Depending on City/state laws, the person does have a right to boot a car in a private lot if the owner or owners of the lot contracted him or the company to do the booting of cars. So yes, a random person who is hired by contract to watch a private parking lot can do booting and even call for a tow if the person leaves the lot and not shop in the stores of that mall.

If you want someone's car off your property you get a tow truck then you bill it to the owner of the licence plate. If somebody attaches a device to my private property I have all the rights to drive off with it or damage it as much as I like. It's a public lot. The property owner may have given permission, but if you give someone permission to break the law that doesn't mean that the law doesn't exist. A non-government official isn't allowed to boot a car regardless of who gives or doesn't give permission
The property owner only owns the parking lot, not the cars parked in it. So the owner has no right to permit any attachments or other modifications to other people’s property. They do have the right to ask the owner to remove his car, or if he refuses, to forcibly remove the car by having it towed. And the police can issue a citation for illegal parking. I think the guy did the right thing by forcibly removing the boot. I would do the same, and then take it to small claims court if necessary. But then I wouldn’t be wrongly parked in a handicap space either.

The majority of cities and towns will 'boot' the vehicle if the registered owner has at least a certain number of unpaid parking tickets. The 'boots' I've seen in use actually clamp the entire wheel, making it impossible to move the car without doing serious damage to your vehicle. And most districts are reluctant to tow vehicles (unless they are parking in a way that poses an actual hazard to others) for a simple reason: Ticketing and booting is easy revenue, but towing costs money - even with the fines and recovery fees.

Thats not serious car damage. You can easily get all that fixed for less than that. That was cheap plastic, not even what I would consider a real boot. No metal at all. Also he does not have to pay that since it was not any government agency that applied that boot or call for that parking lot to be enforced. That was a private company that contracted someone to enforce the rules so no law enforcement can call a warrant since it is a dispute between a business and a civilian. Even if they found the guy and tried to sue to replace the boot they would have to worry about a counter suit for damaged property since they are the ones that put the boot on his car.

In NJ, if you park in handicap space without a handicap placard, your car WILL BE TOWED if not registered as handicap person. That person must be with the car or inside the store. If not, the car can still be towed even if the placard is there but is not used by the person it was issued to.

More and more people just saw it off these days, so if you use boot that's too expensive, you may end up losing money. Btw, at least in the US, there's no way of enforcing fee for private boot in private lot. If the guy saw it off, all you can do is watch and record, then sue him in civil court, where lawyer cost is higher than settlement. If you try to stop him, that's assault, and you're the one who'll get arrested. Cops won't do a thing if you call them, because it's a civil dispute, not a criminal incident.
Of course, public boots cops put on for thousands of dollars of unpaid packing ticket is different, and considered criminal obstruction instead of civil dispute.

Thats not serious car damage. You can easily get all that fixed for less than that. That was cheap plastic, not even what I would consider a real boot. No metal at all. Also he does not have to pay that since it was not any government agency that applied that boot or call for that parking lot to be enforced. That was a private company that contracted someone to enforce the rules so no law enforcement can call a warrant since it is a dispute between a business and a civilian. Even if they found the guy and tried to sue to replace the boot they would have to worry about a counter suit for damaged property since they are the ones that put the boot on his car.
I don't see any damages plus the person illegally parked and removed the boot illegally but i don't think its a real boot as boots are made out of metal and really stop the car for going where, plus i have seen videos of people reacting to a boot very violently

In NJ, if you park in handicap space without a handicap placard, your car WILL BE TOWED if not registered as handicap person. That person must be with the car or inside the store. If not, the car can still be towed even if the placard is there but is not used by the person it was issued to.
