    • @findlisa5
      @findlisa5 3 місяці тому

      Try fingering, not fondling. BTW, fingering without consent is rape, and that isn't true just in Kansas. There is a federal definition of rape based on penetration of the vagina or anus without consent or penetration of the mouth with a sex organ without consent.

    The police were investigating a similar incident that happened two weeks earlier in the same room at the same bar and never even put two and two together to think the cases might be related. Guess who was involved in the case they were investigating? One Arterio Morris--who just happened to be in the room standing next to McCullar at the exact time that Shannon is accused of this incident. The alleged victim thought Shannon was standing next to McCullar. It wasn't Shannon. She allegedly ID'd Shannon after looking at team pictures on the internet. She didn't see Morris's picture on the KU team page because he had already been dismissed from the team after multiple sexual assault allegations. Morris also has colored dreads. This was all uncovered by the defense not the Lawrence PD. This case never should have been charges much less brought to trial.
    You guys have done a good job covering this in a fair manner.

Also, he'd have to prove that she committed fraud, that she knew he didn't do those things (the groping and fingering) to her. But the truth is she does believe that, and she always will, so I highly doubt Shannon will even try to sue her. And, if he did, it almost certainly would be thrown out of court.

    I've been nothing but impressed by every Terrence Shannon Jr. interaction I've ever seen. Always has held himself professionally and kindly whenever I've seen him on T.V. or in person. About 15 months ago he along with Matthew Meyer & Dain Dainja came to the First String basketball tournament (little kid basketball in the North end of Champaign). My then 8 year old and then 6 year old sons played in the league and tournament. It was great to have all three of the Illini players there but TJ stuck around for at least 90 minutes (not complaining the others didn't stay as long, it was awesome they came at all, they could easily have had stuff to do), I left with my family before he left. Literally sat on my son's bench and made these kids feel great. Took pictures with anyone who asked, he came across as surprisingly shy to my wife and me. Obvious he loved being there and making the kids feel good, and he also seemed to enjoy the joy when a kid made a great play. When I heard he was charged with rape I was shocked and so were my kids. I have followed the public information pretty darn closely because I know people can be great most of the time and still behave horribly. I've waited, and I've read police reports and what's been reported to have come out at the trial, and there is nothing in the public record that makes me think he is likely to have done this. I'm not saying the alleged victim is lying, she may well believe he touched her, but if this is what gets somebody convicted of a major crime beyond a reasonable doubt I'd be so sad.

No, you need to be subject to the same penalties that came dangerously close to being imposed upon the victim of your CRIME. This sort of thing cannot be allowed to go unpunished. This sort of thing happens much more often than we are willing to admit, and lower-profile victims frequently wind up committing suicide over it and people just shrug their shoulders and go "oh well". Absolutely nothing about that is acceptable.

    I appreciate very much the way you all went about this as both a victim of SA who went through a criminal legal trial and a sports fan. But you’re missing a lot on this and using one source of information basically, someone whose a defense attorney, Mitch, who is friends with the criminal defense attorney and the coaches at UIUC as a source of your info and opinions. Put it together, he is there because he doesn’t have client attorney privilege so he can talk between the defense attorneys and TSJ and the coaches and UIUC during this and then he’s influencing the public’s opinion. This is by design, this guy didn’t just go on all these podcasts, go to all these trial dates in C-U and Kansas and Springfield and tweet about this nonstop from the kindness of his heart. That’s very naive to believe.
    He says himself he has a small part of his practice that represents coaches and NIL collectives. He is there to ensure the Illini Nation fan base stays happy, loves TSJ, so they keep spending money on Illinois sports and and donating to UIUC.
    You hit a lot of good things, like trauma responses (going back to the bar) and this wouldn’t get to trial if it was not a strong case. The text message thing, that is meant to play on your emotions but come on, you cannot go from those text messages and emojis to the conclusion of going after $. You don’t get $ in criminal trials, if you were planning to make this up for money, you’d want him to first go very high in the draft so he’s worth more and then file a civil suit which has a way lower threshold to be found liable or not liable. Can you imagine if your emojis in texts showed your intentions in life?
    I’ve read almost everything from all of the cases (the criminal one and civil one in Illinois vs. the board of trustees) and first off, defense attorneys are there to WIN, not to be fair and they’re always going to go after the police and the investigation. Duh.

    • @adixon1120
      @adixon1120 Місяць тому

      And if you listen to all of these podcasts Mark Sutter is on and Mitch you can glean a lot from them. A lot of them are very careful to not say she was definitely not a victim and the reason they absolutely destroy her and make sure that’s known is that is a warning to other victims not to come forward, DA’s not to fuck with college sports or the universities, etc. College sports is huge money, one of the people who stood to lose the most $ here was Brad Underwood. Look at his contract, he definitely lost $ from the potential he could’ve hit on some things just from this season and March Madness plus he has tons of NCAA rules he has to follow and is responsible for the players and coaches following. If he was fired without cause in his contract, IL still had to pay him millions of dollars depending on which year it was. If he was fired for cause he doesn’t get any of that.

I'm glad the police took the allegations seriously, but it does seem reasonable to require some minimal detective work and evidence be required to indict someone and upend their life. I have no idea what the district attorney or w/e was thinking when they moved forward with charges. Those text messages are a BAD look. Hopefully the jurors have a clearer picture of what happened than I do and they do the right thing. If you've ever served on a jury you know how stressful that can be. It's a tough subject. I'm not smart enough to handle it.

    Proud of everyone supporting both the plaintiff and defendant. That support is important and needs no bias because these kids lives can fundamentally change from people arguing over it because of their own bs personal agendas. Still cant believe people were against that this whole process.. Hoping this trial puts everything to rest with the truth as you say, whatever it may be

      Let’s stop acting like this hasn’t been an issue! Just last year, 2 black Ohio State players were found innocent after a white female lied about being raped and kidnapped! Both have lost everything! Shawn Oakman was also lied on by a white female and did time just to be found innocent later one! Lost his chance to play in the NFL! So stop acting dumb like this isn’t a thing!

      Not only that, but the all-white jury came to the correct conclusion, without regard to race. Reverse the races of jury, accuser, and victim of the accuser, and I bet you a dollar the verdict is polar opposite, evidence be damned.

    I've tried and defended a lot of sexual assault cases. Let me help you out, you don't need DNA or witnesses for a rape to happen. In fact, you rarely have either. Most rapes don't have witnesses. Often DNA evidence isn't something that ends up being a major part of a trial. If people are expecting those things to be common they are mistaken. Generally these cases involve the accused and the alleged victim and no one else. That's why these cases are hard to prosecute. I have no idea if he did or didn't do it. That's going to boil down to how credible a jury finds her on the stand. Yes, digital penetration is rape. Rape isn't just penis in Vagina or Anus or mouth, anything penetrating is rape by law. But if it helps, consider it sexual assault.
