a denied claim. The VA system did not ask for a VA form, just the new evidence.

In the rating, they should have said something like contact them to get it re-schedule. That would depend on if you contacted them in advance. It wouldn't fall under new evidence. You would have to have someone to review the rating to see what happen and what options the VA gives you. I got a 10 % May 2024 rating for left leg radiculopathy and 10 for right . I thought I should have gotten a 20% for the left . . I submitted a supplemental in November and got increase to 20% but it was effective November . Shouldn’t it have been rated back to May instead of November ?

Relevant evidence is information that tends to prove or disprove a matter at issue in a claim." So if it's not noted on the decision letter that they've used the specific information as a reference in their decision then it could be used. The question now is how do raters weigh such evidence, that and say medical journals.

Thank you for this information. I just submitted a HLR for my back. It was denied and it was for low degenerative arthritis w/ degenerative disc disease other than IVDS and anterolisthesis. I have submitted all the evidence to them. So upon reviewing my medical records, my neurologist stated that I have bulging disc in my lower back due to an injury while in service. I have sent that new info in with my HLR and now it is in rating decision phase. I have tinnitus and have been diagnosis with Menieres disease they denied that claim. I have documents from my ENT about this. I am at 90% but I have Depression have have a rating of 70% what else do I need to do.

What if you were denied service connection at discharge even when there was a record of getting treatment one time? Shouldn’t it still be service connected? Or is one time not enough because I’ve heard conflicting statements about this. This happened to me for headaches. Thanks.

I submitted for lower lumbar with service documents. Part of evidence for my lumbar included cervical issues. I can't submit for supplemental cervical until I receive approval for the lumbar. Are you saying I can not submit cervical documents as new and relevant and must rely on the VA finding evidence within the total back evaluation? IE: x-rays. The only new documentation would be a Nexus.
The back and neck are separate joints. If the neck was denied, you would need new evidence for the neck. This is another good reason why Vets should write personal statements with every claim.

So let me know if I did this correctly. I uploaded a buddy letter online on the VA website for a denied claim. The VA system did not ask for a VA form, just the new evidence.

So if I missed my C&P appointment and was denied, how do I list that under the new evidence section?
In the rating, they should have said something like contact them to get it re-schedule. That would depend on if you contacted them in advance. It wouldn't fall under new evidence. You would have to have someone to review the rating to see what happen and what options the VA gives you. But they also said I have spondylolisthesis and spondylosis in my cervical area

I got a 10 % May 2024 rating for left leg radiculopathy and 10 for right . I thought I should have gotten a 20% for the left . . I submitted a supplemental in November and got increase to 20% but it was effective November . Shouldn’t it have been rated back to May instead of November ?

Can established BVA rulings be used as new and relevant evidence?
Look at the definition of new and relevant evidence.
@@DewayneKimble " As defined in 38 CFR 3.2501, new evidence is evidence not previously part of the actual record before agency adjudicators. Relevant evidence is information that tends to prove or disprove a matter at issue in a claim." So if it's not noted on the decision letter that they've used the specific information as a reference in their decision then it could be used. The question now is how do raters weigh such evidence, that and say medical journals.

Thank you for this information. I just submitted a HLR for my back. It was denied and it was for low degenerative arthritis w/ degenerative disc disease other than IVDS and anterolisthesis. I have submitted all the evidence to them. So upon reviewing my medical records, my neurologist stated that I have bulging disc in my lower back due to an injury while in service. I have sent that new info in with my HLR and now it is in rating decision phase. I have tinnitus and have been diagnosis with Menieres disease they denied that claim. I have documents from my ENT about this. I am at 90% but I have Depression have have a rating of 70% what else do I need to do.
Where does it fall under the five ways of service connection. you have to start there. That could be the issue. What if you were denied service connection at discharge even when there was a record of getting treatment one time? Shouldn’t it still be service connected? Or is one time not enough because I’ve heard conflicting statements about this. This happened to me for headaches. Thanks.

Can the new and relevant evidence be for newly diagnosed conditions you want to add to the supplemental claim?

I submitted for lower lumbar with service documents. Part of evidence for my lumbar included cervical issues. I can't submit for supplemental cervical until I receive approval for the lumbar. Are you saying I can not submit cervical documents as new and relevant and must rely on the VA finding evidence within the total back evaluation? IE: x-rays. The only new documentation would be a Nexus.
The back and neck are separate joints. If the neck was denied, you would need new evidence for the neck. @DewayneKimble Thanks, cervical was not denied, I didn't realize I had to submit for cervical separately and for sure the cervical came years later. Truly a secondary. I am waiting for the lumbar to be rated before submitting the cervical as secondary.

What if you submitted dx and treatment but cp examiner states no dx or treatment would that still be nee evidence if resubmitting after her expires
