- Today I have decided to look back at the video that I made about the National Trust property of Clumber Park.

In this video you will see how I react to the manager that came out to talk to me about flying my drone and some of the silly comments that he made.
He was of the firm belief that the National Trust can stop me from flying my drone over their property even though the airspace is controlled by the CAA and not the National Trust.
He then starts making silly comments about privacy and people that may be at risk.

I remember this video mate. You literally tore him apart on every "argument" he had; and he knew it. It was like watching a game of chess and you having him in checkmate with every move he made.
Really nice guy he seems, but my god, coming out of a "private" area to ask you to leave a public area is insane. He knew this really, and he knew you had him bang to rights. But why can't people realise that their policy means sod all to Joe Public in a public area. You smashed the argument when you said you can take photos inside but not from above. Crazy. Anyway, I could waffle on, but great vid as always. And if the fella sees the vid and reads the comment, - come to your senses pal. I think the mute farmer he was with secretly agreed with everything you said. 😂

@@KeithBurtons yes, they try all sorts, but not being as smart as they think in trying to deflect anything the auditor has said, they draw suspicion to what they may be up to, which makes them look questionable, and their whole arguement which has no substance, pointless. Win again for any auditor !

I've took literally scores of pics of my wife and son in Haggerston Castle and Berwick on holiday last year, loads of people around, nobody stopped me and said no you can't do that, nothing can stop you ever.

Here's a bit of good information, any unfenced land adjacent to public highway for a certain distance is classed as public highway so that verge up to their post fence line is public highway, you could have parked on the verge completely legally anyway, well done PJ, you were far too polite with those clowns tho, he was virtually accusing you of perving on children, that statement subconsciously says a lot more about him than he realises, personally I'd have launched it again to prove a point and told him to stop interrupting a pilot in flight, i wanted to give the m"ron a Knuckle sandwich judt watching!

I’m watching the video, listening to all the conversations, taking it all in, then a dreadlock man interrupts the video to tell me what exactly has been said, which I heard, several seconds ago.

Yes your drone has a camera and theres nothing they can do about pilots flying say a Cessna 172 OR a helicopter flying and someone holding a camera of higher resolution filming the very same scene .
This is one of the craziest drone issues ever and here in NZ its just the same madness .

Ordnance survey make ALL the nations maps and even NT Maos are based on OS maps and there is not very much on the ground surveying any more as most is done from overhead pictures taken from planes

He’s NOT A COP so has NO right to even approach you
Plus you should have told him it’s a CRIMINAL OFFENCE to interfere with a Drone pilot while he is flying a drone and it could put him in the hands of the LAW
Its not a criminal offence to approach a drone pilot if the drone is exempt from ANO240 like this one is, and national trust property is covered by bye laws so you cannot actually fly on their land without permission...

@@JohnfromEngland They do own the airspace according to the CAA, up to a level where privacy is kept, and PJ does not own the highway, flying off it is an offence under the Air Navigation Order 241 as it puts people and property at risk.
He was also parked in an area which could also be seen as causing an obstruction on a highway, another offence they could hit him with, as well as breaking the local bye laws for that area.

I'm not sure if you have had a hand in this, PJ, but the following was posted on the UK defence Journal website on the 22nd:
"The National Trust has acknowledged that, despite previously stating that drones cannot be flown over its properties, it does not have the authority to enforce such a ban on flights over its land.
This admission follows a Freedom of Information (FOI) request, revealing that while the Trust can restrict drone takeoffs and landings on its property, it has no control over the airspace above, which is regulated by the Civil Aviation Authority (CAA).
In its response to the FOI request, the National Trust explained:
“National Trust doesn’t permit drone operation from our places for a variety of reasons, including visitor and staff safety, potential disturbance to visitors and residents, and disturbance to wildlife and livestock. National Trust land is not classed as a public park, but rather is privately owned land, held in trust by us for the nation. As the landowner, National Trust can stipulate which activities we permit on our land but have no control over access to airspace for those flying from outside of our ownership.“"
They are still incorrect, they do not own public highways and rights of way.

Had the same argument in fountains abbey, flying from the road outside and 2 staff rolled up in a pickup and told me to stop. Err no and get back to work was my reply. They were adamant they own the airspace and even said drone assist was a fake app.
According to the National Trust policies if you take photographs on their properties they own the copyright. I used to look after a National Trust site that the local authority was responsible for maintaining it. NT took totally no interest in the site.
Don’t forget Pete that roads in England usually have an easement on each side on which you are allowed.

I fell out with a National Trust Volunteer pensioner at Penrhyn, the buggy driving jobsworth told me to keep my dogs on a lead even though we were on a huge tract of grass 100s of ft away from anyone else, later I saw his buggy unattended with the keys in it as he acted as 'banksman' for a 12 seater minibus, bloke had a walkie talkie so i didn't push my luck for fear of reinforcement walkie talkie holders.

By the way PJ when you re- look at the video of your interaction the grass verge behind this jumped up idiot shows a row of stones around 36 ins in from the road edge and that is ALSO public as a walkway, if they chose to cut it fair play BUT it is still public property and there for anyone walking to do so in SAFTY and he not any NT Worker can stop you from walking on it
