The city cops would be the only ones arrested. A Sheriff is the Ultimate law enforcement officer in his County. The city cop was right to be afraid of getting arrested, he knew this wasn't a favorable battle. The Sheriff runs the Jail as well, so if a deupty gets arrested the Sheriff can say "We're not taking this guy release him".

There was one where the local sheriff had a warrant for an item, a specific cell phone, and his deputies were playing D-line hard. Locking doors to keep Staties out. Threatening to arrest them if they didnt leave. Telling them the Sheriff will honor that warrant if and when he chooses to and not a moment before. And then the staties grabbed and arrested him as he tried to sneak out the BACK DOOR with the phone. And his deputies actually tried to play "how this was going down", all 6 of them. To 15 better armed STATE TROOPERS.

That the Sheriff´s have priority (who didn´t have any huge operation going on, just regular detainees). I feel like there should be a certain amount of time for them to be able to book you in, though. This was terrible. This reminds me of a story I saw a cop tell somewhere. She was undercover as a prostitute for a sting. A "john" pulls up, and since she's not allowed to _offer_ pay-for-play, she talks around it. The guy does the same thing, not giving her a reason to arrest him. This goes on for 5 or 10 minutes before the guy gives up and drives off. Weeks later, she finds out the guy was undercover from another precinct.
Not really. I can imagine a lot of situations where they might say it. If some guy they know is guilty gets off on a technicality for example. Like people who get off because the type of evidence used is too new for the jury to understand. Like that guy that got away with murder because DNA evidence was new and untrusted.

The defense never attacked the DNA phase, but attacked the evidence police used with DNA. (A sock wasn't in one photo but was in a later photo. The blood on that sock had soaked through instead of being on only one side as if it had been worn.) Any time your police witness takes the stand and pleads the Fifth Amendment is not a good sign for your case.

I was referring to the Robert Earl Hayes case. I also had in mind a case where a guy's vein structure, which is unique, was caught clearly on a night vision camera but the jury didn't understand that evidence either and so dismissed it.
Fun fact: Firefighters have essentially 100% jurisdiction when it comes to vehicles being parked in front of a fire hydrant. Imagine the vehicle here was in front of a fire hydrant. I know a firefighter that because the cop left his doors unlocked while parked in front of hydrant actually ran a firehose through a cop car instead of breaking his windows.
Living in New Orleans with Mardi Gras parades, I learned a fun fact. The police will routinely shut down certain streets and roads, along the parade routes. The only ones that they cannot legally prevent from transversing those same roads are postal carriers. Supposedly, it is actually a federal crime to purposely impede the delivery of the mail .

I saw a video where an angry cop is upset with a group of guys dancing and slowly bumps into them with his patrol car to get them to stop. Nothing happened to the cop. Most western jurisdictions (English speaking nations) don't have a legal duty of care or legal obligation to help. Why? Because the high standard would make it impossible for them to do their job and the lawsuits would be excessive.

Those court cases they were referencing the rulings actually make it so you cannot sue the police and especially an individual officer for failing to protect you unless they have restricted your freedom and are therefore responsible for your safety. Officers will still face discipline up to and including termination for failing to attempt to protect someone in accordance with their duties and training. I'll give you an example. If you are the victim of the home invasion and you report 4 people with guns break into your house and you are hiding waiting for help to arrive and a single officer arrives without backup, there an almost certainty that they are not entering your house until they have backup due to the fact that they are outnumbered and out gunned to the point that their death is likely. If you are hurt or god forbid even killed while they waited you or your family cannot sue them because they are not legally liable to protect you. Contrary to rhetoric that people say police are not paid to die for you. No amount of money is compensation for their own death. They assume a higher level of risk of harm then the average person due to the everyday duties of their job and the possibility of danger that they face daily, but they are never required to sacrifice themselves or to take completely unnecessary risks, such as being outnumbered and outgunned, to save someone else's life. Can they be fired for not acting in accordance with training? Yes, and they are such in the case highlighted in the Florida Highschool mass shooting. I'll give you another example, a cop sees an assault in progress and attempts to intervene to save the victim from further harm and ends up in a physical altercation with the attacker themselves. The attacker gets a good punch in and renders the cop unconscious and continues to assault the original victim who is now hurt much worse than they would have been if the cop didn't lose the fight. That cop no that department can ever be sued for losing the fight and failing to protect the person nor, in that case, would it be likely they face discipline either although I would think that some thought to examining the possibility of retraining or fitness for duty might be in order. I know this is a couple months old but I hope that clears up what those cases actually mean.
They can certainly lose their jobs for filing to do so given the situation; police authorities all have some code of conduct that details when officers are expected to intervene and when they may choose not to. The law just means that they can’t be charged for a criminal offense for not protecting someone. A law that would require them to do so would lead to some seriously bizarre situtions and, most likely make it impossible to recruit and retain officers since it would basically require them to sacrifice their lives in certain situations.

I think it's also a problem that people get arrested waaaaay too often in the US. On a documentary about international police exchange I've once seen a US cop in my country who was surprised that only so few people get arrested. That is because in my country people only get arrested if they are an immediate danger to themselves or others, if their identity can not be confirmed, if they committed a major crime and are suspected to flee or destroy evidence. And that's basically it. So as long as you don't kill anybody or robbed a bank or have a big drunken bar fight, or something like this, you usually won't get arrested.

What did they break? The sheriff runs the jail. The problem is with higher ups and the line level staff have to deal with it. But ask why they were booking people when they could’ve cited (still an arrest) and released. If anything this save a lot of people the hassle of being booked.

you'd be much better off calling friends or family for help. cops are only legally required to 'help' people in their custody, and they regularly rape, beat, or kill those types so just imagine what might happen to you if you call them. they have more criminals per person within their organization than the non-cop population... it's insanity that we haven't passed laws and voted for change on this front, but that's true of nearly every issue.

I’m not surprised. In 2009 I missed a court date for a speeding ticket, went to the sheriffs office at the consolidated gov to pay with $350 and they arrested me by walking me into a jail cell. Never did pay that ticket 🤷🏻♀️ but I generally trust the cpd to have less ego, sheriff’s literally threw me in their office jail for question their bad math after they gave me different totals; no Miranda or anything.

@@asdc2076 Nope, the US doesn't have any federal system to deal with police complaints, in extremely rare circumstances the FBI has gotten involved in corruption allegations amongst state officials including Sheriffs but this is very rare. There is nothing like the British "Independent Office of Police Conduct" or anything of that nature.

It looks completely unprofessional, undermining any image of authority &respect the officers may have otherwise had in these types of situations. So the "protect" part of "to protect and serve" only applies to people they've arrested. In other words they have a duty to keep you alive so you can receive your punishment. But if you're just a taxpayer in need of help, they have no duty to help you whatsoever. Fantastic
To be fair, once they've arrested you, they ARE responsible to see to it you get your due process as swiftly as possible. When that's not enforced, you get what's happening with a certain group of federal trespassers.
Actually, Cops aren't meant to protect shit. Recently a video, and Court case, appeared all over UA-cam, where a Cop chased a Camaro due to not having their headlights on. It fled the scene, Crashed, caught on fire, and the Cops claimed it was the driver's fault and Left leaving him to possibly perish in the crash Nearby neighbors were first to respond, and the dispatcher couldn't even Believe what they were hearing. The Cop was fired however by the department's Chief, and the rookie given a 30 day suspension. No charges though.
If it wasn't so pathetic it could be hilarious. Even one of the detainees, commented that it was wrong what they were doing. That clearly illustrates the dysfunction of both departments.

My issue with all of this is it shows how many people they drag into jail every night. Then they have to book them, house them for the night, go to court in the morning and then they are given a summons to come back to court at a later date anyway. Have you ever heard of the broken window policy? It has real world testing and it proved to dramatically reduce crime in NY back when Rudy was in charge. Even the democrats liked him back then because of it. It goes like this, the person vandalizing, smoking a joint on the corner with no concern for being caught, hopping the turnstiles on the subway instead of paying ect... are the ones doing the burglary, robbery, murder ect... Further to the point is that criminals commit crimes. So, one criminal may commit 100 crimes before getting caught. The majority of serious crimes are being committed by a tiny minority and that minority are involved in countless minor crimes because they have no regard for the law. They generally don't even mind prison that much. That single policy was responsible for cutting out at least half of the more serious crimes, probably more. So, letting the "little things" go is a bad idea. Taking one off the street for even one night can potentially stop several serious crimes from happening that one night. If they are smart they wouldn't fool around with the petty stuff but the criminal mind just doesn't generally work that way. When it does you're likely talking "white collar" crimes where crooks are stealing millions or high level dealing.
They couldn’t stop a massacre at a school… too busy caring for “their safety” and precious lifes were lost… What makes you think stopping a burglar might ever happen…. They are only good to be road pirates to bring that gold to their “owners”…
They don't go after burglars because burglary is legal now, at least here in California where its only after 10k worth of theft when its an arrestable offense.
The deputy that threatened to arrest the officer for blocking the way with his car actually got the obstruction elements and law right. I’m astounded. I mean, no actual arrest occurred in spite of the officers breaking an actual honest to god law but they use the interfering and obstructing incorrectly so often against civilians and auditors I’m still just genuinely shocked one of them actually got it right.
But instruction goes both ways. The pd weren't being allowed to process their suspects preventing then from doing their job also. And officers cannot respond to a call if they have someone in their custody from another call.

There was one where the local sheriff had a warrant for an item, a specific cell phone, and his deputies were playing D-line hard. Locking doors to keep Staties out. Threatening to arrest them if they didnt leave. Telling them the Sheriff will honor that warrant if and when he chooses to and not a moment before. And then the staties grabbed and arrested him as he tried to sneak out the BACK DOOR with the phone. And his deputies actually tried to play "how this was going down", all 6 of them. To 15 better armed STATE TROOPERS.

That the Sheriff´s have priority (who didn´t have any huge operation going on, just regular detainees). The PD didn´t organize themselves properly, then they ignored direct orders and protocol, presented themselves there anyway, and got all angry and personal because they weren´t given priority (Im not going to get into the blocking of the car and all that, because I think that one speaks for itself... This reminds me of a story I saw a cop tell somewhere.
She was undercover as a prostitute for a sting. A "john" pulls up, and since she's not allowed to _offer_ pay-for-play, she talks around it. The guy does the same thing, not giving her a reason to arrest him. This goes on for 5 or 10 minutes before the guy gives up and drives off.
Weeks later, she finds out the guy was undercover from another precinct.

Your whining because a jury did not understand DNA testing is misplaced. That celebrity didn't get off. The prosecutors failed to convict because the police screwed up and planted evidence. The defense never attacked the DNA phase, but attacked the evidence police used with DNA. (A sock wasn't in one photo but was in a later photo. The blood on that sock had soaked through instead of being on only one side as if it had been worn.) Any time your police witness takes the stand and pleads the Fifth Amendment is not a good sign for your case.

I was referring to the Robert Earl Hayes case. Fun fact: Firefighters have essentially 100% jurisdiction when it comes to vehicles being parked in front of a fire hydrant. Imagine the vehicle here was in front of a fire hydrant. Living in New Orleans with Mardi Gras parades, I learned a fun fact. The police will routinely shut down certain streets and roads, along the parade routes. The only ones that they cannot legally prevent from transversing those same roads are postal carriers.

Most western jurisdictions (English speaking nations) don't have a legal duty of care or legal obligation to help. Why? Because the high standard would make it impossible for them to do their job and the lawsuits would be excessive.

there needed to be more information explained about what that really means. Those court cases they were referencing the rulings actually make it so you cannot sue the police and especially an individual officer for failing to protect you unless they have restricted your freedom and are therefore responsible for your safety. Officers will still face discipline up to and including termination for failing to attempt to protect someone in accordance with their duties and training. I'll give you an example. If you are the victim of the home invasion and you report 4 people with guns break into your house and you are hiding waiting for help to arrive and a single officer arrives without backup, there an almost certainty that they are not entering your house until they have backup due to the fact that they are outnumbered and out gunned to the point that their death is likely. If you are hurt or god forbid even killed while they waited you or your family cannot sue them because they are not legally liable to protect you. Contrary to rhetoric that people say police are not paid to die for you. No amount of money is compensation for their own death. They assume a higher level of risk of harm then the average person due to the everyday duties of their job and the possibility of danger that they face daily, but they are never required to sacrifice themselves or to take completely unnecessary risks, such as being outnumbered and outgunned, to save someone else's life. Can they be fired for not acting in accordance with training? Yes, and they are such in the case highlighted in the Florida Highschool mass shooting. I'll give you another example, a cop sees an assault in progress and attempts to intervene to save the victim from further harm and ends up in a physical altercation with the attacker themselves. The attacker gets a good punch in and renders the cop unconscious and continues to assault the original victim who is now hurt much worse than they would have been if the cop didn't lose the fight. That cop no that department can ever be sued for losing the fight and failing to protect the person nor, in that case, would it be likely they face discipline either although I would think that some thought to examining the possibility of retraining or fitness for duty might be in order. I know this is a couple months old but I hope that clears up what those cases actually mean.
They can certainly lose their jobs for filing to do so given the situation; police authorities all have some code of conduct that details when officers are expected to intervene and when they may choose not to. The law just means that they can’t be charged for a criminal offense for not protecting someone. A law that would require them to do so would lead to some seriously bizarre situtions and, most likely make it impossible to recruit and retain officers since it would basically require them to sacrifice their lives in certain situations.
If I was one of the guys getting arrested, I would've started egging on my cop and be like, "you gonna take that from him ?!?!?" 🤣

I think it's also a problem that people get arrested waaaaay too often in the US. On a documentary about international police exchange I've once seen a US cop in my country who was surprised that only so few people get arrested. That is because in my country people only get arrested if they are an immediate danger to themselves or others, if their identity can not be confirmed, if they committed a major crime and are suspected to flee or destroy evidence. And that's basically it. So as long as you don't kill anybody or robbed a bank or have a big drunken bar fight, or something like this, you usually won't get arrested.
Was hoping it was gonna turn into an arrest-off. One cop arrests another, then another cop arrests another from the other side and so on until everyone was just standing there in cuffs arguing. "You're under arrest!" "No, I arrested you first!" "I'm arresting you for obstruction by arresting me!"

If you can’t get booked you can’t get bail so I doubt they were loving it all that much.
Those suspects were being held/detained longer than necessary because they couldn't get booked, have a hearing, have bail determined, etc.

Thus, [O Prophet,] if they argue with thee, say, "I have surrendered my whole being unto God, and [so have] all who follow me!" - and ask those who have been vouchsafed revelation aforetime, as well as all unlettered people, "Have you [too] surrendered yourselves unto Him?" And if they surrender themselves unto Him, they are on the right path; but if they turn away - behold, thy duty is no more than to deliver the message: for God sees all that is in [the hearts of] His creatures.
Verily, as for those who deny the truth of God's messages, and slay the prophets against all right, and slay people who enjoin equity - announce unto them a grievous chastisement.

I’m not surprised. In 2009 I missed a court date for a speeding ticket, went to the sheriffs office at the consolidated gov to pay with $350 and they arrested me by walking me into a jail cell. Never did pay that ticket 🤷🏻♀️ but I generally trust the cpd to have less ego, sheriff’s literally threw me in their office jail for question their bad math after they gave me different totals; no Miranda or anything.

Nope, the US doesn't have any federal system to deal with police complaints, in extremely rare circumstances the FBI has gotten involved in corruption allegations amongst state officials including Sheriffs but this is very rare.
There is nothing like the British "Independent Office of Police Conduct" or anything of that nature.

Recently a video, and Court case, appeared all over UA-cam, where a Cop chased a Camaro due to not having their headlights on.
It fled the scene, Crashed, caught on fire, and the Cops claimed it was the driver's fault and Left leaving him to possibly perish in the crash
Nearby neighbors were first to respond, and the dispatcher couldn't even Believe what they were hearing.
The Cop was fired however by the department's Chief, and the rookie given a 30 day suspension.
No charges though.

My issue with all of this is it shows how many people they drag into jail every night. Then they have to book them, house them for the night, go to court in the morning and then they are given a summons to come back to court at a later date anyway. It’s a huge waste of resources and they could be doing better things like I dunno… stopping a burglary. What a joke the whole thing is.

Have you ever heard of the broken window policy? It has real world testing and it proved to dramatically reduce crime in NY back when Rudy was in charge. Even the democrats liked him back then because of it.
It goes like this, the person vandalizing, smoking a joint on the corner with no concern for being caught, hopping the turnstiles on the subway instead of paying ect... are the ones doing the burglary, robbery, murder ect... Further to the point is that criminals commit crimes. So, one criminal may commit 100 crimes before getting caught. The majority of serious crimes are being committed by a tiny minority and that minority are involved in countless minor crimes because they have no regard for the law. They generally don't even mind prison that much.
That single policy was responsible for cutting out at least half of the more serious crimes, probably more. So, letting the "little things" go is a bad idea. Taking one off the street for even one night can potentially stop several serious crimes from happening that one night. If they are smart they wouldn't fool around with the petty stuff but the criminal mind just doesn't generally work that way. When it does you're likely talking "white collar" crimes where crooks are stealing millions or high level dealing.

The deputy that threatened to arrest the officer for blocking the way with his car actually got the obstruction elements and law right. I’m astounded. I mean, no actual arrest occurred in spite of the officers breaking an actual honest to god law but they use the interfering and obstructing incorrectly so often against civilians and auditors I’m still just genuinely shocked one of them actually got it right.
The Sheriffs should have arrested the city PD for obstructing to a call. The call was even a burglary as well if I'm not mistaken.
But instruction goes both ways. The pd weren't being allowed to process their suspects preventing then from doing their job also. And officers cannot respond to a call if they have someone in their custody from another call.

How does no one here refusing to move the car based on what their SGT is telling them... understand the difference between a lawful order and an unlawful one? And if you think saying "because my SGT told me..." lets you off scott free, you are part of the problem and should seek another profession or fix yourself immediately if not sooner.
