    The idea that this met a judge's standards of establishing probable cause to issue an arrest warrant should scare the shit out of people.

    You know what’s missing from this affidavit? The part where the accuser says no!
    It was a crowded room.
    Its hard to accept a “frozen with fear” claim when she could have:
    Said no!
    Thrown her drink in his face.
    Yelled/made a scene.
    Slapped him.
    We need to protect our women from predators, but we also need to protect our young men from $ predators.

      don't be a dick. People freeze all the time in unexpected, shock-type situations. Sure, the rational thing to do would have been to yell for help since it's a crowded ass bar, but when something you really don't expect smacks you out of left field, lots of people aren't going to react in the most rational manner. Freezing up in a situation like that is 100% possible and not unusual at all.
      Not saying she's telling the truth at all, but that's a really stupid argument against that possibility.

      Me having an opinion about a legal situation doesn’t make me a dick. You calling me a dick for having a different opinion than you makes YOU the dick!
      Yes, freezing up in that situation is indeed a possibility. But when you charge someone with felony rape, the prosecutor needs to weigh the evidence and to be able to prove the charges beyond a reasonable doubt.
      You don’t ruin a young man’s life with a felony charge because an accuser’s story is “possible and not unusual“.

    As someone who once practiced law before returning to academia, always teaching law, I am shocked that Kansas has such an incredibly poorly written law and call it “rape.” I knew of no state with a law that attempted to define anything other than penetration with a penis as “rape.” Were the news reports wrong? Was the charge for like a sexual assault or other act defined as a sexual crime? This law is incredibly dangerous if it exists. WHAT IS THE PROSECUTOR DURING HERE? WHY WOULD YOU DESTROY A LIFE OVER SUCH AN IMPROBABLE FILING? HE SAID/SHE SAID SHOULD REQUIRE MORE SUBSTANTIAL SUPPORTING EVIDENCE THAN THIS GARBAGE.

    I think TSJ is innocent, and this is nothing more than an attempt at a money grab/ defamation of TSJ’s character….. but did you actually read the entire affidavit? Skirt not jeans. What I would be questioning, and am baffled by is the timeline, and locations of her cellphone. Seems like they left the game, went to the bar 1st, then home, then back to the bar for the 30 minutes , next to a location 8 blocks away for 40 mins., then back to the bar from midnight- 12:55am when she was allegedly assaulted, almost an hour, before going home. Then she searched KSU, KU, and Illinois basketball rosters between 2:16am-3:49am, then “later in the day” searched sexual assault state, and federal crime definitions, and did not search TSJ until almost 1pm.
    If this truly happened, wouldn’t you think she’d make a complaint that evening?

    what I don't get is where is the evidence to issue a warrant. Secondly why did it take 3 months and thirdly why did Whitman state the U of I had no action in this trip when it has been clearly stated by other U of I personel that the basketball team under the order of an assistant coach told a team support member to escort them the whole trip...... Why is the u of I doing this ????

      As a former lawyer, I never encountered an idiot prosecutor in these situations. We once faced a situation where an underage girl seduced an 18 year old boy. Why? Well, she was on juvenile probation and from the State of Missouri; she was trying to avoid the Missouri attempt (parents wanted her home) to bring her back to Missouri. She decided that it a boy was guilty of statutory rape (underage cannot give legal consent; she was just under 16 and looked older; obviously bight enough to deal with legal technicalities). She seduced the kid, and she almost literally went to the prosecutor’s office and demanded he file statutory rape charges. Why? She reasoned that she would have to be a witness; therefore, Illinois would have to keep her in Illinois for the trial. It did not work, because the prosecutor and the accused’s attorney openly discussed what she admitted the situation to be. Sadly, the boy did go to jail on a lesser charge, and he plead guilty, largely because he thought it would be cool to be a convicted felon. Yea, he wasn’t the brightest light in the room. I say it was sad, because neither he nor his appointed attorney (nor the prosecutor) realized that someone spending less than a year or two in prison (day-for-day good time for served time in local jail) would be thought by the trustee to have committed a crime against a minor child. He was nearly beaten to death in the prison (a farm, which is for those who are not hardened criminals…but still sensitive about child abusers). He survived. I know nothing after that event because I left the practice of law. In hindsight, i think we should have gone to trial. Juries are difficult to predict; however, they are know to nullify bad law. If found guilty of statutory rape, he would have faced minimum sentencing of 5 years. The County Prosecutor had recommended the only crime on the books that offered a lesser sentence, and he recommended the lowest sentence possible; yet, we both ended up feeling bad about the beating (we naively failed to consider the risk). Law is imperfect; prosecutors and attorneys face limitations. But this is just terrible law!

      Nah they'll very likely be ordered to reinstate him. Courts everywhere have been very consistent in invalidating suspensions/expulsions from teams or entirely from school when no due process was provided before the action was taken. Because a suspension or expulsion by it's very nature causes irrepairable harm that can't be remedied after the fact.

      Well, you were wrong about this huh? This whole case is suspect. How can a police department conduct a sex crime investigation and ONLY interview the victim before filing charges??? There were plenty of people in the bar, including the girl in his other arm…
      They didn’t interview her either??? Then the news breaks and they go back and try to interview witnesses after the fact. They made way less than a good faith effort in investigating this serious accusation thoroughly.
      These cases require diligent and meticulously conducted follow up. They literally took her word and filed charges without investigating it. They didn’t even try to investigate it first.
      There was another young black man wrongfully convicted by the same police dept and court. It was overturned later after he was kicked out of school, prosecuted, convicted, and jailed. It made it that far and they had it wrong the WHOLE TIME. She lied, he suffered tremendously and nobody gave a shit about what happened to him. Meanwhile nobody says how horrible of a person the girl must be to lie and watch his life be torn apart. What about her? Kansas doesn’t have laws that apply to filing false police reports. She went on with her life most likely and suffered nothing.
      It should be questioned considering the reputation of the lack luster DA and the lack of investigative diligence on the part of LPD. You can’t pay me to go to Kansas. Fuck that entire state.
